Oh, and make sure to make out the check to "Department of Homeland Security." some people make the mistake and write "USCIS"...this could cause a problem and delay, but not always. Good luck! good.gif

DITTO

In the past, it had to be notarized...no longer the case. This is an example of how an "experienced" member can not be up to date on the current forms and procedures, yet draw from their experience to cause confusion. Fortunately we have a large enough group of people to peer-review everything that is posted...well, most are reviewed. blink.gif

Get I-134 notarized and send to beneficiary before Interview.

I-134 is no longer required to be notarized, but it won't hurt. You can send her any "proof of relationship" materials that she may not have, or new passport stamps if you have taken a trip between NOA1 and interview to see her. Make sure she is well organized and work together on sample interview questions, make sure she knows ALL about you and your life so she can not be tripped up by the VO. Good luck! good.gif

K-1 Fiance(e) Visa Process & ProceduresTotal fees for K1 just to get here
Okay, this is purely speculation on my part, but the last time they raised the fee there was a brief period of time after the published rule change and the implementation. I can not find the post now, but essentially it was published mid-month and gave a short grace-period before kicking in. Unless your interview is within a couple weeks of the rule change, then you are going to be out the additional fee. It really sucks that they can not grandfather it for those of us who started the journey months before the proposed rule change was announced. Our interview is March 10th, I am hoping that we can get in under the effect, but I am planning on paying the additional amount. I guess March 1st is a good time to look for potential announcements. Good luck!

It is such an unfair decision, they know we pay alot for everything and now they want to increase the fee. Ridiculous and totally sad... Nothing else to add. My Irish friends and Scots wrote them emails, I joined them, but I don't think that will help to stop them from making that decision

K-1 Fiance(e) Visa Process & ProceduresK-1 reentering home country
The K1 is a single-entry visa. You must get married within 90 days of entry and then ideally should begin adjusting your status. You can request Advanced Parole to travel while your papers are in-process. More members can outline your other options. The main point is that you have to be in the process of obtaining your adjusted status or obtain special permission, both of which require having been married within the 90 days of entry. If you leave prior to doing this, you will be denied entry if you attempt to return. I know that some VJers have had family emergencies, ect. There is a way to deal with this, and others will be along to add their insight.

How soon after entering the US on K-1 will its recipient be able to travel back to home country?
Thank you

K-1 Fiance(e) Visa Process & ProceduresNewbie, a few questions on K-1 application

No problem at all. I thank you all who read my questions and even more to those who took the time to answer. I just started reading the various parts of this site when I first posted. I've read a lot now and even found some answers to my questions. This is a daunting process we all have to go through. I feel this site is very informative (you just need to have the time and patience to search for your answers) and full of kind and helpful people.

A few more follow up questions on how to fill the forms. They all seem to be trivial things, but I just don't want anything screwing up if the USCIS is really picky.

My fiancee has already signed and mailed her G325A form. But I found out that, as she does not have a middle name, she left those boxes blank. Should I hand fill the middle name box with None or N/A? The form was filled online, printed and my fiancee hand signed before mailing it to me. Is it really that important to fill all the boxes?

I suggest downloading the example forms that you can find on this site, they are quite useful. Most Chinese do not have a middle name, you can leave it blank. You should fill in as much as possible, just be careful about using N/A & NONE..make sure the proper connotation is being used. If the question refers to children and she has never had any..don't use N/A, use NONE...make sense? :)

What about the Apt# box, both her and my addresses are not apartments, so we don't have Apt #, should we leave it blank or write None or N/A? Also, when writing the country China, can I just write China or do I have to write more formally as P.R. China?

Leave APT# blank, we used "China" There can be no confusion about this since the consulate you are apply at is Guangzhou, they will not be confused.

One last thing, in both I129 and G325A, they ask for an A#. What is that number?

Yep, she doesn't have an A# yet, just leave it blank.

I remember I use to have an Alien Registration # (on my green card before I naturalized). But since I was naturalized a long time ago, I no longer have nor remember that number (they take your green card away once you are naturalized). I looked at my certificate of naturalization and noticed there is a INS registration number that is Axxxxxxxxx. Is that the number that's asked for in I129 and G325A? YES

Again, thank you all for help. I'm sure as this process goes on I'll have more "silly" questions.

roger

K-1 Fiance(e) Visa Process & ProceduresNewbie, a few questions on K-1 application
WELCOME TO VJ! Sorry, some people on here are harsh with their responses and forget that they were also once "green newbies."

You can translate the logs yourself, but considering that you both have a mutual fluency of Chinese, that is the burden you will have at the consulate level..to show that you both can communicate effectively. She does not have to speak English, as long as you demonstrate that you speak a dialect proficiently.

She should use English or Pinyin for all areas of the immigration forms, unless it is specified to use Native Alphabet, in her case Chinese script.

For the G325A, this is a new thing. The old system required 4 pages (4 copies of the biographic page) that came as a PDF that would auto-fill, but now the form only has one page. Many of us that filed at this transition point still included four pages. I had no troubles. Unless someone else says otherwise, you should be fine with one page, but can protect your a$$ with 4 copies.

You need to send in your birth certificate, this is part of the instructions, to send in the birth certificate OR ALL pages of your passport.

For GUZ, it surprises many people to learn that there is only one consulate that handles K visas. You can direct consular file at others, but this is not your situation. Read more in the China forum and you will learn about more details of the GUZ process. You can also check out Candle for Love, a website just for China Immigration. They have some great material that is pinned there. You can go to the embassy with your fiancee, but you can not attend the interview. There is a point at which you will not be able to continue, and have to wait for her. Many people say it is beneficial to attend, she can take your passport to demonstrate that you are present. At GUZ, it seems that having more than one visit is very crucial, and attending the interview day is one more affirmation that your relationship is genuine.

Good luck and ask more questions as needed...we are all doing this from "green" to "veteran."

This is normal for students, yes. I have a very cute photo of Yi wearing her uniform and she learned to even shoot a rifle. However, this is not PLA, so is not actual military service. Bernie is correct, as is Mlbarb. However, this is CHINA. For the USCIS portion, the petition will not require a signature and should go through easily as long as the paperwork is in order, the USC is legally able to marry, and has met the 2-year meeting requirement. NOW, when this approved petition is sent to Guangzhou in a few months, they will look for anything to ding this couple on. It is better to have as complete, accurate, and front-loaded petition as possible prior to sending in for a Chinese SO. At the embassy they would ask for your girl's signature, this is one more thing you can avoid to cause confusion if you do it now. You shouldn't have any problems with your visa if everything is clean going in...but I have read too many stories of a VO having a bad day in GUZ..avoid this. Good luck!!! :star:

K-1 Fiance(e) Visa Process & ProceduresJust Starting
You need to have original signatures, not scans or faxes that you submit to USCIS. Most folks on here recommend having your fiancee write in blue ink so it is very obvious that it is not a copy. Everything should be written in English/pinyin. Have you met the requirement of meeting in person in the past two years?

K-1 Fiance(e) Visa Process & Proceduresstarted...nowwhat?
The best thing you can do now is visit again (if possible), plan to attend the interview (if possible), and keep your girl happy and communicate and not think too much about the time it is going to take. Fortunately, CSC is processing very fast these days, so it is possible for you to be complete in under 6 months versus the 9-12months it was taking a year ago. build up your case file for the interview, save your pennies for all of the expenses coming down the line, including the 1K for AOS. Oh, and feel free to ask questions, there is a good group here. If you want a slightly more comical, focused, yet sometimes asinine forum..you can check out Candle for Love. Just do a search for them, they changed servers recently so you might have to dig. I would post the site here, but I don't think we are supposed to do that. Good Luck!!

K-1 Fiance(e) Visa Process & Procedureshow long it will take to know the interview date
Have you followed recent members time lines? If you look carefully, you will see that you have anywhere between 2-5 months depending on time out of NVC, customs holding for GUZ, and how fast you turn around your P3. You do not have the option of scheduling the interview, it is determined by the consulate after they have received your OF-169, DS-230i , and EMS label back from you.

K-1 Fiance(e) Visa Process & ProceduresEOR and I-129f package
I think that the EOR????????????????????????????????????????????????????????????????????????????????????????????????????????becomes engaged a week after meeting the first time and files a scant I-129f shortly there after, then the VO has little to go by. I think this is also the same when it comes to being in Guangzhou during the interview. If your fiancee is well prepared and you both have clearly demonstrated a committed decent-termed relationship, then your presence is not a factor other than to provide emotional support. People can argue all of these points, I think each case will be affected by different factors and it is difficult to generalize without hazard. You do not have to send an EOR letter with the petition, but it also doesn't hurt to include a clearly detailed (not sappy) account of your relationship. Most likely, and EOR letter will only be accepted at the interview if the VO is "fishing" for fraud. A well prepared fiancee will most likely have a couple requisite questions followed by "pink." This is the one trend I have noticed. Good luck!

K-1 Fiance(e) Visa Process & ProceduresUSA is now Arizona
FIRST, everyone on this site is totally free to bash this poster if they choose, but SOME slack should be cut. Did he say some stupid, unqualified things...yes; however, I am sure that given the kick to the jewels he has just experienced they were purely uncontrolled emotion. The point of our forum is to guide and keep on point. If everyone who reads through this thread just piles one more negative, unhelpful comment onto this poor guy then there will be no real value added and the thread should just be closed. Forgive his transgressions and keep on point, please.

Now to the issue....

I suspect that a lack of front loading combined with only one visit is the primary reason for the white slip. It seems GUZ has a track record of dinging people with only one visit unless you are also at the interview. This one visit might also have not allowed for enough pictorial documentation with family that GUZ also likes to see these days. The VO does review the file and is able to draw and instinct decision about the couple. That is why many times we see "pinks" handed out with only a couple of pedestrian questions, the VO has already seen enough from the initial filing to know the bona-fida is met. The converse is also true, a scant file gives immediate suspicion. The embassy is not charged with handing out visas, rather they are gatekeepers and will bounce anything that isn't rock solid (this is my personal view based on over a year of following MANY members through GUZ). Without seeing the OP's full petition there is no way to know what could have given the VO suspicion but something raised an eyebrow.

K-1 Fiance(e) Visa Process & ProceduresUSA is now Arizona

No red flags that I am aware. The only thing I can think is my Divoce was filed in 2007 and the divorce was final July 2010. I put that in my letter with copies of 2007 copy of filed divoce. I met Zheng April 2009 and visited her October 2009, So I can go back this month and file again in September.

hey dude, sorry about the white slip, but am I wrong or are you miss quoting above? You indicate just receiving a white slip for a K1, but also just stated a finalized divorce in July 2010?? If this is true, then the fact that you were not "legally free to marry" is the reason for your white. Please correct me if I am wrong in your wording. Good luck!

K-1 Fiance(e) Visa Process & ProceduresImpact from previous K1 visa?
Just like a prior marriage, GUZ will use that as bait for the fiancee to see how aware she is of the previous relationship and try to trip up the applicant. Not always, but most guys on here who have gone through GUZ with a previous marriage will tell you this was definitely part of the questioning process. So, your girl is going to need to have full disclosure on the previous K-1.

K-1 Fiance(e) Visa Process & Proceduresfilling out the G-325A for submission along with I-129F
Worry less about the material nature of your petition and what that might say about your fiancee and her family and more about the content of your relationship front-loading and the number of trips and family time you have spent together. Prove that relationship is real and reciprocal and it doesn't matter so much about where she is from. Read about the "red flags" and make sure you address and cover them and don't leave any open areas for Kung Fu chops to the body come interview time. No matter what, BE TRUTHFUL....or it will be a waste of your time, money, and emotional stability at some point down the road.

K-1 Fiance(e) Visa Process & ProceduresQuestion 18: "Has your Fiance(e) met and seen you within the two year...?"

Yes, you are also right. But you are guessing that front-loading will be required for the Tokyo Embassy. I do not think it is relevant.

I know TBoneTX insists on it but I think it is a case by case basis. I don't think there are any many rules that apply in ALL cases here.

Good luck.

I am sure that Tokyo has very low fraud rate, as evidenced by the low number of VJ members going through Tokyo versus other countries. With that being said, intelligent front-loading will not hurt the case/petition so I see no reason to not advocate this. However, there seems to be a growing issue with the implementation of the SAFEFILE system and much of the front-load material not being transferred with the original petition. So, even in the case of a high fraud country it may become necessary to change tactics in the future.
garfield529MaleChina2010-08-17 10:27:00
K-1 Fiance(e) Visa Process & ProceduresQuestion 18: "Has your Fiance(e) met and seen you within the two year...?"

Evidence from 2006 and 2007 will be of no use at this point of the process. Technically the same applies to the answer to Question 18. Anything before mid-2008 does not apply. Only use evidence of meeting from about October 2008 to the present.

In terms of answering question 18 you are correct, however I would disagree about ignoring evidence prior to the two year mark in their petition. The prior evidence can be included as part of your front-loading of the petition and it will help to establish a clear and long-term relationship.

two frontal photographs and

together with what I already listed:
1)DS-230 Part 1
2) the checklist itself, acknowledging all items have been aquired or completed as required

When you say needed, do you mean that they need to be mailed back to the Cosulate, or are they brought to the interview?

All documents are needed to be mailed back to the consulate and bring the original of birth cert, cert of no marriage, passport and evidence of relationship to the the interview.

I was confused when Packet 4 came and it gave a list of documents to take to the interview when Packet 3 asked everything be mailed in. I was a little unsure if I'd gotten it wrong, but that's how it's supposed to be. You send it all in with the checklist except for the originals of a few things and your medical, of course.

Interview was so easy! My appointment was at 8 am, I was there at about 7.15 am, I got seen at half past eight and was out of there before 9 am! It never gets done that quickly. Usually I wait for hours and hours. I didn't have my birth certificate (I thought ID and house registration would be enough) so I need to drop that off tomorrow and hope to pick up the visa next Tuesday. Questions were easy: where did you meet, what happened, previous visits to the US, etc.

Did you bring the big brown envelope and the small white one given by the hospital to the embassy or just the 3 medical exam forms?
I am also wondering why I am asked again for some of the documents that I already sent as what was indicated in the packet 3...like the police and the foreign police clearance...I don't have the originals of them anymore just the copies unsure.gif

I brought all the medical stuff, but they only took the smaller brown envelope and I had to carry the damn x-ray around all day. They didn't ask me for anything except the evidence of relationship, which I didn't mail in. Everything else I did. But I got the evidence back, along with the evidence sent in with the I-134. Finally hauled #### to Bangrak and got copies of my birth certificate and name change certificate and will drop that off tomorrow at the embassy. I am so over the paperwork!

I spent most of my time in the CSC May filers thread and figured this was a good place to be for the rest of my VJ. Our NOA2 was mailed out on 10/3/2008 and I'm not trying to figure out if NVC has our case and has sent it off to Bangkok. I e-mailed them yesterday and will call them tonight to see what's going on. K-1 Fiance(e) Visa Process & Proceduresk-1 visa for peruvian fiance
Hello all, So I was wondering if anyone knows of the avg. processing times for K-1 Visas for a beneficiary from Peru? The I-129F NOA1 is 5/6/2010 and I was hoping to get married in October/November but my fear is that it will drag on until early next year. I had no clue the process was this complicated...at first we were planning on getting married in Peru in July until I found out that a K-3 visa takes much more time and requires longer separation. I know our government has a responsibility to not allow terrorists into the country, but for god's sake, why does this f-ing process take 6 months!? I just know that as I write this my paperwork is sitting idle on some beaurocrat's desk. Oh well, I'm deeply in love and I'm eager to jump through these hoops. I just dislike how my own country, a country made of immigrants, puts legal immigrants through such a degrading and stressful process. I've already heard nightmare stories about interviews at the US embassy in Lima, Peru...I just really hope they don't drag my fiance through the coals. She has no criminal history or anything like that. Plus I sent in an overwhelming amount of evidence, so I really don't see why a problem would come up.

PLUS it'd be nice to know just for the sake of planning a wedding...it's tough to not have any idea when the visa will be approved. So far I've been planning on 6 months.

Dear all,

On January 20th my fiancee died of a heart attack related to a congenital disorder known as atrial septal defect (basically a hole in the heart). She was just 24 years old. She was diagnosed with the condition last March, and underwent open heart surgery in Cleveland on January 6th. The surgery was deemed a success and Ally was released from the hospital 6 days later. I had been visiting from England since Xmas Eve and flew back on the 13th January. The funny things was that the day I flew home our visa petition was approved! We were both so excited, as this meant I was looking at being back in the States for good around the end of March. I'd even interviewed for a job as a soccer coach in Cincinnati and been offered the position. Everything was looking perfect until I received a phone call from her mother...

I was wondering if anyone knew what I should do to close the K-1 case? Do I need to call the NVC or the US embassy? Any advice is gratefully appreciated.

I also wanted to thank the people on this forum for the help they provided myself and Ally during the whole process and wish you all luck on your journey.

Tom.

Sorry for your loss Tomas. I can not imagine the pain you must feel right now. All I hope is that you get through this soon and find peace and happiness in the very near future...

K-1 Fiance(e) Visa Process & Proceduresodds of getting a K1 visa
You should be fine like everybody says. As long as you've met the past two years and have proof of relationship then you're good to go! Its just the wait that gets annoying...

K-1 Fiance(e) Visa Process & ProceduresScared
It was hard for me and my fiance too. But my suggestion is Skype Skype Skype. We talked as much as possible and it lessens the sadness of being separated. Good luck and I'm sure you'll get through.
