You need to do a lot of reading and you can start with reading the guides (top of any page) click on guides tab.

I-129F pritition is something the USC does first in order to prove that the alien fiance(e) is eligible to apply for the visa

The K-1 visa is the actual visa that is applied for by the alien fiance(e) at the consulate in there country of residence. You cannot apply for the visa until an eligibility petition has been submitted and approved for you

For you the US Embassy is in Manila... The Embassy website will have all the info you need to file and pay for your K-1 application once your petition has been approved

I am filing for a K1 visa for a different person. The instructions says that since I filed for a K1 visa within two years that was approved, I must apply for a waiver. It doesn't mention how to apply for a waiver or where to apply. Where do I find waiver forms for a K1 visa and where do I file these forms?


no form... you simply write on a piece of paper the previous beneficiary info, facts and particulars as to what happened and close with I hereby request a waiver of the multiple filing limitation.

So even if returning to college is the best, and most rational decision, and even if I own my house with no mortgage and have plenty of savings/assets it sounds like a "no-go."

If this is the case, is the "other way" (remember I am truly new to all this) getting married in Thailand an option that will allow me to do the college route? Or must I wait a year on college, and take a job (which I can get but which is out of my career path) to meet the income requirements.

My 2011 filing in April for 2010 will show a net income of over $50k, but 2011's income will, most likely show only unemployment benefits which I assume is not usable.

Let's use this as a scenario: Let's say that in September of this year I take a contract position that earns $60k/year (outside of my residential area) so immediately I'm back in the "financial capable" ballpark, but now...how long must I be in that job to meet the requirements.

note: If this sort of scenario is covered elsewhere I'll be happy to take a hint as to where to find it... again, thank you.


The financial requirement is there whether it is a fiance(e) visa or a spousal one... the one difference is a co sponsor... in a spousal visa the idea of a co sponsor might be a way to workaround BKK's normal refusal of such as NVC does accept co sponsors

It's very early in the process, so early that I haven't proposed (Valentine's Day is coming up), but still...

Reading on the K-1 requirements I see "minimum income" required at 125% of my state's poverty level, whatever that is for the state of NH--I haven't a clue.

I'm an RN and until mid-September I was a clinical supervisor for a major corporation so income was no issue.

The company I worked for closed my unit recently (forever) and now I'm unemployed. This is a perfect time for me to return to college on my career path so I have begun that process. Unless I find a good job (unlikely) in my area, I'm scheduled to return to college next January to become a Nurse Practitioner planning to graduate in Jan 2014. It is a two years Master's degree course and which will give me one of the top sale-able degrees in the country. I have no doubt that I'll have several offers before I graduate in 2014.

I have plenty of savings and about $26k income from an apartment house--but that's gross income, not net so I don't know if that would count. I'll be attending college at no tuition cost (under a grant available for my nursing sub-specialty) and may be receiving a small monthly stipend for some teaching duties.

Between now and then I'll receive unemployment compensation which will end when I start college. At that time I'll live on savings for the duration of the two years of college. Due to the sub-specialty nature of my nursing skills (occupational health) it is unlikely that I will find a job in my area since manufacturing has been totally trashed.

Now I am beginning to wonder if I must put off college and take an inappropriate (for my skill level) job simply to meet the income requirements until the K-1 process no longer requires that I earn a minimum amount.

In the next two months (assuming she says yes) I'll be engaged and during that time I must commit to this college degree--or not.

Any suggestions or comments would be appreciated.

She's from Thailand if that makes a difference and has no salary history as she works for her family.


The USC's requirement for a minimum income requirement is not based on where the fiance(e) is from. What will make a difference for you is that the Consulate in BKK will NOT allow anyone else to sponsor her other than you. If you are not eligible, no visa.

As for you apartment building income... it is NET after expenses... basically look to the amount on line 22 of the 1040 and how it would be calculated

Thank you for all the info. In regards to the permission from other parent. My fiance was never married to her sons father. He basically is a dead beat dad that abandoned his son about 10 years ago. He has recently made contact with his son and communicates with him ocasionally by telephone. He never gave any financial support until recently as well. What he does offer is peanuts. To the best of our knowledge the father is living illegally in the US, but his whereabouts is unknown. We think Miami.
We can make an atempt to get permission from him, but I think it will be difficult. Is there any other option to show that my fiance has sole custody and that the father abandoned the son?

Second, you'll need to report the 1st K-1 and make sure your current fiance is aware of the previous K-1 and marriage

A K1 visa might not require it but certain countries do, just like some countries require tax returns for the I-134 when they aren't actually a requirement of the form. To get the K1 visa, Australia requires you to have your immunisations up to date (except if you're pregnant already of course), Australia does not require tax returns for the I-134.

Distance means so little when someone means a lot to you and we will do our very best to do what we can just to be with each other and to be as one. He'll come visit me on Feb and we will start the K1 process when he goes back home. Although I have a little concern which I am worried. Part of the requirements of a K1 visa is that "at least you and your fiance/e have known each other for 2 years" What if not? What happen if I don't meet that requirement? Is it REALLY required? How many of you here have processed the petition even if you and your fiance/e have not been together for as long as 2 years?

I assume you are the beneficiary? They will probably ask for any court documents you have and everyone needs a police check for their interview. As it is a drug related offense you might/probably will be denied at least initially and you will have to file a waiver to get a visa. What embassy will you be interviewing at?

I had did have an arrest and conviction 1time in the mid 70's for a controlled substance. The question ask if you had 3 or more arrests so I answered the question no. Can anyone tell me what might happen when they do the background check and find this arrest? Will they ask for any documentation and if they do what kind of documentation.

My thinking is that it is better to spend the $20.00 or so to get the certified copy and avoid the RFE.

The K-1 is a fiance(e) visa.... The alien needs to enter the USA on that visa as a fiance(e) NOT a spouse... If you want to marry and have your spouse enter as a spouse then you need an immediate relative (IR/CR1) visa which cannot be petitioned for until after the person becomes your immediate relative

A K-1 visa is a single entry visa. Once your fiance enters the U.S. with the K-1, she cannot leave for any reason without either a green card or advance parole, neither of which she can apply for until the marriage is done. And when she makes that single entry, both of you must be unmarried. So there is no way to marry outside of the U.S., either before or after her entry. You can have a wedding party anywhere you want before her entry; just make sure an official marriage is not part of the party.


Just to clarify, the K-1 can leave for any reason at any time... it is the re-entry after the departure that is the problem without AP or status adjustment...

I just submitted my package and I already have a concern. The I-129 instructions say that I am supposed to send the USPS Express and courier packages to the Lewisville TX address, but I sent my USPS Express package to the Dallas center which is supposed to receive US Postal regular mail.

Does anyone know if may have any problems because of it?

I was wondering what the rules are for travelling during the K1 processing time.

I don't mean just a weekend here or there but going to stay for 30 - 90 days (or however long is legally allowable) in Japan and/or US to be with my fiance while we wait. I would travel back for any appointments of course. We have just applied for my K1 visa so we are in the early stages and don't expect to hear anything back for 5-6 months as per the VSC processing times and really want to spend as much time together as possible.
Being away that long would mean giving up my apartment but will still have a permanent address here and leaving my job which I was going to be doing before the end of the year to move when the K1 is processed anyhow. I just don't want anything to jeopardize the K1 process or any border crossing issues.

Any links to or info you could provide would be very much appreciated. Thx


You can travel anywhere you want... you must meet the specific countries entry requirements but, there is nothing that says you cannot travel. You are going to apply for a US visa... The US does not put shackles on you

I am in the military and I am scheduled to deploy the first week of July. On the 8th of February we received an email notification that our I129F has been approved. She is from Sao Paulo, Brazil but lives in London, UK. From what I've seen from the statistics on this website, the amount of visas and the wait time in Brazil is shorter. Would it be beneficial for us to change the interview location to Brazil instead of London? My concern is that I don't know how long it would take to process that address change cause if it would be equivalent to the difference between the two wait times, then it wouldn't make any sense. However, we would like to be married before I leave in July. Is that even possible?
