According to recent trends, the NOA2 is probably mid to late August..... If you are then interviewing in Montreal, you have a long wait after that, as Montreal is a very slow consulate

Hi, I think Im freaking myself out and getting confused. I was under the impression that the ENTIRE process from NOA1 to getting the visa in hand is 5-6 months is this right or is it 5-6 months from NOA1 to NOA2? My American Fiancee received our Noa1 on June 1st 2010. So I was estimating that we will receive our NOA2 sometime in September and I would get the visa before the new year. I have to give my work 3 months notice...so I was thinking of giving it in September...but now im not sure....help please...

and on my thime line is says "Based on timeline data, your I129f may be adjudicated between August 7, 2010 and August 17, 2010*.

Adjusted? what does that mean? I thought I was just waiting for the NOA2...?

Since each consulates processing time is very different... the "guesstimates" for processing time is what is common for everyone which is the USCIS part of the process or NOA1 to NOA2. 5-6 mos. is the "official" line. The USCIS speeds up and slows down all the time. Your "guesstimate" is based on actual VJ member results over a recent timeframe (this assumes members accurately report)

They probably won't give you a copy of the DS-2053 (medical report) but ask for a copy of the DS-3025 (vaccination report). If the DS-3025 is NOT included in the POE packet, then you can take the DS-3025 to a civil surgeon here in the USA and have them transcribe it.

The USCIS will request your "A" or Alien file that you give to the POE when you enter, which will include the DS-2053 medical report, for use at AOS time.

Hello all, So I was wondering if anyone knows of the avg. processing times for K-1 Visas for a beneficiary from Peru? The I-129F NOA1 is 5/6/2010 and I was hoping to get married in October/November but my fear is that it will drag on until early next year. I had no clue the process was this complicated...at first we were planning on getting married in Peru in July until I found out that a K-3 visa takes much more time and requires longer separation. I know our government has a responsibility to not allow terrorists into the country, but for god's sake, why does this f-ing process take 6 months!? I just know that as I write this my paperwork is sitting idle on some beaurocrat's desk. Oh well, I'm deeply in love and I'm eager to jump through these hoops. I just dislike how my own country, a country made of immigrants, puts legal immigrants through such a degrading and stressful process. I've already heard nightmare stories about interviews at the US embassy in Lima, Peru...I just really hope they don't drag my fiance through the coals. She has no criminal history or anything like that. Plus I sent in an overwhelming amount of evidence, so I really don't see why a problem would come up.

PLUS it'd be nice to know just for the sake of planning a wedding...it's tough to not have any idea when the visa will be approved. So far I've been planning on 6 months.


It takes 6 mos because there are thousands of petitions in front of you and they have only so many adjudicators.... The USCIS part is taking less time lately than 6 mos. Once you clear the USCIS and your file is on station in Peru, make sure you understand how the interview process works there so you can keep it as short as possible

I just received my NOA2 in the mail, dated June 11, 2010 (which was a Friday), now more than a week later NVC still hasn't assigned a case record #, according to their automated phone system. Should I be worried that something has happened to my paperwork? It seems many people get assigned a case record # 2 or 3 days after there NOA2 dates. Thanks.

If you are going to do this yourself you need to understand the process.... The translation requirement is explicitly explained in the I-129F instructions.... read the instructions completely, you might also find other very important information that you missed (ie... fiance(e) or fiance(e) child's BC not required, original documents or regular photocopies, where to send the forms, who to make the check payable to... etc....)

A..On the checklist the K-1 fiance/e receives it states that English or the native language where the consulate is located is acceptable. If the Consulate *must* have english translations, it will be stated on the checklist.
While the translation of documents may not be required for the K-1 visa, the translation of foreign language documents WILL be required for adjustment of status. If your language is different from English, I would tactfully suggest that the foreign fiance get translations *prior* to entering the US on the k-1 visa.

What about it? This indicates you do not yet understand the process.


USCIS is NOT the consulate... after your I-129F petition is approved by the USCIS, it then goes to the US consulate in the country of residence of your fiance(e). This is a DIFFERENT part of the K-1 process (visa application) NOT to be confused with the petition process with the USCIS.

anything submitted in a foreign language to the USCIS that you wish to use as evidence or as a required document MUST be accompanied by an English translation. If you submit something without a translation you might as well not submit it at all because it will be ignored....

FWIW, your fiancee's BC and the BC's for the kids are NOT required documents for the I-129F

Yes it is true, it is a consulate requirement.

You need to provide a police report for every country you have lived in since the age of 16....

You can petition for determination of eligibility to apply for a K-1... this is a separate pre-requisite process for this visa... 2 yr HRR has no effect on this...

Once the petition is approved and he is able to then apply for the actual visa is when the "waiver" will be needed if you want him here before the 2 yr period expires.. The K-1 will NOT be approved unless the waiver is applied for and granted or the time period has expired

THE USCIS SITE STILL STATE IT RECEIVED MY APPLICATION AND IT IS IN THE REVIEWING PART. IT DOES NOT SAY ANYTHING ABOUT BEING APPROVED OR ANY CHANGE FROM APRIL 16 2010. SHOULD I TAKE THIS AS APPROVAL. If NVC did not receive your approved petition they would not even know who you are...

What is concerning is that you need the I-129F approval notice from the USCIS for AOS after you marry and apply for the greencard... Keep a watch out for it

FWIW, Payxibka is a hugely valuable and knowledgable member of VJ and I respect his opinion very much and he was very helpful to me when I was a noob. I see what he is saying, it is not legal in Ukraine and keep your mouth shut and no one will know the difference and he is most likely 100% correct.

I do not like the idea that is being proposed, I feel it is fraud for selfish purposes, but hey, I am not a judgemental guy. Someone can't wait the extra time to be with their lady love from Ukraine (who can blame them for that?) and they want to keep her and her family happy also (good luck with that, you have never had a Ukrainian MIL :lol: )

My suggestion remains the same...don't risk it. I also sincrely doubt you would pull it off and hawould have problems with the church, but i will leave that to you. I respectfully disagree with Payxibka.


Let's be clear... I never told the OP to do this....there are risks and the whole thing can have unintentional consequences if the PERCEPTION that a legal ceremony has occurred.

I simply have been presenting what is legal and recognizable. It is NOT fraud if it is not a legally recognizable marriage.... it is merely a symbolic ceremony to do this ONLY in the church in Ukraine... but that does not mean I would ever recommend this. The OP is a big boy and needs to make that decision on his own based on true facts and balance that against the associated risks

Correct. But the legal marriage event should occur FIRST and MUST be in the USA. After that have as many ceremonies as you like. Pay, would you suggest they do this and then tell the consulate? The CBP? Who should they tell, Pay? It is not a legal ceremony, so why not tell everyone?

This SHOULD be an excellent piece of evidence for "proof of ongoing realtionship" for the interview...don't you think?

OMG.... don't do it.... almost all the other threads say... go for it but understand the risks... as long as it is not a LEGAL marriage and you get LEGALLY married in the USA then go for it.... just don't give the perception of a LEGAL marriage.....

FWIW, ask your wife if a marriage in the Orthodox church is a legal marriage? or does it only occur at ZAGS?

Your plan will render her visa NULL AND VOID. BAD idea. She MUST enter the USA as a fiancee with a fiancee visa. You MUST get legally married in the USA and submit a US marriage certificate with the AOS. Doing it any other way is FRAUD and subjects her to being deported and barred from future visas of any type.

If you WANT to marry her in Ukraine, then DO SO and file for a CR-1 visa. That is WHY they have differnet types.


You can have as many "ceremonies" as you want... you can only have ONE marriage event... and it must occur in the USA or one of its territories.

You are correct that the GOVERNMENT of Ukraine does not recognize ANY religious wedding. Absolutely true. However the government of the UNITED STATES recognizes ALL religious ceremonies as a legal marraige. The OP would be able to apply for AND RECEIVE a CR-1 visa based on a Ukrainian church wedding ONLY. If it is VALID to receive a spousal visa, then it is equally as valid to negate a K-1 visa. By the same token, the Ukrainian government does not recognize ANY marriage in the US unless it is registered with ZAGs.


I respectfully disagree here Gary... even in the USA, if you are not married by a "registered" officiant qualified to perform marriages in that jurisdiction, you are NOT married (unless of course you reside in a a common law jurisdiction, which is not even in play here).... Every "ordained" minister, pastor, priest, etc... must in fact register with the respective state or they cannot perform a "legal" marriage.

That may be true, but what a USCIS official thinks of what looks like a wedding might be a different story. I have heard of people on these boards that had even just an engagement ceremony that looked like a wedding and they had trouble.


That is because they "flaunted" it. If the USCIS or the consulate are not made aware of it, how can they have a problem with it?

If you marry in the Ukraine before she gets here then she is no longer a fiancee but a wife and the visa would be void.


Please, you need to understand that a church wedding is NOT recognized in Ukraine. The only valid way to get married is at the ZAGS office... as long as you do not do the ZAGS wedding you are not officially married

You can apply today if you have someone you want to petition for and have met the eligibility requirements.... just will need to request a "waiver" if it has been less than two years since you last petition..

Hello,

We're just beginning this process with the K1 visa and so we have a few questions.

Just for a bit of background information I'm the US citizen and my Fiance is an Irish citizen. We have been together for over two years and are currently living in Dublin together.

We're a bit confused about what information to include as proof that we have plans to marry once we arrive back in the US. We don't have the finances for a full on wedding so we plan to just have an intimate ceremony at the courthouse. Is this going to be okay? Should I just include proof of our engagement such as pictures of the ring, pictures of us shopping for wedding bands, picture of the engagement party?

That you can enter the US on another visa or vwp without using the K-1. (Umit still has a valid B-2 visa, and could of used that instead of the K-1). I have read some posts where CBP asked the person which visa they were using (same scenario)


Primarily Canadians who have had limited success with this... I have never heard of anyone else from another country other than Canada do this successfully
