Yeah! That is actually about average for what they SHOULD be. You should get your biometrics notice in another week or so and have it done shortly after. I hope that is the case for you. And, yes, then buckle up and hang in there.

Just remember, you are extended for another year from the expiration date on the GC and they will stamp your passport (with an infopass appt) if it takes longer then that. There really is no disruption to life at this point. Not near the pressure of all the stupid paperwork before.

I just mailed ours regular mail in a priority box. I'm not freakishly obscessed with the whole mailing in process though. Haven't been the whole time and it's worked out well for us. Others will tell you a lot differently, though.

The response was "If you are registered, then you can volunteer and vote"....sooo the day comes and She is working across town and is unable to vote at the her designated polling location, but while she was volunteering she asks around with other volunteers, most felt that she could vote, hell, she was registered. so she filled out a provisional ballot... on the ballot there was a place to sign her name stating to the fact she is a citizen... she crosses it out and writes in "resident"....

Time passes and the volunteer coordinator calls her to get her to volunteer for the Nov elections... we were talking about it and got the impression that she shouldnt have voted, or had been enrolled at the polling place. Sooo she calls again soon after to the County and explains her situation, that she called before the election, was told it was ok, but still doubted it... So the lady told her again that if she was registered that she could vote, my wife asks her to look into the law, and the county lady came back and said, NO you cant vote.... The county lady asks if she had voted, wife says YES, county lady responded with an audible cringe (aka "DOH!")... the lady looked at the original form, saw that my wife marked that she was NOT a citizen, and the lady said it was a mistake on the countys part and said she would delete my wife from the database or whatever its called...

The story confuses a little, but basically, my wife filled out a registration form, was mistakenly registered, and voted in February... Now we are doing to the paper to remove conditions,and are wondering if USCIS will ask her if she voted... Do we need a lawyer? I assume that we have no choice but to tell the truth.



I wouldn't worry about it. Honest mistake. No need to make it bigger then it is. They don't ask that on the forms and she probably won't have an interview. If she does and they happen to ask that question, answer it honestly. Nothing to hide.

Unless she is the Kevin Costner swing vote, it makes little difference anyhow.

Looks great.

Only thing I could think of was:

Health insurance....if you are on a joint policy.
Life insurance....if you are the beneficiary of the other.
Advanced directives....if one of you is allowed to make the decision for the others. (this can be downloaded off the web, filled out, and then notarized.)
And lastly, the paper that the 2 year green card came attached to....they actually suggest you keep it an attach it to the ROC form.

None of those are overly important....just more proof. If you don't have it, I still think your proof is great. You will be just fine.

Yes, I believe you need to send a COPY of it as well.

When we filed for LOC, we included a copy of an arrest that he had in the US for a shoplifting offense. We were approved without an interview.

Don't worry much about it. Just a formality.

According to our list yes, but I'm not sure its a general rule. We have a block in April where they all appear to be from NSC which aren't approved yet, but that could be coincidental. Other NSC filers seem to be getting approved around the same as others who filed at the same time (eg lovelove and BrianBellingham).

Have those members who filed at NSC been around recently? I see felshen posting regularly but some of the others may have possibly been approved?

Well, misdemeanors are definately not as bad as felonies. And, I have not experience with the actual charge. But, I know they don't look favorably on people who want green cards assaulting citizens. Is there any way to plead it down further? You said "arrested".....does that mean no outcome thus far?

If not, I would say be as honest as you can be. Give them every bit of proof you have on the charge from arrest to the outcome, including any punishment that was handed out.

When we were applying for the 10 year green card, we had to list his shoplifting charge on the form. It was pleaded down to trespassing or something like that. It did not effect the 10 year green card.

If I were you, and you were able, I would get a lawyer to plead that down to something minor. It is possible that an actual ASSAULT charge may not be favorable to the outcome you desire.

I do not think it will effect your petition.

We had a shoplifting charge pleaded down to trespassing. It was fine.

Personally, I think they look more at the assault type charges.

Just make sure you send along every single shread of proof you have with your petition from start to finish on that charge. I would even write a little explanation, something along the lines of what you just wrote.

I did not call this fraud. His question was "What happens if I do not wish to remove conditions" I took that as.... "help get me out of the ^&%# situation I am in" and the way to get out of that is to remove the evidence that would allow her to stay in the country. B I N G O! I do not intend to divorce her. I have tried to talk with her about this. She makes it quite clear that the only way this would happen would be in an ugly court situation. Not going to happen! She feels I owe her 1/2 of everything I spent my whole life earning! And, she refuses to take any offers of a reasonable nature. She will only settle after one of those nasty divorces she has seen in the movies. And, she threatens things in my sleep, if I try it!

So, as I read it, if we are married we must either do this I-751 together, or she must request a waiver because she is divorced, and/ or prove abuse from the American citizen!

So, after her green card expires, what next?

Damn.....for your own safety, You need to get away from her, it sounds. That 50/50 split threat is just a threat. She can't do that.

You need to call in a lawyer and see what your options are.

Nothing to worry about. You are not required to be at anything he needs in regards to AOS, especially if he takes deployment orders if he even gets called for an interview. It's rare anyhow.

I never received an NOA either. You don't need it for your biometrics appointment but you do need something if your green card is due to expire soon. The best thing to do is to make an InfoPass appointment at your local USCIS office ( http://www.uscis.gov = choose 'make an infopass appointment' from the lower left hand side of the page). Bring along your green card and your passport with you to the appointment - they will use your A number to access your file and will put an I-551 stamp in your passport that usually will be good for 6 months to a year - plenty of time in which to receive your new 10 year green card. The I-551 stamp is just like a green card and is recognizable for travel and work eligibility.

My FPrinting is on Dec 10th...will go for it.
My GC expires Jan 30th so I have 2 months and will wait I guess till the end of Dec before I make the InfoPass Appointment...
What do you folks suggest???
I get it now, wait for another month or wait till 1 week before my GC expires.....



It doesn't cost you anything and gives you peace of mind. I'd do it now just to be safe.

Also, if like here in St. Louis, the infopass office is just down the hall from the biometrics office. We visited both on same trip.
