OP:  I don't think that going over on one more trip to marry is going to give you a different result.  That's a bare minimum, one visit for K-1, then one more visit for marriage after denied K-1.  You should try to spend more time with your fiance in person, that's the biggest thing you can do to make things go in your favor.

 

Take your kid along, it'll be the trip of a lifetime.

 

And btw, if your kid is 17, then why does he need care?  First you said you need to take care of a mom, then you said you need to take care of a son, then you said your son is 17.  

 

He is 17 and I can't very well leave a 17 year old alone and travel 8000 miles to a foreign country, secondly I do take care of my mom as well, she is 70 and is on set dementia. Can I leave them for a couple weeks to go to India, sure. But I can't do it multiple time and like most people I have a full-time job. For some maybe it's easier to get away, unfortunately not for me. 

 

So Harpa, are you saying that if I do decide to go to India this Dec and get married, our result will be the same. Denied?


Sorry to hear that - one thing I experienced that the Attorney can be helpful (may be) but the best option would be to take a flight and get married. It will be faster than following the K-1 proceedings.

Sorry if I am asking, when he applied for B-2 visa, did he put your name as a person he would come to visit in US? There was another VJ-er here that her fiance visa got denied because she did not mention his fiance name on the application when applied it. Her approval B-2 visa eventually was revoked and they filed spousal visa now.

 

For example, if you started dating him around 2010,  he applied in 2011 but he did not mention your name there and got denied for some reason. When you filed I-129F for K-1 visa, let's say 2013 and putting timeline when you both were started dating and they found out that your fiance applied B-2 visa was actually wanted to visit you but failed to mention it.

 

That's why they have box there asking applicant if they ever been refused visa and when it did happened. I would guess, probably that's a red flag for him for not disclosed his intention come to visit in US and a tiny possibility reason why his K-1 visa was denied. But that's just my 2 cents, I might be wrong about this. -Every cases, countries, circumtances of applicants are treated according to their requirements.

 

I am really sorry for what happened to you. Be strong there.

 

When he applied in 2011 to come to visit we used my mothers name, as she was his sponsor (she has more assets than me). Maybe your right, it's possible the two names might be throwing them off. We did check the box saying he was denied the visa.

CR1 is what you would be looking at.

 

Still think that you need more 'face' time, sounds like he he has not met your child?

 

My son is now 17 now and I don't believe my finane not  meeting him would be an issue. By the time we get anywhere with this my son will have graduated college. LOL

One visit of 10 days is unlikely to pass muster. Especially with the other issues you mentioned. I would make a few more trips of longer duration and try again, perhaps during the school holidays.

 

We are thining now to just get married in India and go the K3 route. Any thoughts? I am trying to work it out so I can go in Dec.

I am confused, could you write down an accurate timeline, as presumably the above is incorrect.

 

If this is what was said to the Consulate probably did not help matters.

 

We met online in 2009 started a friendship

March of 2010 we decided that our friendship had developed into more of a relationship

2011 my fiance applied for a tourist visa to visit me, Denied

June 2012 I went to India

Sept 2012 sumbitted I 29F,

RFE - requested an additional photo from me ( it must of got lost)

NOA1 Approved in August

Interview Sept 30, 2012 Mumbai - Denied, no explanation given, received paper stating being returned for possible review and or revocation.

Sorry this happened to you.

 

I think the denial had to do with your divorce timeline. You began a romantic relationship (perhaps say fiance) while you were still married. Even though you filed for your fiance after your divorce, the fact that you were seeing this person while still married may call for attention. If I were the CO, I would ask myself if the fact that you began seeing your fiance was the cause of you heading to a divorce with your wife.

 

Hopefully for you USCIS revalidates your case once the consulate returns it. Otherwise, start thinking of marrying your fiancee and file for CR1.

For a K1 you have to have met within the last 2 years.

 

I was in India in 2012, he was denied his tourist visa in 2011. I immediately applied for a visit and went to India In june of 2012.

I don't think you should assume it was because of the dates of your divorce and your engagement. My divorce was finalised last Nov and my fiance filed the petition in Dec - I did get asked for an explanation of this in my visa interview about why this was so close together and I explained that my ex & I separated two years prior to the divorce being finalised when he went to work in another country and we agreed to divorce 18 mths before it was finalised, during this time I embarked on a long distance relationship with my fiance who i knew from dating in 1994)

 

You do need to wait for further explanation as to reasons why but assembling proof that you were separated and free to start a new relationship even though you weren't yet divorced might be helpful. (In my case my explanation at the interview was sufficient.)

 

I appreciate your feed back. Your right I could be completely off base here and there could be another reason or several reasons he got denied. He knew all the answers to the questions that were asked and they were truthful, however, if nerves are getting the best of you even truth can sound a little shady. I wish I was the one interviewing. It should be pretty easy to pull together proof that we were separated and living a part for severl years prior to my relationship being with my finace, i.e. Tax Returns, property that is owned, affidavits.

 

I just am so completely disappointed and now it seems we have months more to go. Hopefully their further explanation will be on the quick side.

Sorry, it doesn't work that way, so hiring an attorney will be useless.

 

Instead, wait for the notice to hit your postal mail box. 

 

 

 

And then either File a Motion to re-open, File a Motion to Appeal, or restart the Process over. After I wait.

Sorry to hear it.  They had made the decision before the interview, based on what information you sent them.  What did you send?  How often have you seen eachother?  Even with good evidence the timeline would be an uphill battle.

 

We sent phone bills, over 200 pages of chat logs, emails, photos of my trip to India, Facebook post announcing our engagement. My income is sufficient, I was legally free to marry, we had met and in person in 2 years. We probably spent more time online that married people who live together. 

 

I was only able to go to India one time, I take care of my mom so leaving her is a challenge. 

 

We've hired an attorney now, I am hoping he can shed some light on their decision and we can file a motion to re-open. :-(


With a long term relationship like this and this problem why not just get married so you can get the C R 1 visa? The K 1 requires you to be married within 90 days anyway so I don't know why after 3 years together you would want the K 1.

This should tell you no matter what you do now you wont get a K 1. They just want to believe there is something wrong in the relationship which you will not over come by trying this again. It possible USCIS would turn the case around again but that will take months to even find out what the outcome is.

 

Because I take care of my elderly mother and it is much easier for me to get married here.

awww...I'm so sorry.  It certainly does not sound fair.  I don't understand why the officers don't take all the evidence into consideration when making 'life changing' decisions for people.  I really hope there will be a way to successfully resolve this so that you both can be together! sad.png

 

I am hoping that we will at least get to submit proof that I was in fact separated. I just don't understand the system. When we filed we met and still meet all the requirements of a K-1. So disappointed. I don't know how anyone can make that type of decision in 5 minutes. Thank you.

Hello,

 

My fiancé had his interview on Sept 30, 2013. When he finally got to the interview window he was asked a few questions:

 

What is your fiancé name? Ans. My Name

When did you meet? Ans. 2009

When did you start your romantic relationship? Ans. 2010

When was your fiancee divorce? Ans. 2012, however they have been separated for over 10 years.

What is your fiancée religion? Ans. Christian

What is your religion? Ans. Hindi

 

The interview walked away briefly, came back, and gave him a piece of paper that basically said our petition was being returned to the USCIS office for review and possible revocation. He did not say why the petition was being returned, however, I guess it has something to do with my divorce becoming final in April 2012 and immediately getting engaged, June 2012. USCIS approved our petition and enclosed in our I-29F application were a copy of my divorce papers.

 

All of the answers my fiancé gave to the interviewer were true. My now ex-husband and I have been separated for well over 10 years and in fact we have not even lived in the same state for 8+ years. He didn't bother to look at our proof of relationship, he asked no further questions. 

 

I am real upset over this and I just don't know what we need to do next. 

 

Any assistance or advice you could offer would be greatly appreciated. crying.gif

Maybe something on the part of USCIS was not completed before it being approved and sent off in error to NVC and then the embassy. Just a thought.

I am just going to throw in my 2 cents since my fiance was denied without reason almost a year ago. I think that unless  the CO is 99%  sure that your relationship is real they do not approve. My fiance and I have been together since 2010, we filed for K-1 after two years and met all the requirements. After the long wait, he showed up at the interview, was asked a few questions, and then handed a white piece of paper saying we are sending your case back to USCIS without reason.

 

It was awful and heartbreaking for both of us, so I feel your pain. I am truly sorry.  

 

There was no real reason to deny our petition at this stage other than they just didn't believe. The CO did ask why we didn't marry in India, implying that maybe our families didn't approve of our relationship and that we were just doing a K-1 to avoid family issues. The CO's know full well the cultures of their respective countries.

 

We decided, and after speaking to an immigration attorney that the best option for us was to marry in India and file for an I-130. That's what we did. 

 

After marrying on Christmas in 2013, full blown Manipuri wedding with over 500 people in attendance, we started our I-130 petition. Also, within my cover letter to USCIS for the I-130, we withdrew our k-1 petition. A week later we got a letter in the mail stating that our K-1 has expired and feel free to reapply. 

 

I know it's hard now, but you do have options, and it will all work out.

I was there with him in Mumbai consulate when he had interview but they din't give me to go with him . on Julay 13th 2013 we got letter  tat his case is revoked and we need to apply for his EORI-29 FORM, my lawyer did file that and the reason why they was revoked because he add me with my new name on his passport as my middle name and his last name  but i dint change here in USA any of my documents still using old name,when i convert it  from Islam to Hinduism i got new name the new name he have on   his passport when he  done his passport  in India with affidavits and supported documents,  we got custom married on April 2010 when i change my name that same day but legally we got married on march 22nd 2011 in Kolkata west Bengal and that is why they they e revoked his visa and now we got the all supported documents  only problem is the India government didn't give us back the original supported document they give us a copy only they told us all the supported original documents must stay with the passport office in Kolkata ,now i don't know if there is gonna be again any problem with that i am trying to change my name here i just apply to the court is gonna take a wile ...if any of you have any info on this please post the replay

well it go like this why. i am born and rise in Bosnia  Herzegovina  and he is from India original he is Hindu religion and i was born in Muslim family when i came here 1998 and from that time to 2007 i became a american citizen ship i was never been legally married  to any one in my life, in 209 my friend referred me to one of the matrimonial website for paid member to look for some to get married and settle down any, after fever months there on that website i find this men i am married now to him in January 2010 we star to talk and from there we move on i did really like him and he like me we had some kind instant connection be twine as , he was never been  legally married before. then in April i want to Germany to visit my mom and brother and that time i convert from Islam to Hinduism because, in the Hindu temple in Berlin Germany they give me new name as Hindu Goddess    the name is Laxmi Tapoti Kapoor , when i came home from Germany here in USA that time i dint change my name in my original papers document such in license or anything, when i came home i told my fiance that time that i convert to Hinduism and i have my middle name us Bengal because he is from Bengal west Bengal India and he was wary happy with that he taught his family will accept me  if they here that i have Bengal name. in may 2010 he told me  he will do his passport and  he will tray to come to usa by tourist visa and i told him he can go  do his passport by the time he want and apply for his passport they give him a form to fill his name and etc and the father  name mother name and spouse name he put  my middle name as Bengal name Tapoti on his passport. he dint know we gonna have any problem with this name ,then when i app lay for him for tourist visa to come here that time my sister was getting married her daughter and we taught he can come here and meet all my family and every one and when i did the application i fill in that he is single because that time we dint had marriage certificate any why when he want to that interview they ask him if he is married and he said no then the officer ask him who name is this on your passport and he said that we are not married yet and that i will not travel with him from India  that is me in usa and an d have the name change it but the officer dint understand him well because his English speaking is not vary  well there was miss communication the officer taught he is lying that he is married with Indian lady,   and there was confusion and they reject his visa. then we decide i will go there in india i went there but his family was not happy with us. me and him we got married only by court register there is usual in India religion marriage but ours is not been done there because.  of his family  we had only regular court marriage . that was march 2011 i came home in April i want able to stay to long that time i had job working 2 full time and i aply for his i-130 then after 2 months his i-130 was approved in June 01/211 then they ask me to sub meet all the documents requested and i did then in august 1 2011 they send it to NVC  center they send me to pay the fees and i done all whatever they ask me to sub meet them of evidence , then they send in Mumbai his document for interview . on December 2nd 2011 he had interview i was there with him we travel from kolkata to Mumbai with airline then we stayed in hotel that day he want to interview they dint let me in  he want inside they did his finger print and give him all the documents back in folder in his hands then told him to go talk to the officers for interview when he did his English was not so good and the lady ask him for marriage certificate he dint understand what she was asking him and there was no translators in his native language he speak Bengali not Hindi language and there was miss communication the officer hand him a G221 white papers for a proof of evidence of marriage certificate, proof of,Bonn field weeding pictures passport copy, but they had all that in the folder and they give him back in his hands and he was confused what they are asking him for that when they had all that and they give him back but the officer ask him only for a marriage certificate noting else and in the g221 she wrote other thing that they need to, the same day we want to vfs office in Mumbai and drop all the evidence again and from that time he was under administration process to august 2012 for about 9 months then i got a lawyer  to see what is going on with his case then she request the information and they send back his case in October 2012 back to uscis they told me in 120 days they will let me know what they will do with  his case. then in February 15/2013 i got the mail the Home Land Security i tend to revoke his case base on this   feve  thing i mention above then they give  me by march 14 to send all the evidence  about my name about the name on his passport and why they reject his tourist visa and they said that there was not e naught Bonn field evidence that we don't own properties and we don't have any large amount money on our account in India and i did explain to them i send him about $20.000.00 dollars tr aught western union and money gram to pay for his loan he had a business but he sold it out because we taught he will come here after the interview  that is why i send him to pay the loan off on the business he did had .... any why that is my story and now i just received email  on June 13 2013 from USCIS that his case is revoked now i don't know what is mean revoked by that because i had a lawyer Silpa Malik i just waist my money paying her she dint done ###### on His case and i left her a message to call me on Thursday and today is Sunday i never heard from her i just paid her for noting she is useless  lawyer only money .i need help with this case similar if any one had in the past and what i need to do next, the only reason why i dint stay there in India for long time i am a hearth patient and i see cardiology here and i am on medication that i need medical care in India is to hot where my husband live in Calcutta or kolkata  west Bengal how other say during sames time is up to 45 Celsius and i cant handle that hot there with my heart condition they had my medical report and they dint really care anything............i am Thanking in advance to all of you who can help me with this kind problem

ANY HELP WITH THIS CASE 

My Husband Case was send back to uscis for second look ,then they send me on Feb 15 2013 intent to revoke blue papers and the explanation why they want to revoke his case, me and my lawyer Shilpa Malik talk and we gather all the document they need it and send it back to the uscis office and they told us we will notifiedf in 60 days well60 days past and noting then i called uscis to see what is going on with the cae they took the inquiry and they told me they will let me know in 15 days and just last night on June 13 i got email with this message
