Ok, then I would strongly suggest you get an updated affidavit from your mother anyway, so he can have it on hand if needed. All you have is a very new job and no history. Technically, you qualify but the decision is a somewhat subjective one. I'd have insurance in the back pocket to avoid delaying the visa approval.

You're right...I'll have my mom do a new one and have her 2009 tax return documents attached to it. I'll only provide it to them if they're are trying to say that my income is not enough or they need someone with a history.

Sending both wouldn't hurt but there's a good chance they'll only need yours if you can document your current income with pay stubs and an employer letter. I would include three years of tax returns though, to show the history of income, even though one of the years may not look too good. It won't hurt to add a letter of explanation indicating you quite working to care for a child and have since returned to full time employment.

I really don't want to submit one from my mom because I don't want to have her be obligated to do anything especially since I'm working now.
Well I can't include three years of tax returns because in those years, I've never earned enough to have to file for taxes. I've only worked for really short periods of time over the last 3 years because I was a full-time student at a university.

Hey Everyone:

My husband has his interview scheduled on May 18th at the Embassy in Barbados.
Although we got an case complete and a scheduled interview, the NVC requested a new I-864 be brought at the interview. The I-864 initially sent in 2009 was from my mom (his mother-in-law) as the sponsor. I was not working for 11 months of that year because I was taking care of our son. After the NVC sent us the appointment letter, we received an RFE in which they wanted an updated AOS from my mom. However, I would like to become the sponsor since I started working in December 2009. My salary is 27,386. $5,000 over the poverty guideline for a household of 3.

My plan is to give him my AOS to submit at the interview.

He's freaking out because "They didn't ask for a new AOS they asked for an updated one from my mom."

Wouldn't it be better for me, as his wife, to be the sponsor and not my mom, his mother-in-law? What should we do?

What do you mean by didn't have to file in 2009, you didn't have a job, or your income was not subject to taxation?

Yeah. My income was not subject to taxation because it was under the minimum amount that requires you to file for taxes.

Again, it your 2009 income,,that is why they request 3 years of income tax and a letter from your present employer a-testing to that the fact that your present income is constant to meet the income level.

Okay then explain what they do to people that didn't have to file in 2009. The I-864 states that if they didn't have to file, all they have to do is type up an explanation letter and show evidence backing it up. What happens to people in that case?

I even got it in writing. I asked the person I was talking to to send a confirmation e-mail and she did. I attached that to everything that I'm sending.

im not sure but i think that they may be right with 2009. Because that way they can see a person has kept a job and may have money or what not, where as if you only just got a job anyone could have a job for a month or 2 and lose it again. I hope that makes sence..

Have you tried calling the NVC? Maybe they will know?

I don't think I can call the NVC anymore because they no longer have the case. In a way that doesn't really make sense either. If that were the case, that would mean that I'd have to wait for a 2010 poverty guideline? no right?

And it says that no where on the I-864. I told her all of this and I guess I convinced her because she said that I could go ahead and send my new I-864 with supporting documents (employment letter, W-2, check stubs, etc.) :dance:

My husband and I went to his interview for an immigrant visa on May 18th. One of the documents that they requested was an I-864a to be filled out by my mom, a joint sponsor. However, I am now working and making well over the minimum for a household of 3 ($5k over actually). From my understanding that means I no longer need a joint sponsor.

So I called the embassy and the local Barbadian that answered was trying to say that I needed to make at least that minimum in the year 2009 to not need a joint sponsor.

Is that right?

I thought that I just needed to show that I am making at least the minimum regardless of what year.

Who's right in this situation? Please respond because I'm sending it to them via DHL in a few hours. :thumbs:

Hi,

I'm married to a Us Citizen who lives with us here in Canada. Me and my soon to become 21 years old daughter were petitioned by my husband while my husband is in Canada and we got an interview in January 2010 but we postponed it after realizing that my daughter is not ready to immigrate in 6 months ( if given a Visa) because she is graduating in college this school year. Also we realized that my husband needs to reestablish ties with USA ( domicile) as a requirement in the application.

This is what we did:

- we already finished medical exam
- however, we postponed the interview and wrote US Embassy in Montreal via email ( as the only means of communications accepted) and they acknowledged that by replying to us and to inform them when we are ready to set an interview.

- I sent them a new email in Feb 21, 2010 that we are now ready for an interview and if they can book us a specified date as my daughter will be turning 21 years old in June 2, 2010.

- I received an automated response via email that they received my email and that they will get back to me in 2 weeks. I was worried its passed 2 weeks and close to 1 month already and I have received any response from them through email or postal mail when is the re-scheduled interview?


Questions:

1. Does anybody know the time line in rescheduling interviews in Montreal?

2. Are they going to respond to me via email or post office mail to inform me of my rescheduled interview?

3. As an initiative to establish US domicile , we sold our house in Canada, and my husband is moving back to the US this end of March 2010, get a job and get settled first.

4. We moved to a rented place and I have a mail redirection from an old address to a PO Box. I did not use the rented place address since this is just temporary and while waiting for our visa approval.

How can I inform the embassy of our new address. Is there a form to fill-up?
