I feel like I have a good grasp on the situation and have read lots of posts regarding the topic, but wanted to make sure I've got it right. My conditional status expires 08/11/11. My husband and I are planning to move back to Thailand early next year, likely at the end of January 2011. We are sure that this move will be permanent and so I realize that the best decision might be to let my status die a natural death. (I don't quite see the point of going through the ROC when I won't be there while filing, and we will probably be back in the States for only a couple of weeks over Christmas 2011.) Does it make sense to simply give up my permanent resident status? I will probably just get a tourist visa for our visits back here. (I had a 10-year B1/B2 visa before my K1 so don't think it'll be a problem to return to the States for visits.) I just need a few different opinions on the situation to be sure I'm choosing the best path. Suggestions are welcomed.

PS. We have considered filing the I-131 for a reentry permit, but don't see the point when we are planning to live in Bangkok. Paying that $300 fee just to put the status on hold isn't going to change our decision, and we've moved so much already that we're not planning to bounce around anymore.

Hi all

First I must apologize because this is not at all about lifting conditions on my conditional card. However, it is the only topic area I found that is related to conditional green cards; and this is about traveling.

This is the first time I will be traveling outside the US after I received my green card.

Some details first. (Please correct me if this seems wrong to you). I have my (conditional) permanent residence card (which I will need to renew in Aug 2010, about 3 months before it expires). I will be traveling on vacation in Europe for one week in April 2009. My foreign passport is still valid till the end of 2011. Hence, I do not need to file for an I-131 since I am only going for one week (after you receive your green card, you only need an I-131 if you intend to stay abroad for more than 1 year).

However, here is my question: On my way out of the US, do I hand in the I-94 form (the one I still have attached on my passport from the date I entered the US as a K-1er, the one whose photocopies were used in I-485 etc), as I would have normally done when exiting the US had I been e.g. on a tourist visa (B1/B2)? I know that for a tourist to the US, forgetting to return your I-94 before you leave the US to return to your original destination abroad may delay your re-entry to the US. What happens in this case (i.e. for permanent residents)? And if I do need to hand my old I-94 at the airport desk just before boarding the plane to exit the US for my vacation, do I still fill in a new I-94 on my way back to the US (to be shown to the officer at the PoE together with my passport and green card)?

So I need to know two things, basically: do I need to give away my old I-94, yes or no? And do I need to fill a new I-94 on the plane, yes or no ? (I know that everyone has to fill in the green customs form, of course).

Any help would be truly appreciated!

Hi Real Pi.

1) A# is correct.... I've seen references to it as #A but if you look on your GC, it is A#.
2) No, any document that the author signs in-front of the notary public will do.
3) I am not sure about this, but I had the same question when I was preparing these documents for our friends and I ended up leaving them at 1 page. Your friends can go to their local bank which has a notary public and should be a free service to members of the bank. You can call and ask to see how they would handle a notarized document that is more than a page and see if they have any special instructions.

For the cuteness factor, we sent a certificate of adoption of our lil love bug, Casey the bunny smile.gif along with a letter from the HRS and a copy of our id in both our names as members. We volunteered in last year's rescue and were featured in the STL Post dispatch in an adoption of rescued bunnies event both in the printed issue as well as in the online edition. A copy of this went to USCIS smile.gif Also, sent a picture from a st patricks party last year where my husband and I are wearing tiny (dog) irish customs, hat and all, really funny!!

I hope the IO for our case at least gets a chuckle smile.gif

Can have two entirely different views on this subject, what is morally correct and what the USCIS wants, if you want to get your temporary permanent ten year green card of your spouse, you have to provide the information the USCIS requires.

My own personal opinion of the entire I-751 and immigration process is entirely of a different nature. As a born US citizen and a veteran of a foreign war, I do not feel the government has any business getting involved with my personal love life, but yet I had to show personal letters, phone calls, the number of times we met in person and literally go through hell not only to bring my wife here, but to get her into some kind of permanent resident status. Then to learn it's only good for two very short years with the entire process being repeated again. Against the laws of our constitution, I am guilty of bringing in a alien into MY country until I prove myself innocent. I have broken no laws, we both went through extensive back ground checks, and we followed the procedure to the letter of the law, but still guilty of a crime we did not commit.

I was horrified at the treatment given to my wife when she first arrived her, a 120 pound 5'3" woman, red hair, green eyes, with flesh that is all American white with a 13 year old daughter. They put her through a four hour interrogation, strip search, ruined her luggage, lost items when all of her paper work was in perfect order, there is no reason for that.

I have been trained to defend this country for the freedom of which it stands, even at the cost of my life against the enemies of this country, I view Homeland security and the USCIS as key enemies to the freedoms of this country and this was violated to us with no just cause. If there ever was a time I really felt like machine gunning down a group of people with hatred for how my wife was treated, again with no just cause, it was this time, and this includes what we were told was enemies of this country. My wife, as good natured as she is, just said, please do nothing, I am here, Ha, Welcome to the USA.

But that is just my opinion as to how sick MY country as become with a draft dodging president that just has broken every law of our US Constitution and getting away with it. But when the USCIS tells me to jump, I do not ask why, I ask, how high, I eat my pride so I can live with the woman of my dreams.

But in the deep back ground, discussing these issues with my senator and congressman, for whatever good that will do. It is good for me to study our civics test with my wife, to realize once again, how great this country can be. Just like meeting my wife, a miracle how this country was formed, and how it should be.


It is NOT a requirement. The I-751 instructions that proceed that statement you mentioned say "The documents should cover, but not limited to, the following examples:" I am looking at the form right this minute because I have been prepping to send ours in for the last few days.

If you have enough joint proof, I would not stress over one affidavit.

However, that being said, I think for us, it is important to include them. But, then again, I am ####### about this stuff and believe in the more the better.

I didn't 3 hole punch. I 2 hole punched at the top and used ACCO fasteners, exactly as I did on all the K-1 and AOS paperwork.

This time, there are 4 seperate sections.

And, my dividers are colored sheets of cardstock marked with what is in each section. I am not using divider tabs this time. However, when I did for the K-1 and AOS, I put them on the side. Had no issues whatsoever.

Not according to your timeline. Since some of it appears to be in MM/DD/YY format and some in DD/MM/YY format, I'm a bit confused; but I think you were originally approved for AOS on 7/10/07. That would make your 2year green card expiration date on or about that date. You could not file for ROC till 90 days before 7/10/09..roughly sometime around mid April of next year.

Is your timeline wrong?

Check the expiration date on your Green Card to make sure of the right date.

According to your timeline, you have a ways to go before you need to do this. The earliest you can apply is 90 days before your 2 year GC expires.

You need to get the ROC in so you receive a NOA. With that NOA, it will say your LPR status is extended for until that NOA expires, 1 year from the date your GC expired this year. Understand so far? For instance, if it expires November 1, 2008 and you file ROC, the NOA will give you another year till November 1, 2009. You can renew a driver's license with this if you need to also.

If your ROC goes past that date, you can make an infopass appointment and get a stamp to extend until you are approved.

Andre's GC expires November 1st. We are very close to your timeline, I suspect. Welcome to my club!
