K-1 Fiance(e) Visa Process & ProceduresHow does a US/Australian citizen living in the US get an Australian police certificate?

I'm a US citizen and will be petitioning for my fiance who is from Vietnam. I was born in Vietnam but grew up in Australia from 1981-1997. The K1 requirements state that I need a police certificate for over from any country in which I resided for more than one year while age 16 or older.

How would I go about getting a police certificate from Australia? Australians please chime in.

Thank you.

USC does not need police certificates... only the non-USC alien who will be applying for a visa

K-1 Fiance(e) Visa Process & ProceduresHELP! Questions on K1 Visa Application Forms

My petition is under initial review as of this moment. But as i was reading up on K1 tips and guides online, I'm wondering if the items below will affect the processing of my approval --

1. On my G325A form, I failed to write NONE or N/A on the portion that says File Number and Alien Registration Number.
2. The fiance letter of intent that I submitted didn't have the USCIS address on its heading (but it was duly signed by me and dated properly)

Will USCIS be so strict about these things?
Please clarify.

Thanks a lot!

K-1 Fiance(e) Visa Process & ProceduresDoes USCIS make calls for information?

My fiancé lives in Manila and has lately been receiving a lot of blocked calls and unknown numbers that she often would either miss or not answer on her iPhone. Since our K1 visa is still under initial review, I joked with her that it might be Immigration services wanting more information and that she should answer it . After all, in the application, I did use her cell number as a contact for her.

My question is if there is a possibility that the USCIS or any governing body would call the beneficiary for information? Our processing time has hit the 30 day mark so we are expecting another 100 plus days before getting our NOA2 , There's nothing remarkable for Home Land Security to be worried about myself and my fiancé in our backgrounds.

Personally, I doubt our fiancé visa application would warrant such special attention as a personal call but who knows? Maybe someone in the VJ community has experienced or heard cases of this.

They rarely if ever call, but if the USCIS did it would be to the USC not the alien

K-1 Fiance(e) Visa Process & ProceduresExpedite Request Suggestion

Hello everyone,

I know my fiancee' file has been at the VSC office for a month now. Lately it has been a draw of luck with NOA2 being sent to Jan and Feb filers.

I'm a US Citizen by birth and my fiancee was in the USA for a year and left prior to her visa expiring.

Curious if I could contact the USCIS hotline and place a service request for an expedite due to the bomb blastings in Pakistan taking place on a daily basis.

As I know everyone have been waiting for their NOA2 for a while now... but honestly it is not fair that we as US Citizens are kept apart from our soon to be wife longer than the processing time posted on uscis.gov website of 5 months.

My fiance had her background check conducted by DHS as part of her visa processing during her last visit to the USA in 2009.

Daily bomb blastings in Pakistan, multiple daily murders by the Mexican drug cartel, Tsunami devastation in Japan.... Where would you want them to start approving expedites and where would it end?

K-1 Fiance(e) Visa Process & Proceduresprocess if you have a child with fiance

Hello, I am about to start the whole K1 process, and it is all overwhelming!!.....my question is, Are things handled differently at all when we already have a child together?
My fiance is colombian, living in Costa Rica, our daughter was born there, and given a passport at the embassy, me, our new daughter (now 5 months old),and my other daughter ( 7 years old) have come back to the US. I read so much info about bringing over someone else's child with your fiance. Does anyone know if there is anything different i need to do? Thanks....

The big difference is the US Citizen child does not need to apply for a visa

K-1 Fiance(e) Visa Process & ProceduresDo I send I-129F to this "lockbox" or directly to VSC?

When I filed my first I-129F way back in 1999, I just sent it directly to VSC in Vermont. Now, I see the instruction reference this "lockbox" address in Texas -- what is that? Which is the correct (or best) address to send it to once I have it ready?

Yes, I tried the search function.

It is possible that over the last 12 years the process and procedures have changed... you need to follow the CURRENT instructions

Hi...I am a Filipino citizen presently working in Korea. My K-1 visa is presently under review at the California Service Center. K-1 Fiance(e) Visa Process & ProceduresCertified translator needed...does that include emails??

Does an email count as a "document" that needs a translator's certification? I translated a few emails myself as proof of an ongoing relationship (I am fluent, but not certified, in spanish). Does it matter that much that the emails be certified? Will that cause problems?

You do not need to be certified to translate... you simply need to be competent in both languages and sign a certification as such

For the I-129F, e-mails not needed nor even wanted by the USCIS.

....there have been cases where the beneficiary is at the interview and the CO claimed a certain document wasn't there. These documents will need to be current at the time of both the visa interview and exit date from Ukraine. No way around that.

You know this for a fact? I love it how experts from half way around the world provide specific answers for a consulate they have no personal knowledge about.

My wife's documents were 8 months old at the time of the interview (dated in October, Interview in May). As for exit, our documents worked more than two years later for exit from Ukraine...

To the OP.... If the consulate has a time limit on the permission document, which if it does it might be one year, then it is best to e-mail them directly (kyivIV@state.gov). Then you know that the answer you get is what it is for that consulate

K-1 Fiance(e) Visa Process & ProceduresMy Ukrainian Fiancee JUST got divorced

I don't know who to ask for advice, but I want to know that this is ok. In Ukraine, women don't have a lot of rights, so the woman I am applying for a K-1 Visa for WAS married to her cousin. (they lived 6 hours apart, they never saw each other in 2 years, etc) She just got her divorce from him and now I want to apply almost immediately for the K-1. Is this OK or is there typically a waiting period between when the divorce was finalized to when I should apply for my K-1 for my Fiancee.

Everything else is good. We literally talk all day every day for over a year now through Skype, I've gone there to see her twice, we've been engaged for 4 months, I've met her parents and her friends, etc.

Any advice would be appreciated!!
David

officially.. no waiting period required... as long as she is free to marry and you have met in person... she can be petitioned for

It's not a bad idea to front-load by including proof of relationship with a petition that's going to be sent to a high-fraud country, which I've gotten the impression the Philippines is. 1 1/2 inches isn't extraordinary, really. But no need to print off every chat and email you ever sent, or anything like that. Just snippets here and there. If you've got every convo, email, text message, etc, then cut some out.

Front loading is an unproven theory...

Hi. had another question. My I-129F package is about 1- 1 1/2 inch thick. Is that ok? the thing that makes it so bulky is the proof of relationship and ongoing relationship.

my package was less than 25 sheets of paper... I submitted NO proof of relationship or ongoing relationship evidence. The USCIS does not even want this evidence.

Hey guys,

How much does it cost you guys to do the medical examination in Cho Ray Hospital in Saigon, Vietnam? It only costs my fiance $300 VND. They didn't even ask to see her passport or appointment letter. They only wanted two visa pictures. This is weird considering the appointment package for K visa listing it as $110 USD. And, am I correct that Vaccination is optional?

Non-immigrant visas do not have a vaccination requirement... It is suggested you may wish to get updated vaccinations in preparation for the green card because of cost typically being cheaper outside the US

K-1 Fiance(e) Visa Process & ProceduresK2 turning 18 before interview

I was answering the K2 question you had since when I went through this process in my prior petition, I was confused at that time as to what paperwork was needed to generate the K2. Well it is born as part of your initial K1 approval (NOA2). You'll be getting a Packet 3 from CDJ. There will be instructions as to forms you need to fill out for your consulate visit/interview process. The Step-By-Step Guides for K1 found in the FAQs are excellent : http://www.visajourn...content/k1guide

I was also letting you know what I was preparing for the K2's on my current K1 petition. It's good to have all the medical vaccinations done ahead of time if you can. Every embassy has their own unique process and reading the reviews for CDJ they have recently made changes as i noted above. Some VJer's have recently posted their reviews as seen here: http://www.visajourn...php?cnty=Mexico

Your still confused.. A K-1 is a visa type. NOA2 is a petition approval NOT K-1 approval. The I-129F petition approval is merely the USCIS acknowledging that the alien has had there eligibility reviewed and now is eligible to apply for a visa. Nothing more and far from a visa approval.

K-1 Fiance(e) Visa Process & ProceduresK2 turning 18 before interview

Hi Sarah&Michael,

As part of the K1 his K2 is initiated. There are no forms needed to generate the K2. His age should be fine since I believe he needs only be under the age of 21. My fiancees daughter is 17 and her son is 18. I am making sure they have their birth certificates "apostillado" in order for the embassy to acept them. Also I am making sure they have all of their vaccinations taken care of and stamped with the dates taken; my fiancee says she has the booklette for both of their shots. She recently completed her shots as well.

Not quite correct... Don't confuse the petition with the K-1 or K-2. While it is correct that there is nothing more on the I-129F petition for the child other than to list his name, but once the petition has been approved, several forms & and a medical are required (DS-156 et al) at the consulate if he wants to apply for the K-2

K-1 Fiance(e) Visa Process & Proceduresevidence of meeting,suggestions

Hi all,

We are about to file our petition. We are finishing the intial I129-f, in regards to question 18 , evidence of having met in the past 2 years. :

We have emails confirming airline reservations, and emails confirming amtrak reservations, and boarding passes for Amtrak with our names, and photos of the trip. AS well as 1 passport stamp each in our passports, hers to USA,,mine in Holland corresponding to the emails(our flight), we Dont have airline boarding passes for that trip.

We would like to include a further piece of primary evidence,

we are currently together and like any suggestions of what we could do to get some good evidence of us together, today.

we are in France, could we get a U.S. consulate to sign a paper that we are both together ?? would they bother or is it too much? any suggestions greatly appreciated

Why need evidence of "that" trip, what about the current trip?

Your over thinking it... The evidence of meeting requirement is quite easy to meet and I would say you have done so already.

FWIW, The Consulate would not sign such a paper. You could always have someone take a photo of you holding a dated newspaper... While it is secondary evidence, it supports your passport stamp date into Holland.
