Always download the latest forms from the website (in your case I think http://travel.state....orms_1342.html). I know from personal experience that newer versions are fine to use. Usually, if the Embassy sent you slightly older forms they will accept them, but they can certainly not refuse the newest forms that become available (on the contrary they will be pleased that you used them instead!).

I am pretty certain that this is an important question that needs to be addressed. You should definitely not put "address not known". Also, I am pretty sure that they use the information given here to learn of your intended permanent residence (AFAIK, they want this to be pretty "solid" until you get to the US and perhaps for at least some time after that). I would very strongly recommend that you call up the Embassy and ask them about this. Mention to them the situation and they will be able to advise you what to put in. I think that Mae's suggestion is also very good. Mention to the Embassy that he is currently staying home with his parents. Unless his parents live far away from where he lives/intend to live, you might as well get all your paperwork to go to their house, if the Embassy feel this is a better idea.

Anyway, that's my two cents worth.

Thanks to all who replied so fast! Sorry that my questions was not very clear, but essentially you all guessed it right; I was just wondering if the original form is called I-639A (as the old FAQ mentions) as the one I have in my hands is called DS-3025. Anyway, it seems I will NOT need a medical I-639 after all (I will be well within the year limit by the time I apply for AOS) but I will definitely need a I-639A attached simply because my list of vaccinations includes two "age-inappropriate waivers" (pneumococcal, Hib) and for this reason the list of vaccinations was marked by my Embassy panel physician as "incomplete" (I also have a "blank" for DT/DTaP/DTP which are for infants and thus not applicable at all). I suppose that most people will have some sort of waiver for a vaccine and thus have an incomplete list. Additionally, as I mentioned before, additional vaccinations are required after February 2008, and while my panel physician had told me they still go by the old list, it's probably a good idea to bring officially translated (if need be) copies of the new additional vaccinations required (e.g. Hepatitis A is a new one, and requires two shots to be completed over a period of a month). I will thus contact one of the civil surgeons that thread mentioned and fax him my DS-3025 (unless the civil surgeon in future needs to see any of the additional new vaccinations in which case I will have to go in person to see him/her).

When we traveled from St. Louis to Chicago last year, Jomo took his passport as proof of ID. Until he had his green card and state ID, we didn't want any issues to come about where he would have to proof ID and not have any. Now, his passport is safely locked up in our safe deposit box.

Just got all documents from my fiance in Ukraine. Ready to send I-129F out. Fiance`s signature looks like her last name, or initials, or combination. She says ukrainians do not do full name like americans. IT MATCHES HER PASSPORT SIGNATURE PERFECTLY. Anybody know anything about this??



Its better to have her sign her full name and even her Patriarchal name which will become her middle name in the USA. I believe it begins to matter more for SS number and other things later on. I agree with the poster that said she should sign as is recorded in her INLT passport (and not her propiska).

This is how we did it and had no problems. However, a good rule of thumb is to sign what best represents you, But if it bears little resemblance to her true name it could be questioned by the adjudicating officer.

Remember, she is coming to the US and things should be done in close accordance as not everyone handling the documents understands how things are done in Ukraine.

Looks to me like she talked him into sending her money and now, she wants him to marry her for a visa.

Now, while that is not the case, I think it would be better to show she was employed (even if slightly questionable cause it can be explained) and supoprting herself while casually meeting him and falling in love.

If you are filling out the I-129F, you won't have an number yet. Just leave it blank.

If you are filing for AOS, you will have one then.

If they had got married in a Christian church or some other religion and just had a ceremony without handing in a marriage license would it still be classified as married? It won't matter if you pin it or what......someone always comes on here asking the same question. I kind of get irritated when I hear people trying to make excuses around the K-1 visa. If they want to get married before the visa is approved, REGARDLESS of the excuses why, then they should wait and file the K-3. It's really a no-brainer. Yet, it seems every day someone asks how they can get around the rules of the K-1.

I believe they say 40 days for the police cert in the UK. Assuming that he doesnt get the visa before the wedding date make sure he brings lots of evidence of ties back to the UK. You dont want him denied at entry because they think he's going to stay... But lets think positive and home the cert comes tomorrow and you get the interview in a few weeks! Sending positive vibes your way... :blink: that's my + vibe face :)

The bottom line is, if you get legally married before the interview, the K1 will be denied. If you happen to get married and don't tell them, then you will have some explaining to do with it comes to your AOS. They will require a marriage certificate and will see you were married before the Visa was issued. Do you really want to fight that battle? They may see it as you obtained a K1 visa Fraudulantly.

Wait for it.... or get married and file for a K3.

While I was originally thinking WTH were you thinking, I get it now. I too looked long and hard for a site just like this before figuring it all out on my own via trial and error and finding this after. So, I do know what you went/are going through.

I wish you luck. My advice is to now sweat it at all. There are enough things to sweat in this whole process and your wedding should not be one of them NOW. If you have to use the whole thing you booked already, do it without making it legal. Then, when he gets here, go to the courthouse and make it legal. I would not switch to a K3 now. It's too far along in the process.

If you end up making it through beforehand, it's all good then.

Either way, this is pretty much the celebration of this long, rough process. Celebrate it either way and just go with the flow.

Have a "fake" wedding, if you must. Let the presider know this as they may want to change some wording or something. Do not sign anything official.

Hi Kristen! My name is Alicia. My Husband is from Nicaragua. We were hesitant about the whole fiance visa route but it turned out to be perfect. We got our visa in 5 months from start to finish. He has been in the states since March 18th and already has a social security number. Because of his K1 status, when we applied for his social security number we were informed that he has temporary permission to work (until his K1 status expires~which is June). So, he has a job and we are working on adjusting status. Hope that helps.

I don't think work is possible after a K1 without EAD. A social security number is not, on its own, permission to work.



I was thinking the same thing. Also thinking you can't "work on AOS" till you marry and once you marry then temporary things are no longer any good.

Just follow the guidelines... enough with the "fake" or "Non-Legal" marriages. One slip up and you're going to regret it. That is exactly what I said to that other post. A K-1 is a K-1 and has rules to follow. If it is that big a deal, get married in you SO's country and file for a K-3. I just don't see the big deal. The wedding is just a formality. The relationship....the marriage.....the rest of your life is so much more important. Would you really do anything to risk something that may come back to haunt at any time?

Firstly hats off to visa journey for being an invaluable source of information to those (like us) who weren’t smart enough to appoint an immigration attorney.

Secondly enjoy your sigh of relief when your visa arrives as it will be a short-lived respite from the joys of dealing with the exceedingly knowledgeable (sorry what year is it again) chaps at USCIS

I guess the first thing to mention is do not bother doing what I did and flying a 3 hop (terribly expensive) journey to the mid west just so I could go via JFK in hope of getting I94 stamped work authorized for 90 days.

I did easily get a work stamp by the way which lasted until I invalidated it 6 days later.

Here’s what they don’t tell you.

You can’t apply for a work permit (1 year) until at the same time (or after) as you apply for adjustment of status.

You cant apply for adjustment of status until after you are married (obvious)

What they don’t tell you however is that as soon as you get married you nullify your visa and any temporary work authorization you might have.

There will therefore be a 1 to 3 month period (depending on processing times for status adjustment) when you don’t have any work authorization irrespective of whether you obtain a temporary work visa.

Also worthy of noting is that when you arrive apply for a social security number before you get married. Some states allow marriage without an SSN however you cant get an SSN after marriage without going via USCIS

Yes it is advisable to wait for two after arrival to ensure you appear on the “save” database however you cannot apply for a social security number after marrying unless your status has been adjusted.

Hence in short follow this time line

1. Don’t bother going via JFK to get work permit
2. Wait 2 weeks after arrival
3. Apply for social security number (this takes about two weeks) via local social security office. Go to their website www.socialsecurity.gov to download the form for New Social Security Card
4. Marry (If you haven’t already just gone home)
5. Send file of forms to USCIS being
a. I765 Employment Authorization ($180 for this baby)
b. I485 Adjust Status to LPR ($325 thank you very much)
c. G325a Biometric Services ($70 that’s for taking your fingerprints again even though they reside on immigration computer already)
d. I864 Affidavit of Support ($0 yes really, although you may recognize this as being almost identical to I134 Affidavit of Support) Still needs to be filled out again though in new format
e. Photocopy of Visa from Passport
f. Photocopy of I94 (arrival/departure card)
g. 4 x color photographs 2 each for 765 & 485
h. Copy of birth certificate
i. Separate Checks for processing fee’s is advisable so $180 for 765 & $395 for 485 & 325a
j. Medical Info (see below)
k. Copy of Wedding Certificate
6. Send package to address on I485 assuming you send all forms in one go

Form 485 clearly states that as a K1 you do not need a full medical only proof of vaccinations
This needs to be on a specific form of course only available from USCIS doctors (list on website) and of course every doctor I spoke to would not transfer Vaccination info from form they use at London medical onto correct sheet without of course you undergoing another full medical.

If you shop around you can get some doctors willing to transfer the data from your UK records although if not expect another $150 fee
I phoned a dozen and eventually found an emrgicare willing to do it for $36 while I waited

Don’t bother getting the vaccinations done at the London medical center as their paperwork doesn’t have any effect here either.

Sorry to be the bearer of ill tidings however fore warned is fore armed

I've never had any issues at all changing. If it is going to cost you that much difference, you could make the reservations and then just change the flights if necesary. Tickets are good for a year.


Yes, most airline's penalty for changes on the date are only $100, so if you want to you can book your tickets now and if soemthing happens you'll have to pay $100 for each ticket, to change the dates.

You can also do some online search to find itineraries with the same return flight, these are great sites that display all the airline's itineraries available : www.kayak.com , www.cheaptickets.com.

My fiance and I, traveled to Europe last year together from different departure cities, and we were able to find on those web sites the exact same return flight with the same conection. We always buy our air tickets online, it is cheaper than doing it through a travel agent and you can choose the itinerary that suits you better. I think is a bit weird that the travel agent said there are no one way flights for your fiance, do some online search yourself to see if there are any available.


I was not able to make a reservation ORIGINATING in Jamaica (i.e. foreign country) via the internet. I had to call the airlines directly and make Andre's one-way reservation, so I made mine at the same time.

My suggestion is don't get so down, where there is a will there is a way. You need so much as a job that pays $8 an hour to meet the financial requirement for one year. Set a goal for yourself if you truly want to be together and stick with it. It might take a year it might take two but at the end of the immigration process it is worth it.

It took my husband and I nearly two years to get over all of our hurdles, financial, divorces setting up a home etc. It wasn't easy but we did it for ourselves and we have now been living happily ever after together in the states for nine months.


My suggestion is that you get a second job. Work part time at a fast food restaurant if you have to. You don't have to make the money last year. You can annualize this year's income and back it up with current pay stubs at interview time.

Second, stop the pity party and get on with it. Nobody is forbidding you to marry. The issue is qualifying as a sponsor for a visa that allows you to live together in the same country.

I have to agree a little on this. While the answer may have come across a little harsh, this ENTIRE process is so difficult and seemingly never ending. If you let one problem in the beginning stop you, one you can correct fairly easily, then you will never make it to the end. I agree with the 2nd job. I have 2 jobs and it is doable.

Well here goes... I am in the process of applying for a K1 Visa to allow me to enter the US to marry my fiancé. I am making payments to my car through a finance company on a 5 year deal. So far I’m into my 4th year of payments but now seeing as I’m planning to move country I may need to make arrangements for them to repossess the car as I cannot realistically take it with me. I guess this will totally mess up my credit so I was wondering whether this would have any bearing on my Visa application?

I just wanted to see if anyone had any experience in the this gamble and how it worked out for them.


There have been horror stories on this very subject.

I can attest that people from Jamaica going through the K-1 process are at least a month behind the very same process I went through just last year. You never know.
