K-1 Fiance(e) Visa Process & Procedures6 months wait after a divorce
Thank you for clearing it up cause I would've had a different conclusion as far as what is legally free to marry.

But, yeah, no need to jump on people here. All answers are appreciated. They are trying. You weed them out as you go.

K-1 Fiance(e) Visa Process & ProceduresK-1 with a Caveat
I just had to look up the statutory rape age laws in the state of Michigan before I responded. You seem safe there as long as she is over 16.

Knowing what I knew at 16, I'd say she isn't prepared for some lifelong union. But, I know love makes you do crazy things. At 21, I don't think you are too old for her so, no issues there.

I say if this is what you want to do, then get all the necessary permissions and make sure you have lots and lots of evidence. It will probably be an uphill battle for you. I wish you the very best of luck.

If you want a big marriage their ( for her family ) another route would be to bring her here , get married even at the courthouse. Adjust status or get AP and then go back there for a big wedding.

What about doing a ceremony first without paperwork being signed. The look of a wedding, without the legal nuptuals? Then she is technically not my wife, and we can sign the marriage license/papers here to make it official? Any idea if the church would go for that? (Roman Catholic)

Thanks, Tim

No Roman Catholic Church would do that. You need to be very careful about any "fake" ceremony anyhow. Not sure about your embassy; but there have been numerous cases of pictures of those ceremonies surfacing and the embassy and or immigration at POE questioning, denying, etc. because they believe the applicants truly are married already.

At best, if you go K-1, you could get married in the US and go back for a reaffirmation of vows or something like that in the Roman Catholic Church.

If you want that wedding in home country, marry and go for CR1.

Good luck to you.

Same thing....we filled out the K-1 in 2005, no father's name on birth certificate. Hell, his even had wrong mother's name on the certificate.....she found out she had a different name while growing up. We put what we knew on the K-1 including the fact that father was dead now and why mother's name different. I did not even attend the interview. No problems whatsoever.

USCIS is only concerned that they are free to marry when they send in the petition and that you met within the previous 2 years of the petition.

(How you get there is of no matter)

Exactly.....it just must be BEFORE you file the K1.

K-1 Fiance(e) Visa Process & ProceduresK1 and Pregnant!!!

To stop and get married now, wait for your marriage certificate, then refile for a CR-1, you're probably looking at over a year before being interviewed in Montreal. I'd just stick with the K-1. I don't know what you mean about your parent's beliefs? Because you're pregnant they believe you should be married now? Sorry, I don't understand....

If you have the baby before you get your visa, then you'll have your baby in Canada. Probably preferable anyway since it won't cost you any money which it surely would in the U.S.!

I agree.

And don't think just cause you're pregnant pushes you to the front of the line, speeds up anything, or even means you can show any less proofs. Proceed just as you were before.

IMO, he should apply for his citizenship and then apply for either the K-1 or K-3 or CR1, depending on if you want to marry in the US or Jamaica. Right now, those visas are running about the same time in the approval process.

Otherwise, yes, you are waiting on a number to be issued and that is a very long time.

K-1 Fiance(e) Visa Process & ProceduresGetting married in the USA before receiving the K1 Visa
The K-1 is a fiance visa......You have to still be a "fiance" when it is issued.

The wait is going to be shorter then if you chuck it all and start all over again and file for the K-3.

Maybe you should just tell her...
For the legal aspect of it, you were married so I would assume that you HAVE to write it down on the petition. I mean, I am not an expert on the subject, but even though you never changed your status in the USA, you were married and that is what they are asking. You don't want to lie to the government.
And seriously, I don't know anything about you or your fiancee, but if my now-husband had been married before I would have liked to know. It usually isn't good to start a relationship with lies or by hiding things.

QUOTE (Tom2008 @ Sep 5 2009, 03:25 PM) <{POST_SNAPBACK}>
Hi,

On the G-325A, just below the box for the applicant's signature, it says "If your native alphabet is in other than Roman letters, write your name in your native alphabet below."

My fiance is Chinese and she will also complete the G-325A. Does she need to write her name in Chinese in that box, or is the pinyin letters (Roman letters) considered acceptable?

Thanks,
Tom

She needs to sign her name in Chinese in that box. For the signature line, I had my fiancee sign her name in Pinyin and also Chinese. When she signs the G-325A, be sure to also get an original signature on a "letter of intent" for marriage as that is one of the other required documents. Again, I had my fiancee sign with both Pinyin and Chinese. Anyone else have thoughts on this? Good Luck! good.gif

just reading the checklist on what is required for NOA2, I was wondering if they will need my fiancee's birth certificate at any point during the process?

You NOA2 is the approval of your visa application stateside. Once it is approved, it will be to your respective embassy for further processing. This is the point at which your fiancee's birth certificate will become important. She will take it to the interview at the embassy along with all the other paperwork that she will have received.

Read the guides, they are very detailed and will give you all the information that you need.

Which "chinese forum" are you referring to? Anyone, including myself, in the VJ chinese subforum will tell you to follow and read the K1 guide. With your I-129F application, you will submit a copy (front and back) of your (petitioner) birth certificate OR all pages of your USC passport. K-1 Fiance(e) Visa Process & ProceduresGoogle Wave and translation bot
QUOTE (grinchus @ Nov 29 2009, 09:06 AM) <{POST_SNAPBACK}>
Hi everyone,

I just watched a demonstration of a new Google tool called Google Wave. I don't know how widely available it is yet, but according to this demonstration (link below) there is also a translation robot that they're working on that can translate chats in real time. The part demonstrating Rosy the translating robot starts at minute 6:48 of the video (but you should watch the whole thing because it's cool!). I don't know whether the translating bot is ready for prime-time or how many - or what languages - it incorporates, but something like this could be a great help to couples who speak different languages to communicate via chat, and to prove to doubting officials during the visa application process that you really CAN communicate with your sweetie and that language is not a barrier to love!

Let's hope this kind of technology continues to develop.

http://wave.google.c...using-wave.html

P.S. Dear administrators, I posted this in the K-1 forum but please feel free to move it anywhere you want.

I think this tech is really cool, and I agree that it will help you to communicate online with your SO, but in their language. The problem that arises is in situations where the SO doesn't speak your language well and you don't speak their language well. This type of method would not help to improve spoken communication between the two of you. I guess you would really need to work on that in a separate setting. I think that is what the sticking point for many couples is: the proof that clear and effective communication exists. Thanks for the link..still very cool.

So i finally gathered up everythg we need for the K1 process. Ive visited my fiance 4times in the last 13 months in London, so i added all the air ticket stubs, hotel receipts, restaurant receipts, shuttle receipts, movie tickets, train tickets, car rental receipts, cruise tickets and all the other ones i could find over this period.
Ive added my phone bills and highlighted all her calls and she's done the same. Its abt 50 pages. Ive added another 50 pages of emails. Then another 18 copies of pictures over the period, Im a soldier and she's on my life insurance certificate as a beneficiary, ive added a copy of that.
And everything on the guide has been added, all forms have been filled to perfection. And other stuff that goes on to prove its a legitimate relationship. The packet weighed 4lbs..(i feel bad for the examiner) but its just to prove its real, no fraud.

Did I miss anything?...if not then pls wish me luck

Passport stamps? You really don't have to send so much for the initial filing...just need to prove that you met and establish the relationship. The embassy is where you need more in depth supporting evidence, but many on here say it doesn't hurt to "front load" your petition. Everything looks good...GOOD LUCK!! good.gif

Hey all

First, I sent in my I129 Packet on September & I have received no touches on the case updates online & we haven't received our second notification yet. I sent it to California Service Center & I'm just wondering how everyone else is doing with their second notification?????? (if you went through CSC) Is this just a waiting thing or should I be worried?

Secondly, once we get our second notification, is there any paperwork that we should have ready? Just wondering about the next steps!

Please help us out! Thanks!

You probably won't receive any touches until just before approval or before receiving and RFE. Are you following Igor's List or looking at the timeline portion of VJ? http://www.visajourney.com/timeline/

CSC is starting to process September filers now, and since your NOA1 was the 21st, you should see some action in the next couple weeks. Your calculated adjudication is between December 19, 2009 and December 25, 2009. This is an estimate and not a guarantee and is purely based on how everyone else on the site is moving.

Have you looked at your consulates website to see if any of your forms can be downloaded? I would start getting things ready for your Packet 3. You have to wait until the embassy has sent out your Packet 3 forms before you could potentially send in your already completed forms ( I am referring to the foreign fiance(e) ). That should get you started. Good luck....

Hello everyone.

While filling out the Fiance Letter of Intent, I can't decide which address to use for (USCIS service center address). I live in Texas, and according to the USCIS website, I could submit to the following two addresses.

USCIS TSC
P.O. Box 850965
Mesquite, TX 751185-0965

and

USCIS
Vermont Service Center
75 Lower Welden Street
St. Albans, VT 05479

Most places that I've read up on states it's the later address. Which one should I designate in the letter? unsure.gif

I don't know where you got your information from, but the Texas address is your local USCIS office and not for filing your visa petition. All I-129F petitions are handled by Vermont (VSC) or California (CSC). Living in Texas, you file with VSC. I am not sure that the Letter of Intent has to have the address for the filing center. The example on VJ has a place for the address, it couldn't hurt to include it. Do you have the instructions (current) for filing? If not, here is the link:

http://www.uscis.gov...I-129Finstr.pdf

Take time and read the guides section and you will learn a lot from others. Welcome to VJ! star_smile.gif

I am just curious about this, how much time can you take between receiving the P3 and returning it to the embassy before it becomes an issue? We may need an extra month or two before we interview for personal reasons. Our petition has arrived at Guangzhou and we may be in for a wait before receiving P3 already, however many timelines suggest that they are recently moving faster. That is the problem, we based our plans on older timeline data and not the more recent experiences. I would prefer to delay the P3 and not request a delay of interview. Thoughts? whistling.gif

My fiancee in Belarus is constantly calling the Warsaw embassy with questions. Most of which I can answer. And some of which almost caused us to be rescheduled because the woman answering the phone thought she was so nervous that maybe she needed more time. Unlike others here who cannot wait to get this over with, she is taking her time, crossing the T's and dotting the i"s, but to the point of being absurd.

My question here is who should be making the calls to the US Embassy. The guy who sent in the petition or his fiancee? Personally I have an issue of all her calls, when I can be of more assistance, but when she comes up with a question, off she goes.

Did your fiancee do this?

I think this is something that needs to be discussed with your fiancee. I don't see how our individual experiences will help you, the issue lies between the two of you. Personally, I feel that a relationship requires open communication and trust...she needs to trust you for help and answers and not go behind your back. This is setting a terrible trend for your future life together. Just my opinion. wacko.gif
