I initially want to say this website is tremendous tool to this community because of the willingness of those who share their knowledge and experiences for others to benefit.

I have all the personal relationship history captured including family photos which are all compelling to our relationship. Her English is not perfect however very good and we almost exclusive communicate 30 minutes by telephone once or twice a day where I maintain a prepaid call log. I can assume I meet the income qualification of over 100k even though I am sure this is no guarantee, otherwise I would not be looking at other areas that can foil the visa approval.

I will make sure we will incorporate all the suggestions posted here in our preparation as we move closer to the Interview date. I hope others can benefit from the advice offered here. After this post I will now accompany my finesse at her interview when the time comes.

You mention that you communicate almost exclusively by phone..you may want to consider including chatting online every couple days. Just from a devils advocates view, I would question a call log more than several pages of chat communications that identify the users and characteristics of wording. We use skype and MSN, both of which allow for "free" voice/video communication and a way to record the conversation. Just something to consider. Also, we make a point to exchange "snail-mail" a couple times a month. A $.94 stamp and letter is much cheaper than any potential for rejection at the interview.

Yeah, listen to Darnell. It seems that a lot of divorced USC's fiancees are blue slipped for more information regarding the divorce. Write a detailed EOR letter and have it notarized and sent in closer to the interview date. USCIS doesn't care about your divorce, only that you are "legally able to marry." The embassy in Guangzhou will possibly care more about this on a case-by-case basis. Along with the EOR, write a detailed explanation about your divorce history so that it will be clear that this is not a potential case of fraud. This can help prevent a blue slip if the VO asks about the divorce...you have your ammo ready to go. It seems that the more VJ educated you are, the more organized you are, and the more questions you ask, the better your outcome will be in the end....that is my opinion based on following other couples here. Oh, how is her English? This is another potential bump at GUZ. Good luck!

Jim is right, and rightly harsh. The initial filling is pretty straight forward and laid out clearly in the guides on VJ. The process only gets stickier, but manageable, as you continue on. One other thing, which is not a rant on the OP, is it just me or has there been an upsurge in people who just "want" to post advice only to not make ANY sense or be COMPLETELY off base. When I originally joined there seemed to be much less of that and more "followers" or the older sages. Anyway, refile and good luck! :thumbs:

I am sorry to hear what happened to your fiance. I dont think age difference is a matter as long as you can prove your relationship is real. My fiance is 20, and I am 33, he just got his Visa last month. His interview was less than 5 mins yet the VO asked him that I am so much older than him, why he loved me....and the VO was very satisfied with his answer....the VO didnt even want to see any of our chat logs, phone bills, E-mails....None of these, all she saw was just some pictures....


It is a huge factor, and in China it is NORMAL for an older man to marry a younger woman for multiple reasons. This is what happened in your case, an older male, so the VO doesn't see this as a "visa killer" and gave the K1. The OP is in the opposite position, a culturally opposite situation. There have been too many cases of men from the beneficiaries region of the world who have married older women to gain an entry into the US and then disappear. If you don't believe this, read back over the last few years of VJ archives and you will find many stories of just this case. The consulate knows this and that is why they heavily scrutinize. The OP will probably have to go and marry and spend time and establish a stronger relationship in the eyes of the consulate. Good luck! :thumbs:

Push or Darnell know the delay timeframe allowed, but you should be able to delay your interview, just not exactly sure on how long you can do this for. You can delay sending back the P3 and then request a delay on the interview, which might be able to get you stretched out to the full second year. Let's determine this before you squash the application in process; no point in throwing away that money until you know for sure.

I know drug use is not a good thing, but this rule needs to change. If you apply for a job with the FBI, yes FBI, they ask if you have experimented with marijuana. As long as the use was limited, it will not prohibit admission to the training academy...because they know that even intelligent college students will experiment. Of course, admitted use of narcotics is an autofail, but my point is this seems a little extreme to me. Good luck! :thumbs:

Thats fine if you want to live there, but if she comes here, married or not, the visa fee will apply. And just to let you know and brighten your day more...the fees are but a very small down payment on all the other costs. In fact, I do not even see them as anything at all.

Gary makes a good point, your monthly costs overall will certainly go up, but that is just part of being a couple. The main impact on most couples is if your spouse is not able to find a good job quickly or is in school or you have a baby right away. If you are happy together, in the end it really doesn't matter. :thumbs:

For GUZ, they will ask how you communicate if it seems your fiancee doesn't speak English. As long as you demonstrate this ability you will be fine in this aspect. I don't quite understand how you can be in a mature relationship if you both are not fluent in at least one language, but my opinion doesn't matter. In this economy it is quite normal for job transitions. The main thing that you need is to keep continuity of jobs and have supporting documentation of your past and current employment status and income. You are at the petition stage which does not involve your finances. USCIS is concerned about if you are both single and willing to marry and do not have any red flags that suggest immigration fraud. The consulate will worry about your finances when you get to that point, which will probably be in the early summer. In theory, you can submit additional paperwork, but I wouldn't worry about this. You should make sure your fiancee has everything up to date on her end. :thumbs:

Where are you getting this form? From the Guangzhou site? We printed the blank form and Yi handwrote everything. These forms are convenient if you can type them on the computer, but all the embassy wants is the information..whether handwritten or typed. Just make sure your fiancee writes clearly.

We carefully followed Packet 4 instructions, putting both English and Chinese answers on specified fields of the on-line DS-156 form. But when clicking "Continue" (to get the printable DS-156 with barcode), we get an "invalid entry" error that only English is accepted.

What do we do? Is it acceptable to print the form with English-only answers and then add the required Chinese translation by hand? Thanks.

You are wrong. Notarized letter is NOT necessary.

It depends on the embassy, Guangzhou requires a notarized letter to withdraw support for a petition. However this visa has been issued so it is not an embassy issue, it goes back to USCIS. He can use the visa, he just will not be able to adjust status because he won't be able to marry the petitioner.

Some excellent advice, this. Having looked into the whole matter more carefully, I decided to put up what we have so far for the benefit of all others who may wish to look up this information. Please do correct me again where I mess things up blush.gif .

First, let me thank again Carla and all the rest who have helped so far by contributing their opinion and other input. Okay, so I wrote to Missouri State and they replied telling me that they only deal with state IDs/driver licenses but for the marriage license details it's all here

First of all, it is important that one can apply for a license anywhere within Missouri; they do not need to apply in their vicinity, except for reasons of convenience. However, I also found out that there is another hidden factor. Our priest told us that, while we can go to another office to apply for the license, he recommends (strongly) that we do so at the County office since that is the one that the church (situated in the County) normally deals with. It seems that since they are comfortable with the paperwork of that office, the natural thing for us to do is to apply to the County and not to the City, where we will be. Otherwise, WE might have to sort out all the paperwork ourselves! you can imagine the potential delays here ... blink.gif More generally, this may also affect e.g. the diocese paperwork (situated in Chicago) where some of the paperwork will go through. Similar considerations will certainly arise for other people who have a non-civil wedding.

Summing up: apply anywhere within the state that is a) close to you and cool.gif is well-suited to the bureaucratic needs of your church/group.

In the case of K-1 visa holders like me, it seems that having my birth certificate (stamped copy given directly by the custodian of records abroad and also translated by an official legal notary abroad with an apostille that allows this document to be valid in the US), SS card (or letter of from SSA office saying I will have one at some point), perhaps an official government letter like the one Carla received, my I-94 and passport would be more than enough. In fact, it seems to me that simply having a passport (AND I-94 of course in my case) would probably count as the "equivalent" of "state ID" for a US citizen. Even the SSA-issued letter (saying I will be getting my SS card) may be waived since I can instead sign that I have not received one yet.

As a final thought, it seems that a few nice changes have taken place in the State of Missouri. For one thing, applying for a marriage license does not need a 3-waiting period any more. The cost has also gone down slightly and (quote) "couples will be able to apply and obtain their Marriage License on the same day as long as they are getting married within 30 days of their application date; the marriage ceremony must occur within 30 days from the date of issuance of the license or the license is void".

This is particularly important because some websites confuse things quite a bit. As an example, I will bring jzoom6's great site http://usmarriagelaws.com/ that he discovered (thanks!). In the Missouri section, it mentions "You'll typically need to apply for your marriage license at least one month before your wedding ceremony", thinking in terms of expiration in MONTH*S* whereas it's in fact "at most" a month now, since it now expires WITHIN one month! Interestingly enough, it mentions that you do not need to be a resident of Missouri to apply, which means that proof of residency (while required for the "state ID"/driver's license) is not strictly speaking required for obtaining the marriage license.

Initially, I had been really confused and had reasoned as follows: since I cannot provide a "state ID" in time for the marriage license application, I will need the equivalent documentation needed to obtain one under my status. "Status ID" applicants who happen to be K-1 visa holders need proofs of lawful presence, residency and ID. Hence, if I can obtain all three for the marriage license people (Recorder of Deeds), I will be OK. But, as it turns out, things are easier and the papers needed as evidence to obtain a marriage license are a subset of the aforementioned set. Nevertheless, when it is time to apply for a driver's license (or state ID) with the State of Missouri, all these papers will be needed.

To sum up. Having the following documents (*) suffice to obtain a marriage certificate at the St. Louis County in MO.

(*) Birth certificate, (foreign) passport, I-94, SSN card or appropriate letter from SSA (although it seems the latter can also be waived, as was the case with Jomo's girl).

Does all this sound about right? Or am I off my rocker once again? wacko.gif .

Please note.........even though it said Andre needed a SSN, I called and explained that he was a K-1 visa and did not have one. They said they see it all the time with immigrants and would just use his visa number in the SSN slot on the form. It went just as they said. We had absolutely no issues with not having a SSN when applying.

Okay, now let me just clarify what you said. So, you're essentially saying that it all boils down to this letter that the SSN office sent you with your US address.

Is this standard procedure when you apply for a SSN (do they send such a letter automatically to you)? Or did you have to specifically request this letter when you applied for the SSN? Also, at that time did the SSA office ask to see any sort of proof of residency for you or was that something he managed to figure out through other sources (e.g. perhaps intended permanent address shown on the I-94 given at the airport or through the online info that appears on the SAVE system etc)?

I'll be traveling on the 19th of May, and the wedding is scheduled for the 5th of July (sort of our day of independence smile.gif) The idea of a meet sounds fun, it'd be great, looking forward to it. I'll be moving near Forest Park area, not far from the Metro station.

Hi all,

I am a K-1 visa holder (successfully had my interview last week at the Embassy in Athens) and will soon (mid-May) travel to the US to marry my fiancee. The wedding will be early June in St. Louis County (MO). I had a question regarding the documents I need to bring with me in order to obtain the marriage license in St. Louis County.

According to the County, one of them is the social security card (which I will have obtained by the time I make the application for the license or if not then an appropriate document from the SSA office certifying I have been assigned a SSN and will get the card soon in the post should suffice) and the other one is ‘state ID’ (or driver license). It is about the second one that I have questions, since the State of Missouri has some stricter requirements, it seems.

Now, correct me if I am wrong (please! blush.gif ) but this is what I thought so far.

First of all, I think it takes a very long time to actually obtain a state ID/driver's license if you are a new alien (in my case coming from a K-1 visa as I will have about a month after arrival to the US before I apply for a marriage license - typically 2 weeks before the wedding, so we are within the 30 day limit of the license's validity plus I have enough time before to obtain my SSN in the post). Therefore I reason that it might be sufficient to provide alternative papers (at the time when I and my fiancee go to the Office to apply for the marriage license) which show the same type of evidence as a state ID would. Is this true? Or do they actually require that I have a state ID in hand?

That is my first question. My second question continues in a natural way from the above (relating to it).

More specifically, I had a look at the idrequirements.pdf file from this site http://dor.mo.gov/mv...equirements.htm . Thus it seems that I will need three things (for state ID and thus for the marriage license): Proofs of lawful presence, identity and residency.

Proof of lawful presence in my case can be covered by my (valid unexpired foreign) passport and future (valid unexpired) I-94. Check.

Proof of identity will be shown by my SSN or the appropriate letter from the SSA (in case the SSN has not been assigned yet). Check.

However, I am not sure what sort of things could alternatively be used as proof of residency. I am a bit hazy if I will be in a position to open a bank account and have a statement or join the lease agreement for my fiancée’s apartment in time for the marriage certificate application. Is there anything else I could use in my case?

Any suggestions would be greatly appreciated. I'm truly at a loss what to do here. unsure.gif

(Note on dates: I will arrive on May 19 in the US. The wedding is scheduled for July 5.)

Just got off the phone with IRS customer service...they are very picky about where you have them faxed to, it sucks because i don't have a landline phone so faxing is tricky for me. I tried to get them to send to an e-fax # and they refused...then to a fax machine at my parent's house which they also refused to do(apparently they want you to be physically next to whatever fax machine they are sending it to). BUT in the end they gave me the address to a local IRS office 5 miles from my house where I can walk in and they'll give me everything I need. WHEW! You all saved me much heartache so thanks for the advice...could have been in for a shocker if they denied me for my 'unofficial' tax transcripts..pretty ridiculous.

I filed it electronically (through TurboTax) & it was accepted by the IRS. I have a PDF of the document saved but it's not really original.

The k-1 visa interview appointment is set for September 22 at the US embassy in Lima, Peru. I plan on attending the interview so I already have my flight & rental apartment booked. I have been meticulously gathering evidence/proof of our ongoing relationship in the last few months and plan to bring it with me. We are fairly well prepared and this website has helped tremendously! We are waiting for the visa interview appointment letter so she can bring it to the medical exam but it has not yet arrived...all her other documents are pretty much in order (i.e. antecedentes policiales, penales, judiciales & partido de nacimiento verified by RENIEC).

An immigration attorney recommended it so I sent in the I-134 affidavit of support w/ all the supplementary documents along with the I-129F petition..however, I later read that this was not recommended (I am making a new I-134 dated closer to the interview..just so they know that I still have a job and haven't gone bankrupt).

I have ready somewhat contradictory statements about the I-134...is it necessary to get my financial documents (or any documents, for that matter) notarized? The I-134 instructions state that this is not necessary but I read somewhere in the Peruvian embassy reviews that it was. Also...any last minute advice? I know that it's helpful to show up really early and not bring any electronics..

The instructions for the I-134 state that the documentation to support the financial information should be provided in duplicate. I have 2 questions. First, does that mean there should be two copies of w2 and two copies of tax returns? 2) I have the signed letter from my banks showing how much money i have but only have one signed letter from each one. If two copies are needed, is it ok to submit one original and one copy or do i need to get another signed copy? Thanks for any help!

They called her to come and get the information at the embassy instead of them mailing it. She thought something was coming in the mail and if they called her in it was for the interview. We knew by Monday that's what it was, but I called the embassy to confirm anyway. She has all the information and the interview is set for December 27th! Thanks again.

Something really is fishy. The NOA2 stated that i would receive a letter letting me know when the NVC processing center sent my petition to the Armenian embassy. I haven't received anything yet. Thanks for the help! She received an email about 4 weeks ago saying she'd won the visa diversity lottery which was a scam so someone has her information. Thats scary. Again, thanks.

She has received nothing. There have been no physicals, nothing. I am wondering if this is a scam, but she is to go to the embassy on Monday at 2:00. Sounding suspicious. I was planning on scanning and sending everything but am worried about what is going on.

I received my NOA2 on Nov 18 (dated the 14) for approval of my K1 Visa for my Fiancee from Armenia. I have not received anything else and today she told me the embassy called her and told her to come on Monday at 2:00 for an interview. She is to bring her passport, a copy of the passport and $150. This was her first notification of any kind. I'm assuming this is in lieu of mailing her something to give her the package of the requirements but has anybody had any experience with this before? I was planning on sending her all the originals of the affidavit of support and other docs FedEx on Tuesday. She doesn't have any of this yet, but will have it by Friday. I am assuming this is preliminary but would like some confirmation :)

There are several on the USCIS website where you are able to fill them out online and then print out.

Been there, done that. There was one week, I called in sick so much cause I wasn't even in the country, that I had to go to the doctor and get a slip to return. You do what you have to do.

I would use your permanent address for everything and make sure someone is there to pick up your mail and forward it to you. You want to be careful here.....there is a lot of paperwork that goes back and forth and you dont' want it lost somewhere.

Been to phil 5 times this year to see her. Its been a loooooog trip back from Manila today..... wonderful place, and so perhap one day I can meet a wonderful person, but I am afraid I am k-1 maxed out even though I have never married or brought anyone over..... If I choose to can I refile for her now that we have honesty (sort of) on the table, or is that high risk since she clearly lied in the original application. A much more likely scenario, lets say I meet someone new in life, can I still do a k-1?


Email the Embassy in Manila indicating they'll be receiving a notarized letter from you, withdrawing the petition. Mention your fiancee's full name and the case number. Write a similar letter to the USCIS Service Center that adjudicated the petition originally.

At most, you'll need to provide a letter explaining why you would be filing another I-129F for a fiance, whether for this or any other woman. If you decide to pursue a relationship with the current beneficiary, you might consider marriage first and just going the CR1 route. No need for a waiver in that case.

Risk, is for you to evaluate as you are the one with the most complete information from which to do so.

I want to warn you, though, there is a chance the petition will not be cancelled. I know of people in the Jamaican forum who did this and the messages never go to where they needed to go. 2 people that I know of still went to their interview and go their visas. They came to the US. Never heard much of what happened after that. They are probably happily living here illegally.
