Even looking at it that way it's not the interview fee that is the problem, it's AOS...

I still don't understand why there is even a K-1 Visa when the CR/IR-1 does the same thing for cheaper and the separation is just a month or so longer. I know, back in the day CR/IR Visas were a slow lumbering process and the K-1 was designed to help reduce the wait for couples in love but times have changed.


Actually the LIFE act of 2000 that authorized the K-3 visa.... the K-1 has been around a lot longer than that and I think it was was authorized but the INA Act of 1952 (as amended)

How exactly is it not fair?

We paid $400 each for my Wife & son's Immigrant Visa Interviews. While a K-1 technically isn't an Immigrant Visa it is a dual intent Visa which means that they move some of the processing to after POE and charge more for it.


think of it this way as it relates to cost to obtain green card...

I-130 petition $355 + IV fee $400 + I-864 fee $70 = $825

I-129F petition $455 + visa fee $350 + AOS fee $1010 = $1815

about a $1K difference

Would like to get some input from those who have passed before me, so I can allay our anxieties. My fiancee along with her 7 yr daughter are finally scheduled to arrive in Miami. Unfortunately I'll be waiting in Phoenix to greet them.

Is there anything in particular to prepare her as she goes through immigration? is there a separate process for her entry compared to other visitors who are entering the U.S. Will she need to request for certain documents like employment authorization documents. How much time will she need to get through, I gave her a five hour window to make her "connection" hoping that will be sufficient.

Any ideas how I can send her a phone at the Miami airport or a credit card so she won't be "stranded" at the airport.


depending on how busy the POE she may get sent to secondary inspection... no big deal but a possibility because the front line is too busy to handle the extra processing required..... Five hrs. should be plenty of time

It covers what it describes as FAQs for both K-1 and IR-1 visas. And it's misleading, if indeed the Manila embassy won't process an IR-1 because I'm not living in the Philippines, as there is no mention of this requirement. In fact, the same page implies the reverse concern: Q: "Can I file a petition if my permanent residence is in the Philippines? A: Yes, you may file a petition if you live overseas..." There's no mention of DCF that I can find. A phone call or two (or four) during business hours may get me the specific info I need, though I would rather have it in writing, on their website, at least.

I'll check with the Manila embassy directly to get the word straight from the horse's mouth. And JlovesA is surely correct in that I really should be digging/posting in the IR-1/DCF/Philippines forums to further my inquiry.

According to the same instructions, from there, assuming the IR-1 visa petition is approved (at the New Hampshire NVC), there's still some unknown delays during which:
1) I submit an I-864 to swear financial support
2) NVC sends forms to spouse
3) I notify NVC that these docs are ready
4) NVC sends their relevant docs to the Manila embassy
5) embassy schedules interview with spouse

I'm guessing I really need to contact the US embassy in Manila to get a definitive answer & start the process. Is there a game-wrecking detail I have missed in all of this?

First allow me to say this is a great site and thanks to everyone for their input in advance. I have read many internet articles and advertisements and stumbled across this site. (thank God) I have searched but have failed to find this question at least this bluntly stated. I am the USC and my Fiancee is from Ecuador. I have some possible red flags and want to know if the concensus is I need a lawyer or do it myself. I am capable of filling out the forms but am worried also about an omission. Here are the potential the flags.
Two felony convictions in 1985. Only one is supposed to be showing in the records but who knows for sure. Did not serve prison time, probation only. Both are long behind me with no further problems.
Next, Reported income level is Not above the 125% guidlines, and i am self employed.

So, Plain and simple, Hire an attorney or not?

And i'm also curious, Are the "Cupid" websites considered a marraige broker?


1) Depends on the type of felony convictions and whether they fall under Adam Walsh or disclosed under IMBRA

2) No attorney is going to help you make up your income short fall. I-134 is submitted to the consulate not with the I-129F so you have time to figure it out.

hey everyone, I have a few questions and would appreciate the help. Now for the affidavit of support I will need a co-sponsor, at the same time my brother is also in this same process as me trying to bring his fiancee, now the question I am asking is would me and him both be allowed to use the same co-sponsor? We know a family friend and he has agreed to help us out but we dont know if he can be the co-sponsor for both of our fiancees.

Another question I have is when we file the affidavit of support, is the support needed for me and my fiancee or just her?

And the last question is having a co-sponsor who lives in another state possible? Like does the co-sponsor need to live in the same state as me for the person to be eligible?

it will NOT affect the K1 process.

Whether you get approved to visit for that long or not is up for debate. If you get denied a visitors visa then it shouldn't affect your K1 either.

JUST a letter from your employer won't be enough. You'll need to show strong ties to your home country. Such as land, family, etc etc in order to obtain a visitor visa. They're not the easiest visas to obtain. It will be over soon enough.. the waiting I mean. Personally while being apart sucks I would stay and continue to work and save money... you're going to need it.

Either party can max out the credit cards or drain every dollar from the bank account. If his ex max's out the credit card HE is JOINTLY liable for that debt. If he puts $10,000 in the bank account and she takes it out, he has NO recourse against her, because any money put in that account belongs to them BOTH.

A joint account is a joint account... you do not need to be married to have a joint account. It is not his account but their account. He simply needs to STOP using it. All he needs do is open a new account in his name only or jointly with you...

That is the first thing he should have done 5 years ago right after the divorce

I'm gathering all my documentation at the moment for my K1 interview and I have one little concern:

I was born in 1974 and adopted when I was only 6 months old. I have my adoption certificate and an accompanying birth certificate that was issued at the time which only lists my adoptive parents, not my birth parents.

Does anyone out there know from experience if these will suffice? I really don't wish to go through all the rigmarole of obtaining a copy of my original birth certificate (fill in a form, send to the council, meet with a counsellor, etc.) Besides, I've gone 36 years happily not knowing who my birth parents were and I've no wish to know now!

When you are adopted your original birth certificate is null and void and is replaced by a new certificate.... this certificate becomes your legal document of your birth and is what you should use

Just answer the question... put in the dates... Canadians typically do not get an I-94 when they enter and can stay for up to 6 mos.

He is about to be recruited for the Navy so, Im in two minds on weather to pay for his medical $440, police report $156, flight to sydney to be interviewed etc....and in the end he will be in the Aussie Navy and wont be coming to live with us anyway....but....I dont want my son not being able to come live with me (even if he is 22) when he wants.... :blush:

I was thinking Ill just leave him off all the forms etc and he can apply later if needed...if he is able to ....


He only needs medical and PC if he is getting a visa (medical is only valid for 6 mos.)... when/if he decides then get it done. Don't waste your money until you need it.

If he is past the one year mark, then if the stepparent/stepchild relationship between him and your USC spouse occurs BEFORE he turns 18, then your USC spouse can petition for him.... if it occurs after he turns 18, then you can petition for him, but it will take several years to wait for an available visa number (or you will have to consider becoming a USC (when eligible) to possibly speed it up).

It's not my intention to argue, I have more important things to do. AND I certainly don't have to justify my opinion to anyone.
These are all just opinions and different experiences (99% of posts)- definitely not rules of any kind. Only people who know the actual rules are people working with USCIS, NVC or embassies. So, just leave people who are posting alone and no offending, please. I really think that we are all much or less the same.


I will back up my "opinion" with a USCIS source (ie. Instructions to the I-129F):

Translations. Any document containing foreign language submitted to the Service shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English.


Does not say any REQUIRED document or any document EXCEPT e-mails.... it simply says ANY...

I bet that there's no one in USCIS speaking that language yet there certainly is someone speaking Spanish. Do not worry about e-mails and chat logs- those aren't official documents so there's no need for translating them. If you are in the process of preparing your I-129F packet I really don't think you need your fiancee's Birth certificate, all you need from the person you are petitioning for is her G-325A biographic form (signed), Letter of Intent to Marry (signed) and visa type picture taken within one month (30 days) of filing for K1. If you aren't sure about what to send :guides: , they will help a lot.

You do not need to translate e-mails and chats because you DO NOT need this type of evidence for the I-129f.... If you include non-English evidence and you want it considered for the USCIS then translate it... If you do not translate non-English documents then do not send them... they will be ignored...

You can track a money order by calling there 1-800 number and following the promts, it will ask for your tracking number which was on the money order and the receipt stub which you should still have. Enter that number when it is asked for and it will tell you if your money order has been cashed.

Your Notice of Action (NOA)from the USCIS is the definitive way... The ability to early track will depend on who your issuer was... however most do not have a tracking system... you simply call them... hit or miss if they can give you the answer. That is why a personal check is the payment method of choice if you want to know anything before the NOA
