Follow the instructions!!! The Dallas address is merely a mail intake center that will open the petition, log it in the system and forward it to the proper center for processing

K-1 Fiance(e) Visa Process & ProceduresDid everyone receive a notice from NVC

Just thought of something, I never received any notice from the NVC. Once I got the NOA2, I know that USCIS will sent my files to the NVC which then sends them to the local consulate (which is China in my case). Before I thought of contacting the NVC to inquire about the progress, my fiancee received the packet 3 from the consulate. And we went on from there. So I never got any paperwork from the NVC. But from reading people's timeline here, it seems you all receive some notification/paper from the NVC. So I'm wondering what did I miss. Is it something important, something I should have? Will I need it in the future, e.g. for AOS, green card interview, etc?

nothing you would have received from NVC is needed later on in the process....

K-1 Fiance(e) Visa Process & Proceduresk1 visa

Hello to all, my fiance just received her visa from Ankara. Two questions, one, visa says petition valid until 11/29/10, and expiration 01/13/10. Does this mean she has to be in USA by Nov or the Jan date?

Next question, instructions sent say "please do not remove the immigrant visa page from visa envelope" what does this mean? She called me all confused and i don't get it either. We understand first instruction not to open envelope, but don't understand the second part which i quoted above.
All she received was yellow packet (do not open), her passport with visa, and all the paperwork we sent and took to embassy.

Any help will be greatly appreciated, and as i am back in the USA, tough for me to help when i cant physically look at what she's talking about!

petition expiration is no longer a concern as the visa was issued... she must enter the USA by the expiration date on the visa itself

K-1 Fiance(e) Visa Process & ProceduresAh I just realised I'm a big idiot!

On the I-129f and the G-325a's I listed our county as the state/province because I forgot Ireland had provinces!(Grr I can't believe my Fiance didn't say anything when I had him look over the forms!) Are we going to get an RFE for this? If they don't notice should I make a note of this mistake on the next set of forms so they don't think I'm providing conflicting information?

If they believe it is important they will RFE but I doubt it, I doubt the USCIS knows the exact particulars of each and every country in the world...

In the next phase have your fiance fill it out properly...

Congratulations!

But I'm wondering why they would ask her how much you make. It then makes me wonder what kind of information I should provide my fiancée before her interview. Interesting.

It depends on the consulate, consulate officer and case... My wife's visa application was the "bare" minimum required and she was asked zero questions...

Not based on your description of reason for the denial.... something like misrepresentation in a previous visa application that was denied would

K-1 Fiance(e) Visa Process & ProceduresTranslations for the I-129F Petition

I doubt they'd be fine with him translating them himself. In the US and in Romania a notary cannot certify documents for their own personal legal use. My fiancee is a certified translator but we still had to go to someone else for her docs in order for a notary to certify them.

Hundreds of people on this site alone have done exactly what the OP is asking about.... For USCIS purposes it is OK!

K-1 Fiance(e) Visa Process & ProceduresTranslations for the I-129F Petition

I know that, they're not required. But we'll add them to our petition anyway. As evidence of ongoing relationship. :) We're sending just a few, 5 to 10. I'm aware of the fact that the most important proof for the petition is showing you've met at least once in the past two years. And we have all the proof we need. We're just 'front-loading'... for our peace of mind. :P

Are you worried about the Bucharest consulate for some reason?

FWIW, your fiance(e) if competent in both languages... can in fact do the translations

K-1 Fiance(e) Visa Process & ProceduresPlease HELP!!

3) If the baby is born in Indonesia, then you will need to file the papers to have the child declared a US Citizen and not require a K-2 derivative visa. If the process is drawn out so long that the baby is born in Indonesia, it will not affect the case, but you will need to pay the additional visa application fee and file for the K-2 derivative visa.

Good luck.

A USC does not need a K-2 visa but a consular report of birth abroad and a US passport

K-1 Fiance(e) Visa Process & ProceduresPlease HELP!!

Hello all,

I hope someone can shed some light on the follwing concerns:
I met my fiancee on may 6th 2010, we instantly fell in love. Spent 2 weeks together, then i came back to Washington. June 19, 2010 flew back to Indonesia and proposed! she accepted, and spent 20 days together (at her mom's house).
Now here are the issues:

1)My fiancee has only one name on her Birth Certificate and Passport. (How do i fill out the forms g325 and i-129?)
2) We've known each other for 4 months, but i visited twice already. (will that be a problem?)
3) She's now pregnant with my baby! (how will that affect our case?)
4) She's 28 and never worked

By the way, i'm planning on sending the paperwork this week!
Thank you so much!

1) her name is her name... if she has but one name then "none" might be an appropriate answer on the forms
2) a real relationship is what the CO looks for, not the number of visits
3) no affect
4) no affect

K-1 Fiance(e) Visa Process & ProceduresK2 Details

Does the K-2 recipient have the same restrictions are far as traveling? I understand that my fiance will need advance parole to travel outside the U.S. (3-4 months) but her son who we plan to join later on, will it take 3-4 months for him to be able to travel? We are discussing with his father about future visitation once he joins us.

Yes, K-2 must also have advance parole or GC to re-enter if he travels

K-1 Fiance(e) Visa Process & ProceduresSocial Security

Does anyone know about the social security application process after entering the US on a K1?

I arrived on Thursday (finally...woohoo!) and looking at the K1 flowchart on here it seems that you can get your social security now? However, I am wondering if that is necessary at the moment? If I get it now I can't work anyway? And then surely I would need to apply for a new one once married with my new name? Maybe/maybe not i don't know! So basically what I ned to know is should I go get it asap, is it necessary at this time, or is it ok to wait until I can work?

Also, I already have a social security from 2 years ago when I was teaching here on a J1 - so do i need a new one or continue with that one?

Thanks in advance for info...

numbers are issued for life... if you have one, you do not need a new number... just an updated card for name or immigration status change when that occures

You might want to update the Timeline input section to reflect the new center as Dallas, TX. Soon, we will not be able to submit to CSC or VSC anyway.

Note to OP:

Dallas is a mail intake center only.... they then forward to the correct service center (ie. VSC or CSC)

K-1 Fiance(e) Visa Process & ProceduresDate of filing ( I-129 F , question 11)

Hi everyone. This is my question: Is "date of filing" the same as "priority date"? In the past,my fiancé got married by applying for a K3 visa. Now, he has a doubt in I-129F Q. 11 Part A about "place and date of filing" ..It is supposed that "place" is the State(for instance, TX)but regarding the second one, is the "priority date" stated in NOA 2?

Thanks in advance!

Use the priority date and for the place of filing would be the USCIS service center it was sent to..

K-1 Fiance(e) Visa Process & ProceduresRequest to open provisional file

I am about to file our I-129F and I noticed some where on this site that after the NOA2 has been received that you should FAX the NOA2 to Embassy (I think along with a letter stating the I-797 received, and a Request to open provisional file).

Can someone please clarify this? I just want to make sure that I know what is needed when we reach this point I know that it is a ways off since i have not submitted anything yet but if I can learn anything to make it go smoother I want to know about it

Thanks.

K-1 Fiance(e) Visa Process & ProceduresK-2 Colombia questions

Please forgive me for not slogging through the entire website for the off chance I will find the answer to my questions. I have found that too many posts are old or not specific to our situation or consist of more congratulations than actual info.

Here is our situation in a nutshell.
Today my fiancee was denied her visa due to not having the paperwork for a medical exam for her son (13 years old). OK, I'll take the hit on missing that info and the extra cost of flying back and forth from Medellin AGAIN!

Here is my question: They told her today at the embassy that she has to make an appointment for her son's medical exam IN BOGOTA! Is it absolutely necessary that he needs to fly to Bogota for a medical exam?

I have read nothing about anyone under the age of 14 needing to go to Bogota for a medical exam or to the embassy. It is bad enough that I have to pay for another trip for my fiancee without also needing to take her son out of school and paying for his flight too.

(For anyone who also may have missed the info, you must pay for a K-2 visa and meet all of the same qualifications as for a K-1).

Also, I have read what appears to be conflicting information on the travel.state.gov site stating the the K-2 visa follows the same criteria as a K-1 (which would be good for 6 months) then in the next sentence it says the K-2 has 1 year to join the K-1. So if he gets his K-2 in September can he join us in the USA in June of the following year?

I appreciate any insight that can be provided.

Nooch

A K-2 applicant must apply and be issued a visa within one year of the K-1's issuance... after the K-2 is issued, the visa holder has 6 mos. to travel

K-1 Fiance(e) Visa Process & ProceduresOverstay, K2 Dad is US citizen, K1

the overstay was 5 years and she just left without marriage

The child was born in Sweden, the father is a US citizen

The overstay and departure resulted in a 10 year re-entry ban for your fiancee... Yes it will impact the issuance of the K-1 and will require a waiver.

The child simply being born in Sweden is not a final determination of whether or not the child is a citizen or not. Citizenship can pass as the result of parentage (ie. at least one parent being a qualified USC at the time of the child's birth). You will need to sort this out as the consulate will not issue a visa to an individual who is a USC.

K-1 Fiance(e) Visa Process & ProceduresLiving in Ireland

Hi guys.

I am engaged to a US citizen and we were finding it hard to find a sponsor for the affidavit of support. We needed one because my US citizen fiance is living in Ireland and we plan to move to US together, so he couldn't sign for me.

Now I'm wondering if the person who agreed to sponsor us needs to file the affidavit for both of us or just me?

Also, would there be any complications about applying for K-1 visa seeing as my fiance is living with me in Ireland and not in US? can he still file to bring me over with him?

Thanks for the help!!

A USC does not need sponsorship as they are not the ones immigrating but simply returning home

K-1 Fiance(e) Visa Process & Proceduresk2 visa questions

Yes, you can do that. As long as he comes within 6 months and you are pretty well locked into that. They do not have to come together, she can come first. In this case he, technically, is not a "K2 follow to join" he is "accompanying". It was not an option for us because of the timing, but I suggest just doing one interview if you can. Why repeat the whole thing twice?

Thanks. Glad to help others in the same boat, especially when they have children.

She MUST go first (or concurrently)... The K-2 CANNOT go first ...

Certainly requires you to keep track of and make sure you accomplish a few more items, that is for sure... Regardless, you MUST make sure you marry within the 90 days or everything else behind it, as it relates to the 18 year old son, will fail.....

K-1 Fiance(e) Visa Process & Proceduresk2 visa questions

I will be filing my fiancee's visa in just a few short weeks when I have all the paper work finished. her son who is 18 would also like to come at a later date. what is the process to bring her son also? I will have him listed on the I-29f and the I-134 when the time comes. will I also need a G-325a for him included in the packet? Will he also need to attend interview with his mother or at a later date? I know he will need the same documents plus a military waiver ( he already has). since he will probably travel here when University lets out for Summer, should we wait to adjust her status until he is here?

Listing on the I-129F is all that is needed... No G-325a needed. He will attend an interview when HE applies for the visa.... He must apply and receive the visa within 1 year of his mother's visa issuance. I think Gary (of Gary and Alla) said that his wife had to have her status adjustment completed, (he had a K-2 follow to join) issued by Kyiv... Hopefully he will happen by and clarify

usually, its a photocopy OF the certified copy, showing stamps/seals/clerks signatures (whatever certifies it).

Without showing a seal, expect an RFE, later. Usually.

Must show the certified copy on interview day, though - don't forget that one.

For the beneficiary maybe, but rarely for the petitioner
