Well, its official, after almost 5 months of feeling confident that the forms, pictures, phone records, and hotel bill would get me to my baby, an RFE is released in our names. Still havent seen the list of things they need, but I am not sure what else we can do to prove to them that we are in a comitted relationship.....

I do think it's BS that showing receipts from dinner and movies and gass bills are accepted forms of primary evidence, yet time stamped photos are secondary along with phone records.... It shows us together, and how often we talk to eachother..... :(

I have seen stories of other people on here with less evidance getting accepted, and it disheartens me to see my RFE. I can't really show passport stamps, because they just give me a quick scan and send me on my way.... what else can we include to prove beyond a shadow of a doubt we are together, and want to be for years to come?


uscis is only concerned with determining eligibility for the petition to be approved. phone records of how long you talk does not help in any of the categories for determining petition approval eligibility

hang on...your i 130 i-129f was only accepted meaning it will be processed..you still have to have the final approval...then you submit your evidence...however that said you can work on collecting evidence over the next 5 months because it seems it will be taking about that amount of time if not longer for approval...

Once your i 130 i-129f is approved THEN you submit evidence and they arrange an interview...

ok i applied for i129f back in august 2010 but i got married to my fiance in 11/2010 any how long story short i had to submit I130 cause they told me forget about the i129f since we r married now which idid in 12/2010. guess what they asked for RfE for the I129 so i sent it to them and wrote them a letter saying that she is my wife now and not my fiance. today i got a txt message saying they approved the I129f ???? are nt they suppose to deny it since she is my wife and there is a pending I130 now ? and if they approved it does that mean i can use it or what ???? its so confusing dont know what to do i did not lie to them i even sent them a copy of our marriage certificate with the evidence they wanted for the I129f !!!!


no you cannot.. the petition might have been approved but their is still no visa.... if you tried to get a visa based on the I-129F it would be refused by the consulate as being no longer eligible

Thanks for the info and encouragement from everyone. I just got off the phone just minutes ago with the NVC (603-334-0700) and representative (by the name of Penny) told me (based on the verbiage on my NOA2) that my petition went straight to the Consulate. I asked her again to confirm, "..so, it's possible for it to go straight to the consulate and not stop at the NVC for an I129F?" and she said "YES". So there you have it folks, she said it possible and that is was the case with my petition.


Trust me, Penney is confused... It is impossible for the petition to go straight to the consulate... It requires to be assigned a consulate case # (which is different than the USCIS case #). This is ONLY done by NVC.

I was just confused cause I've been reading that the packet goes to the NVC first and then the consulate but my letter from USCIS said that they forwarded it to the consulate. I was thinking that this happened because I had an approved expedite request with USCIS.


The USCIS belongs to a different department than the consulates... USCIS does not have the ability to send directly to the consulate because they do not know which consulates do what visas.... that is the job performed by NVC. NVC gets the petition, assigns the appropriate consulate and it moves on...

No offense, but the only way it goes "straight to the consulate" is via the "gateway" to the consulate system. Would you care to know what the "gateway" to the consulate system is? A place called NVC.

Police Certificates will be issued directly to the applicant from the local Garda Station, not Garda Headquarters and the Guarda Headquarters stamp will no long appear on the Police Certificate.

I'm currently staying with my fiance in London, and we got our NOA2 email last week, and my roommate back in NY (whom I trust and has been watching the mail for us) said the hardcopy arrived yesterday. She's going to send it to me here in London since I plan to be here through his interview. Should I instead ask her to scan it and email me that, and hold off on sending? I've read through the guides again and from what I understand, I won't be sent anything else; I just need to get the I-134 (which I think I have to get from the embassy here) and get to working on that. I know he needs a copy of the NOA2 for his interview, so should I go ahead and have her send?

I'm getting ready to file my I-485 for adjustment of status. I am wondering since I'm going change my last name, can I change my FIRST name as well. My name is hard to pronounce so I decided to go with an English name. The problem is that nothing on any of my legal document has that English on them. Should I just stay with my non-English name? I'd really love to use JUST my English name though to avoid a long name like Shiao-mei Cindy W. Shaw.


Name change is not a federal immigration issue but a state law issue... google "name change marriage <state>"...

In MN it is very easy to do when you marry... My wife changed the spelling of her first name, adopted a middle name and changed her last name... In other states the process maybe anywhere from simple to complicated

I'm sending off all of the documents and required evidence for my fiance's interview. The file weighs about 7 lbs with everything I've put in it (including co-sponsor's documents JUST IN CASE). I looked online and DHL wanted over $120 to send it, UPS and FedEx had the exact same rates (SHOCKING) at $139 and $148 depending on the services I chose. USPS is between $48 and $65, but it can take a couple of weeks for it to get there (my last pkg from him took nearly a month by Royal Mail, and it was open when I got it, so I'm a little skeptical about sending it through the regular post). :wacko:

Does anyone else know a better/cheaper route?

If you leave the US (even to a US territory) you run the risk of the IO not letting you back in the country when you come back. The "At Your Own Risk" category is fairly accurate. The K1 visa is a one-time-only entry visa. If you leave the country and try to come back in, they could tell you you've used your visa and have to go back to your country and apply for a spousal visa instead.

Play it safe. Find a nice place to go that isn't outside the US (Hawaii might be a nice option) and get to know your new home. There are gorgeous resorts in Florida, California, pretty much any coastal state that would give you a nice get-away for your honeymoon without risking your visa.


PR and USVI are not considered leaving the "country".. Flights from the mainland to PR and USVI are domestic flights without any IO when you arrive

One more question about kids, Their mom never married but dads name is on older boy's Birth Certificate (Mexico)
We will get dad to sign for passport (no problem) However what will we need from him when it comes time to take a minor child across Mexican border with only one parent???
*Do we need a notarized paper of some type? Should we get this ready now?

I -129f that I filed in behalf of my fiancee was denied because we did not personally met within the 2 years preceding the filing of the application. I filed the application on february 2010, we've been dating since 2003 but the last time i saw her was nov 2006, although I went to see her on may 2010 while the petition was on process. I got a denial letter on june 28 2010, letter says it was denied due to not having personally met within the 2 years before filing the application. my question now is, is the denial letter final?do i re-apply or rebuttle?and if in case i re-apply, can i do it immediately or is there a waiting time before you can apply again after a denial? pls help...


re-file based on the recent meeting... any the rebuttle will fail because you were deemed ineligible as of the date the first petition was filed, and you cannot provide any evidence to correct this finding and prove a meeting within two years prior to the filing date.

My wife needs to travel back to Belarus to accompany her son to his K-2 interview, which is not yet scheduled. The issue we have is that she needs her AP to do so. It has only been one month since we sent out her application ( along with her AOS and EAD and have recieved back the I-797's)but because her son will age out soon, we need the AP in about another month, and cannot afford to wait for the normal processing times.I think, and would appreciate advice on this, about going for an infopass appointment, but will it make a better case if we did ask for an interview date and bring that with us to the infopass appointment? make an infopass appointment and ask for expedited AP... bring all you AOS paperwork to show that you have an actively filed case.... an interview date scheduled for the K-2 will certainly show an emergent situation

Ok,again,this might sound weird,but we never received any notification until I got Packet 3 from the US embassy here(I am the beneficiary).When my fiance called the hotline and explained the situation he was transfered to a supervisor.The lady told him the petition was approved on 06.25.When we finally got the posted NOA 2 it was 07.12 so we never knew the date when the case went to NVC or anything.However what's weird is on the website of USCIS the status never changed.It still shows they received the RFE on 06.09 and we should wait for a response.It didn't change even after my fiance and was advised by a supervisor the petition was approved,in fact at first when he called the regular customer service told him what's on the website.So I'm wondering should he call them again and ask them to updated our case online so we can keep track of it or should we leave it like that.It's just really weird I think.Since it's an electronic system and every "touch" is supposed to show when they scan your case ...
Any advice ?

There is no more tracking online with the system anyway beyond petition approval... as your case travels to the Department of State via NVC and then the consulate. NVC and the consulate belong to a totally different department than the USCIS. NVC/DOS/consulate do not have an online system

The USPS received notice is the official notice.... the electronic system is not... my petition status did not change online until after the consulate had the case file for two weeks... don't worry about it...

Still no NOA2. We filed over four months ago. No Request for Evidence either. Very frustrated and distraught.. our plans for the Fall are falling apart.

I would simply indicate both, but let me ask you a question... Which passport will he submit to the Consulate for the visa? The answer to that question is the one I would indicate first and foremost.

Hello to all of you. I am new to this forum and perhaps this question has been asked before. I have read the IMBRA regulations and I cannot find the crime I was convicted of in 2005 (Theft by a bank officer or employee) is relevant. But I am wondering if this will have an adverse effect on my K-1 Visa filing. An immigration attorney is aware of the Felony conviction (I have completed my sentence and probation) and says it should present no problem but may need clarification if my name comes up on a criminal background check (I am assuming it will).


If it is not an IMBRA crime or an AWA crime it will not have an effect on the petition.... FWIW, AWA crimes are the only crimes that cause a USC to be ineligible to petition
