OK, my petition for Ukrainian fiance is being processed at the Vermont Service Center. We sent copies of her birth certificate, marriage and divorce documents, police clearance, etc. that are in Russian language. We did not have these translated as our understanding was that it was not necessary for use in the US Embassy in Kiev. Any thoughts on this in regards to the VSC? I would appreciate your experience with this. Thanks !

Hi all,

I'd really appreciate your advice. We applied for Fiancee visa and everything goes fine - we just received NAO2. But our plans have changed a bit - my fiance got a job in Europe from May '12. What's great and I'm very happy about it. But what are we supposed to do now? When I get my visa can I go to the US, get married there, stay there for a month and then go back to Europe? It doesn't make sense for me to start the process of Adjustment of status, or? I just don't want to break any bureaucracy rules. Any idea what's correct to do in this kind of situation?

no in all cases for a k-1 and no in your case for a SSN as you already have one. you are issued a ssn for life...you will simply get the name changed on your existing number

Several years ago their was much discussion on USCIS allowing unsigned letters of intent and g-325a's as long as they were completed at the consulate. I could dig this up for you if you want.

Assalaamu Alaikum and hey everyone :)

Well, my question is, I married in Tunisia in 2009 and brought my then husband over on a k-3 visa which was filed DCF. We have since been divorced :(.

I have since met someone who I would like to bring over using the fiance visa. But can I do this if it has only been 2 years since using the k-3? Also He is Afghani but studying in Malaysia. Does this pose any additional difficulties? I will be going in April or August for one month depending on if I would be able to start the process then.

He actually has his SIV (special invitation visa) approved up until the last step...but the NVC has basically told him it could be years to actually be accepted and receive it. He was eligable for it as he was a translator for the usa military in afghanistan, and Obama has dwindled the number of those visas issued to only 50 a year..so we are thinking to stop that and go along with the k-1 visa. Any advice would be sooo helpful.

Are you sure it was K-3 filed DCF? K-3 petitions can only be submitted stateside. Petitions for IR1/CR1 visas could be submitted via DCF.

Regardless, you are able to submit an I-129F for a fiancee visa.

Today, I was prompted by question here re: and RFE for this question. I went over my form again and just noticed I didn't answer the question re: three or more conviction relating to controlled substance....and I have already mailed in application :crying: . I looked at the example form on this site and that form didn't have a yes or no option but the I-129F I have did and I totally overlooked it hundreds of times! Does anyone know if this will result in RFE? I am certain it will...but wanted to know if anyone had done the same. I'm so disappointed because I feel a RFE is imminent just for that.


You may receive an RFE to answer the question, but it certainly is not imminent.

Since receiving the NOA2 she has done some freelance photography work as an independent contractor. The work is very sporadic at best. Would it be ok to list her "present occupation" on the DS-156 as unemployed? The intent here isn't to lie about anything but rather make sure it's right.

It seems such a ridiculous arrangement, that they can't assess people and decide whether to allow them in or not at some earlier stage, and save everybody a lot of energy and costs and grief... Oh well!


Do you not understand that facts and circumstances can change after visas are issued? Hmm, lets see.... I apply and am approved for my multi year multi entry visa and then I go to a terrorist training camp. Since I was previously approved, should I still be allowed to enter?

B-2 and F-1 are very different entry categories and will be "treated" differently. In a nutshell, each entry category has its different entry "requirements", and all within the category are treated the same

I have NO personal experience with this, but just a thought in reply to the poster above. If the airline's main goal is getting the person out on the next available flight, and you're worried about being held (don't blame you there!), I would try and schedule a flight that arrives early in the morning. That way, if something happens, you hopefully would get immediately sent home since I'm sure many flights leave during the day with no stayover.

The account I read of the man who was handcuffed etc. was on another immigration forum similar to this one. He was also on the visa waiver program, like myself, but he was from the UK, and had recently become engaged. He told the truth but couldn't show enough ties. He said he was quite traumatised by the way he was treated. Apparently they transferred him to a county jail because there wasn't anywhere else to hold him, and he was in a cell with a bunch of convicted criminals, all his personal belongings including his ring and so forth were taken from him and only returned an hour before the flight, and he was only allowed two very short phone calls to his fiancee. I just wondered if that was a normal thing to happen! It seems a bit odd to me, if you hadn't committed a crime and you weren't resisting being returned home, why they'd even need to hold you anywhere. And if you have to pay for the flight back yourself, how do you make the arrangements and try to change your ticket or find a flight that isn't ridiculously expensive, if you're stuck in a cell and not allowed to use a telephone or the internet? I want to visit so very much, but I really want to know what I could be letting myself in for - the worst-case scenario I guess.


Where else will they hold someone overnight once the POE closes? They cannot let him/her run a muck around into the airport.

No need to find a flight, make travel arrangements or change a ticket. The deal is to get this person out on the next available flight. Period. No regard to price. The airline does this.

its mid feb... no extension yet required for two months. if ead is truly 30 days away, ssn should be issued before tax day

I don't know how to explaine my situation.
I came to the US on 2002 as Student on F1 Visa , then I left the US with an orden on Nov 2004 since I over stayed my VISA .
I stayed in touch with my girlfriend ( now my Fiance ) she came to visit me like every year since in Spain and in Morocco, and now she is comming to visit me again the april in Barcelona Spain.
we are both tired of the long distance relationship.
We wanna file for a K1 visa so we can get married in the US.
She now lives in Baltimore , MD
Just we want some help so we can be on the right path.
So we should to file for the K-1 ( NOA1 wait until NOA2 ) then file for a waiver .

If any could help or passed throo the same experience please sahre the informations you have .

You file for a waiver when and only when (if and only if) the visa is refused by the CONSULATE.

yeah his punishment was till march of 2010 after that they told him we was able to apply for a other visa. he applied for the tourist one again but they denied it cause he didnt meet the requirements. but he asked if he had anything in his record and they said no that it was due to lack of papers

A ban is a ban is a ban. If he has been banned then they would not give him a visa of any kind. You say he has been allowed to apply for a visa again, so I assume they have given him one. If so, then no refusal on the K-1 for this reason

If you are looking for definitive confirmation of what you are doing, the best place is the website of the organization (in this case the USCIS) not a search on another website that might accidentally return old information (nature of search engines) based on the first hit of your search criteria.
