K-1 Fiance(e) Visa Process & ProceduresSouth Africa - Law for police records!

how do i do a"power of attorney"? forms i gotta fill and send in?

I doubt there is a form but you will need to create on or have one created for you. Try google for examples

It will consist of wording something like:

To: [Name of Agency]

I [Name] hereby authorize [Agent Name] as a representative and all rights regarding the application to obtain [name of report] required by the United States of America for immigration purposes.

Sign it and have it notarized

for South Africa...we have people over there that are related to her to pick up for her, but they told them my fiancee had to come.

alternatively according to the Department of State she could give someone "power of attorney" and authorize them to get it for her

K-1 Fiance(e) Visa Process & ProceduresSouth Africa - Law for police records!

Now i have been told that when u apply for the visa, the foreign fiancee CANNOT travel outside of her permanent residence!...

What can i do?..She says her relatives tried to ge tthe police record and they denied them saying, My fiancee had to be there!!!

PLEAASSE SOMEONE HELP!

Can my foreign fiancee travel to South africa to get her police records? will that be a violation?

Violation of what? Your fiancee is applying for a visa to visit the USA... That process does not put shackles on them and prevent them from traveling elsewhere. Nonsense, pure nonsense.

Police Records

Available. Criminal records since 1901 covering the entire Republic are maintained at the South African Police Headquarters, Pretoria. The period The Commissioner of the South African Police issues certificates upon application, stating whether or not a criminal record exists, and, if so, particulars of the offense as well as any sentence passed.

The police authorities require an applicant to present verification of identity, such as a Book of Life, or valid passport, and a payment of R41.00 (South African rand forty one payable in cash, cheque or postal order, made payable to the South African police).

To obtain a certificate that is issued in single copy only, fingerprints must be taken by the local police in the applicant?s place of residence. The South African police forwards the completed fingerprint chart and the fee to the head office in Pretoria for issuance of the police clearance certificate. If the applicant is residing in the United States, he or she should forward a bank draft in the aount of R41.00 together with a completed fingerprint chart (bearing an official signature and stamp of the local police station) to:

South African Police Service
Criminal Record Centre
Private Bang X308
Pretoria 0001, South Africa

Alternatively, he/she should authorize a friend/relative in South Africa to submit the application on behalf of the applicant.

I also just noticed that the letter does not say anything about being forwarded to NVC, I am worried now that this is unusual.

NOA2 is not the official determinant of the consulate. NVC will send it to the proper consulate that handles K-1's. Do not worry so much the system does work

K-1 Fiance(e) Visa Process & ProceduresBirth Certifcate or Passport?

Hi guys, we are preparing for an interview in Russia, and we have a problem in our hand: fiance birth ceritifcate indicates one place of birth ; while passport say another. it's long story; of course we are worried how to explain this at interview. Main document in former soviet republic is passport, not a brith certficate, and i-129f and I indicated info from the passport. Does anyone previoulsy has this problem? What might happen? Any input is appreciated!!!

My wife had the same issue... I did not think it would be a problem but she went ahead and had it fixed so I don't know if it would have been or not

K-1 Fiance(e) Visa Process & ProceduresSon turning 21 soon - what may be his chance to get K-2 visa in case our 129-F is approved ?

Hello payxibka,

Thank you for the advices. Are you saying also that we should no longer try or pay for his visa application just in case after we get our NOA2?

There is no paying until such time as you actually make a visa application and that appears to be weeks away yet. The time clock is ticking and I suspect it is physically impossible for all of the remaining tasks to be completed before his birthday.

You say you are still waiting for your NOA2 (1-2 weeks?, more?), the file then needs to get from the USCIS to NVC and then on to the consulate (2-3 weeks typical). Then your file must get into the consulate appointment system and an interview date granted (2-3 weeks? not sure for Manila). Then the visa needs be issued (1 week?). The child must travel to the USA and enter. All of this needs be done before he turns 21.

K-1 Fiance(e) Visa Process & ProceduresSon turning 21 soon - what may be his chance to get K-2 visa in case our 129-F is approved ?

Hello VJ members !

Greetings of peace!

We are still waiting for our NOA2. My Fiancé listed my own 3 children in his 129-F Petition as we really hope all of us to be together as one family. We are not very sure though if my eldest will still be included in case we get approval soon. When the petition was submitted last February my son was only 20 years old plus a few months thus my Fiance included him. To date, 2 more months he is turning 21. We are very much aware that only 21 years old below may be considered for K-2.

Questions :
1. What is the possibility for my son obtaining a K-2 visa?
2. Will the US Embassy consider the date of petition filed or the interview date ?
3. What is the next option for my son (21 years old then) in case my K-1 visa is approved ?

We hope anyone who has knowledge or experience on this case could shed light or clarification. This would mean a lot to us once we get our NOA2 – God’s will – as we prepare for the next steps. Because if my son will no longer qualify then we will not anymore pay for his visa fee, medical fee, etc so we won’t be wasting our limited resources.

We really have no idea before when we started our K-1 visa journey, but finding this very informative and helpful site is really a great blessing from God especially we have not consulted any immigration lawyer.

Thank you very much to all in anticipation for great advices. Cheers ! :star:

May God bless all of us !

1) almost nil.
2) does not change the fact he is aging out
3) in order to immigrate you must become a US citizen and petition for him. He would be several years away before getting a visa

K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions

Well don't the VJ gudes seem to recommend it? So many people here say that, so they got that info somewhere. You want to show that your relationship is ongoing don't you, so thats just one way among the million others. My initial respone wasn't about the letter of intent but I see no harm in it.

If the consulate has to request later you've already broken your golden moment. Ideally you would like to see the Visa given to your fiance on the same day, so that you can go back to the US together.

Do you believe that everyone who is in the visa process is on VJ? I would say it is consulate specific answer and the majority (if not super majority) of the consulates do not require it or request it at any time
payxibkaMaleUkraine2011-05-08 09:25:00
K-1 Fiance(e) Visa Process & ProceduresG-325A & Letter of Intent questions

But can you generalize that to every case? Your case was probably slam dunk / approved. But what if a case has some red flags somewhere or the CO just had a case where it looked like fraud. I'm just saying that when it comes down to whether your Visa gets approved or in AP or denied. I would rather go way above the 'requirements' rather than risk the possibility of failure.

If it is not on the required documents list on your appointment letter, how can an applicant know to come with and updated letter or anything else for that matter? You provide what the consulate wants. If the consulate wants it they will request it. What value does an updated letter of intent do anyway? Nothing.

K-1 Fiance(e) Visa Process & ProceduresK1, Fiance Visa

My take on this would be to not put the children's info on the I129F form since they're not coming with the mother, anyway. But provide proof of marriage termination with the ex-husband.

Your take is wrong... The question is not "List only the children who will apply for a visa."

I'm in the process of filing for a K1 visa. However, I do have a couple of questions and need a little assistance. In my situation, my fiance from the Philippines is divorced and have sole custody of her children, (ex husband is gone, working in another country). She is NOT planning on taking the kids with her. (Children will be staying with her mom and family) Now my question is.... Do i fill out the children's name on the I129 form and does she disclose that on the ds156k visa form? If we do, would the embassy ask for a signed permission from her ex spouse to allow her, my fiance, even with her having sole custody of the kids to leave the country? Should we even disclose the kids information if they are not coming? I know that I can go ahead and provide the kinds information on the I129 form as the DS156k will ask if the kids will follow, and we can just put no. Would there be any problems with her being divorced and leaving the kids behind? Would the embassy ask the ex spouse for permission? Or would they even know she has kids if we just leave it blank? Just don't want any kind of problems, any response will be greatly appreciated, thanks!!

Divorced in the PI? Are you sure?

K-1 Fiance(e) Visa Process & ProceduresSchengen Visa Question

Here is what they decided for us. On the NOA2 the Department of Homeland Security listed Moscow as we requested. Then the NVC letter arrives and they listed Warsaw. I guess Olga will be going to Warsaw for her interview. Good thing she updated her passport!

Thank you to all who posted here.

As was predicted, DHS does not nor cannot assign the consulate, only the DOS does via NVC

You mean the I-129F. They will most likely schedule your interview where you requested provided that they do a K-1 visa.

Interview will be scheduled in Poland despite what you wrote for your requested consulate.

K-1 Fiance(e) Visa Process & Proceduresk1 visa pregnant benificiary question

one question my fiance is pregnant interview date coming up soon finally do the consulate require dna testing for the baby ? Or can they deny the visa for not getting one a little worried .thanks for the input .

they will not deny the visa because of a lack of DNA testing. if they wanted a DNA test and it was not given, then they could deny based on lack of a bonafide relationship...

bottom line is that the reason for DNA testing would be to determine if the child has a claim for US Citizenship or not... and if a USC then child is issued a US passport and not a visa....

K-1 Fiance(e) Visa Process & ProceduresProof of Relationship

Pay, how can you know? No CO is going to blurt out "Had you not front-loaded your petition, I'd have never granted this visa." It HAS been stated here, many times, that it appears that the COs made up their minds ahead of the actual (perfunctory) interview. For consulates that are known to be difficult, sensible front-loading can't hurt and very well may help.

How can you say anything else or to the contrary... It is a fact... it has not been proven either way.

BTW, I never said it would hurt so please do not add to my statement

K-1 Fiance(e) Visa Process & ProceduresProof of Relationship

Regarding proof of relationship materials, I sent in my application just before I went out to see her a third time, and will be going out to see her again Wednesday, with 4 days in her little industrial hellhole hometown in LiaoNing scheduled.

Is there a way of getting that data in front of the VO for consideration in our application? I came across a post from last June by Bleauwolf regarding front loading the application while it's being brocessed at the NVC.

But this is a K-1, and NVC has given us a case number as of the 14th, and will be sending our stuff out any day. I don't know if we are going out via SAFEFILE or not, I have a GUZ case number. So there will be no time to do it through NVC, we'd have to use the NVCGuangZhou@state.gov email address to front load it, or could we send it in along with the DS-230 from the P3?

PS.I seem to be lucky; my fiance seems to trust me. I didn't catch a bunch of flack for suggesting she only listen to the girls on 001 posting from the US ... and even then they might not know everything.

The concept of front loading is based on a "theory" that the Consulate cannot re-adjudicate information contained in a petition that has been reviewed and approved by the USCIS. Trying to add info after that fact does not work for this "theory." Mind you that front loading is still a "theory" and has not yet been proven to be guaranty or even being helpful in assisting in the approval process.

You do not need the NOA2 for the interview but will for adjustment of status...

USCIS expedite is just the USCIS.. if you need to expedite the consular process you need to inquire

All requirements for the visa must still be met, including applications, PC's, medical, financial, etc... They assume nothing and so should you.

K-1 Fiance(e) Visa Process & ProceduresVisa Extension?

My fiance and I were approved for our K1 Visa in December of this year and I must use it by June or it is no longer valid. I am a Canadian citizen and he is American. The only reason I haven't moved to him yet, is I was planning to stay here in Canada as long as possible to save as much money as possible towards our wedding. But I recently had a close family member pass away and had to use most of my savings towards paying off a remaining debt they had. Now I'm almost back at square 1, financially, and would like a little more time to save some money so we're not struggling once I move. Has anyone requested such an extension or does anyone know if it's possible? I'd appreciate any help anyone has to give. Thank you so much!

It is up to the discretion of the consulate, so you only need to ask them, they may indeed help you

K-1 Fiance(e) Visa Process & Proceduresconsulate question

I just mailed out my I-129f yesterday...finally...and where it asks what consulate my fiancé will use (she's Russian) I put Ekaterinburg because she lives in Chelyabinsk. Anyway I was looking at the consulate website this morning and it states they don't do fiancé visas...they all hi through the U.S. embassy in Moscow. Will this be a problem and should I do something about this?

Thanks!

not a problem, NVC will correct it and send it to the consulate that has jurisdiction over her current place of residence

K-1 Fiance(e) Visa Process & ProceduresLetting a K1 expire...what happens next?

So I pretty much got my answer...there are no extensions and its better to cancel the visa then let it expire...now this is a different question. Since I am not only a US citizen but also a Canadian citizen. I have my Canadian passport but have not used it yet. When crossing customs and I use my Canadian passport, what do I tell the customs officer? Do I say I am going home even though I live in the US? I just want to minimize hassle and any chance of being denied. Should I say I'm visiting my fiancée as I have before with my US passport?

Thanks, you guys have always been great help.

If you are crossing into Canada on a Canadian passport... Do you really think they will deny entry to one of there "own"? Unless you are "persona non grata," I am quite sure it is "illegal" for such a thing to happen..

not an issue until interview time. You probably have 6+ mos. to formulate a solution. Don't know how solid your finances are but I believe London is one of the few consulates that allow the alien to self-support for the K-1. If true, this would buy you more time before the green card application is made.

K-1 Fiance(e) Visa Process & ProceduresMedical exam fees

I saw on the french consulate info that there are about 287€ to pay in the packet 4? What are they? Are they for the medical exam? I thought it was 170€ and then it's written 355dollars +45 for immigrant visa if not paid at NVC.... I am lost... Do I have to pay all of this? Please Help.

It appears packet 4 is being used for more than one visa type. $350USD (287€ ?) is K-1 visa fee.

$400USD is the CR1 visa fee (if not paid to NVC) so ignore this.

Consulate does not get involved or collects the exam fee. This will be paid directly to the clinic at the time of the exam. Fees for this vary widely by country.

Reasonably speaking. I did not go to VJ and and seek a Free Online Advice Kit. While in the Philipphines I gathered all Necessary Documents that will be required later. I paid my Attourney for a Service and made sure she has what she needs since The Attourney's Services are in the Agreement.
I Gathered as many Supportive Documents Posible while I was there. Not Have Her (My Finacee' Mail them later and wait.) Those Documents are in my File with the Attourney. Mav has a Copy (Best) in Color of her Birth Cert as well.
There are many things Members agree on and things that are dis-agreed. I myself am not always right but learn by reading and double checking BEST ANSWERS.
Just a thought: What if; the petioner went through all this and never worried about a birth Cert just assuming she had one? And later found out she never had a True Copy.?

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance with Lost Passport (Korea)
Here is what the US Department of State says on the issue:

Police Records

Korean National Police Certificate (Crime-Investigation History Report: Bomjoi-Soosa Kyongreok Johoi Hoiboseo) is available to visa applicants of any nationality who are physically present in South Korea. The new KNPC now includes all serious crimes since 1945, regardless of expungement benefits under Korean law, and misdemeanors for five years, according to the Individual Information Protection Law of March 2003.

Applicants presently in Korea: Foreign nationals, regardless of visa status, and Korean citizens must apply in person at any local police station. The KNP checks non-Koreans according to the requestor's Korean alien registration card or passport. Korean citizens must show a Korean identity card with the Korean citizen's unique, lifetime Korean identification number, which is found on Korean national identity cards and Korean passports adjacent to the applicant's name. KNP processing is no fee and takes less than one hour. The new KNPC bears a red ink half inch square stamp on the bottom containing the Korean characters for National Police. It is issued in Korean only and applicants must attach a complete English translation, certified as true and correct by anyone competent in Korean and English, for the visa interview. A simple computer printout of criminal records is issued with the Korean annotation for information only, has no red ink stamp and is not a KNPC for visa purposes.

Applicants outside of Korea: Unavailable.
