My husband is here since November on K1 visa. He has filed for AOS and received advance parole. We were told his son could follow within a year, and we are going back down to Jamaica to get him...

What do I do? Where does his son get his own visa...I am getting conflicting info all over the place. The embassy made it sound like he could just come join no problem, but now I am hearing we need to file all these forms.

Has anyone here done this? What was the procedure?


You need to speak with the consulate... you will start with the forms similar to what provided your hubby from the consulate (DS-156 et al...)...

In part 5 q.21 we are a little confused as to what to check. We checked '1' for 'Enter the number you entered on line 10', which is me. We then checked 'Yourself' for her but then for the next one we are confused! It asks her if she is married to enter 1 for your spouse, well she is married, to me! so we check '1' but then at the bottom it asks to add up all the 1's and enter the final number for our 'household size' which we done and our number is '3'. The problem is our household size is not 3, it's 2, just me and her!!!

Anyone know what we should do??

This is kind of a 2 part question.

As I understand, the baby is a citizen of whatever country that the baby was born in even if the father is an American citizen, correct? There's no way to get around this at the embassy level to change the citizenship of the baby to American. Am I right?

Secondly, for those that have filed for their fiancee with dependants be that the child is theirs or someone else's, is there anything special that must be done? Would the child just simply be added to the i-129? I'm sure birth certificate will need to be provided but anything else?

A child is not automatically a USC... it depends on several factors. If the child has a claim to US citizenship then this issue needs to be resolved first... a US consulate will NOT issue a visa to a US citizen. This information comes out when you supply the parentage information for the child... so it is not so much about TMI... as it will be difficult to hide this information.. besides... a lot cheaper in the long run just to deal with this now and get a determination.

The USA does NOT have a problem with dual citizenship.....

Was she going to school during that time? If so, she could just say she was a full time student. Can she find a part-time job to keep up until the interview? This way she could have an answer to the question. I think what they want is to determine that they are sending a skilled person, able to work, not to become a public charge.

The process is virtually the same regardless if you are Dutch, Korean or South African or any country in between

1) You do not start the procedure but the USC must

2) You must first decide your immigration path then your work options follow.... each path has different points where work authjorization starts

3) Maybe, maybe not

4) getting married is not the issue... it is remaining in the US and how that happens is the issue

5) you can start the process in the USA.... work authorization however is not immediate...

6) look at the guides and study them... your options will depend on whether you are fiance(e) or spouse

There are two spousal visa types... the required I-130 is petition for immigrant (CR/IR) visa and the follow on optional filing of the I-129F (K-3)

Answers will depend on which visa you ultimately get... you can pursue both up to a point in time then you decide

K-3 interviews are in country of marriage

Immigrant visas are in country of residence... so if she returns to Russia it could be Moscow.... Avoid Guangzhou if you can because it is notoriously SLOW

I do not know why or how an attorney could help solve a USCIS receipting issue... just be aware... at this time of year the USCIS is innundated with H-1B applications and all other mail takes a back seat until they get through that process because those are very time sensitive..... while I-129f are not so much
