That you can enter the US on another visa or vwp without using the K-1. (Umit still has a valid B-2 visa, and could of used that instead of the K-1). I have read some posts where CBP asked the person which visa they were using (same scenario)


Primarily Canadians who have had limited success with this... I have never heard of anyone else from another country other than Canada do this successfully

Hello,
I need all of your smart advice. My fiance's K1 interview is this Tuesday in Rio de Janerio. I am 99.9 % sure he will be can denied and he can apply for the I-601 waiver. However, my mom just got off the phone with a highly powered person in the government working on immigration and she said he will most definitely not get the approved. She said I should of married him and petitioned as a spouse and that my only chance is that. What should I do? Should I marry him in Brazil in June when I visit and start a whole new petition? Can I even do that? Will they look at my other visa petition and not accept it? Can or should we still do the 601 waiver and can we get married during the waiver process? Please help me I am so confused and it seemed we just wasted a lot of money and a lot of time.


Depends on the reason for denial.... If you do not solve the issue causing the K-1 to be refused... the spouse visa would be refused for the same reason....

I hope someone can help me. I just married my fiance whom I brought here from China on a K-1 in April. Her son is on the original petition but did not want to follow her here. He has since turned 18 and now wants to join her. I was told by the National Visa Center that he must contact the embassy in Guangzhou and they will send him the paperwork. My wife is afraid he will not know how to do this. Do we have to do anything here in the U.S or is it all up to him now? Please give me any info you may know on this subject. Thanks so much. Jeff

In most consulates, I doubt it would. There are some consulates that are just rife with visa fraud and to them almost anything is a red flag. Kiev is not one of those.

In many other consulates, Kiev included, the reaction of a steady contribution of money is "Meh...who cares?" It really is not much of anything either way. So while it may not be a "red flag" in some consulates, it is, at best, really low on the totem pole of "evidence".


In addition, if you are relying on this information to "make or break" your case for a bonafide relationship, then you have bigger problems....

Hundreds on here have had K-2 children.... For the I-129F stage... no added information just name the child(ren) on the petition form... for the visa application stage, just follow the consulate checklist...

But the C.O in this case, was more concern with my fiancee's answers to begin with, and my father's past, the questions were horrible, nothing related to "us" as a couple, i was there, but not allowed to go in with her, and the denial was based on the fact that he thought she was seeking immigration benefits, and literally told her "I think you are trying to get a green card" my fiancee and i were married before, when i lived there, we were separated when i left Brazil, but not divorced, i don't know if i wrongfully or logically recently filed for divorce, in order to bring her as my fiancee, because is faster...and maybe this had a significant impact on the C.O's decision, but it's obviously not what he told her...



All of your actions appear to be geared to get your ex-wife (now fiancee) immigration benefits... It is easy to see how the CO concluded what he did.

I do not know where or who told you a fiance(e) visa was faster... it really is not THAT much faster to even consider doing what you did which basically paved the way for the result you received....

I visited Thailand for the first time last December and it didn't work out between the woman i went to visit and myself. I met someone in February and went back to Thailand to visit her in June. We are now compiling documents/information to apply for a K1 Visa. Can anyone tell me will my prior trip in December be a problem? How should I disclose it?


Unless you filed something then you must disclose the fact you filed a previous petition.... you are not required to disclose your international travels on the petition. I was in Ukraine 3 times before I finally filed a petition for my now wife....

So there is no penalty, no down side to marrying after the 90 day limit? Surely this cannot be viewed the same as marrying within the 90 day limit.


the first downside is that you cannot adjust directly from K-1, as you are required to submit an I-130 for determination of eligibility as an immediate relative. The second downside is that this can only happen if the alien married the K-1 petitioner. If they married a different USC, then they cannot adjust and must leave and do consular processing.

She's still here in the USA. They can simply marry and file to adjust her status. Since the marriage occurred after the 90 days allowed, he'll need to file an I-130 concurrent with the adjustment of status filing but there is no need for a new visa.


This is the path to immigration for the OP that allows the status to be corrected WITHOUT leaving the USA...

she can leave anytime she wants... however, if you want her to return, she cannot leave until she has received new "re-entry" documents. These documents cannot be applied for until after your marriage and you have filed for her adjustment of status. Interim re-entry document (advance parole) takes about 60 days from application

Your fiance(e) will need a copy of your birth certificate and the original to carry as backup for the interview at the Embassy. Order your birth certificate NOW!!! Make sure it is a long form certified version (has your parents' names and has a raised seal or stamp).

Search the internet for the city/county/state of your birth. Often you will find services that will go to the court houses and get proper copies for $40 or so. Maybe order a couple of them.

i sent in the 129f and had photocopies of my valid passport ,all pages and the page with my picture on it., i didnt provide my birth certificate because i dont have it ., and i was told by many in this forum that my passport was sufficient for proof ., ., will i get a rfe? or is what i sent good enough? i already got my noa1


if you read the instructions to the I-129F, you will see it says to provide your birth certificate OR your passport (all pages)....does not say both so why do you think you will get an RFE

I am a graduate of the visajourney living with my husband in California. A friend of mine is about to start the process of applying for a K-1 fiance visa. However, I did not obtain a K-1 and cannot remember the answer to her question so was wondering if you could help me out: If your fiance is on a tourist visa at the time of filing, is he or she eligible to stay in the US throughout the duration of filing for the K-1? I know that if you are on a student visa or an H1-B, your current visa is extended but am unsure if this is the case for tourists.

You are eligible to stay as long as the time that was granted by the CBP upon entry (ie.. the date on the I-94). A tourist visa stay period is extendable, but being the beneficiary of a I-129F petition is not something that makes one "automatically" eligible.

Hello, I tried to find this answer on the forums befor posting this but was not able to , i am putting my K-1 package togeather for my Girlfriend in Brazil. My question is I am Half Chilean and speak , read and write spanish and I got lucky because my girlfriend/ fiance does also speak , read and write spanish.My question is do i have to have all of our emails, and chat sessions and love letters that are being submitted translated into english?.. I would assume yes? and if so can you just get anyone to do it ?or does it have to be a selected translator?..

E-mails, love letters, chat transcripts are NOT required for the initial I-129F submission but are optional evidence... most people do NOT include this type of information because of the translation requirement.

I recently sent in my K1 Visa application (I-129F / G-325A / supporting evidence). Problem is, I wrote that my fiance would be doing his interview at the US embassy in São Paulo, Brazil and it has now come to my attention that they do not process K1 visa applications/ conduct K1 interviews at the embassy in São Paulo. I do not want our case to get delayed because it is sent to the wrong embassy. I'm thinking he will have to do his interview in Rio de Janeiro. Will the USCIS California Service Center notice this mistake and automatically send it to Rio instead? Since I sent it in so recently, I am still waiting for my NOA1. I was thinking maybe I should wait to receive the NOA1 before I call or write in about the mistake...that way I can give them our case number so they could easily look it up and correct my mistake.

Has anyone made a similar mistake?? Any advice for me??

Great forum! My girlfriend and I have been getting a lot of useful information here, and I hope to learn enough here to be able to help answer other peoples questions too!!

My girlfriend came up with a really good point that we would like some feedback on.

I am a resident of Minnesota, but am living in Montana. Am using a Montana address for everything and my passport and id are Minnesota issued. Are there any stipulations or problems with this that anyone has incurred or heard about?

We are filing for K1, and she's in the Philippines.

Non-issue... Your passport was issued when you were in Minnesota... that never changes even if you move... You will never need to provide a state ID...
