Never ever use red pen on official documents. You might not have had issues but you are very lucky. Red is considered an "official" colour and in that same vein, USCIS use it while processing your stuff most of the time too (all my K1 stuff was smothered in red pen).

Blue or black, only acceptable colours. Blue for signatures (that's my preference, black is also technically acceptable), black for completing the forms.

I was wondering if anyone could help clarify something.

In my package for the K1 application (the packet with the checklist) it quoted a fee for the non-immigrant app of $350 or €287. In the next package there was a letter quoting a fee of $404 for an immigrant visa 'or equivalent in local currency'.

Now, as I understand it, I'm applying for a non-immigrant visa not an immigrant visa, so in theory it should be the first amount - but the other letter has thrown me sideways and I've no idea how to find out what I should be doing. My interview's in a week, so it's not as if I could send them a letter asking them to clarify.

Any help would be greatly appreciated.


"K" visas are interviewed by the IMMIGRANT VISA unit of the consulate... many consulate prepare one document that is sent to ALL applicants and many times some of the information on the sheet does not apply to the "K" immigrant and vice versa

As baron stated, she can come over of her own accord HOWEVER she needs you to adjust her status, or she can try the VAWA route (accuse you of abuse etc). She cannot simply marry someone else and live happily ever after based on your K1. She will need to leave the US and re-enter for that. But she can still use it to live here and meet someone else, or work and live under the radar... at the very least you should report that you aren't going ahead with it so it doesn't come back to bite you somehow.

If you truly believe you do not want to go ahead with it then cancel it. Bearing in mind if you chance your mind after that, you will need to re-apply.

Do you mind if I ask what she's said/done to 'cause you doubt? Maybe its a cultural difference thing? Maybe she's just scared? Sometimes it helps to have an impartial second (and third and forth etc) opinion. You don't need to respond if you don't feel comfortable but it might help.


AFAIK, for a K-1 entrant, without a marriage to the USC... no VAWA route exists

Hello, this is Charlie. Schatz and I are in a unique situation, just like everyone else?s, I am detailed oriented person. Like for us to be prepared for January/February and ?not to be caught with our pants down.?

My fiancé and her son are coming to the US in early January. Their visas (K1 and K2) expire mid-February.
What we would like to know, will the 90 days that are given for marriage and AOS be truncated due to the expiration of the visas or will the 90 days supersede the expiration and allow us to use that time as needed.

Basically? arrive early January? the 90 days that are given after the POE will...

a) be shortened due to the expiration (mid-February) of the visas.
b) take over from the POE.

You are misunderstanding the "clocks" associated with a K-1/2. The visa expiration governs the entrance into the USA ONLY. In other words, they must present themselves at a US border on or before that date. Upon entry the visa is no longer valid (as it is a single entry visa and it has been used) and any date associated with that visa is meaningless

Upon entry, a brand NEW 90 day clock begins and will be indicated on the I-94 entrance/departure document that they will receive at the border (this is initially filled out on the aircraft prior to arrival). It is that expiration date on the I-94 that the K-1 entrant must marry by in order to adjust status from K-1 to resident (and the expiration of the I-94 will be 90 days from the date of entry).

Is the medical portion of the visa process scheduled by the uscis or the local embassy, and my fiance is given a date and a place for the medical examination? What is the usual time span between sending in the petition and medical examine? If anyone could help me out with these question it will be greatly appreciated.


Different by consulate, but most require the applicant to make there own appointments.... The I-129F petition is submitted by the USC and it could take the USCIS 2-5 mos. to approve... then the case file sent to the consulate. Once the case file is at the consulate, then and only then is when the alien is allowed to apply for a visa.

Does anyone know if a student loan has to be paid off before a person can emigrate? My fiance has an outstanding student loan balance to the Thai Government of approximately $5,600 (170,000 Thai baht). She currently pays about $67 (2,000 baht) a month, which will take about another 7 years to pay off at this rate. I'm going to help her pay it off eventually, but cannot come up with the total outstanding balance at this time. I know it's not part of the I129f package but does the topic of unpaid student loans come up at any time during the Visa process?

Wow, how heartbreaking! My wife and I met 15 months ago in China. Ten (yes,10!!) trips to China and 150,000 flown miles later, We found ourselves at the embassy in GuangxuoAttached File  IMG_1194.JPG   73.56KB   297 downloads for her interview. As you can imagine, we had hundreds of photos, receipts, etc. as evidence that our relationship was legitimate. We even had a wedding ceremony this past february in her hometown. I even lived with her last summer in Shenzhen.
The interviewer was incredibly RUDE and gave her less than 3 minutes of his time. He barely looked at a little of the mountain of evidence and denied her with a "blue" form. He told her that she needed phone records and that was all we were missing.
This sounds like total BS to me. Had he spent three minutes with both of us ( I was waiting downstairs! ) he would have easily seen that ours was a legitimate union. After talking to many people ( including her friends, all of whom were passed with barely a thought! ), we were told that maybe our age difference (she is 29, I am 48) was a factor in the denial. My greatest worry is that this man was not being truthful and has no intention of approving us. As you can see by the photo, neither one of us appears our age. Anybody have any thoughts/comments/suggestions would be greatly appreciated.


Please see the highlighted... if true and legal then it is no wonder you have problems getting a FIANCE(E) visa....

I already sent to him the form G 325a signed by me, and the letter of intend to marry within 90 days of my arrival to US, and the other letter telling about our relationship, but on the letter to intend to marry, I didnt put my address and I didnt put the USCIS address as they ask for this. So, I need to know what´s the USCIS address in UTAH.

That and a $1.30 will get you a cup of coffee... No requirement for a "professionally" composed letter or any usage of the USCIS address. The requirement is a STATEMENT of intent not a letter of intent.

"I plan on marrying my fiance(e) within 90 days of entry in the USA." Is a simple statement of intent and works just fine for USCIS purposes

The word I got was that the consulate does not cite the older K2 as the basis for denial, they use something else for the basis. Usually the "failure to show a bonafide relationship" catch-all.


The K-2 CANNOT be denied because of a "lack of relationship". A K-2 is given AUTOMATIC approval as a DERIVATIVE visa of the K-1. It cannot be any other way. They can deny a K-1 for this reason but NOT a K-2 of an approved K-1

In a recent topic I related info about my K1/2 situation. We do have some red flags, so I contacted a popular immigration attorney.
I sent an email relating our relationship timeline. When I talked to the atty, (I think it's best not to mention his name) he recognized the red flag issues, recommended we marry in China and persue a CR1 visa. Apparently he had not read my email. When I mentioned our issue of my fiancee's son (K2) being 19yo he made this comment -The Guangzhou consulate routinely denies K1 visas that have a K2 with age-out potential, they have been doing that for years- This news is significantly discouraging for us, it seems there is little hope for a K1/2 based on this alone. One strategy recommended is that we wait for one year to file for K1, however that strategy leaves the young man without a derivative visa/path to GC. So we were considering a more limited wait, 6 mos maybe, then going forward. Of course this would cut it close on the K/2 AOS before 21yo. We have also considered a K1 without her son, then she can file I130 for him when she gets her GC.

So I guess I'm looking for some feedback on the atty view that K1/2 are usually denied because of the older K2.
Anyone go through the Guangzhou consulate for a K1/2, with a 19yo or older K2, in the last few years or so?
What was the result?

A K-2 receives automatic approval once the K-1 is approved. I am surprised that Guangzhou is reportedly doing this.

Okay, so being the 'foreign fiance' I am filling out the G-325a for our first package to send in, and I just wanted to double check that I have things right.

Where it says 'file number: A____' I have put 'none', like on the sample form. Is this right?
And the same for the social security number, just 'none'?
And what about my 'Alien Registration Number' at the bottom, 'none' again?

Finally for the proof of having met/ongoing relationship, I include photocopies of things like boarding passes, etc, I don't need the real ones - correct?

There is no question on any form that asks what name appears on the birth certificate as the father. The questions simply ask the name or name + of the father. Unless the name is actually unknown, to answer "unknown" would be a lie. Never lie on an immigration form. Listing "unknown" for the father of the child of an immigrating fiancee or wife would raise the issue of prostitution. Trust me on this, really. It is quite rare for a non-prostitute to be unaware of the name of her child's father. There are other exceptions, like rape or just promiscuity but you get the picture.


I still disagree and would never suggest to anyone what you are proposing. PERIOD. Your suggestion could require someone to seek permission from the this alleged "father" for the child to immigrate. A totally unnecessary potential complication that can be avoided.

In the "visa application" process, particularly when the DS230 or DS157 are used, the visa applicant (Children apply for their own visa using visa applications.) is asked for their parents' full names and on the DS230 even more. Unless the father is truly unknown (such as in the case of the mother being a prostitute) the father's name will need to be disclosed and the local laws will need to be complied with regarding taking children out of their country of residence.


I disagree... if the father's name is blank on the birth certificate then the father is "legally" unnamed\unknown... Why put a name on the DS-156? What purpose could it possible serve other than to make the visa petition/application process uneededly more complicated. The applicant could put Santa Claus.

Hi everybody! I have another question and therefore start another topic. This board is awsome, I got plenty of input and good ideas on my previous and first post.

Now to the point! My main plan of action is still applying for a K-1 for my girl and I got somewhat contradicting info after visiting a few law offices in the area. My situation is that I, myself, got the US citizenship not too long ago, august of '09 to be exact and one of the responses that I got was that basically a certain amount of time should elapse before I can try to get someone else into the country. I was told that a minimum of 5 years must pass from the day my greencard was approved in order to be successful in this undertaking. The lady said that I could still apply but the application would really hit the red light and I would be asked to bring a proof that my previous marriage was not a fraud if I applied before those five years elapsed. I got the greencard and the citizenship through the marriage with a US citizen. Is that true? Thanks againg, I appreciate all of your help!


Was your previous marriage that you gained your US citizenship from based on good faith? If so, what are you worried about... If not, maybe you need to be worried...

For the initial petition, you are required to provide proof of face to face meeting... Relationship evidence is not required to be sent.

Hi guys,

I have sent monies to my fiancee (considerable amount) and that is mainly to re-do the kitchen in her house. This happened after my very first visit to see her and then i sent her the money to do the kitchen and we built a beautiful one. She was also unemployed at the time and i helped her during that time but since august this year she got a job (good one) and doing it right now but with greatest difficulty as the commute is very hard. We decided it is better she keep doing the job especially when it comes to her visa interview.

I am just wondering should we enclose this information at the interview if she is asked? If she say no, then it would a lie. My heart tells me to be upfront with the CO if inquired about it. Also if worse comes to worse she might leave the job and be unemployed until her visa interview (i am shooting towards february 2011) and in that case i have to support her until she comes here. She have enough assets but not cash. It is very practical for a fiance who lives in US to send money to his Fiancee who lives in sri lanka as it is a developing country.

Can you guys see any problem with this?

It is not important whether we see a problem with this but will the consulate officer. Since that is probably not known, it might be better to not present this type of evidence because you do not want to give a remote impression that the relationship is based on some sort of a financial arrangement.

So I know that they do not run credit checks for either the petitioner or the foreign fiance, however, a about a year and a half ago, my fiance was here in the states, went to the emergency room, and had a $700 hospital bill. He left the country before receiving any of the bills, and the only personal info he provided the hospital with was my address. I began to receive a few bills from his visit, but always just sent them back. Does anyone know if this will be a problem? I haven't received any bills in many months, so I'm assuming the just wrote off the case, and he has a very generic name, so other than my old home address, they have no way of connecting us. Even if the government were to somehow realize this, would it hinder him in getting the visa? When they run the FBI checks, would something like this show up? Any advice is much appreciated!

My fiance received the letter from the HCMC US consulate. It told her to download the instructions for packet for IV instead of instruction for K.
Instruction for K pdf shows we need I-134 but instructions for packet IV shows we need I-864.

Does anyone know the difference between these forms? Are both OK for K-1 Visa?
