@ Sergi9: Yeah well I disputed the fee but they said that since the last time we was there was over a year ago (May 2010) that we had to pay the fee again. Also some of the documents expired such as the medical exam and police certificates. Either way he still has to travel to Barbados to conduct the new medical exam. :thumbs:

Hey Everyone,

So hubby and I saved up the money to pay the new visa application fee, medical fee, and travel expenses for when he will be in Barbados for his interview. So i sent an email yesterday letting them know that we have all the updated documents with the exception of the medical exam docs and that we would like to get an interview date that would allow hubby to complete his medical and get the medical results in time.

Sooo....

They responded back EARLY this morning and stated that his interview is scheduled for September 1,2011 @ 7:30am. YAAAY!! :dance: :dance:

They also said that if he supplied all the docs that they requested that he would RECEIVE HIS VISA the SAME DAY!! :dance: :dance: :star:

This is awesome. So excited for hubby. So right now we're just waiting for the official interview letter that he would have to take to the Medical Clinic and to the Embassy for his interview. :D (L) :luv:

Yeah during the waiting process you have no idea what the result to me. Your just waiting to find out if your gonna be moving forward or if you're gonna have another ordeal to go through if denied.

Like Spice Chile, my hubby also had to do a waiver because he illegally entered USVI and was there for a lil over a year. But I typed up the hardship letter. It was about 3 pages long. Just talked about how hard it would be for me to take care of our son on our own. Talked about the currency difference in USD and EC and how it's hard for him to support us the way he should when he's in DA. Talked about my aspirations to get my masters and how I would loose that opportunity if the waiver was denied because it would mean I would have to move to DA to be with him. I talked about the necessity of a father in a child (especially a boy's life). Showed that there are no employment opportunities for me in DA with my degree. etc. I even added pics of the times that we have had together which are only 4 weeks worth since he went back to DA three years ago.

USCIS Santo Domingo received the waiver app March 28 and it was approved June 13th. :dance:

Your case may require a lawyer considering the lengthy period of time that you overstayed your visa, but I have faith that you will make it through. :star: Good Luck!

I also honestly think you shouldn't call so much?? If you have nothing to worry about...that is! We ALL pay high fees to the immigration and there are thousands of other people and other cases pending i don't think because you paid you should be treated any differently.
She probably answers the phone all day deals with all kind of people and calling all day is just going to make yourself look stalkerish if i was you i definitely would just chill.

I agree with you on the frequent calling. Multiple calls within the hour is definitely excessive. Ease of to once every two or even three weeks.

I disagree on the reasoning behind the DOS lady's rude comments. At the end of the day, she is getting paid to do a job and that is to answer the phone calls and assist the caller with whatever they are inquiring about. I think she's lacking greatly in professionalism and in understanding the complete concept of customer service. Even if she wanted to tell you that statuses don't change that frequently and etc. there was a professional way to go about it.

She could have said, "The status of the case is .... please feel free to call back after 2 to 3 weeks (or however long). We do have an immense amount of cases and we do need some time to get through them all. Thank you and have a nice day."

UPDATE: Hubby received his visa and the package he is suppose to immigrate with! Yaay! Now im here searching for a place for all of us to live together. The plan is for him to come in 2 months. Wish he could come right now but at least i know he can.

GUESS WHAT EVERYONE HE GOT APPROVED!!!! :dance: :dance: :dance: :dance: :dance:

His appointment was @7:30am :blink: so got up super early and caught a taxi to the embassy. They basically asked him for the documents they requested and the updated medical exam and police certificate and said Congrats you're approved! He didn't get his visa in hand as the lady said via email but they took his passport and had him arrange with DHL to pay for the airway bill to send it to him in Dominica. They said that he will get his visa next week.

I'm so relieved and happy. :dance: :dance: :dance:

Yeah so after three years of this immigration process (including the 1 year wait for my tax return to reflect my qualifying income as a sponsor and the 3 month wait for his waiver) to be approved, tomorrow is my hubby's final interview appointment. :dance: :dance: :dance: He's in Barbados chillaxin right now and making sure he has everything for the millionth time. He basically had to do a new medical new passport photos and a new police certificate to bring along to his final interview because the last time he did all that was over a year ago.

The embassy representative did state in an email that if he has everything that they requested that he could get his visa in hand the same day. I'm so excited for him.

So hopefully all goes well. I'll be updating everyone in this thread so stay tuned.

Thanks so much. It's enough risk, we think we'll not go with a co-sponsor. Concern was about past taxes, not income level.

Yeah it's enough risk that my co-sponsor backed out. I started a government job in December 2009 so my w-2 did not display an income over the poverty guideline for a household of 3 (hubby,son, and myself), I think about $22,000. Since my co-sponsor backed out i had to wait until I worked a full year so that my w-2 displayed my full salary which was well over poverty guideline. It put hubby's case behind but we're ok with it.

Hopefully this won't be your case. If you have enough income over the poverty guideline for whatever your household size would be, you won't need a co-sponsor. Here's the link to verify.

In theory, the Affidavit of Support can be a commitment for life, if the beneficiary is a bum or drug user with no drive to find a job and due to their criminal past no chance to ever become a US citizen.

In practice, I have never heard of a case where the US Government sues the sponsor of an immigrant for reimbursement of means tested benefits that the immigrant was not eligible to apply for in the first place, and I have also not heard of an immigrant who successfully sued their sponsor for support.

Those cases may exist, the same way there are people who are born with two hearts, but how often do you encounter one of them?

Never the less, the risk is still there. The previously mentioned risk are to be taken seriously when considering becoming a joint sponsor.

Some one correct me if I'm wrong but signing on the responsibility as a Joint Sponsor also puts you at risk for reimbursing the Government should the beneficiary (immigrant) receive financial aid such as food stamps and welfare. This however should not happen because the beneficiary (immigrant) is suppose to financially by all sponsors that signed. Also if the primary sponsor fails to support the beneficiary(immigrant) and the beneficiary(immigrant) receives the before mentioned aids, the Government can by pass the primary sponsor and seek reimbursement from the joint sponsor.

CanadaPORT OF ENTRY TO US

Hey Yall,

Got my visa a couple weeks ago and plan to move tomorrow from the Montreal airport. I got my passport back and a sealed envelope from the DHL. Is there anything else I should know when at the port of entry? Do i need to bring anything else with me other than my passport and that sealed envelope?
Any documents??? What can I expect to be questioned and usually how long is the questioning?

Also**** When I check in at the airport, should I be showing the airport clerks my Canadian page in the passport or the visa page in the passport??

Soorry for all the questions! just dont wanna screw this last part up!

The Consulate that approved your visa should have instructed you on what you need to have when traveling. If not you should contact them so they can give you the correct information.

It looks like administrative processing to me. They really should have flat out said they would put you in administrative processing. Hopefully you won't be in AP for too long. An indicator that it may not be for too long is that the consular witheld your passport. If they didn't intend to issue you your visa shortly they would have simply given it back to you. I think that you should continue to be POLITELY persistent in inquiring about the status of your case. Never get an attitude or come off to pushy because it gets you nowhere fast.

hello everyone
i am new user here , but have been read alot here and it was helpfull to me with my case . i got deny 23 march from uscis after 11 months waiting and after sending FRE back to them they deny us by strange way , even when my wife went to the lawyer , he told he they shoudln't deny . it's just bullshit reasons. i told my wife to come to fill from my country but the lawyer told her to better to fill again from there and sure with him when i belive the lawyer don't do much as we do all about the papers right ? my Q to let my wife fill again from there or better when be with me here ? and lawyer said no hope from appeal coz it can take years , and if we filled again without lawyer from there did u think guys my deny will effect on the new fill coz sure we will write it in i 130 or it will not effect ? and there is ppl tell we have to wait 6 months to can fill again is that true? and what a chance we have if we filled again ? pls need help


I think that we all need to know some more information concerning your case. We need to know where you are? Where she is? Who's the beneficiary and who's the petitioner? Most importantly the reason for the visa denial? :thumbs:

This is the 1st year in which I will be required to file taxes so I'm not familiar with the whole tax filing process. The Barbados consulate is requesting that i send them an updated I-864 with my 2010 fax documents which will show that I make well over the minimum income for a household of three.

What does the federal tax return look like or include that I-864 is requesting that I attach to it? :innocent:

Well if it's a glitch in the site you wont see anything until the problem is fixed I guess. Look on the bright side! You can always call, use your receipt number, and get your status that way.When I was that stage I kinda preferred to get an actual person because they may disclose exactly what is going on with my case versus " Case is being processed" or some vague statement the site might dispense. :thumbs:

For a household of 4 the minimum income you can have to qualify as a sponsor is $27,937. So yeah you're well in the clear. Verify with the following link. I-864p Poverty Guideline
