I have been telling you all day.....It's just a debt collector calling you. Next step is a court case which could be continued on and on, especially if they can't serve you. Next step if you lose the case would be wage garnishment and that takes a court order and time to file and process AFTER you lose the court case.

Talk to the lawyer on Friday and quit worrying. You will be just fine here.

How old is the debt?

In my experience, it takes them a good long time to do anything at all........up to a year or more. And, the steps are....

letters & calls
debt collector
more letters and calls
suing you......that can actually drag on for a year even if you never show
Lastly, garnishing your wages

It's not something I would completely ignore as you do need to do something about it.

But, by October............PU-LEEZE!!!! Unless it's dragged on for a year or two now, I would not stress one bit about October. And the state department? I would not even think something like that.

I am sorry to hear about this. You can go there (India) to get married and come back to the US and file the paperwork for the CR-1 visa. You can also have your fiance come to the US on a visitor visa and get married. The only problem with this way is that he will have to go back to India and have proof that he intends to return, like a return trip ticket, or they will deny him the visitors visa.

Please don't do this on a visitor visa. You have already been denied the K-1. The intent is really clear here that if you do this on a visitor visa, it was premeditated. This would be the easiest case I have ever heard of for them to deny you the AOS.

If you are going to marry, please save yourself some headaches in the future and go the CR1 route.

Not really an answer to your question, but I hope our experience helps. For fiance visa, the first question is how long have you known each other and how many times have you met. In our experience we found that getting a fiance visa after knowing each other and after one visit was impossible. Ghana Embassy is very difficult to prove a relationship, it is a high fraud country. How many times have you met physically, proves to very important. That said, be prepared to show a relationship that has built over time. If you can not show that, plan a trip back befor you get to the interview stage. What we were told by the CO during our I-130 interview, these are the reasons why were not approved for the I-129F. it does not matter either way you are looking at minimum one year. "But I do not know the exact date for the CR1 visa in Ghana". This goes up and down, Ghana Embassy seems to go through periods when they have to regroup, and it goes slow, and then they speed up. It is weird.

This is sooo depressing. I did not realize K1s were difficult to get through Ghana. Even though I have been to visit 3 times since our engagement and will have gone at least twice more by our interview, I am now nervous. I am now tempted to go ahead and get married at this visit and start all over. I am just discouraged :crying: i don't think I can take a denial.

You can now avoid the common misconception that filing a petition and applying for a visa are the same thing. The US Citizen files the petition. When that petition is approved, the foreigner applies for a visa.

Right, you have nothing to lose and, frankly, we don't really know how USCIS is adjudicating the I-129F for spouse since they started transferring I-130 petitions to local offices for adjudication. Please let us know how it goes.


I know I am usually slow to grasp certain things but this is the first time this process has made sense to me. Thanks for the clarification. I used to wonder why there has to be two identical packets sent for the same visa--I sent the 129 application and get a NOA1 and NOA2 and then my fiance brings the same information to an interview Duh! I get it now. :bonk:
