It's not a China thing. Any country only has one Embassy in another country and it's always in the Capital City. Consular services are provided at both Embassies AND Consulates. India and Canada come to mind as exceptions to the general rule that petition/family based visas are handled by only one Consular unit in each country. Are there other exceptions?

Consular services are NOT provided at the respective Embassy. They are provided by the Consular section which may be housed in the same compound as the Embassy. In Kiev, the Consular section and the Embassy, though in the same city, are separate physical addresses though close in proximity to each other.

As for countries whose consulate in the federal capital city does NOT provide IV visa services include Mexico, Brazil and Australia to name a few more

According to the US embassy in Shanghai China, only Guangzhou embassy handles Immigrant visas. While technically the K1 is non-immigrant, many consulates (like Australia) treat it as an immigrant visa.

In Australia only one embassy out of the several in the country handles the K1. I had one 3 hours (car ride) from my home but it didn't do K1's, I had to travel 2 hours by plane. Others have to travel clear across the country for it.

There is only ONE embassy in China and it is in Beijing. Guangzhou and Shanghai are Consulates. In Australia there is one US Embassy and it is in Canberra.

While K-1 is a non-immigrant visa, WORLDWIDE it is handled by the Immigrant Visa (IV) sections at the designated CONSULATE.

recently my fiancée and I married in Ukraine. In fact this marriage wasn't official. It was just a ceremony/ banquet with family and friends. However one year before the ceremony we did get a religious authority to document our marriage, and now I wonder should I mention any of this to the USCIS? Will this hamper or strengthen our process?

Unless your marriage was performed at ZAGS office your marriage is not legal in Ukraine.... With that said... it is probably best not to mention anything about a pseudo marriage as you do not want to give any wrong impressions to the uninformed. If they misunderstand your petition will be denied

I am wondering how USCIS works for the NOA2 (K-1) visas. My timeline is as follows:

I129F Applied: 7/23/2010
NOA1 Received: 7/28/2010
Touched: 10/3/2010 (Not touched so far, it's been almost a month now)


When I call them, they are useless, all they say that it takes 5 months to process.
I don't know when should I expect NOA2??

If you are using the USPS it goes to the PO Box in Tx. If you are using UPS/FedX then use the street address in Tx. Tx will intake the petition and send it to a regional service center for processing

as long as he has an address to receive mail all should be fine for the petition... As long as you can demonstrate a bonafide relationship the all should be fine for the visa

The consulate does not nor will they ever officially document a refusal decision for a visa because of age, as that would be age discrimination.

Hello everyone,
How's it going? I have a question for those who had sent in their original petitions with success and no RFE's on how the petition was put together. USCIS recommends the we use ACCO fasteners; I was wondering what size are the correct ones? What are the dimensions? Does anyone have a link to the exact ones because I don't even know what they look like? I sort of have a little idea, but not completely sure. Also do I put the whole petition documents together in one bunch on one fastener or do I separate them in sections? I wish USCIS wasn't so picky, but that's just the way it is. Can't change a bureaucracy, but the bureaucracy will change you. It's sounds like this ACCO company has been favored by USCIS or they are connected, either way this probably keeps them in business. Like the military and Haliburton. LOL. Since the amount of petitions is skyrocketing, it might be a good idea to buy stock in ACCO. Your advice and help will be much appreciated. Thanks.

Thanks in advance to anyone that will take time to reply to this message.

My fiance and I were filling out our paperwork together today and we ended up having a couple questions, mainly with the G325A form.

1. My fiance worked in Taiwan for a few years before coming to work in Canada. She doesn't have her exact addresses for the places she lived while in Taiwan. How important is having the exact address.

2. When I complete the packet for the I129f, where do I send it. I am confused because it appears to list 2 different places to send it. It seems that the uscis website says to send it to Dallas Lockbox. If this is the case then what does the Vermont/California center have to do with anything. Does the Dallas Lockbox forward the paperwork to one of these 2 processing centers? Do we have any say where it goes? This part is just a little confusing to me.

I also want to say that this site has been a huge help in this process. I was thinking about hiring a lawyer to make sure it gets done correctly, but with the information I found on this site I feel confident that I can fill everything out correctly. So thanks to all that have contributed to the site.

Right. I'm afraid I tend to think of the process only from filing to receipt of the 10 year card, but it wouldn't surprise me if about half our members' loved ones decline to pursue citizenship and DO renew those ten year cards. I expect my wife will be one of them who renews.

Nevertheless, an I-90 fee is not of any current concern and will surely be much higher once it IS of concern.

Unless a green card gets lost, the I90 will not come into play in the immigration process.

The RoC fees are $545 each then for total $1625. The $80 for the biometrics fee would be needed at the time of AOS not RoC correct? That is when it is needed for the finance from what I have read.

no, RoC fee's are $545 plus a biometric fee for each.. so for three removing conditions at the same time would be $785.. ($545 + $240 (3 * $80)). A biometric fee is needed just about anytime you interact with the USCIS starting with AOS and thereafter...

***I-129f - $340 - due to start the process.

Month 3-6 Dept. of State Visa Application Fee (paid abroad) $350.00 x 3 = $1050
***The cost of three medical exams (about $100 each) = $300
Month 6-12 Dept. of Homeland Security, USCIS - Adjust Status Fee $1,070.00 + ($635 x 2) = $2340
Month 27-32 Homeland Security, USCIS - Removal of Conditions Fee $505.00 x 3 = $1515
Total Immigration Fees To Permanent Resident Status $5,245.00

I think that shows all the corrected fees. Thanks for clearing that up for me.

New question, I have read that some documents will need to be translated. I have also read that I will not need to have documents translated if the are in Russian, Ukrainian or English. So, as long as the documents are in one of these 3 langauges. It seems like this might be fine for the interview process but will I need some of these documents later for the AOS and Removal of conditions? If so, I should probably have them translated now and be done with it. Anyone have a recommendation for a good certified translator?

translation services are all over ukraine and in most every city.. you fiancee can find one easy enough

don't forget that the biological father of the kids need provide his permission for them to emigrate from ukraine

So, my research is right so far and it resembles your list there with the exception that I will also need to pay $635 for each kid for the AOS as long as I submit them when I file for her AOS. So this adds another $1270 to your $2,265 for a total of $3535. I think the best news is that my research has provided the correct information. Still a little surprised the government will let the kids come for free except for the $1270.

no kids do not come for free... you will also pay a $350 per K-2 visa application fee to the consulate and a med exam fee (was about $100) per to the clinic

1. How do I know where to file the paperwork?
2. When it asks where I will be applying? is it always Montreal? for Canadians
3. I have 2 small munchkins that will be coming with me..Is there extra paperwork? I see the spot on the K1 to list them but is there more paperwork? or is that at a later date? haha Im assuming theres more fees somewhere for them?? Do they require medicals as well? interviews?
4. After we start the paperwork am i still free to travel between the border like normal or?? Looking at going to visit in March..Do I tell them we are engaged or just?? help

1) initially you don't file any paperwork, the USC must start the process. The location for him to file is in the form instructions

2) for a K-1 it is Montreal or Vancouver in Canada. For Ontario it is Montreal

3) not at the beginning... when you go to Montreal then yes they will have there own application

4) sure, but just like any other time you could be denied entry.

Qualifications for a K-1 visa are quite different than qualifications for a tourist visa... To qualify for a tourist visa, the applicant must demonstrate that they do NOT have intent to immigrate.. A previous K-1 petition/application specifically shows an intent to immigrate that would need to be overcome. It can be done but you must understand that she has a hurdle in front of her

Does he need to send me photocopies of his : I.D., Italian residence documents, Ivoirian Birth Certificate, Police Records and Passport, for the I-129F petition?

I didn't see any of these items on the V.J. checklist. I wasn't sure if he will need this stuff for his interview. He has everything at this point except for the police records and passport. Should he just bring these once he has his interview, giving him more time? (they're 'processing').

1.it can define where you can live afterwards for a couple of years as long as you have a green card,as far as i know ( correct me vets if I' m wrong) as long as you have a green card you have an obligation to live in the states at least 6 months a year or else you'll be abandoning it.if you apply for k-1,when you arrive in the states you'll be applying for adjustment of status,when it gets approved you'll get a two year conditional green card,so at least for the first two,three years,you cant LIVE in any country other than states.


A conditional residency card has nothing to do with living in the US or not, but about the length of the marriage by which the immigration benefit was received. In order to maintain US residency you can't "live" in another country at anytime. If you move your residency, other than for a temporary period of time, would put an end to your US residency. This does not matter if it is a conditional to 10 year card.

Ok, so a little background information: I'm 28 yrs. old and from Denmark. My boyfriend is the same age and from the States. We are currently looking at the whole process of getting married, but we are confused on where to start and which way to go with this. I'm currently a student, I'll finish my degree in a year though. My boyfriend is employed and living in America, but in general our funds are limited.
Anyway, so here are some questions (I'm sorry if these have been asked before):

1. We might want to live in Denmark for the first couple of years only. However, would it still be the same deal if we get married in the States? Like would that influence where we can live afterwards? Or if we get married in Denmark, does that mean we can't move to the States afterwards?

2. I read somewhere else on this site that the fiance visa is a costly process and some would recommend doing the spouse visa. How does all this work? Would we then just go to the JOP to get married next time I'm in the States, and then apply for a spouse visa, or is this a bad idea?

I just have no idea where to even begin with all this. I hope to get some help from some of you guys. Thanks a lot!


The US Citizen can petition for their spouse at anytime... It does not matter if the marriage took place in the US or abroad...

There is a cost difference between the spouse visa and the fiance(e) visa when you take into consideration the forms you need to file for the fiance(e) to get the greencard but in the end, it is but just a few hundred dollars different

You need to do a lot of reading and you can start with reading the guides (top of any page) click on guides tab.

I-129F pritition is something the USC does first in order to prove that the alien fiance(e) is eligible to apply for the visa

The K-1 visa is the actual visa that is applied for by the alien fiance(e) at the consulate in there country of residence. You cannot apply for the visa until an eligibility petition has been submitted and approved for you
