I am in the process of compiling my I129F forms to submit hopefully tomorrow. I have one question I hope someone could answer. My fiancee has sent me 2 passport photos of her and I had 2 made of me. One of each goes with the package I am submitting but I was wondering what do I do with the other one I have of her and of me? Do I include in the copy I send to her once I129F is accepted? Any help is greatly appreciated!!

You can only have one marriage license,one marriage certificate and one official marriage event. If you do as you plan, the official one is the one you do in the court and is the official marriage event is the one that you base your AOS on... you can have as many celebration ceremonies as your heart desires and the USCIS does not care about anything other than the one that is the legally recognized one.

You are never FORCED into doing something you do not want to do.... Even if you cannot get it stopped at the USCIS, you can stop it at the consulate before the visa is ever issued.... Even if the visa was somehow issued you NEVER have to say I DO unless you want to

Because it seems pointless to wait another few months, only to have our application turned down due to the lack of a sponsor, we have been wondering whether or not we should void it and go for a K-3 or other visa instead. We want to get married and continue our life together in the U.S. It is that simple. I do not know if there are any other options besides the K-3 (perhaps there are lawyer firms or other establishments that would sponsor people in return for collateral and a certain fee?). It would certainly be preferable to continue on our current course so we may be together sooner rather than later. My fiancee and I would love to hear your thoughts on this matter.


It would be pointless to stop the K-1 and start a petition for a new visa, because an affidavit of support is required for them all.... A sponsor must be a qualified person not a company or organization

First I'd like to say hello to everybody and thanks for all the help that we have received by reading this website and these forums. They have been a huge help. :)

Today I mailed our I-129F Original Submission, and we are trying to plan ahead for the next round of paperwork.

I am a native U.S. Citizen and my fiance is from Japan. She has been to the U.S. many times going back to her childhood. Every time on tourist visas, just brief one week or less trips. She has had three passports in her lifetime, but she only has the last two passports. We are trying to locate the "childhood" passport, but it looks unlikely we'll be able to find it.

What I would like to ask is: does anyone know where to possibly find her old trips and how important it is that we list her trips to the U.S. that she went on as a child and/or teenager?

few years ago i met some so special to me through the net.
she is US citizen and we contact with each regularly.
recently we have decide to get married.
she even suggest for me to come there in the states, but we dont know how and what to do before we apply any visa.
i have looked through the net and i have found out the difference between K1 and K3.
so my question is, is it necessary for us to meet in person before we apply for K1 or we can apply while we havent met yet.
and my second question is that, if we go for K1, does that mean i have to go back to my country to do the processing or i can do the whole process while i am still here in Saudi Arabia. cause here in Saudi Arabia i have work/residence permit/visa.

One of the basic requirements for a K-1 is a face-to-face meeting.

You can be interviewed at a consulate in the country that has jurisdiction over your legal place of residence

If you are stationed on an base that is U.S. imminent domain and considered US soil. She could come to you at that base and you could be married on the base and it would transfer. USCIS would recognize this as a legitimate marriage. As always, if you call the USCIS and ask them directly you can find the official answers to these questions from the USCIS directly.

Hello I am worried because im about to leave soon but she dont have a interview day yet. I read she have 6 month to depart her country once the visa is approve then the 3 month here in USA for a total of 9months window for us to get married.
but im worried I wont be able to come back on leave because next year would be my last one. because I be over there for about 6months I dont know if they would let me take leave since Im not gonna be there for the full 12 months.

any visa extension needs occur before she arrives... there is no extension to the 90 days after arrival. Period. Simply explain to the consulate the reason for the extension request. Any extension request is at the discretion of the consulate and I would think you being deployed would be a pretty good reason

Your chances were nil if the USCIS did not approve the petition...

The USCIS's role is to determine eligibility for the alien to apply for a visa. It is the consulate's task to determine eligibility for the issuance of the visa. All that has been accomplished so far by the USCIS is that your fiancee is eligible to apply. Nothing more.

I went to cvs to get my passport photos. I asked for 8 passport photos(just in case guys). So she took the picture of me. I paid..done!

I did not open the package with the photos until I got out of the store and that was when found out that she did not cut them for me. She gave me 4 sets on separate print papers. 2 photos per print paper. Will that be a problem? or should I go to another place to take new photos and ask them to cut them for me 2x2?

Hello everyone,
I appreciate any help you may give me on this matter. My fiance is awaiting the information to be sent from the Polish consulate. We filed the I129F which was approved so we are now waiting for him to be granted a K1 visa. His sons are now 18 and 12 and their mother was given custody after the divorce. He did not wish me to put his sons' names on the I129F since they could not come because of the custody situation. So, on the form I indicated that he had two sons living with his ex, but I did not name them specifically. So here are the questions I have. Will the younger son be able to come as immediate relative (no waiting for visa)when he turns 18? Will the older son be able to come with his father or must he wait since he was not actually named on the petition and is already 18? Will he have to wait years for a visa number to come up? The only way for the 18 year old to come immediately is as a K-2. Otherwise he will need to wait until his father is eligible to petition for him

FWIW: The I-129F says list ALL children... not just children that will immigrate. I am continually amazed as to why people do this only have it come back to haunt them and they wish they had done it correctly the first time

Hello I been looking for what is the minimum salary to make sure I qualify and that I dont need a co-sponsor.

also as Im filling the form I have a question regarding #2 I was born in Puerto Rico as part of U.S.A making me a U.S. citizen. should I type the day of my birth day or the actual day I move here (to USA).

my W2 show a different amount of money compared to question #7 (annual income) because there some money that is not taxable like the one for meals. because im in the Military.

Do you think it is fair to say that it depends on the country you are applying from as to how long it takes to process a K1?

I'm living in France, and I would suspect that there wouldn't be as many K1 applications from there as there would be from the UK for example. Most French do not speak English very well, so American Franco relationships would be quite low in comparison.

Do you think that this would mean that once the US embassy in Paris receives my application, that the time taken to process will be quicker?

(Hopefully the Americans in Paris haven't been affected by French bureaucracy and the age it takes the French to do the simplest of tasks ;) )


The Dominican Republic used to take 12-18 months...

Manila (the busiest consulate for K-1's), is 3-4 months for an interview

Montreal, takes 6-8 months for an interview

Kyiv, which is in the top 10 or 12 for K-1's is currently 3-4 weeks.

If somebody has never been petitioned for before... an alien registration number has not yet been assigned. The "A" number is a unique identifier for the alien, sorta like an SSN but for immigration purposes.

It typically is assigned upon petition approval and will be listed on the approval notice. It is identified as Alien Registration Number or "A" number. It is NOT any control number, petition filing tracking number or anything else other than "A" number

i think our situation is unique but i'm hoping that someone has information for me or has been through something similar. My fiance has been living in Spain for fours as a refugee. His home country is Gambia. We have filed the I-129F petition and have received the NOA1. In the packet I submitted I requested that the embassy in Madrid process the K-1 visa, however my fiance is out of status in Spain. I think he was legally allowed three years as a refugee in Spain. It is not in his best interest for many reasons to return to Gambia before he has been issued the visa to come to the US. My question/concern is if he is out of status in Spain will they still process the visa there? Will the US embassy care that he is out of status? Has anyone else had their K-1 visa processed at an embassy other than their home embassy? Any information/help is greatly appreciated to ease my never ending worries.


You can process at the Consulate who has jurisdiction over your current legal place of residence... the "out of status" situation might be a complicating matter for the consulate in Madrid...

Are you writing a love story? The intent letter need only be short and sweet... "I intend to marry may fiance(e) within 90 days after arrival to the USA." That is all. Period. no need to be "mushy" or tell them how or even what the wedding plans are.

Include the child just in case you change your mind. At the end of the process you will be asked if the child is coming with your fiance or you can list the child as follow to join and they can come in up to a year. This doesnt mean the child has to live with you permanently, just grants access to the US to visit the parent. This is your fiances' child, there may be summer visits or holiday visit, listing on the visa will grant the parents status to the child. You've got nothing to loose, plus as the child grows up you are giving him/her access to the US which can make his/her life easier!



A I-129F is a petition for eligibility for a "K" visa, which is a visa to allow potential permanent immigration to the USA. Listing the child on the I-129F does not give a child, as you say, "access" to a visiting visa or "access" to the USA in any other way than a "K".

I am preparing to file form I-129 F on behalf of my fiance, but I have a question regarding question #13 which asks to list all children (if any) of alien fiance. My fiance does have one child, but we do not intend for this child to migrate to the US since the child's mother has physical custody. Also, I would not want to go through the additional expense of obtaining the K2 visa for my fiance's child if he is not going to come to the US to live with us (in other words, what would be the point of obtaining a visa which will not be used). So, can I simply not list any children or would this omission be interpreted as lying? If I list the child on the form, is it assumed that I am seeking a visa for him, too?

Thank you in advance for any input. I would particularly appreciate the advice of people who experienced a similar situation.


The petition is NOT a visa application...listing a child on the petition does not mean they will apply...

the form is very clear ... ALL CHILDREN... If they wanted you to only include intended visa applicants they would indicate so... but they don't... they say ALL

Two possible options.... If he wants to come within one year of the issuance of your future wife's K-1, then he can come as a K-2. You would simply contact the consulate to start the process.

If you become his stepparent BEFORE he turns 18 and it is after the one year mark of the K-1, then you as the USC step parent can petition for him via an I-130.

Im new here, but after read and read all the post im very sure u guys can help me a lot.
All our process has been with a lawyer help. but since 2 weeks ago my fiance received the approval of our process for a k1 visa. The lawyer told us that i have to call to the embassy in Bogotá and let them know about our approval. the embassy's people said that now i have to wait until receive a instrutions package. But im waiting and waiting and im still without any new. At the beggining of our process the lawyer told us that after the approval all the process is almost done,however i have read about the intructions in the embassy webpage and looks like it will take longer. Im very anxious!!! Someone have any idea what's going on there?

Your petition was approved but your K-1 visa has not yet been approved because you have not yet applied for it... you are about half way done.... your next step is to gather the needed documents and actually apply for the visa

No one can ever say because they will NEVER refuse a visa, if you are by age, eligible for the visa. If they question the age difference, they will document another reason (ie.. lack of bonafide relationship) to refuse the visa. It will never be specifically documented as age gap.

I am new...I am sure that you can tell. Lol. I am American, and my fiance is English. I live in Tampa, FL. We have just started the process of getting all of our ducks in a row to file the I-129F, and I realized that I don't even know where exactly I should be sending it!
