Police Records

Korean National Police Certificate (Crime-Investigation History Report: Bomjoi-Soosa Kyongreok Johoi Hoiboseo) is available to visa applicants of any nationality who are physically present in South Korea. The new KNPC now includes all serious crimes since 1945, regardless of expungement benefits under Korean law, and misdemeanors for five years, according to the Individual Information Protection Law of March 2003.

Applicants presently in Korea: Foreign nationals, regardless of visa status, and Korean citizens must apply in person at any local police station. The KNP checks non-Koreans according to the requestor?s Korean alien registration card or passport. Korean citizens must show a Korean identity card with the Korean citizen?s unique, lifetime Korean identification number, which is found on Korean national identity cards and Korean passports adjacent to the applicant?s name. KNP processing is no fee and takes less than one hour. The new KNPC bears a red ink half inch square stamp on the bottom containing the Korean characters for National Police. It is issued in Korean only and applicants must attach a complete English translation, certified as true and correct by anyone competent in Korean and English, for the visa interview. A simple computer printout of criminal records is issued with the Korean annotation for information only, has no red ink stamp and is not a KNPC for visa purposes.

Your missing the point... the DOS is recommending that if the visa applicant is NOT present in the UAE that the visa issuing post waive the requirement for a police certificate from there... Bring in a printout of the info from the DOS website to the interview as proof why you cannot get a certificate from there

By the time my girlfriend files her forms she would have to have gathered Police reports not only from the Phillipines but also from Oman, the UAE and Hong Kong. This process is quite labor intensive as some of you probably know. The matter is compounded by the fact that I believe the UAE requires that you file the Police report in person. Hey all,

I have a question and hope I am in the right forum here. I am sitting here in Cairo waiting to come back to the US tonight and we are now officially engaged. We both could not be happier. So now the fun begins. So we met in Egypt, and everything went great, but there were concerns about her passport. A month ago we tried to go to Paris, but her visa was denied. Essentially when the French embassy called her manager at work to ask about her employment he was not there to talk, so rather than call back later they said, "Next." So she now has a stamp in her passport they probably says in French, "Visa was deined for France." So moving forward we decided on Egypt and less than a month later here we are in Egypt. She went home yesterday and I am heading back tonight. Had a wonderful time, but she had a concern about the French stamp saying her visa was denied. Our question is does she need a new passport so that stamp is not in there now? She thought it would be a good idea to get a new one because of the French, but now she has an Egyptian visa in this one which obviously will not transfer. Should we worry about this, or will she need a new one? I looked in the application guide and there really was nothing that said we need to show a copy of the passport for the application. However this may not be true for the interview and she may be asked baout it.

Also I must have not seen in the guide where it says she needs a passport sized photo for the application. I never thought about asking her to bring one, or even getting one when we were here. Is there a ways she could email me the passport photo so I can make the copy, or is it acceptable to look at the many pictures we too and try to find one that meets the specs? I'm sure she could take a bunch herself and then email them to me and I can use one from there. I'm sure we could use DHL or FED Ex to send the photo, but as most of you probably know the Russian mail is slow as hell. Not to say ours is much better.

Us has particular passport photo specifications (you can google for the specs)... she/you can do it yourself or she can go and have some taken... chances are that you do not have anything current that is within specification...

My fiancee and I are in a probably unusual situation. She is Canadian, I am a US citizen. We just got engaged last month. We have 2 options to be together. 1 - we can do the K1 fiancee visa route and wait the 6 months. Alternatively, I have the option of working in Canada and getting a work permit there. This option might actually take a little less time than the K1 visa. I wanted to apply for the K1 anyway just to get it started in case we do want to do that. Does anyone know what would happen to my fiancees eventual immigration to the US if we get a K1 and don't use it?

Just another question. I found out that our AP has cleared and is on its way to India. As you recall my fiance had already a second interview and told he was approved and later we were placed in AP. I found out from DOS that they just sent the file back to Mumbai. But the file weighs a bit more then 5 lbs. Can all the paperwork actually weight that much, or does this mean that they also included the big brown do not open envelope with the package being sent to the consulate. I mean they did request a lot of paperwork from us as we got a total of two 221g's Any insight could be appreciated? Thanks!

FWIW, An alien registration number is assigned by the USCIS based on petitions submitted on your behalf... A J-1 visa application never got anywhere near the USCIS

POE does not care if a K-2 enters concurrently or after the K-1 or at all.... they only care that the K-1 enters first.

Hello All,

My fiancee and her two children have received their K-1 and K-2 visas. Problem is that my fiancee's 14 year old daughter is now refusing to travel to the US (two days before the flight). Reason - she is 14 and doesn't want to leave her cozy environment at home - we have tried everything.
Staying back in india for her is not a big issue as she is living with my fiancee's mom and is very close to her. We are willing to give her the space till she is out of this "odd 14 year stage", however, we want to make sure that the doors are not closed for her to travel to US when she gets her senses back.
Possibility 1:
Her K-2 visa is good till Oct. 2010 - she may change her mind by then (hopefully) - then it should't be a problem, I suppose?
Possibility 2:
Can I file for her AOS even if she doesn't travel to the US? Her status is derived through her mom so is it possible?
Possibility 3:
She may not get her senses back till a few years from now - in which case her mom can file for the daughter when she gets her citizenship (in 3-4 years)? Any issues there?

I am looking for any suggestions/ pitfalls etc that we might run into right from the point my fiancee enters the US (POE) of AOS etc.

Although the list on the State site leaves a different impression, going by shere it seems this form is almost always needed.


I-134 instructions state that employed persons need to supply:
A- letter from bank
B- letter from employer

Only self-employed is asked to submit tax return for one year.

I'm assuming advice here is to keep things on safer side and supply much more than what is being asked. Being a curious and somewhat lazy being that I am, has anyone here gone through interview successfully without supplying tax returns?

I have got a letter from the consular saying our K1 petition has been approved. the letter contains link to the consular website and link for medical. but the link does not contain any instruction as to what form to fill, how to book for interview and how to book for medical test.

That is all they care about.

There is no age limit for the K-1. (unless the country you are in doesn't allow your age group to marry that is :))

That would be your K1 approval which can take 3 to 6 months from your service center. A lot of times cases are not updated in the system. You can make an inquiry after 120 days if you have not heard anything. After the K1I-129F is approved it gets forwarded to the NVC and from there they forward it to the consulate.

Yes and no but mostly correct. We've seen I-129F petitions filed from abroad be returned for the lack of a US address. So, while the petitioner need not either currently be present OR reside in the USA, they need an "address" in the USA, listed on the I-129F. That's the address NOA's will be mailed. Using a friend or parent's address is fine. Strangely, you'll find nothing indicating that in the instructions.

"Residing" in the US and and "being" in the US are two different things. While you do not have to be present in the US to submit the I129f, you must "reside" in the US.

It the OP does not have a current US residence, then he cannot file a I-129f.

No, not correct. A K-1 can only be submitted to a stateside USCIS service center but it does not require the petitioner to be in the US.

I'm a student in Puerto Rico (a US territory, so I have a US citizenship) and I got engaged to an Australian man.

Here's my issue. We're applying for the K-1 visa. Problem? He planned to come visit me in July (under the visa waiver program), already has a ticket, etc. I was told that he must be abroad while we apply for the K1 visa. Is this true? Can I apply now and have him come here in July while it processes? We'd both hate to lose the money, but oh well.

And how long does the K1 take to process? I stupidly booked the venue and everything for December 22nd. Hoping I can get the visa by then.

I explained to her that if we sent in the visa application tomorrow it would probably be about 5 or 6 months before we would get it approved so that we could schedule the interview - at which time she would need the signed document from her ex-husband to allow her son to leave the country. If he still hasn't agreed to sign the document at that time could she get her visa and come alone and then later get a visa for her son once the ex-husband agrees?

Yes, the child can come on a K-2 based on the original I-129f for up to one year after the K-1 is issued. If after that time frame, then the child could still come based on a new petition (I-130) if the child was under 18 when you became the USC stepparent.

Then get the necessary permission document and notify the Consulate to send an application packet for the stepson. He would only have been named in the petition. He'll need his own visa application in order to obtain a visa to follow to join within a year of his mother's visa issue date.

If you are unable to obtain the necessary permission, then file an I-130 for your stepson, so once he's 18 he can obtain the visa without the permission.


If I remember correctly, I think in Ukraine the cut-off for the permission slip is 16

When we initially filed the K1 visa my fiancés son wanted to stay in Ukraine to finish school. Consequently he was not included on the original application with his mother.
We were married last December, biometrics now complete and we are waiting for the interview process. In the mean time her son, who is 17 years old has decided he wants to join us here in the US.
Can anyone advise me as to the best course of action to accomplish his request?

If your fiancee has ever been to the USA before, when they came through customs a "A number" would have been assigned and a small card with that number would have been given to your fiancee.

If your fiancee has never been to the USA, you may leave it blank since it says "IF ANY".

I think it is best to put in NONE in blanks instead of N/A. I reviewed my I-129F from July 09 (approved) and in all the blanks that did not apply (like part A, #7) I put NONE instead of N/A.


"A" numbers are only assigned to immigrants to intended immigrants, not just anyone who has been to the USA as you indicated

I am presently in PI meeting my fiancee and her family. This our first encounter together and I am delighted with her and she is also with me. I understand that when I return to the states I am the one who has to submit a petition on her behalf to the USCIS. I just wanted to know if she could complete her part of the process in HK since
she works there and it would be easier for her complete the application there. She lives in a small province in the PI and traveling to Manila everytime she has to go to the US Embassy can be a tremendous hardship for her. She know her way quite well in HK and she can go to the PI Consulate there as well as the US Embassy.

Thank you again ever so much for your assistance. You have been quite a support in these times when you are filled with anxiety about a process that appears so complicated. Archie


She will apply at the US consulate with jurisdiction over her current place of legal residence... If that is HK then it is HK
