So, did you receive the 10 year green card yet or not?

I agree with going to the consulate. They should be able to fix it as it is a unique situation. I would take some kind of documentation as to the nature of the emergency. The only problem you might then have is the continuous residing in the US part if you were to want to file for naturalization.

You do not have to send in seperate checks. I didn't, nor has anyone I know done that.

Some people do it if there are dealing with children attached to the original visa petition.

Make a phone call and ask. I had that issue with the NOA for our K-1. When I called, they assured me it was there and it was just a fluke of the system.

Our ROC NOA was in there after about 3 weeks.

However, there are many extreme cases where you could be denied. If you do everything right, I dont' see why they would.

Definitely include evidence of your pregnancy.
Affidavits from friends, pastor of your church, etc.
Do you have anything that lists that you are the beneficiaries for each other -- life insurance, investments, wills, etc?
More financial evidence that spans the length of your entire marriage.
Show how you have co-mingled your day-to-day finances, since you do not have joint accounts.
Show a sample of photographs that span the life of your marriage.

Oh, and what does the RFE specifically ask for? Because that's what you need to concentrate on.


Thanks for the ideas....the RFE included every category...it didn't say specifically. But financial, affadavits, proof of co-existence throughout marraige, a statement of our story of how we met, and other things...I don't have it in front of me right now.




Story of how you met is not necessary. That was proven before.

Thanks. We're pretty upset we got an RFE. I'm only 16 weeks pregnant..so no baby shower.

They didn't say what was required. They just said they wanted more evidence.

What about life insurance? Is either of you the beneficiary for the other?
Advanced directive or will naming the other as decision maker?
Car insurance or apartment insurance in both names?
Junk mail showing your names and address?
Pictures together at events with other people?
Plane tickets? Receipts?
Did you buy any furniture together when you moved into your apartment?

I would send in the rental agreement showing both names.
I would send a letter stating that the other utilities are included in the rent and have your landlord sign off on that.
I would amend the tax return and add him. Being out of town for a few months is not a reason not to file jointly.
Call and add his name to the light bill. I did this quite easily.
You could open a bank account with a small balance in it jointly. Maybe a small savings account.

Once you apply to remove conditions, you will use that NOA to show you are granted an automatic 1 year extension of your 2 year green card. I have heard rumors that the backlog is greater then 1 year at this point and am unclear what you do beyond that one year expiration date.

We'll be there next fall, so if you find out and have some good advice, make sure you post it.

Normal is anywhere from 4 months to well over a year to get approved.

If you do not get the 10 year before that 1 year NOA extension letter expires (one year from the date your 2 year green card expired), you will need to make an infopass appointment and get them to stamp your passport and extend till you do receive your new GC.

My hubby is my beneficiary and vice versa for our piddly little work life ins.; but, like someone said, all we did was copy the cards and the paperwork showing our address for that part. Now, life insurance we pay for, we definately showed the beneficiaries on there.
