Calling USCIS after the petition leaves the USCIS system is pointless... they have no idea... (as your answer from them demonstrated). Calling NVC might get you an answer.

Also, it's been a bit of a struggle to find the exact process one uses to facilitate the K-2 visa for my fiance's child. I think I have most of it nailed down, however there remains some gray areas. I've found conflicting reports about whether or not a G-325A is required for her child who is under 10 years of age. Most sources say no. I've also read that children under age 14 are not required to attend the visa interview in London and was curious about how the visa is approved and issued without the child being present.

A fiance(e)'s child is granted derivative benefit based on the approved petition of the parent. The ONLY requirement for the child to be eligible to apply for a visa is to be named on the parent's approved I-129F. Nothing more. No G-325a regardless of the child's age. The K-2 process begins with the consulate when you actually apply for the visa (DS-156 et al...).

I stayed at her house in NJ and we made a couple of trips to New York where we got hotel rooms. I have those receipts that cover a few days however they only have my name on them but not my fiancee's.
My passport is stamped from when i entered the U.S in Hawaii, and other than secondary evidence like photo's that's the extent of the proof i have.

I'm wondering whether the evidence i have will be sufficient in this process based on the knowledge you guys have on this.

why would a criminal background check include your credit score?

On the I-129F some crimes needed to be disclosed regardless of expungment... if it was a disclosable crime and you did not disclose it could be a problem

So the AOS... that one must be gotten once inside the US, correct? The fee is due when applying for it? (meaning, the money must be included with the application?) And the flow-chart is a little vague about this -- how long after being in the US would you apply for it? (it says 'as soon as possible' but what does that mean in terms of months/years)


If you enter on a K-1 you are eligible for adjustment of status once the marriage has taken place.

I'm now looking at the Guide page for K-3. I don't see any information about costs on the entire page. If I click into the various links for the I-130 package, I haven't found anything yet that mentions the cost or fee for that, or if there is no fee needed for it. I'm not sure what you mean by 'simply look it up' -- so far it it's not seeming very simple.


The VJ guides will give you help to the process including the different petitions and applications that will be required to be filed. Then you can go to the USCIS &/or your embassy website to see what the current fee structure is for various filings.

Currently for a K-3 there is no additional filing fee for the I-129F (but you do need an initial I-130).

One would simply need to lookup and add together the costs of all the petition filings and applicaiton fees. I would guess $1500 - $2000.

They cannot nor will not TRY to issue a visa to your daughter unless you submit a visa application for her.. which you will NOT. A USC CANNOT be issued a visa... This is not an unusual situation... so yes, stop being paranoid.

probably not, besides most airlines stop allowing a pregnant women from flying at about 7 mos.
