My fiance went to get his shots today and receive his documentation to take to the Embassy for his interview. He was told that the envelope he was given was to be given to the Embassy, but he also received x-rays that he was told he should give at POE. Is this true or should everything be given to the Embassy instead? Did this happen to anyone else?

x-rays are yours to keep. ours are in the closet, never to have been needed.

no speculation needed, you are confused. the texas address for the petition is not the service center but a glorified mail room. they take your package, open it, put it in the system, assign a service center (csc or vsc), send the package to the service center

There are different signs at different airports. She should use the line that says visitors. She is not a USC and she is not a resident yet, so she shouldn't use the line reserved for them, unless directed so by CBP officer.

I don't think your fiance is a US citizen yet. If so, she should not go to the line that's reserved for US citizens, unless directed so by a CBP officer on duty. You rather want to err on the safe side, than having to deal with that one CBP officer among a hundred or thousand who takes this as a false claim of US citizenship on her side.

I've never used a line reserved for US citizens, not even as a Green Card holder traveling with my US citizen wife, until I became a US citizen myself. Funny enough, at the U.S. Virgin Island the visitors line was much faster than the US citizens line.

There is no such thing as a USC ONLY line... If you look at the signage, it is "visitors" and "USC & RESIDENT" lines

As is the standard response for this question each time it is posed (about once a week.)

Just ask the crowd control officer... he/she will direct you accordingly. Chances are you will both be directed to go to the USC/LPR line.

K-1 Fiance(e) Visa Process & ProceduresMedical Exam for K1 Visa . . .

My apologies if this is the wrong place to post this.

I was wondering if any Canadian females out there who have recently undergone the medical exam in Canada could share their experiences with the medical exam. Was a pap smear required? Sorry for the bluntness of the post...just a bit uncomfortable with the idea of having to go to another province and be seen by a completely new doctor.

Thanks for any help you can give!

K-1 Fiance(e) Visa Process & ProceduresAfter the K-1 visa approval at Juarez

Here is what I found. There are only 2 POE at Juarez/El Paso that process K-1 visas. The CPB representative told me that the K-1 visa holder must go to the POE stated on the visa. Once processed, the visa holder can fly out of Juarez or walk across the bridge. The bridges are Bridge of the Americas POE and Ysleta POE. She suggested calling ahead for a taxi at the El Paso side because not all POE have taxis waiting. The POE is open 24/7. Here is the CPB link for more information.

http://www.cbp.gov/x...rts/tx/2402.xml

You are not obligated to use any POE... You use the POE most convenient to you... You can use any POE from Brownsville to San Diego... or use any international airport that receives flights from Mexico

K-1 Fiance(e) Visa Process & ProceduresK1 OR K3 COULD EVERYONE PLEASE ADVICE !

I think you are confusing yourself. If you get married you are not elligible for K1 Visa anymore. K1 visa is a FIANCEE visa not a wife visa. If you are planning to get married prior to applying for a visa, you are most likely looking at CR-1, as K-3 is rarely used at this point.

The financial information is the same as for K-1, K-3, and CR-1.

On the financial support you would want to show the tax returns for the last 3 years. If you fiance/husband doesn't have sufficient income you can try to find a co-sponsor.

Hope this helps and good luck!

While three years is a standard boilerplate answer, the real answer is depends on your consulate. Some consulates (including Kyiv) only require one year and current. The 3 years is reserved for those who are self employed or need history to disprove a bad current year. Some consulates, well maybe just one, do not require financial information at all.

Thanks Velociraptor! I didn't know police certificates had an expiry date. I'll have to wait a bit then.

Payxibka : thank you, I found that page on travel.state.gov too, and I did contact the Turkish consulate here in my city, but they don't seem to be aware of that.

unfortunately the US Consulate is going to go by the information it has which is on the travel.state.gov site. You will be expected to provide a police report. My wife had to travel to the other country to retrieve hers...

K-1 Fiance(e) Visa Process & ProceduresPolice Certificate when lived abroad
Police Records

A Turkish Criminal Record is available and the quality of the document is high. The document can be obtained in 2 or 3 days by applicants. It is available both to Turkish Citizens and other nationals, whether they are living in Turkey or residing abroad.

Police certificates from Turkey are known as "ARSIV KAYITLI ADLI SICIL KAYDI". It is mandatory that they come with the archive records.

In Turkey, the applicant can obtain the document by visiting one of the 167 Criminal Records offices of the Ministry of Justice. The official there will do a computerized records check on the national system. To request the document from abroad, the applicant should contact any Turkish Embassy or Consulate. When the police certificate is prepared at a Turkish diplomatic mission, Turkish, English, French and German translations will also be shown on the document.

When requesting the police certificate (adli sicil kaydi), applicants must specifically request that both the current and archived records be shown on the document. The report will indicate the presence of a criminal record even if the convicted person was released after completing the sentence or was pardoned by an amnesty. The document lists each section of the conviction and sentence. Crimes are supposed to be entered into the system within three days of conviction. For crimes of moral turpitude, records for crimes committed by children between 11-14 years old are purged in 2-5 years; crimes by children between 15-18 are purged in 5-10 years; crimes committed by adults are purged in 5-10 years. Multiple crimes are not purged.

If a criminal record is needed in a language other than Turkish, the local Office of Criminal Records must request the information from the Turkish Republic Ministry of Justice General Directory of Criminal Records Central Office in Ankara (address above), which may take a few days.

Please note that if you are currently living outside of Turkey and would like to request a police certificate, you should not contact the Turkish National Police directly. Rather you should contact the nearest Turkish Consulate in the country where you reside to request the information. Please be sure to sign your request and include a copy of a valid identity card with your request. You may request a response in English.

K-1 Fiance(e) Visa Process & ProceduresChange of address while file is at consulate

I (USC) moved 2 weeks ago and our file is currently at the consulate. I know I have to call NVC to notify them and we will put the new address on all the forms for the consulate. My question is USCIS. I know they don't care about me moving now that our petition is approved, but the new address (where he will live once he gets here) is different than the one we listed on the I-129. Do I need to change it with USCIS now and can I use their online system to do it? Or do we wait until he is actually here to change it? I've read their directions and old threads and still not sure.

no, the uscis does not care about the usc until you have an i-864 on file with them.

K-1 Fiance(e) Visa Process & ProceduresI-864, Affidavit of Support questions

Ok so now i am confused, i thought from the above statement mentioned in my first post that the income of all relatives that reside in a single domicile could be combined...thats what i understood from the above statement or is that only on the I-864 form and not on the I-134 form? Would a single person have to meet the requirements for the I-134 form? Then when i filed for AOS the I-864 form could use the combined income of a household? I would be using the London US consulate.

London consulate is not involved in AOS process so the i-864 question does not apply to them, but the USCIS. if the income is to be combined then the i-864/i-864a is used

K-1 Fiance(e) Visa Process & Proceduresnon-legal religious wedding before K1 visa

We are in the process of getting a K1. She wants a religious wedding in her home town before she leaves. We have a priest that has agreed to perform the wedding without any of the legal paperwork so it would be a religious but not a legal wedding.

Would this put our K1 application in jeopardy?

no... but what will get you in trouble is doing stupid things such as pretending you are married (action and/or photos), and allow people (consulate, CBP)assume or misunderstand things that are not true. That is what has burned people before

K-1 Fiance(e) Visa Process & ProceduresRFE a Formality or Potential Problem

I received an RFE notification and have not received the official letter from the VSC yet. My understanding is that most of these requests are minor issues and generally the K1 petition is approved after providing the requested documentation. Does anybody know if there are cases of K1 petitions being denied after RFE's and if so, what was the issue?

of course their are cases... issues are widespread because RFE's cover any part of the information requested that is contained in the petition.

The petition will fail if the documentation submitted with the RFE was insufficient to answer the adjudicator's question. Plain and quite simple.

The basic tenants of the petition is that the petitioner is a USC. The two individuals have met in person face to face within the last two years and are both are free to marry.

Hello Fellow VJers!
I have a question for those who are done with embassy interview.

During the embassy interview is it required to submit ORIGINAL W2s, Form 1040s and tax return transcripts? or submitting photocopies of them is acceptable? i sent to fiancee all originals (2008 - 2010) but would be good if we can keep the originals for future AOS requirements (assuming a k1 visa is granted).

Anybody who can help, pls. do. We would really appreciate them. Thanks so much!

original w-2's and 1040 are on file with the IRS... all you have is a photocopy of the return anyway

K-1 Fiance(e) Visa Process & ProceduresUSCIS website change of address/AOS

Hello everyone. My fiancé and I are waiting for our NOA2, and hopefully will be receiving it soon. According to the Visa Journey processing times, I129Fs filed at the California Service Center in June are currently being processed. (Butterflies!) I just changed my address, though I moved about a month ago from Reno, NV to Brooklyn, NY because I wasn't sure if I would be moving again to another apartment. I changed it online at the USCIS website.

I was wondering if anyone had any experience with online Change of Address forms and if it really works? I will be calling the USCIS asap just to make sure but I figured I would cast a net here first.

Also, I'm currently a graduate student and am living off a student loan and savings. What's the likelihood, in your opinion, I would need a co-sponsor? My parents and family aren't exactly supportive of the marriage, seeing as how they don't know yet, and will most likely not sign off as co-sponsors. Thanks and good luck to everyone!

K-1 Fiance(e) Visa Process & Procedurespetition for fiance visa

hi everyone:)
this is my very first post so please bare with me!
i just became engaged to my boyfriend of 1 year. i'm a US citizen and he's a citizen of nicargua who currently resides in costa rica.
To my knowledge, i've filled out pretty much all of the required forms. the following are questions that i still have, and i want to get them figured out before i mail the petition! UCIS recommended i get a lawyer because they were unable to answer these questions. thanks for your help!

1) "Other names used" only pertaining to last name?
2) I HAVE INCOMPLETE INFO ABOUT MY ESTRANGED FATHER (who's now deceased)
3) Costa Rica has very strange addresses and i want to know if it is acceptable for the forms (but I don't think i have any other options!) For example: "Across the street from the cemetary, San Carlos, Costa Rica." Or "200 meters south, 50 meters west of the school, la tigra, costa rica"
4) Do I have to write N/A or NONE in every single box? also, is SAME AS ABOVE allowed?
5) Can I use testimonies of mutual friends about our relationship?
6) Do I just mail the petition to Dallas? Do I need to see anyone in person or go to consulate in my hometown?
7) the form G-325 seems like it only pertains to the beneficiary. what exactly do we need to fill out? are we supposed to leave blanks?
8) what if he doesn't have an alien registration number??
9) What info should i get from him while i'm still here with him in costa rica? blank pages with his signature just in case i have to retype it? what else?

1) typically
2) do your best
3) do your best, you wont be the first for this country to have this issue
4) I would not use Same as above... use N/a sparingly
5) not beneficial at this stage. relationship evidence is presented at the consulate
6) Dallas... no such thing as a consulate in your hometown...
7) no blanks
8) he will upon petition approval... until then NONE
9) yes, several signed g-325a and signed statement of intent to marry...

K-1 Fiance(e) Visa Process & ProceduresTeenage K2's

Hi All,

I have 2 children. My daughter is 16 and coming with me, so she's easy. My son is 18 and studying at college here in Aus and won't graduate till December 2013. I estimate arriving in the US first half of 2012 and both kids are listed as K2's. I've been trying to find out what the process will be for the K2 and the time line, but can't see anything. I'm not sure if it will fit my son's circumstances, as he will need to return to study and the max time he could come over prior to the end of college would be 3 months. That wouldn't be enough time for the AOS for him I think...so maybe I should take him off the process.
Is it a problem to remove a K2 off the list? Has anyone else had a circumstance like this?

Thanks all.

not a problem for him not to apply, but it will cause A huge delay if he ever wants to become a US Resident if he misses the K-2 opportunity, it is likely many years before he can be petitioned for by you after you arrive (like about a minimum of 4)

K-1 Fiance(e) Visa Process & ProceduresRussian Police Certificates for non-Russians

So, you think just because it's a public forum, it's OK to call someone a liar? You're a jerk. :bonk:

It doesn't matter now and it's pointless to discuss this further because obviously you know it all. What matters is my fiancee got her visa after a 15-minute interview in Vilnius on September 29. No problems whatsoever despite a missing police certificate. Explain that if you can.

I'll gladly provide copies of the emails and visa to the forum moderator upon request.

That being said, this discussion is over.

OK..

The consulate can decide to require or not require.. It is bad etiquette to detail a one-off exception as something to be done by everyone... it sets an unrealistic expectation.

Russian police certificates are easy to get for anyone... you were lucky that they gave an exception.

K-1 Fiance(e) Visa Process & ProceduresNVC has not recieved noa2 from USCIS

How do you know that USCIS has no idea about the consulates processing I-129F? Is it too difficult to have a list of the processing consulates?!!! They can simply get it from NVC.
Although I don't want to insist, but it makes so much sense to me that they send I-129F directly to the related consulate. It saves so much time for NVC and payment to DHL (from USCIS to NVC and from NVC to the consulate). After all, NVC doesn't do anything except giving a case number, which is basically useless when the designated consulate is already known.

It was also mentioned in my letter of approval that if we want, we should contact the consulate for transferring the case to another consulate, or the petitioner can file I-824 with USCIS for change of consulate. It didn't say anything about NVC. Do you still think it is Impossible?

YES, IMPOSSIBLE... NVC is the drop off "POST OFFICE" for the system to get petitions to be delivered to the consulates. The assigning of the useless consulate case number and getting it logged into the Department of State database system is a pretty damn important step

K-1 Fiance(e) Visa Process & ProceduresNVC has not recieved noa2 from USCIS

Yes! I received my NOA2 on July,28th and it says that the petition has been forwarded to the listed consulate. I called USCIS and the operator told me that I-129F petitions are directly sent to the consulates whereas I-130 petitions are sent to NVC. I'm not sure if it's a new policy or the guy in USCIS just wanted to get rid of me!

Impossible... NVC is the gateway to the consulate delivery system and is responsible to assign the appropriate consulate and new consulate case number. The USCIS has NO IDEA which consulates do or do not do the type of visa being petitioned for.

For example, if you put on your petition that you want an interview in Mexico City and the USCIS sent it there you would be out of luck as Mexico City does not do K-1 visas, only Ciudad Juarez does...
