Solution

 

Just as you declare what embassy you wish to be interviewed in, you should also declare your POE.

 

Then embassy sends to the POE and you get email/text notification that it's there and you can now POE. This resolves the missing, wrong person, stolen, ripped DNO envelopes.

 

But knowing this whole immigration process it will just turn into another epic clusterfrenchpie.

You need to call DOS with your GUZ number every few days and get confirmation from a real person on the phone that your packet has been received. They will probably tell you that the case has not be given an interview date, if this is the case you should call back at least once per week until that changes and they have issued a date.

She will receive her P4 interview packet with her letter to gain entrance into the embassy and directions on her medical exam.

This I can not answer. DOS oversees the embassy offices, so I would think that they have a handle on the number of interviews at some level, but the person on the phone might not have access to that information.

I'm just received my police record checks today, and filling out the DS-230 Part I form from the package 3.

I downloaded a fillable DS-230 form to fill out on my computer, and was wondering if I could submit this. The only thing is I cannot print the form out double-sided like the one came with the package. So I printed 2 pages.

it's just much neater to fill out on the computer than by hand.

Would General Console in Guangzhou accept it? Or I must submit the form from the package?

Is there a specific reason for delaying the petition application? I would go ahead and apply, your second trip can be properly documented and that evidence given at the interview. Also, you will need to concurrently file a K-2 for the daughter if you plan to bring her over. You will need documentation from the father which allows the daughter to leave China. As per your questions:
1. 6months is not a long time, but does not mean that you will be denied as your interview at GUZ probably won't occur until you are close to the 1 year mark of knowing her anyway. I would certainly front load your petition with email chats, written letters, photos, ect. Don't go crazy with the loading, but some evidence certainly helps. You should also include an EOR (evolution of relationship) letter to explain in more detail how you met and your relationship.

2. You age difference will not give you favor, but it is good that she is not significantly older. Your main issue will probably be documentation for the daughter. On this issue, I can not give advice, but if you read back through the forums you will find good information.

First, I am really sorry about your blue, but a blue is not a denial, it is a request for further evidence of bonafide relationship. What I raise as a potential redflag in your case is the mention of the wedding ceremony you held in China. Did this evidence come up during the interview?? You can not file a K1 and then have a wedding ceremony, it will invalidate your status as an engaged couple and require a resubmission as a spousal visa. So, they only asked for more phone records??

just a quick reply, GUZ will care more about her family's opinion than yours. I is important to have some pics with her family if this is possible. The converse is true when you are applying for AOS, the officer will want to see pics of your wife with family members and also in places that they can tell are local. They will also want to see those original pics from China with her family as well, since this helps to provide the proof that you really do spend time together and that both families are aware and involved in the relationship. You can translate them, and in my case I have written letters to my in-laws and they care less about the content of the letters and more that I took the time to carefully write the letter in Chinese.

Wow a copy of a cover letter would be great!! It would give me a good idea if how to word and format my letter!

The only issue I can think of is my recent divorce date, which was 9/17/10, however my ex and I have been separated for a well over a year now.


I promise that I will pull that file, it is on my portable HD, and get it posted asap. As far as the marriage issue, I was also separated from my ex-wife for a long time but due to issue with the kids the papers were not filed until after I had already met my fiancee. As terrible or ironic as this sounds, we filed the K1 petition the day after we had the certified copy of the final divorce decree in hand. This gave us no troubles, only that GUZ was very upfront about asking if she knew that I was still legally married when our relationship began. The most important thing is to be upfront, honest, and clear with the consulate. You might have little embarrassing things from your past, but they WILL know and your girl BETTER know or you will feel worse having to explain to your fiancee why she is stuck in China because you hid something out of pride. I would HIGHLY recommend doing this process yourself as long as there are no BIG immigration issues (she has multiple children, you have been married to multiple foreign woment, ect). America is a great country because we have the right to succeed or fail under our own hand. Don't give someone else your hard earned money to do something that just requires a little homework and grit. Take time and read back through the posts here on the China forum. I know, it SUCKS to spend so much time wading through a lot of silly questions and comments from members, but you can learn so much from their mistakes and problems. You do not need such an excess of records. GUZ is looking for history, not day-by-day accounting of your relationship. Show a history by including letters, emails, and other records, a few from each month and you are more than covered.

Look at it from the CO's perspective (soneone that reviews petitions for a living and has to be able to defend their decision) and make the strongest case possible.


Absolutely seconded, it would be quite easy to have letters of support from family that are fraudulent and this is what a CO is looking for. You need your letters of intent(from both partners), along with your EOR and your front-loaded evidence. As long as you have no other red flags you should be fine. From my experience talking to others who have gone through GUZ, these are the main issues that kill a visa petition at GUZ:
1. Scant file, unorganized and lacking information.
2. Unprepared fiance(e), who is unable to answer questions about the relationship.
3. Facts regarding your case that were hidden by the petitioner (such as having 3 previous marriages and not disclosing them...hey, it happens).
4. Issues with the beneficiary (CCP, prior visa petitions, ect.)

In our experience, due to a mail delay we only had about three weeks from receiving P4 and the actual interview date. This doesn't leave a lot of time. The key I think is to call DOS almost every day after the P3 has been sent back until you have confirmation of interview. This way you will know when the interview is well in advance of the mailing. Good luck! Oh, just wanted to point out that your "filing status" says you are AOS pending...you might want to change that if you care. :thumbs:

One BIG issue to consider is that she IF you are going to have her stay with you until just prior to the interview, then who is going to take care of her P3, get her police report, singleness certificate, ect.? These are things that you will need to consider. The other issue is that sometimes POE is denied if they know the B2 holder is engaged, because they see the potential for intent to immigrate. So, she will have to be honest, otherwise she will have a LIE in her file. I am pulling for you, just some things to consider. Good luck! :thumbs:

Two points:
1. I think this is fine as Sam has mentioned, just be sure to be truthful at the interview if this is brought up or asked about. To be honest, if you can demonstrate that the two of you are able to communicate and can show a bonifide relationship, then her ability to speak completely fluent English is not an issue. Only an issue if she speaks no English and you speak no Chinese.

2. This is more for your fiancee. Regardless of her level of comfort with English prior to coming to the US, she will have an adjustment period that takes time. As she progresses in her ability she will seem much improved to you because she is familiar with your voice and accent. She will have trouble with other people. I have seen this a lot with the University students here. They have superb language scores but have a tough first year, but then adjust quite well as long as they are immersed.

She is a K1, outside of the AoS she only needs proof of relationship materials from the two of you and what is specifically requested. Honestly, I have not heard of someone asking this question, at least at GUZ, but that doesn't mean it couldn't be asked. A simple answer is best, simple and honest. The "unfrosted" side of me thinks that this type of question would be used to try and trip-up your fiancee if they question bonafide relationship. I think a better way to go, outside of 001, is to ask some of us for our wive's emails or QQ adds if she really has questions or concerns. My wife read some of 001 and knew what was going on and steered clear. There are just some Chinese women (and some in all cultures) who enjoy playing mind games and this is not going to help your fiancee. The last thing that you want is some fourth-K1 denied gold-digger messing with your fiancee. And the idea that the ones in the US are somehow safe is not a good foundation, because I know a few personally who have very intelligently convinced their men that their relationship is real and that their past is honest (and non-existent). I will address your support question. GUZ will be looking for evidence that you will be able to support your future wife. They ask for 3 years of taxes because they want to see a trend of gainful employment. A newly acquired job is great, but not as powerful an indicator as a solid salary over several years. This doesn't mean you won't be approved, just telling you the rational. If possible, line up a sponser and have their taxes and paperwork in the ready in case GUZ doesn't like what they see from you. If 2010 was your only off year, then I wouldn't worry too much, they know the economy has been shifting lately. Just have 6 months of paystubs for the current job, since you will have that many by the time you get to the consulate stage since you are just now applying. Hope this helps~! :thumbs:

You have only met in person one time and you were introduced by family, which for China starts to smell like fraud to GUZ. I believe that you are legit, just my view based on what you have already said. I have not read of any beneficiaries in China who have had the consulate contact their work or family. (I say non that I have heard about during my two years on this website.) This does happen in some other county consulates. My wife had some concerns also, but they were more about the chance of her losing her job if the consulate contacted her office, since being pregnant or attached to a foreigner are not "positive" attributes for a good employee to have if you are female. That being said, no one ever contacted any employers or called her family. Don't sweat it, include everything, hide nothing. :thumbs: Good luck!

We really need to create some type of document summarizing everything necessary for the embassy stage for Guangzhou because the EOR letter has been a well covered subject and should not have been missed. The problem lies in new members not reading back through old posts during the "learning" phase of this process. This is not a kick at the OP, just a fact. Unfortunately, GUZ (like many embassies) has their own procedures and expectations that you have to satisfy or they will ding you. While this process should be easy for USCs, it is made difficult to prevent a flood of people into the country and to prevent additional stains on the social services already under stain. Get them what they need and you will have pink soon. I would also consider yourself lucky, because the "crying fiancee" is usually escorted out by security without second thought. GOOD LUCK! :thumbs:

Get the travel agent to send you a receipt showing the dates of travel, hotel dates etc. They can probably print a copy of your hotel voucher. Explain what you need, agents keep a lot of information on file. You need to put a timeline or copy of your itinerary with all receipts, vouchers, and boarding passes that you still have attached to the relevant places on your itinerary. Even if you don't have all boarding passes and copies of everything this gives an entire representation of your trip.

receipts give a representation that "someone" took the trip, but not necessarily the OP. Boarding passes and passport stamps are required. This has come up before and is a hard sell if you don't have primary evidence. The point is, anyone can fake a receipt using the right software, but a boarding pass from the airline and official passport are very difficult to fake. Good luck! :thumbs:

I initially want to say this website is tremendous tool to this community because of the willingness of those who share their knowledge and experiences for others to benefit.

I have all the personal relationship history captured including family photos which are all compelling to our relationship. Her English is not perfect however very good and we almost exclusive communicate 30 minutes by telephone once or twice a day where I maintain a prepaid call log. I can assume I meet the income qualification of over 100k even though I am sure this is no guarantee, otherwise I would not be looking at other areas that can foil the visa approval.

I will make sure we will incorporate all the suggestions posted here in our preparation as we move closer to the Interview date. I hope others can benefit from the advice offered here. After this post I will now accompany my finesse at her interview when the time comes.

You mention that you communicate almost exclusively by phone..you may want to consider including chatting online every couple days. Just from a devils advocates view, I would question a call log more than several pages of chat communications that identify the users and characteristics of wording. We use skype and MSN, both of which allow for "free" voice/video communication and a way to record the conversation. Just something to consider. Also, we make a point to exchange "snail-mail" a couple times a month. A $.94 stamp and letter is much cheaper than any potential for rejection at the interview.
