Your petition sits in a box from the day it arrived until it is picked up for review... then the USCIS either approves it or sends you an RFE. Their is no one who touches your file in the between time to "let you know by now" anything.

Here is our situation. It looks like we will be having the interview in Kiev in early May for the K1 Visa. My fiance has a 17 year old son. He will be 18 in July. He is a student at the Maritime University in Odessa. Right now he has no desire to move with his mother to the US. But as we all know 18 year old's plans change. Does he have to go to the medical and interview with his mother or can he do it within the one year window?

I remember hearing/reading that - wasn't aware it was still common in some places (especially the part about not needing an actual affidavit of support). It really demonstrates that while the affidavit of support is important (or even required), it isn't always the deal breaker - a lot of other things go into the decision making. All intended immigrant and "K" visa recipients require a medical exam. As for the interview the answer depends on your consulate. Many consulates the age of attending the interview is 14 or older. You need to check with your consulate for the exact answer

This is a K-1 question by nature so please don't move it to the "Family Based forum".

Here's the deal...

In 2001 I signed a I-864 for my current wife, we are now divorced, she is a Permanent Resident. She gained this status by me petitioning for her (she was here illegally), and paying a fine. This may sound odd but there was a law passed and a "window" opened for people in or situation in 2000.

She lives on her own, we have one child together, she has two others. She gets Food Stamps, Health care, yada. yada, yada. Technically speaking with the I-864 I am legally obligated to support her until she works 40 quarters or becomes a citizen (she has worked 25 and has no desire to become a citizen. One of the provisions is that I would be responsible for certain gov. benefits, i.e. pay them back.

I am not necessarily worried about the gov. coming after me for the I-864 because there is no trigger really for that.

Here's my question...

I have a Mexican Fiancee, I want petition a K-1 Visa for her and her daughter, marry her, yada yada. Obviously I have to put my x wife's alien number, name, and status on the K-1 paperwork, I also have to put her on the I-864 as me supporting her.

I am fairly certain that my fiancee will have no issue coming into the country, I make decent money, we meet the criteria. Will this come up in the Adjustment of Status interview? How could this negatively affect me? Also, what type of issues could this bring down on my x wife? she has been arrested a few times for small offenses and I really don't want to get her wrapped up in a bunch of problems.

I feel that as long as I don't petition for another person "everything will be OK", but I love my fiancee... what to do???

If your income supports your current family plus all sponsored aliens it should really not be a problem. The I-134 Affidavit (which is not even required at CDJ) is typically much less an issue than the I-864 for her adjustment of status when that time comes.

FWIW, IMO your situation is not as much K-1 related as it is adjustment of status related. I will leave it here even though I believe it belong belongs in another forum

In birth certificate in the line of Father is the name of my dad. (in my country if we don't want to mention who is the father, authorities automatically put my dad's name). Not neccesarily... My wife changed the spelling of her name to Svetlana when we were married, adopted a middle name and changed her last name... No issues for us so far... her GC is in the spelling that she wanted.

I filed the I-129F with my wife's name as Svetlana and my son as Vladimir... When I finally saw the passports it was transliterated Svitlana and Volodymyr... Needless to say they are here without issue... The consulate will issue the visa in the name in English as spelled in the passport

If the alien arrived on a "K" visa then it might be possible to exercise follow to join... follow to join is the ability for a dependant to get a visa (K2 or K4). the window for application is one year from the issuance of the alien's original "K" visa.

If it is within the window then you contact the USEM directly for instructions on how they do it locally. (not all USEM's do it exactly the same)

Just read a post from another topic by Nik+Heather. Said that last year at this same time processing of family based visas stopped for a few weeks when the USCIS started to accept H-1B visa applications. This year the USCIS states that "We will begin accepting H-1B petitions on April 1, 2010 that are subject to the FY 2011 cap." Does anyone know if it is true that starting today we will likely see slower processing times? That's disappointing since I've seen some lightning fast NOA2 come out and was hoping to have the same :(


an annual occurence... slows down processing for a few weeks or so ... the length of time will be determined by the number of H1-B's received... in 2008 and before the limit was reached after just a few days... last year it was not...

The Child Status Protection Act (CSPA) generally protects a child with a derivative immigrant visa from "aging out" if their AOS petition is submitted before the child is 21. However, it only applies if the child is a derivative of an immigrant visa petition (I-130). This means that IR2/CR2 and K4 are generally protected by the act, but K2 applicants are not. The only exception is if a parent/step-child relationship is established between the petitioner and the child before the child is 18 (i.e., the petitioner marries the child's parent), in which case an I-130 can be filed for the child with the AOS petition. About the only way this could happen is if the child was originally a K2, the petitioner and K1 married before the child was 18, but didn't submit the AOS petition for the child until the child was almost 21.

Eligibility has nothing to do with when the visa is issued. It has everything to do with when the AOS petition is submitted. When CSPA applies, then the AOS petition must be submitted before the child is 21. When CSPA does not apply (as in your case) then AOS must be approved before the child is 21.

If the child does age out, then she will not be eligible for any future immigration benefits until such time as her mother becomes a US citizen. You as the USC step parent, are precluded from petitioning for her as you did not become her step parent before her 18th birthday

I was under the impression (wrongly it seems) that if Tanya's daughter came with the K-2 visa and was under 21 at the time the visa was issued, the fact that she turned 21 after was not a problem. So let me get this right: She needs to have the green card before she turns 21, not the K-2 visa before she turns 21?


Visa issuance is not what it is based on because you are applying for a K-2 visa ( a non-immigrant visa) and at that time of visa issuance, the applicant is not yet eligible for a permanent residency. CSPA may provide protection if the I-485 is filed before she ages out but I am not 100% certain on that issue.

That is cutting it way close if they are not arriving until August... AOS can be a finicky process with it taking anywhere from 3-7 mos. typical (though things have sped up a little)...

Yes. there is a new fee. It's been discussed in length in various threads since the proposition was announced late last year sometime.

The K1 while called a "non-immigrant" visa is actually an immigrant visa given you have the ability to AOS (it's like a transit visa between non-imm and imm). SO yes, you would need to pay the immigrant fee which WAS US$131. Some embassies have already started charging the new US$350 fee.

I hear you on the "but ours is $400".. the fee is CONVERTED to the local currency of where the visa is being applied for. When i paid MY $131 fee the US to Aussie dollar was bad so it cost me $176 Australian (or something like that) and now people pay closer to $140-150 in Aus.

So it looks like your/her embassy has implemented the change and the new fee is payable. Nothing you can do except pay the fee.

Hey everyone :)

We're now at the stage of waiting for the interview date at the US embassy in London but have a couple of questions regarding the I-134 affadavit of support.

Both my fiancée and her mother (co-sponsor) have filled in a form each. However, we only have evidence from my fiancée as she's the main sponsor (e.g. pay stubs/tax returns). We're wondering if that was satisfactory at this stage, or whether the co-sponsor was also required to furnish evidence if the I-134 form wasn't enough. If they do, do you have any examples of the kinds of evidence that may be required?

Any help would really be appreciated!

The I-134 without supporting documentation is not satisfactory, because the sponsor (as well as any co sponsors) needs to prove they have the means to support and the I-134 alone by itself does not do that. Evidence samples are the same for anyone who provides an I-134 (pay stubs, tax returns, bank statements, etc....).

Hi all,

I just got engaged. My fiancee is in Chennai, India.
This was my original plan (since it seemed to be easiest & fastest way to bring my fiancee here):

  • Go get engaged
  • Come back to US and apply for K1 Fiancee Visa
  • After my Fiancee is approved for Visa, go back to Chennai and have a traditional ceremony (but don't register as husband/wife with the Indian gov't)
  • Bring her back to US with me.

However, when I came back to the US, I found out (thru a lawyer in Chennai),
that having the traditional ceremony automatically means that we are married,
even if I don't register with the Indian gov't.
(Still getting a second opinion on it -- he was certain of it, but not 100% sure..)

Which means that I can't bring her back as a fiancee. And I really can't bring her
here without that ceremony (both the families require it!)

Does anyone have this experience?
This means that I'll have to apply for a Spouse Visa - K-3.
Is that right? Or am I missing something.

Can anyone recommend me an Indian lawyer who will be aware of
these issues.

If you are legally married before her arrival in the USA then the K-1 visa is no longer a valid visa for you... If you want now a spouse visa, then the marriage needs to occur first and then you begin the petition/visa process

Please read the Definition: "International Marriage Broker” is defined as an entity (whether or not U.S.-based) that charges fees for providing matchmaking services or social referrals between U.S. citizens/permanent residents and foreign nationals.

What have you read about "arranged marriages" or "mail-order brides," etc. What I have read indicates that there is a problem with this type of activity and it does raise concerns (red flags) during the process. We're all trying to help one another in this forum so I answered his question/concern to the best of my ability. So, we will see what happens during his VisaJourney in the future.

The use of an IMB does not automatically infer a "FINANCIAL ARRANGEMENT".... I know what an IMB is so I do not need to read the definition. I can speak to this point from PERSONAL EXPERIENCE... I can tell you from PERSONAL EXPERIENCE that the use of an IMB is NBD in the eyes of the USCIS, as well as the consulate in Kiev. So unless you have other important information that actually adds to the conversation or personal experience with an IMB or the consulate in Kiev......
