IR-1 / CR-1 Spouse Visa Process & ProceduresDS230 question

Ok! But with the original petition and the Biographic form they wanted, we did put his dads info down as he does know who he is, date of birth, etc. If we put unknown now, I worry they might raise an eyebrow?

Andre's father was not on his birth papers. We wrote his name and that we thought he was deceased. Other then that, we had no information on him.

It's been fairly common in Jamaica. No Worries!

IR-1 / CR-1 Spouse Visa Process & ProceduresChat Logs - specific format required?
If you are still concerned about extracting this information, just do a google search for SkypeChatExporter. It is a simple program that outputs your Skype logs into a much more user friendly format. Disclaimer: I am not affiliated with this software, just in a similar boat.

Good Luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresA stupid question about Guangzhou
QUOTE (ChinaQuest52 @ Sep 9 2009, 06:24 PM) <{POST_SNAPBACK}>
Hi to everyone,

I just received the email alerting that our 130 was approved... YEAH!!!!

It sounds like we will have to go to Guangzhou for the interview and final part of the process. It seems like Guangzhou has a slightly different process and can be a little difficult at times. Now to the stupid question, can we request our VISA be processed at a different Embassy in China?

Thanks,

Tom &vJialian

The more experienced guys will chime in here I am sure, but my understanding is that Guangzhou is the only embassy processing fiancee and spouse visas. I have heard that other embassies will do this, but they are special cases, and you would know if you are connected enough to be a "special" case. We are all in the Guz boat...sink or swim...you will survive. good.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresOF-169 what is it?!
QUOTE (Emmamama @ Nov 29 2009, 05:28 PM) <{POST_SNAPBACK}>
Hi guys,

I was wondering what exactly is an "OF-169"??

I read an old post which states:
"Form OF-169 is a consulate specific form that lists the documantation needed to be gathered by the benificiary for the interview."

OK, so where can I find it? (I'm in Argentina and looked on website..not there)
Any ideas??

THANKS!

OF-169 (K1 Packet 3 checklist) will be included in Packet 3 sent to you from the embassy after your petition arrives and is opened. From the information on the embassy, they do not appear to issue a Packet 4, everything comes in one packet. You can see from this link: http://www.visajourn.....=Buenos Aires

I looked on the actual embassy website and I do not see links for the forms (I can access them on the Guangzhou embassy page). Anyway, here is the embassy page: http://argentina.use....gov/index.html

Hopefully someone who has been through your embassy can give you more specific information about their experience.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresSemantics in Letter of Employment
QUOTE (celiothrkn @ Dec 9 2009, 10:42 AM) <{POST_SNAPBACK}>
I am in-between jobs. My first day of my new job starts on Jan 5, 2010. I've already signed the employment contract.

For my letter of employment, should I have the HR dept. write me one now, in which it would say "So-and-so will be employed as a full-time employee starting Jan 5, 2010?"

Or should I wait until Jan 6th and then have HR write a letter that says "So-and-so has been employed as a full-time employee since Jan 5, 2010?"

It's really just a question of semantics, and I was wondering if one way would be better than the other. Would NVC care?

Our IV package is already done, so the only thing I need is my AOS package to complete the NVC phase of my CR1. My spouse and I were hoping to finish the NVC process of my CR1 as soon as possible. If we decide to wait until Jan to send the letter of employment, we'd be adding something like 3-4 weeks to (unnecessary) wait time.

Maybe sending in the employment contract would be better. Worst case, you get an RFE.

IR-1 / CR-1 Spouse Visa Process & ProceduresTouched ?
While I agree with Malrothien that you shouldn't base hopes on touches, it does mean that something is happening..which means an approval at some point or an RFE to fix issues. I prefer touches to silence any day...

Touch could mean anything or nothing. Do not base hope on touches.

garfield529MaleChina2010-03-12 11:31:00
IR-1 / CR-1 Spouse Visa Process & ProceduresTouched ?
Most people are "touched" twice or more...typically the first "touch" is logging you into the system, the second "touch" is usually when the adjudicator opens your file (lately this has been about 2-3months after first touch), and then a third "touch" could be more work OR the processing of your Approval letter/RFE letter. This has been the general trend of most VJer's since I have joined.

Understand, but it does not necessarily mean it is close to being adjudicated, correct?

Thanks
Dan

stuff bolded above - is for K-1 visa - OP is CR-1 with an I-130 in play. Not the same thing, not the same timelines at all.

Also, he's got a military expedite, and IMO, somethings's wonky.

IR-1 / CR-1 Spouse Visa Process & ProceduresNOA2 to NVC
Actually, you must be in AP if you are not out of NVC. The normal processing time for most members is about a week and then shipped off to your consulate. The 90 days comment must be their default for all cases, the same as the USCIS saying it takes at least 5 months to process your petition. I am not sure how long you have to wait before calling USCIS, but you might want to do that.

What does the color slip mean, all I know is Pink means your approval what does the other color mean? Can anyone clear this up, for future people going to the interview

Thanks

The very simplified version:
PINK/ORANGISH: approved petition
BLUE: request for additional evidence
WHITE: denial (which in some cases can be overturned)

Again...simplified version. :innocent:

IR-1 / CR-1 Spouse Visa Process & ProceduresIn GUZ what is ASH or ACH
Evolution of Relationship (EOR) Letter:
This is an important component of the visa process for countries such as China when the burden of relationship is heavily examined by the VO. This is essentially your opportunity to explain the genesis and evolution (yes....pun intended) of your relationship, how you communicate, what you have spent time together, ect. The application form asks you to explain "how you met in person" and this is when many people include a long sappy explanation of their relationship, when in fact all that the USCIS wants is a simple two or three sentence statement. The EOR letter and your evidence of ongoing relationship "should" be prescreened by the VO and help form the basis of their subjective view regarding your relationship prior to the interview. I say "should" because with the electronic implementation of NVC to the consulates it seems that not everything in a file is being sent always. With that said, it is a good idea to include an updated EOR letter with all evidence that your fiance(e) takes into the interview.

I did not attend ACH/ASH, so I will defer to Darnell or others to comment here. Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresAny Bad Interview?
From what I have seen during the last year, many couples who have a bad experience tend not to post much if they are denied at interview. This is not always the case, but often will happen. I was helping a guy all of the way up to his interview and then he fell off of the radar, however I could see that he was still logging on, just not talking to anyone. SO, I assume that they hit a bump at their interview and his wounded pride kept him from letting us know what really happened.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterrogated at POE!
You were questioned this way because there is an unfortunate history of Westerners going to Asian countries for illicit behaviors (drugs, sex with minors, ect.). A single trip in a year will not usually trigger the scrutiny, but as highlighted by members here and other site, multiple trips in a year will often times bring you under the microscope. It is unfortunate because they give the impression of guilt and then search for the evidence of this guilt. Until the time comes when these deviant behaviors cease, this type of treatment will certainly continue for the unfortunate "selected" persons.

IR-1 / CR-1 Spouse Visa Process & ProceduresCitizenship or Not???
As a Chinese, taking US citizenship can have benefits and also create problems depending on your long-term plans. Many older couples seem to be on track to spend time in the US but mostly retire in China, with the cost of living being less in the smaller cities. In this case, she would need her citizenship to buy an apartment and avoid the need for applying for residency in her own country. For the couple, mostly younger, who intend on spending the majority of their lives in the US, then the citizenship option is more likely. Many Chinese have strong filial relationships and the concept of giving up their Chinese citizenship is equivalent to cutting family ties. Others however do not feel this way and are more open to adopting the values and lifestyles of the US. It is not a conversation that I would bother having during the first year, since there will be so much going on in life...give it a year and she may already have brought up the topic.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about travel
Tarda pero llega...

According to this thread:

http://www.visajourn...h...=19229&st=0

Posted by meauxna in the DCF forum but applicable to all immigrant visas including CR-1/IR-1

In Secondary, info will be entered into the computer and a few random questions may come out (how long married, where are you going etc). You may want to confirm your US mailing address here. You'll give a fingerprint and autograph (for the Green Card) and the visa in your passport will be stamped aka endorsed. This endorsement is the equivilant of your Green Card and serves as evidence of your status as a Permanent Resident. You can travel with this stamp as a Permanent Resident until you get your Green Card. Hopefully someone will tell you "Welcome to America" as they give you instructions about removing conditions in 2 years (ideally & if applicable).

So, now what you have to check is the endorsement of your wife's visa.

Best luck and Bon voyage,

Jess

K-1 Fiance(e) Visa Process & ProceduresBringing my fiancee over to the US from China
I was introduced to a girl through a family friend, and been talking to her for about a year. I returned to my homeland back in May to meet her and we engage to marry, but what does she need to get to come to the US. I heard in China its harder for their citizens to get travel visas and stuff. Should I marry her in China first before applying for the K1 or I-129F here? Do they give out marriage license to US citizen in China?

I am not familar with this process.

Also, would getting a lawyer make this process go quicker and smoother? I know two lawyers locally that deal with marriage and immigration, but I haven't asked them about it.

Any recommendations or advice? This site will be helpful in helping me fulfill this. thanks!

Anyway to get these formalities done quicker if I marry in China? I have I-129F and G-325A forms ready to take with me next week to Beijing.

However, I am wondering what I can do to marry while in China, what do I need to show to get a marriage certificate? Or what does she need to get a marriage certificate?

K-1 Fiance(e) Visa Process & ProceduresProcessing the Visa for fiancee from China

Yes 9 months is about the average, I sent our I-129F petetion in to USCIS the end of august, and using the NOA2 date and the timelines here I was able to get a good estimate NOA2-Visa interview of 196 days.

Use the timelines here to get good estimates of the process, and spend the time preparing.

If you are going over there next month, Prepare an accurate G-325A for your fiance to check over, and sign and date. Get a passport photo from her while you are there, and a signed letter of intent, also get plenty of pictures together, and evidence that you were together. You can prepare the rest when you return from your trip.

A few links I found useful when I prepared our K-1 case.

http://candleforlove.com (Chinese/American immigration and relationship advise)

As for cost, This can varry depending on travel costs.

But for the USCIS, there is cost involved with filing I-129F, then later, Interview fee, Medical Fee, And associated with Adjustment of status another filing fee, biometrics fee, Fee for optional EAD, and AP. Be prepared to spend at least $2500 or more.

Here are the docs I am bringing tomorrow:

1) I-129F
2) G-325A
3) I-130 K-3 VISA

Anything else. The passport photo I can get while I am there.

Whats the signed letter of intent? How do I obtain this? Is it something she would have to write out to me?

I have the I-129F already filled out, but I need to get the G-325A alien form filled out from the fiancee. However, what worries me is the length of the process to get my fiancee to come to the USA. She is in China. I'll be going around Christmas time to see her again.

but my uncle told me it may take years to process the docs even with these forms filled out and sent off. :(

Is this true?

How many years or months does it take to get her to come to the USA???

Anyone have experience with this? Also, will lawyers make this process and getting the K1 visa quicker? How much will lawyers cost on average? :help:

I just got a speeding ticket from a pig yesterday going 17 over the limit. I paid the fine, but they say I have 2 points on my license.

Will this have an impact on my record and slow this process down? or do they even check on this? I heard they check for criminal history and stuff, but what about a speeding ticket?

I am worried they will see this little violation and slow down my process. :help:

please let me know, do they check for this?

this is the first speeding ticket I got in the last 6 years, last one was back in 2001.

Yesterday I sent her the pdf G325A form and I also written a letter of intent, which I will let her alter and sign. She will then have to send it back to me using China Post. She send me B-day cards and Christmas cards it tooks 2 weeks to receive the bday card, but the Christmas card took about a month to get. The forms I'll have to go over it with her this weekend on how to fill out certain parts.

Roughly how long will that take me to receive the parcel/envelope???

Als, to summarize what I have and need, here is what I have:

1) I-129F form filled out by me
2) photocopy of my birth certificate
3) photocopy of my passport
4) pictures of us together
5) airplane ticket stubs from both me and her
6) her ID picture/passport photo
7) her residental address written in chinese

The bold is stuff I need to get for myself and from her:

1) G-325A forms filled out by me and her
2) letters of intent from both of us.

What else will I need? I don't want to keep or make this get delayed. I want this process to run as smooth as possible. :help:

K-1 Fiance(e) Visa Process & ProceduresK-1 visa documents check list

You will need all 4 copies of the G-325A signed by your fiance, not just one. And they must all be original signatures, or you will get an RFE for that.

You (the US citizen) also need 4 copies of your own G-325A, which I did not see mentioned on your original list.

Not just 4 copies of page 1, but the 4 slightly different pages of the G-325A form, each page goes to different sections of USCIS, and DOS. In the old days this would be a 4 color 4 part carbon less form, that by signing hard on the top copy the signature gets transfered to the other 4 pages, since you printed out one from the internet you need to sign each of the 4 pages separately. Again 1 4 page form for you and 1 4 page form for her.

Does she need to fill the information out on the other 3 pages or just need her signature on those 3 pages?

I guess I'll have to send her the PDF to print and then send back to me using snail mail.

Also I notice she didn't fill out the employment part on the form, will I get RFE for that??
