HI everyone! I have the k-1 petition approved but there is a problem with income requirements. My fiance meets the min income requirements according to his earning statements but last year he made less money because he visited me a couple times and his trips were pretty long(1.5 and 2.5 months). We have read that if we dont meet the requirements then a co-sponsor is needed.. but we cant find any... We dont know what to do.. the interview is soon.. will that cause the visa denial or maybe they will consider the fact that income requirements cant be met because of the trips here? we would appreciate any ideas... thanks...

If 2010 was a down year, then you can show 2009 and indicate that 2010 was abnormal and the reason why.. (long visits to Ukraine)

Kyiv is a reasonable consulate... just be prepared to explain and all should be just fine

You cannot get a visa without a passport because the visa is printed INTO the passport. Traveling internationally children need a passport.


Actually in some countries a minor child can be appended into the parental passport. If this is the case then both visas are placed in the one passport.

A copy of my divorce decree is in my original submission. I was just checking out the interview requirements on the uscis website and it says she should bring a copy of any divorce records for either of us. Interview requirements are established by each individual consulate and NOT the USCIS.... What Moscow says trumps anything anyone else might indicate for that consulate

Incorrect Answer : A copy of the Divorce Decree is needed but this usually is associated with the Approval of the 129-F or NOA2 Approval. What is needed is:
A Stamp or Seal on the Document from the Court House containing every page if the Decree. Signed/Initialed by the Country Clerk and dated. A scanned copy is No Good. Some Certification of the Document is needed and this is how it is done. Been there. done that. RFE for not knowing myself. The Original is needed.

When you file your visa application to the US consulate in London you can submit his as well at the same time... However, you CANNOT do this until YOUR petition has been approved by the USCIS.

I have been living in Chile with my fiance for almost a year now on a student visa, and it is now being changed to a temporary residence visa. We are starting to gather documents to send with the I-129F, hopefully at the beginning of March sometime. I'm confused about how I do this whole process being in Chile and not in the US. Is it considered DCF? From what I'm reading that's only for I-130 and not for I-129. Do I still send the I-129 packet to the Texas Lockbox address? And what USCIS service center will I use??

No, the only petition that can be filed for via DCF is an immigrant visa for an immediate relative such as a spouse, child, parent or sibling. If you want to DCF then get married in Chile and then petition for her directly to the Consulate in Santiago

Hello everyone! I have a few questions that I would like to ask.

First of all, my fiance's interview is March 21st in London. For the I-134, do I need to give him an actual bank statement or a letter from my bank? Also, do I need to send him the originals of anything for the affidavit of support?

Also, we are hoping to get approved on March 21st and then get married in late June/ early July. I am going to fly to London in early May to visit and then fly back with him to America from London. Would it be okay for us to travel to Spain or some other country within the EU before coming to America (even with the k-1 visa in his passport)? I know that it is only to be used when he enters America, but I was wondering if we would have any problems..

When he arrives in the America, how long will it take to receive a SSN? I saw on one of the DS forms that he can opt to have the SSN sent to him via mail within three weeks of arriving without having to stand in line at an office.

For the I-134 you need a London specific answer

Correct, the alien needs the visa to enter the USA... it does NOT restrict your travel to any other international destination... I have several visas in my passport... the countries that issued the visas don't care that I traveled someplace else between visits

DS-230 option does not work for a K-1 entrant... you must go to the SSA between day 1 and day 75 of arrival to apply

Hey Guys,
Need your suggestions on this one badly! My fiance have included the itinerary of his visit to my country, which happens to this last week of Feb. Since we are still waiting for NoA2 we thought its unwise for him to leave US right now. He has also booked the marriage office in US on an earlier date, I mean which is quite close now (NOA2 still pending).
Do you think the consulate will view it from a wrong angle and call it false evidence? Should we try and submit a rescheduled one for both when I have to return the package 3 or shall we leave it as it is and try and explain things out at the interview (if I am called for ie., touch wood)?

Hi.

So i've hit a wall... just to give you guys a low-down on my circumstances:
My fiance is from the USA and i am from London, UK. We are currently working in Israel for a charity and my visa ends in 6 months! There is no option to extend it either.
We filed our I-129F in January and got our first NOA on january 3rd saying it was being sent to the Vermont service centre. It then got 'touched' on JAnuary 7th. We have had nothing since. I realise that it's probably far too early to expect the NOA2. The thing is, seeing as i might not be in the country or a temporary resident in Israel by the time the medical and interviews come around. I am looking to move back to london in 2 months.
So my questions (if you can help) are:
1) Can i re-route the petition to go to the London Consulate?
2) How can this be done?
3) Will this affect my timeline and put me to the bottom of the pile again?
4) What about the fact that all of the addresses and information on the i-129f form says i live in israel?!

Please please help...
any links to forms or other threads would be great too.

In Jordan and as an Arab girl, the "wedding" status is only announced after the wedding party, and the "engaged" status is confirmed not by verbal proposal like it's done in the US between Americans but through signing a mutual contract of our bond, which is considered an engagement. My concern is that if we go ahead with the K1, is the American Government going to consider us married while the Jordanian one considers us engaged? It's done differently here and there so I really don't know what the correct visa is.

No, but it will make a difference to the consulate... They will take exception to what you have done and NOT issue you a visa. Period. A fiance(e) visa REQUIRES the alien enter the USA as a fiance(e) NOT a spouse. The legal marriage MUST take place in the USA or one of its territories.

I'm a US citizen and will be petitioning for my fiance who is from Vietnam. I was born in Vietnam but grew up in Australia from 1981-1997. The K1 requirements state that I need a police certificate for over from any country in which I resided for more than one year while age 16 or older.

How would I go about getting a police certificate from Australia? Australians please chime in.
