K-1 Fiance(e) Visa Process & Procedures6-9 months away from my fiance? is this right?
You can visit. I went to see Andre every month during the process.

You will want to keep a residence and a job in the US for the I-864 and AOS purposes.

K-1 Fiance(e) Visa Process & Proceduresbirth certificate question
QUOTE (jixel057 @ Dec 11 2007, 09:53 AM) <{POST_SNAPBACK}>
Hi! Just wondering my fiance is from the UK and I am from the US. Just wondering when you need the foreign applicants birth certificate? I know it doesn't say that you need it in the first packact, but I thought I read that you COULD put it in if you want. Just wondering if we need it towards the end, just at the interview or what??
Thanks for any help?!

For the interview.

And, you'll need it to marry, for SSN, State ID (if applicable), a DL.................

K-1 Fiance(e) Visa Process & ProceduresEmployment an issue for K1?
I would think he may have to explain what you just said and show some sort of proof along the way. Not that it matters much in the whole scheme of things where they work at all. It's just sometimes that "unemployed free ride" ####### comments come into play and may need to be proven wrong.

K-1 Fiance(e) Visa Process & ProceduresWill this be a problem?
I've seen people in Jamaica approved for K-1 after being turned down for a visitor visa. Like the person above said, she was turned down cause she did not meet the requirements.

I think they ask that question primarily to catch those who have overstayed other visas.

I don't know that we had anything unique. I had sent him handmade cards......I made 1 a day for a year and 1/2. Does that count? And, he made me this picture thing of seashells.

While going through it, my husband had no idea how much work I put into my part of it. Even when he had all these errands to run for the process, he thought he knew; but he didnt'. Once he got here, and saw my complete bound book of paperwork and proof, he was amazed.

Be as patient as possible. Rarely do things happen as quickly as we want them too.

If you are this anxious already....at the beginning.....you will drive yourself insane later on.

I didn't have any passports notarized. I just copied the thing and sent it in.

Our copier, here at work, has a warning on it that it is against national law to copy certain things.....passports, checks, and licenses are included in that. I laugh every time I think how many times I have copied all of those. Now, the money, stocks, bonds............those I get. The others, not so much.

K-1 Fiance(e) Visa Process & ProceduresInterviews 2nd Havent recieved Packet 4???
Now, this is for Jamaica..........Andre's packet 4 contained only his interview date/time information and the specifics for what he needed to get and bring to the interview: non-impediment, police record, birth certificate, passport, and medical results.

Look up your embassy specific information somewhere on this site. This is where I found all my information before we ever got packet 4. We really never needed that packet.

And, yes, go to the interview, no matter what. Worse case, you will get a slip and another appointment for the missing stuff.

K-1 Fiance(e) Visa Process & ProceduresAffadavit Of Support
QUOTE (cmboothe @ Jan 2 2008, 11:48 AM) <{POST_SNAPBACK}>
QUOTE (Mia Clakre @ Jan 2 2008, 11:31 AM) <{POST_SNAPBACK}>
Hi everyone.

I am looking for some advice regarding the I-864 affadavit of support form. My fiancee is a freelance sound engineer and receives payment for work in cash. He also had some financial problems in the past and owes creditors money. As a consequence of these problems, he does not have a bank account. He also has never filed his taxes. He rents property, and does not have any assets.
We spoke to an accountant, who said there is probably a way to file for last year's taxes. However, I am concerned that one year will not be enough, and that the lack of bank account details and cash-in-hand employment will be a problem.

We have a co-sponser, who meets all the requirements.

If someone has any thoughts on whether my fiance's (pretty poor) financial situation will prove a problem for us when it comes to filling out the I-864 form, or later down the road (such as AOS). I would really appreciate it.

We hired a lawyer, but it seems that people on this site are way more helpful.

Thank you!

Who is the US applicant? You or he? If you, and your affairs are in order, good news. If it is he, I would suggest the following. 1) He must begin to pay taxes and create that record. This will be important for more than a K-1 visa, you both with have to apply for your conditional permanent residency once you get married. Then, you will have to re-apply app 2 years later, and then 10 years later. It never stops, so it's never to early to talk to a qualified accountant and get your affairs in order.

2) Focus on your sponser and use his information. This will be sufficient for now.

Exactly what I was thinking.

I am marrying my first cousin, who is from Brazil. Please no rude comments, it really isn't a big deal at all to marry your first cousin. In my state it's perfectly legal to marry your first cousin and my lawyer didn't mention anything as far as denial goes so I was just wondering...do any of you think that us being first cousins will be a reason for us to be denied? unsure.gif I really hope not.

Thank you

I honestly don't think it will fly. I think once it is revealed, it will look suspicious.

Are you the US citizen? If so, they never ask for your criminal record. Your fiance is the one who has to provide the police certificate for the embassy.

Do the best you can on the filling out of forms part. Be as careful as you can and you will be fine. They really don't sweat as much of the teeny tiny stuff as we imagine they do.

Visa fraud pisses me off. Don't even get me started on this one!!!!!

QUOTE (eric_and_teresa @ Jan 4 2008, 01:37 PM) <{POST_SNAPBACK}>
If they get married they can not apply for a fiance visa (K-1), they would have to apply for a spouse visa (K-3) or for CR1/IR1.

In any case, the baby will be born before the visa is granted, unless they are lucky but as the above poster said the pregnancy wont make a difference for the process.

So if they apply for a fiance visa, the baby is born, and then the fiance visa is granted, she can come to the US to get married? (in that order)

Depends on if/how Catholic the girlfriend is. Family may pressure for marrying in Mexico before the baby is born.

Thanks! Yoru help is truly appreciated!

No required unless you were previously married. Then, you would have to produce the divorce decree.

AOS is adjustment of status. You do that after he arrives in the US and you marry. You have a whiles to go before you have to evey worry about that one.

The mistake was so stupid. The question was if I had filed for this or any other alien fiance before. I checked both the yes and the no box.

It means they will send you a letter stating they need some clarification or more evidence on something.

A minor issue and easy to correct. Just hang in there.

Well, I am ####### and made two copies of everything (one for me and one for him in JA), so I am the wrong person to ask.

Mostly, I made his copy so he could study what I had sent in from this end, in case any questions arose from that. In reality, none did that we had not already discussed anyhow.

I do refer to my copy all the time to guide people who ask me questions I can no longer remember the answers to.

All in all, I think the odds are with you that it will be okay.

True on the annullment part. But, the rules do say "free to marry" so the answer to this question is NO, you cannot petition for any type of marriage based visa without divorcing first. No way around it.
