My name is Kirk and my fiancé is Jane, she is from the Philippines and we met in December, well way before that but just chatted as friends and started a relationship in December. there is no anectdotal evidence to suggest that a personal check causes any kind of delay (unless the check is not honored at by your bank)

I beg to differ on the statement that it does not say. Here is an excerpt from the instructions.

Copies. Unless specifically required that an original document be filed with an application or petition, an ordinary legible photocopy may be submitted. Original documents submitted when not required will remain a part of the record, even if the submission was not required.

it is important to provide the right information...

A letter of intent needs to indicate that both parties are intending to marry withing the 90 days... while dating the statement would be good practice it only indicates a original statement of intent not an original DATED statement of intent

That is not true.
The beneficiary can likewise see adjustment under I-360 Violence Against Woman Act (WAVA) if the petitioner turns out to be a sour apple. Likewise a beneficiary who can also seek relief under the provisions of Asylum and Withholding of Removal (I-589).

a catch-22... the answer is yes and no... 90 day EAD stamp is historically only given at JFK ( a few isolated other places but inconsistent at best)... however, based on the new I-9 rules, it is nearly impossible to fulfill that requirement based on the solely the "stamp" in order for a legitimate employer to hire....

I was informed that it will be longer to petition your spouse compare to Fiance'. Is that true that spouse is actually longer process than Fiance' Huh


spouse petition/visa process could be longer unless you have the ability to file the I-130 directly with the consulate and thus avoiding the USCIS service centers. If you are legally resident in your spouse's country for 6 mos. or more, you may qualify for this alternate and many times faster process.

Ok! we will prepare photocopy of the passport pages with immigration stamps and photographs ad evidence of meeting. Is that Ok.


Well passport stamps is one of the primary evidence types they are looking for.... photographs are secondary evidence that supports the primary... a million times better for the evidence of meeting requirement than chat logs...

they do not care about your financial situation ... they don't care if you have $1 or $100,000.... your finances will not be addressed... This is very different than a tourist visa application.... where your finances are more important

the requirements say that you must have met "in person" within the last two years... It does NOT say that you must have met "in-person" for a minimum of two weeks withing the last two years.

BOTH sides of the birth certificate. If the back of the birth certificate is blank, copy it and submit a blank page, wirte on the blank page "copy of back of birth certificate" You could try to be sneakey and simply attach a blank sheet but they may have copy detector scanner fratastats which would become discombobulated and be able to tell you slipped a blank sheet under their nose. You would then get an RFE asking for a fresh sheet of blank paper run through a copy machine and your case would be delayed for weeks. Best to copy it first. smile.gif

As silly as some of these instructions seem, it is best to follow the instructions or as indicated above, make slight modifications so the the adjudicator understands that you actually READ the instructions....
