Removing Conditions on Residency General DiscussionA-number on Sample Affidavit

The information on the document should be related to you so it should be your A#. In the document itself, your friend should put their name, address (their information).

Thanks again v33k! That makes a lot of sense. As I said, it was a rather silly question :P

Removing Conditions on Residency General DiscussionA-number on Sample Affidavit
Hey all,

Probably silly question but ... I was looking over the sample affidavit on VJ. Underneath the main title is that line

# A _____________________

which (as we discussed in the older post "Sample Affidavit Questions") should have been

A # _____________________

namely, the A number of ...

... and then I realized something. I wasn't sure. WHOSE A-number is this supposed to be?

Is it supposed to be the A-number of the Permanent Resident friend who is going to swear and sign the affidavit for me (assuming I have one or else if my friend is a US citizen that line is simply N/A)?

Or is it supposed to be my A-number I put there?

Thanks for reading this :)

Removing Conditions on Residency General DiscussionIRS tax transcripts from local IRS office

I sent them the same tax return transcripts and so far I have done my biometrics and haven't heard anything bad from uscis so i assume it's all good.

Thanks for the reply. That sounds encouraging. I will go back to the IRS office later this week and see if they can give us some more info.

Removing Conditions on Residency General DiscussionIRS tax transcripts from local IRS office
Hey all,

So following upon the advice of many of you here, I went today to our local IRS office.

Indeed, it took me literally 5 minutes to have the transcripts in my hands. They only asked to see ID and since it was a joint filing with my wife they wanted to know both of our SSNs. However they did not even ask to see my SSN. I also found out that they can give past transcripts of any place you've filed at in the US, not only locally.

However, as I also expected, when I simply asked for "tax transcripts for 08 and 09" they DID ask me to be more specific and whether I was referring to "tax RETURN transcripts" ... I said yes.

Should I have asked for anything else too?

Anyway, what I got was this.

I am just the general format of the transcript I got, picking the 2008 one at random:

---
Tax Return Transcript [SSN#] 1040 [number] [code=auto:0]

IRS

This Product Contains Sensitive Taxpayer Data

Tax Return Transcript Request Date: 06-14-2010
Response Date: 06-14-2010
tracking Number: [number]

SSN Provided [number]
Tax Period Ending: Dec 31, 2008

The following items reflect the amount as shown on the return (PR), and the amount as adjusted (PC), if applicable. They do not show subsequent activity on the account.

SSN: [number] SPOUSE SSN: [number]
NAME(S) SHOWN ON RETURN: [NAMES]

ADDRESS: [address]

FILING STATUS: Married Filing Joint
FORM NUMBER: 1040
CYCLE POSTED: ....
RECEIVED DATE: Apr. 15, 2009
REMITTANCE: ...
EXEMPTION NUMBER:
DEPENDENT 1 NAME CTRL:
..etc.

Income
WAGES, SALARIES, TIPS, ETC: ...
TAXABLE INTEREST INCOME: SCH B: ...
TAX-EXEMPT INTEREST: ...
...
etc.

It continues on p.2, etc. 7 pages overall.

(They include: Income, Adjustments to Income, Tax and Credits, Other Taxes, Payments, Refunds or Amount owed, Third Party Designee, Interest and Dividends,
Schedule E -- Supplemental Income and Loss, with sub-headings,
Form 1116 -- Foreign Tax Credit with subheadings, Parts I-IV
Form 8863 -- Education Credits (Hope and Lifetime Learning Credits)

So will these transcripts suffice?

It basically comes to my old question which still remains unclear, namely: is the CIS satisfied with Tax RETURN Transcripts or does it need other things as well e.g. Tax ACCOUNT Transcripts or Tax RECORD transcripts etc.?

Has anyone submitted these before and do they suffice?

Thanks for reading this! :)

Removing Conditions on Residency General DiscussionWhich Service Center sent you ROC reminder notice?

If you read my question I just posed on this Forum (CIS, AR-11 and interesting stories) you will see that we got a ROC as well and in fact the whole question was because it was sent by mistake to our old address.
However, on reading your post I realized that while the ROC was sent to us from Nebraska (like you) it was in fact forwarded by Vermont (again like you). Initially I thought that this was because Vermont perhaps deals with Missouri (where we used to live) for I-751 apps and while we are in Wisconsin now and our I-751 is meant to go to CSV (like you) since they thought we still were at the old address they sent the ROC notice from Vermont instead. Now I believe your theory is correct. Indeed, I think it is something like what you describe.

If your I-751 says send it to California, send it there, like we did. Do not send it to the Center you received the ROC notice from. I am 100% sure of this. Anyway, if you or anyone else can provide a quick reply to my question as well, I'd also appreciate it :)

Thanks and good luck!

Apologies for the reply to myself but I tried to edit but it did not let me, for some reason. I wrote the above while missing the one posts where you had already got your infopass appointment and that you were unconditional (some sort of lag made me skip a page). Obviously in your case you did not have to send anything. Had you have to have sent the I-751 though, you would have needed to have sent it to the Service Center mentioned in the I-751 instructions IRRESPECTIVE as to where you received your ROC from. Anyway, at least it appears that I also received a ROC from Nebraska forwarded by Vermont and confirm the above. The only difference in my case is that because USCIS had misplaced my change of address they had attempted to first send the ROC to my old address in St Louis and not in Wisconsin. As a result, I received what you did PLUS a letter from CIS (Nebraska again) saying that if I changed address recently I need to tell London, KY (where AR-11 forms go to). You may want to read that in the Forum for more details. Congrats on unconditional status and hope all works great for you :) Real Pi

Removing Conditions on Residency General DiscussionWhich Service Center sent you ROC reminder notice?

I was already writing about the notice I got (my status is IR1 now and I got it after filing I-90 and correcting CR status over a year ago).

First, I decided to write to Vermont Service Center (the letter came from there, and got forwarded from Nebraska) and explain the error and send all the evidence, but then I realized one thing. If we were to file I-751, we would send the application to California Service Center and have nothing to do with Vermont anyway. I was just wondering if Vermont is some kind of centralized place that sends the ROC notices? Anyone got a ROC reminder from California?

I just do not feel comfortable sending my evidence to some address and think that I should just ignore the reminder, especially if it is auto generated. If people get notices from the service center which they are supposed to use, then I am definitely not sending anything anywhere.

Removing Conditions on Residency General DiscussionFiling I-751 for my wife

Thank you for the replies! My wife is able to come before the GC expires in February, but the baby won't be able to come with her. First of all, the baby needs to be registered at an embassy in China before he can come to the States. Also, he is too young to travel, and the change of vaccine schedule and medical insurance could get messy too. I am thinking to let the baby stay in China until he's at least one year old before bring him back to the States.

All been said, it will be difficult if my wife files I-751 with me and wait for the biometric appointment in the States, while leaving the baby behind in China. I was thinking that if I can file I-751 for her as early as possible, then my wife can just fly in for the biometric appointment without leaving the baby for too long. I just want to make sure that this is legally allowed, so it won't jeopardize the entire application.

Thank you again!

In theory, even if you file after the 90 day period, so long as there are valid reasons that made the delay understandable the I-751 instructions claim you are OK. Of course, in practice this could lead to serious problems and I would never suggest you do something like this. Apart from what has already been mentioned, it might not be a bad idea for you to make an INFOPASS appointment as well to discuss this matter with an immigration officer and see if she or he also have some other suggestions and/or recommendations for your situation, particularly as the factor of 'timing' is involved here (wife - baby). Hope it all works out great! :)

Please, do share what you find out.

First, I am sorry for the delay in getting back to you guys. Thursday was super-busy so I could not log on.

Anyway, essentially there is nothing new and we were all on the right track. However I confirmed some interesting things.

So, the officer understood the situation and explained to me that what happened was that VSC still had the last address only because their records were still up to the time of the I-485 app which had taken place in St. Louis. In other words, from what I understand if your next 'case' with CIS is 'far into the future' this can happen with some departments; and it also confirms that there is a 'discontinuity' of sorts between the departments, which I suspect is also for reasons of security.

However, the IO was able to track all my addresses recorded at all centers. It turns out VSC was the only culprit and interestingly enough the most important of all departments for addresses (namely the London, KY that receives them in the first place) had received it and displayed it correctly. In short, this was a specific boo-boo of VSC. They put that 'if you haven't sent an AR-11 send it to London, KY' letter clearly without checking with London, KY. It is an automated thing.

The IO also confirmed that the only one that matters right now is CSV (for me), for the I-751 and asked if we already got our NOA for that and we said yes; so she said it was OK.

Finally, a very interesting thing: the IO said not only is there no need to examine what address the other departments have right now but it is probably not a good idea to try to change anything with VSC (I think she was talking about updating systems) because this was a one-off thing they do, basically, and we won't hear from them again. She said there is no way that e.g. they are going to be waiting for a week or so and not seeing us e.g. try to send an AR-11 to London, KY write back or something. Of course, the IO is definitely right and we know this from the simple fact that if VSC wanted to know in detail they would simply contact London, KY which DID and DOES have our correct updated address.

Like with many government departments around the globe, red tape takes precedence over common sense. Furthermore, trying to upset the Balance of the Red Tape (imagine if the IO had attempted to alter the VSC records or even worse if we had attempted to send an AR-11 to London, KY without consulting CIS what sort of chaos would ensue) is certain recipe for causing chaos, anarchy and utter destruction in our Universe :P

On a slightly more serious side, the IO did say that in such situations we can also write to them by snail mail if we wish to avoid doing the trip (for those of us who don't live around the corner from their local CIS office).

So the upshot is: So long as the current Center that is dealing with your case has your proper address details and so long as London, KY has your proper details, it does not matter if the others do or do not. The former covers you for your case and the latter covers your behind since if anyone does not have your updated details it is because they did not update their system from London, KY and not because you failed to give it to London, KY.

The moral of the story: after you have moved and sent out your AR-11, write a letter to your local CIS office (if it is far away) or make an INFOPASS appointment with them (if it is not too much of a hassle to drive there) and find out if London, KY received your new details. They can and do check it on their systems. While you are there you can also ask (or write) about the other departments' status in order to avoid a situation such as ours, but when all is said and done I think there is still a chance for error in that respect.

Any comments, I will be glad to answer but from Monday as I'm still running around like a headless chicken. On a different note (but more related to this Forum) I will also post some ideas on how to organize the I-751 evidence material together based on how we did it, as I think some people will find it useful.

Removing Conditions on Residency General DiscussionCIS, I-751, AR-11 and other stories

From what I understood, they sent you the ROC notice although you had already filed I-751? If that is true, that only shows that the Centers are not that connected. The message itself may have been automatically generated based on the data when and how you entered. The second message is probably automatic as well.

Please, do share what you find out.

You are correct. However here is what happened in some detail. I sent the I-751 package on Aug 5. It arrived on Saturday where it waited at the local post office in Laguna Niguel, CA (most likely the Laguna Beach post office). It was picked up some time on Monday morning and signed for, before mid-day. The NOA has Monday's date on it (Aug 9) and I noticed the check cleared on Wed 11, which means they did everything on Monday: checked the basic parts of the package were OK (I-751 form with the possible addenda, check, green card front/back copies) and then they sent out the NOA the same day. (I know they do not check the extra evidence immediately, beyond what I mentioned, because as you know the NOA says that if you have not already submitted necessary evidence documentation you should do so now, giving you some idea, and don't forget by the way to add now also the NOA's receipt number since you are now having a case with us etc etc - basically for those people who never bothered to read the instructions :) ). Anyway, so they picked it up on Monday and dealt with everything on Monday at CSV. Now, the Vermont letter arrived a few days later but here is what happened precisely:

Originally, the VSC sent an automatic ROC to the OLD address in St Louis and the date is Aug 3. That letter has a postal service redirection date of Aug 4; when it was MEANT to go to us but was intercepted and sent back to them. Finally, what I received was: a) this ROC (originally sent on Aug 3 and redirected to VSC on Aug 4) inside its own envelope PLUS b) the aforementioned 'AR-11 reminder' note from VSC. Both a) and b) were included in a NEW letter that was sent DIRECTLY from VSC to us in Wisconsin (no redirection this time). In other words, they realized that we had changed address, made a note of the actual address and sent both the original ROC that had been returned to them PLUS the 'AR-11 reminder' letter AT THE SAME TIME in the SAME letter; I repeat this time DIRECTLY from VSC to us. I am sure some human being is involved in the second part of the process, but definitely these forms are clearly 'standard'. Overall it is quite impressive, except for the fact that they had no record of the updated address :)

Anyway, the answer is that it is still inconclusive if the departments are 'disconnected' in this sense or not.
Also I believe this way I clear out exactly what we received because it appears there was some confusion and you guys thought I received two separate notes at different times; I received one with both together in the sense described above.

I will try and ask what I can on Wednesday. Thanks again for the input :)

Removing Conditions on Residency General DiscussionCIS, I-751, AR-11 and other stories

This is very normal for USCIS to send the notice to the old address.

You can ignore it and file your I-751 with the new address showing. As long as you did your part of changing address, and as long as you can show that you did that, there is nothing to worry or stress about. Many people, including me, got the notice at the old address and have gone through ROC without any problems.

V33k, you are very correct in what you wrote (so is floridagirl) and I thank you both.

I just want to add that the NOA did arrive from California on Saturday (yesterday). :)

However, having an ROC arrive at an old address and receiving not only the ROC (that had been redirected back to Vermont I presume) plus a request to check the AR-11 status (because they didn't have a record of your address change), is something that is definitely worth checking out. It is very possible that only certain departments/centers of CIS do not have a full record, unless they have equal access to everything electronically (which I very seriously doubt). One way or another, when I called up the 1-800 national CIS number to speak to an officer, I was told to make an INFOPASS appointment as soon as possible to ensure that the CIS has a properly registered record of our new address. I just thought I would point this out because I was explicitly told to do so.

Anyway, I will ask all sorts of questions I have on Wednesday and any interesting feedback I get I will post it back here so everyone can share :). Thanks for the input guys! :)

One would assume that when you filled up and confirmed something online, you do not have to do anything else.

...

I thought the post office will only forward mails to the new address up to certain period only (if i am not mistaken, up to a year) and after that all mail will be returned to the sender.

...

How you file AR-11 is not important, although they appear to prefer online. What you say that all you have to do is send the AR-11 (and of course the I-865) is enough only if you also have NO pending case with CIS at the time. If you do then you ALSO HAVE to call the 1-800 National Customer Service number for CIS to INFORM them of the change of address AS WELL as sending the AR-11 (and I-865). It is mentioned in the directions from CIS. In general, I would always recommend after sending an AR-11 to also call up to tell them. Make a note who you spoke with, time and date etc. so that no one can say you did not do your best. What I'd like to know though is this:

Are we supposed to get an NOA for an AR-11? Or not? 'cause we got one for the I-865 although not for the AR-11. Is this because they don't give out NOA's for AR-11's or is it because they forgot to add the address and thus never acknowledged it?

This is something I'm not sure about; did you (or anyone else reading this) get an NOA from an AR-11? It'd be nice to know 'cause in a year or two we might move again.

As regards your comment on the postal redirection service. You are correct in that normally the post office will only forward post up to a year which in our case has gone by a bit now. However, good post offices appear to keep a record of your new address for longer and if the government attempts to send you some information they intercept it and inform the government (like they did in my case). I think this is a great idea, as it reduces the chance for all sorts of fraud. I suppose this might depend on the post office as well. I've seen excellent post offices and some real terrible ones, right around the corner as well (once, in one of those horror post offices neaerby -- not the one that redirects our mail -- a new parcel containing a new credit card had been sitting at their desk for a week because they forgot to inform us that it had arrived...)

Still, one thing I am very happy we did is that we set up a redirection of post. I recall some time in February we were trying to get our 1099 from an old bank in St Louis and even though we had given them our new address, guess where the 1099 ended up at... Luckily, the post office redirected it to us and it never ended up in our old apartment complex for some curious guy to open it up and read all our sensitive tax info, including SSN's.

Oh dear... Guess what?
...

Man, I cannot go to Kansas City all the time and have Infopass for every mistake they make! We will be broke!

We are a two drive away, it's kind of inconvenient too. However, let me make it clear that we did NOT change the address over the phone, the officer simply told us to go to our local service center. But I agree with you, I think that the NOA from California (where our I-751 went to) will end up at our new address; especially since the I-751 form explicitly asks for the new address and wants all records to date mentioned in an additional sheet (part of the form).

Anyway, the officer was certainly not surprised to hear my story and said these things happen sometimes... Which I can understand. I think I won't call them again before Wednesday not to confuse matters more, and just turn up and if we have to we can fill a new AR-11 there and then (I will of course bring one with me ready and all, just in case).

Removing Conditions on Residency General DiscussionCIS, I-751, AR-11 and other stories
Hi all

I would like to present an interesting thing that happened to us today as regards a letter we received from CIS. First though, the background to the story.

We were living in St Louis last year and we moved to Wisconsin last June. A few days after we moved we sent both my change of address form (AR-11) and my wife's (the sponsor's) change of address form (I-865)priority mail to the appropriate addresses (DHS/USCIS Services, London, KY and Nebraska Service Center, Lincoln, NE respectively) with signature confirmation and photocopying the post office forms at the post office before they left (we asked the post office personnel and they were kind enough to oblige). A few days later, both forms arrived at their respective addresses and we received signature confirmation by email which we printed for our records. It is important to also note that at the time I did not have any pending cases running with CIS; I already had my conditional green card. Nevertheless I did call the USCIS Customer Service phone number just to make sure, and a rep confirmed to me that since I had no pending case with CIS, sending AR-11 (and of course I-865) were all that was needed. A few days later we also received an NOA I-797C for receipt of the I-865 form from Nebraska telling us all was OK and they showed the correct new address. However I never received an NOA for the AR-11 but I figured that this was just a change of address and they may not send any information on the matter.

At the end of October, my green card expires so I and the wife had in the meantime already prepared the I-751 joint petition with all the appropriate material and evidence and sent it within the 90-days window, a few days ago. It was received on Monday by a CIS officer at the California Service Center (where the Wisconsin I-751 applications are meant to go to).

So far so good.

Today I received a strange letter from USCIS, from the Nebraska Service Center which I found odd as I had been expecting an NOA from CSV. However, this was nothing to do with my I-751 form but the following thing happened.

Apparently, DHS/USCIS (from 850 S St PO Box 87751, Lincoln NE 68501-7751) wrote to me to inform me that:

"The records of the Service indicate that you entered the US as a conditional permanent resident on [DATE]. In accordance with Section 216 of the Immigration and Nationality Act you must file Form I-751, Petition to Remove Conditions on Residence. Failure to do so may result in the automatic termination of your Status. You can obtain From I-751 ....[etc etc]".

So it was kind of nice of them that they now INFORM immigrants with conditional cards about 90 days before the expiration of their conditional green card that they need to file I-751 within said window. However, this was not sent to us in Wisconsin but to our old address in Missouri! The post office that has been redirecting our post all along, saw it, presumably contacted CIS, so what I received in the end was the above letter from CIS from Nebraska (with a redirection notice from the post office) together with an additional note from Nebraska Center saying:

"We received notification that your address has changed. If this is incorrect please contact the Service Center immediately. If your address has changed you must also complete an AR-11 Change of Address form and mail it to the following address in order for us to completely process your address change: [London, KY address follows]
Every person over the age of 14 who is not a citizen of the US or in diplomatic status must complete a Form AR-11 within 10 days of an address change. An AR-11 form has been provided on the reverse of this letter for your convenience. Where possible please provide an A-number (from your alien card) or other identifying numbers. You must complete the Form AR-11 and mail it to the above London, KY address. Failure to complete all applicabler sections may delay processing of the form. Please disregard this notice if you have submitted an AR-11 form to DHS/USCIS within the last two weeks to the address listed above.
You may obtain additional copies of the AR-11 form from...[etc]"

Of course they sent this not realizing I had already done this a year ago when we moved to Wisconsin; it was they who were in error.

I called Customer Service phone number and was told that it happens sometimes that the CIS sends the info by mistake to the old address and I should make an infopass appointment to speak with an immigration information officer as soon as possible so that the record of the address is properly registered with CIS. He also told me that there is nothing to worry with regards the I-751 form that was sent as regards awaiting an NOA from them, but I should speak with an officer as soon as I can about the issue of the address.

Well, I did make an appointment for me and my wife (it would be good for her to come too) at our local center for next Wednesday (it is a couple of hours drive), which is the earliest we can make it. I will bring these letters I received, all the evidence that AR-11 and I-865 were sent on time and who received them as well as the NOA for the I-865 we got back plus of course the INFOPASS receipt (and ID for both of us) including a copy of the I-751 package signature confirmation when it arrived in California.

Beyond this, is there anything else I should bring with me?

Also, is there anything else I should perhaps do? Is it possible e.g. to contact the Nebraska Service Center and let them know directly before Wednesday about this issue or should I just wait to speak to an officer on Wednesday? And if I should contact the Nebraska Center what are their phone numbers? Who should I speak with?

Anyway, does anyone have any ideas if I should do anything else in the meantime or should I just wait until we go to our local service center on Wednesday?

Thanks in advance for any suggestions and help!

Real Pi

(P.S. Note: In case someone is confused why I received this info from Nebraska Service Center, the reason is that if they think we still live in Missouri, they are responsible for our I-751 forms and not California Service Center (where we of course sent it correctly to since the I-751 apps from Wisconsin go to CSV instead).

I understand your frustration, but i encourage you to wait a little bit more. this is only a waiting game, try not to think about it and just live your life and i am sure one day when you know that your case been approved you will check the mailbox and you will find what you've been waiting for.

This is so true. I won't forget how I had given up checking after a while, thinking it may well be months before I get a reply (and it may very well have happened that way). This way I missed my approval date by a few days. I just went to check one day 'for a laugh' and it had happened :)

So don't worry, it will be fine! Remember that we are not the ONLY August 10 filers around!

Congrats to all accepted and to all who are still waiting 'hang in there' and 'take it easy'!

Removing Conditions on Residency General DiscussionI-751 August filers, 2010
After Thanksgiving tonight, we came back home and I thought I'd log on and congratulate the newly accepted folk. Then I realized I hadn't checked my case at CIS for a while (I don't have automatic email set up with them).

So I went and I found the following message:

On November 24, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283

WOO HOO! Now that is what I call something to be thankful for! :)

Thanks for the info. I haven't yet decided if I'll go early or just wait till my appointment. I'll post my experience if I do a walk-in.

First of all congratulations :) Good to see they did not forget you after all!

The following is all speculation and therefore not to be taken to heart. From what I've seen so far from folk, experiences differ widely and they may also depend not only on the CIS center but also on the person you happen to talk to. The only thing that I've always worried about early walk-ins is that (in theory) someone may get annoyed; particularly if it's not too close to your appointment date (i.e. more than one day in advance, say). Since you want people to remember you well, particularly if you are also scheduled for an interview as well at some point (especially true for those of us who didn't have an interview at AoS, as the VJ community suspects), it's probably wise to be careful. I don't think all officers appreciate early walk-ins. However, I'd definitely recommend that if you do go on the day of your appointment you should try to get there much earlier than the appointed time. If they're not busy, they'll definitely take you and will not complain. Other than that, I don't think that going in two or three days earlier will make any difference with your application being delayed. Thinking of how red tape usually works, I'm sure your case is currently 'suspended' (except for rudimentary checks perhaps) until after the date of your ASC appointment. After that date, there are many variables: the personal factor (who looks at it), their schedule otherwise (how busy they are with other things), the amount of information you gave them (the more the better but also more usually means delays in checking that information), the service center workload, your personal circumstances which may vary (e.g. if one of you is out of work, some illness, problems with family) and so forth.

But if you do decide to check in early please do tell us of what your experience was like. :)

Congratulations to all those who got accepted

Also, as regards the comments about VSC vs. CSC: If I am not mistaken (and I may very well be :) ) it appears that VSC's average is higher than CSC's which is currently at the level of the expected mean of the ideal 6 months (the national average is 11.6 months). Also, it seems that each case depends heavily on who picks it up since an officer may also have a lot of other things to take care of, while another officer might be less busy.

Also one one question from the 5 people who got accepted so far:

How many of you have had an interview at a previous stage of your immigration process?

It would be useful to find out (for it appears likely those who never had an interview before might be delayed by having to go through one now) ...

Anyway just a random thought :)

Thanks for the suggestion, RealPi. Right now I have a bunch of stuff going on (good stuff, just a busy life!) and if I have to wait then I have to wait. It's frustrating, but I do know I'm in the system, and they told me to call back at the end of November if I haven't got my bio letter before then. My local CIS office is actually pretty close to where I work so if I get bored waiting before the letter/end of November (whichever comes sooner) then maybe I'll go and visit.

Fair enough... Personally I'd wait 3 weeks at most after they received the package and I'd make an appointment and just go... losing an hour is so worth it compared to losing a whole month in waiting ;) ... Let us know as soon as you know something... Good luck :)

I just received this email from USCIS. Did I get approved or not, or is this an administrative review?

It sounds like it :) Although to me that 'post decision activity' sounds a little confusing; but since it does say 'approved' I see nothing to worry about ;)

I suppose in theory something particular to your case may also be required after approval (I won't even begin to guess here), but once you have the actual letter in your hands you'll know...If there's anything else though let us know... Oh and congratulations :)

I was told the same thing....... Posted Image

So long as you know that they recognize you on the system under the current petition I wouldn't worry :).

Now over the phone, well, that's all they would normally say (wait wait wait). :(

So what I would do (if you have not already done this) is go to your local CIS office if it's nearby; you could always make an appointment to ask if all is going OK and that you felt you just wanted to check all is fine. I have the feeling they may have access to additional info about your case to that of someone over the phone (I presume they didn't check who you were over the phone and just told you to wait). One way or another, you will at least be assured that you're OK in their system and all is fine. For example, if somehow the appointment was meant to be sent and they think they sent it, it will show up on the officer's screen. I recall when I went once about some confusing letter I had received just prior to receiving my ASC appointment (won't go into the details again it's in earlier threads) I noticed that the officer could see all the details each center had on me including addresses and status and probably other info as well.

Alternatively, if you live too far, you can always write to your local office center; but I find that the personal touch is always best ;).

You are welcome; anything for a fellow Badger  Hopefully someone will arrange a Wisconsin VJ meet-up some time in future? It'd be fun to meet some people from VJ :)

:ot:
Ack... it's late and I can't have with this thing again... :crying: I apologize; the usual problems with editing a reply ... it forbade me to make changes, for some strange reason. I was trying to multi-reply to you and The2ofUs which didn't work as planned and I was trying to edit something and something else went horribly wrong ... it told me it saved the data, I clicked "back" on the browser and, sadly, editing options were lost forever. :( This is the second time this has happened to me in a week! :bonk: My comment on "fellow badger" was meant for The2Ofus, obviously... Still you guys also live close enough; maybe we should update the Wisconsin meet-up to a Midwest VJ meet-up :D

:ot2:

Anyway, what I meant to say was that if any one of you (or in fact anyone else) has issues to ask and they think of doing it at the bio, best thing would be not to expect to get anything from the bio IO per se; you'd probably need to have made an INFOPASS app as well.

Of course, what I wrote addressing you also holds for you if you replace "Milwaukee" with "Chicago". It also doesn't help that you two had your names next to each other's

Anyway, all the best to both and to all others who are expecting bio letters and apps!

Thank you, RealPI and Yurika & Jim!!

That's very good to know that we aren't the only ones and it seems to have worked out for MountainClimber. We contemplated making an InfoPass but figured that Biometrics appointment should be in near future and would be a good time to get this sorted out. Based on our past experiences, we didn't think calling National Call Center would go far in resolving the issue. We will take both notices to Biometrics appointment and see what they have to say.

The "Receipt Date" on both NOA letters is 8/16/2010.

Thank you, once again, to both for your information!

Anyway, back to topic!

Well, I just wanted to add one thing. Basically, assuming you have any non-biometrics-related queries you'd like to ask an IO at the Milwaukee Office... Well, the thing is that the officer who will be taking your biometrics will most likely NOT help you with any questions; it is very likely you will get no answers from them except "go upstairs and make an appointment". And you would need an appointment for that; I think at the appointments they have access to information not normally available elsewhere. Anyway you have nothing to lose, really. So if, say, your ASC appointment is at 10:30AM why not make an INFOPASS for 12:00PM (say) on the same day so that after you are done with your bio on the 1st floor you can go and talk to an officer upstairs at the INFOPASS section about your issue? They can look at the screen and answer some questions.

Of course, if you are busy that day and relatively close to Milwaukee, you could always schedule another appointment at another time. I just wanted to point out that you should not count on the officer who takes your biometrics to answer other questions.

It actually took 6 days for my ASC number to appear in the USCIS website from the day I received the appointment in the mail. And yes, NOA and ASC numbers are different.

This is good to know, thank you. I was not certain about my aforementioned suggestion for those who got their ASC number but their case not appearing online whether "to wait" or do something else, but it seems from your input I was correct. In my case the online status appeared immediately after I received the ASC number, so I suppose it depends on when CIS finish updating their records.

@The2ofUS

I just wanted to point out that if you received your ASC appointment letter which gives you the new and important Application Number, that number when input on the CIS website should give you your current status for your case (click on "Check File Status"). I presume that where it asks for a Receipt Number that you entered your new Application Number found at the ASC bio letter? No dashes, just the letters and digits all together? And it does not recognize your case?

Assuming this is true, it could be that they need to update their info, so check in a day or two and they should be there. This Application Number that you received with your biometrics letter IS the one that is meant to be used to track your case on-line. I know because mine works.

I would theorize at this stage that they simply have not updated some of the records, but I am sure others have had such experiences before and they might have other suggestions. The only three things I can think of are the obvious ones: a) Make sure you input your number in the correct format as it appears on the Biometrics letter without dashes; b) wait for a few days and try again to input the number; c) call up the National Hotline and ask if this matter is worth making an INFOPASS appointment for (or simply make one anyway if your local CIS office is close by). :)

I haven't gotten my bio appointment letter yet, but I did call the USCIS about the case # not being recognized on the website, and they said that often after the bio appointment you will be given a different case # than the one on your initial letters, and that case # will be able to be tracked on-line. Relatively standard procedure to not put the case # on-line until after the bio appointment.

I concur from the info I received from our NOA1 and ASC bio (see my comment below to Z&S).

Removing Conditions on Residency General DiscussionI-751 August filers, 2010

That's interesting! We received two NOA1 with two different case numbers, none of which are recognized by the case status online. Both NOA1 are identical except for the case number and the time (one NOA1 was printed one hour after the other). We were wondering what was that about. Perhaps, one case number is for the later appointment letter that you are talking about.

That is strange. There should be only one NOA1 letter as I far as I know. I would call the National Hotline to inquire about this just to make sure that the second NOA is not due to some error that might cause problems later on (e.g. generate two different ASC numbers by mistake). If they tell you over the phone to make an INFOPASS appointment, you might as well wait for the bio date and try and make an INFOPASS appointment on the same day to talk to an IO about this (so you don't make the trip to your local office twice).

Also, if my understanding is correct, the NOA1 gives a Receipt Number and the instructions on the NOA1 say not to attempt to track the case on-line before the biometrics appointment notice arrives ("enter the app number found at the top of the ASC app notice"). Our bio appointment arrived and (as promised) gives a new number, called an Application Number. The formats of (original) Receipt and Application Numbers are indeed identical (number and order of letters and digits) but the two alphanumeric 'numbers' are quite differ (except for the letters which indicate the service center).

The USCIS website asks for you to input a "receipt number" but in this case it refers to the Application Number that you will receive in the near future from your ASC appointment notice (biometrics). Indeed, I just input mine and it works fine giving me the obvious info viz. that they are at the stage of "Initial Review", as well as the mean app time values Nationwide as well as Center-specific (in my case CSV).

Ack ... I knew I would mess something up  I didn't change the number of CSV applicants by mistake  . There should now be 13, including me, and not 12 that is stated.

Please the next person who adds their name can you simply change the number of CSV applicants to 14 instead of 13? Anyway, good luck to all!

Removing Conditions on Residency General DiscussionI-751 August filers, 2010

Wife and I are sending i751 this week. The package is complete; however, one question still plagues us - the Last Name. Her GC shows her MAIDEN name. We are sending it in with her MARRIED name, and we stuck her MAIDEN name in the MIDDLE name field. Any thoughts? The application reads: FIRST / MIDDLE & MAIDEN / MARRIED LAST; the expiring GC shows: FIRST / MIDDLE / MAIDEN.

Are we reading different forms? Part 1 (Information about You) reads third on the first line "Full Middle Name" saying nothing about "Maiden name" there. However, if you now turn to Part 3 Question 1, it says "Other Names Used (INCLUDING MAIDEN NAME)". So, I would simply put her FIRST / MIDDLE / MARRIED LAST in Part 1 and put her MAIDEN LAST in Part 3 Question 1.

Removing Conditions on Residency General DiscussionIRS Tax Trascripts and Form 4506-T

All you really need for I-751 purposes is your "Tax Transcript" for the appropriate years.

Its easy, don't stress over the forms.

Thank you for your time to read this and for your kind suggestions :). It is much appreciated. I am a 2-hour drive from Milwaukee, where my nearest local CIS office is situated at. I also believe that it would probably be an IRS office -usually situated near the CIS office- that would deal with tax transcripts.

Actually, I had a talk with my CPA (more than 20 years experience in their business) this morning so the matter is now more clear to me.

It would probably be useful to post the answers I got here, because it would be useful to anyone who has moved during the time between getting their conditional card and removing conditions; useful that is for those who had to file with the IRS in the interim period at two different locations.

One of the things that are not clear is this: which tax transcripts we need to ask for. Return or Account? As it turns out, Return should be sufficient for our purposes unless significant adjustments/adjudications had taken place by the IRS after filing. In my case, as I mentioned, we even got a refund (we're sure it won't happen again, but it did for the past two years!) Because of this, Return transcripts should be sufficient. And of course I do fill in "1040" in question 6. And I only tick 6a. Of course I keep Part 7 unticked (since we did file both times) and most people would too (e.g. if someone did not have to file due to being below poverty level, they would need to tick Part 7 to show that they did not file and why). Part 8 must also remain unticked: this is only important if one needs new copies of their old W-2s etc. which they lost somehow. Finally, for Part 9 it is as I wrote: "12/31/2008" for the 2008 return (going to Kansas, MO) and "12/31/2009" for the 2009 return (going to Fresno, CA).

I was also correct on Part 2b, 2009 case. However on Part 2b, 2008 case, my CPA suggested that I write my first name under the slightly different (yet legally acceptable) spelling I had used that year (i.e. "RealPy" instead of the usual "RealPi"), then my surname, and the spelling "RealPi" underneath the already typed "RealPy" and initial next to it.
Namely

RealPy SMITH
RealPi

She also said that I should NOT leave Part 4 left blank in EITHER of the cases. Apparently, I should ignore the confusing expression "last return filed". The best thing to do would be to write here the old Missouri address (of 2008) and put two dashes next to it and add "per 2008 tax return". I should do the same for the 2009 return Form, regardless. That is, Part 4 should be in both cases:

Old Missouri Address -- per 2008 tax return

She then explained to me that what the IRS are looking for here are different ways to identify a person. There will probably be more than one Realpi SMITH around (or even Realpy SMITH :) ) and putting the 2008 address helps the IRS identify that I am who I claim I am. She did admit though that they had worded that question in a confusing manner (strictly speaking my "last return filed" happened in 2009 in Wisconsin, period; so strictly speaking there should be no need to write anything in Part 4, since our current address in 3 is the Wisconsin address).

Anyway, specifically as regards Part 6, I would be very interested to hear if anyone else who has asked for tax transcripts from the IRS in the past if they ticked something other than (or additional to) 6a and why.

Thanks again to all who took the time to read this and to Weatherman taking the time to make some suggestions!

Removing Conditions on Residency General DiscussionIRS Tax Trascripts and Form 4506-T
Dear all,

I hope someone has been through something like this before and can help out! I've been at it for more than a day and I am still confused. :(

First let me give some important background info before I ask my question:

I have a conditional green card (wife is US citizen) which will expire at the end of October this year. This means that we will be filing I-751 some time early August.

I and the wife had filed our taxes jointly as a couple for both 2008 and 2009. The first time we filed was February 2009 (for the 2008 return) when we were in Missouri. We then moved to Wisconsin in June 2009. February 2010 we filed in Wisconsin (for the 2009 return). As part of the I-751 process, we need to include all IRS tax transcripts since I became a conditional resident; namely, the tax transcripts for the years 2008 and 2009. Now, based on the information given on p.2 of form 4506T (Rev. 1-2010), we need to fill out two different copies of the form and send the one requesting our joint 2008 return (when we were in Missouri) to "IRS, RAIVS team, Stop 6705 P-6, Kansas City, MO 64999" and the 4506T copy requesting our joint 2009 return (when we had already moved to Wisconsin) to "IRS, RAIVS Team, Stop 37106, Fresno, CA 93888". (Parenthesis: either I or the wife can fill these forms to ask the IRS for the transcripts; we decided that the wife will ask for these, so "current name" below refers to her name and she will be signing and dating the form at the end).

Now, we are not certain how exactly we need to fill each copy of form 4506T. (By the way, the form can be downloaded here http://www.irs.gov/p...-pdf/f4506t.pdf )

This is what I have got so far.

A) My first name can be legally spelled in two different ways (being a transliteration). This is common with non-Latin names. For purposes of demonstration, let us call the first spelling of my first name as "RealPy" and the second one as "RealPi". My surname remains unchanged i.e. I have only one (let us call it SMITH). Anyway, the 2008 return was filed with my first name spelled as (say) "RealPy" while the 2009 return as "RealPi". Does this mean that in question 2a (I am the spouse here; the wife is in part 1a) I should input "RealPy SMITH" for the 2008 return request, and "RealPi SMITH" for the 2009 return request? After all it is asking for the spouse's name "shown on tax return", right?
B) Part 4 of 4506T asks for the "Previous address shown on the last return filed if different from line 3". (Part 3 asks for "current name, address, city, state, and ZIP code" -- namely wife's name and our Wisconsin address). Now whether we are dealing with the 4506T that we will send to Kansas, MO for the 2008 return (when we were in Missouri) or with the one that we will send to Fresno, CA, for the 2009 return (when we were already in Wisconsin), it appears to me that in both cases "last return filed" must mean the 2009 return. Which means that Part 4 should be left blank in both cases. Is this correct?
C) I am confused about Part 6. What should we request here (for each form copy)? My understanding is that we should ask for 1040 and tick 6a (Return Transcript). But do we also need 6b (Account Transcript)? Or perhaps 6c (Record of Account)? What does the USCIS want us to obtain here?
D) Clearly part 7 must remain unticked (we do not require verification of nonfiling). Right?
E) However Part 8 mentions "Form W-2, Form 1099 series, Form 1098 series, or Form 5498 series transcript". Do we need to tick this as well? (If so, does it mean we need to fill Form 4506 instead?)
F) As for Part 9... My understanding is that the 4506-T Form going to Cansas, MO (corresponding to our request for the 2008 return which we had filed while in Missouri) should have in Part 9 only one of the lines filled, with the date "12/31/2008". (We filed jointly before April 2009 for the 2008 returns, as normal; no complicated situations, we received a refund). And the form going to Fresno, CA (corresponding to our request for the 2009 return which we had filed while in Wisconsin), should, again, have only one line filled with the date "12/31/2009". (We filed jointly before April 2010 for the 2009 returns, as normal; no complicated situations, we received a refund). Is what I have said so far correct?

So basically: I need confirmation or correction on what I have said so far and help on how to fill Parts 6 through 9!

Any help would be hugely appreciated!

Thanks to all for taking the time to read this,
