K-1 Fiance(e) Visa Process & ProceduresWhy did Vermont SKIP NVC and send NOA2 to Consulate?
QUOTE (I Am Mello @ Apr 8 2009, 11:10 PM) <{POST_SNAPBACK}>
I got my NOA2 APPROVED! But this is puzzling to me. The letter starts as follows:

The above petition has been approved, and forwarded to the listed consulate.(Juarez I guess) Please contact the consulate with any questions about visa issuance, or if you would now like them to forward the petition to a different consulante. The petitioner can also file Form I-824, Application for Action on an Approved application of petition, with this office to request the we notify another consulate of the petition approval for visa processing purposes.

I did contact my congressman and told him I was concerned about all the violence in Juarez and was there any way to let her do the interview at her consulate in Guadalajara. (This was before I knew ALL interviews must go through Juarez) It seems as if Vermont sent the approved application to Juarez and skipped sending it to National Visa center. That's Odd... isn't it !

I am in Guadalajara this week for Holy week and can not read the contents of the letter for myself. I had someone open the letter and then email me the contents. I do know the letter was from Vermont and NOT the NVC. So it seems as if they went directly to Juarez with the approval. When I get back to the states I will contact the consulate.

I'm scratching my head here and hoping this doesn't add more time to the whole process. Does anyone have any ideas here? helpsmilie.gif

Well...My fiance is wanting to feed me cheese, I need to eat it... opps she said its not cheese it's a snack LOL

It is the standard letter, it still goes to NVC so they can send it to the consulate.... NVC is the gateway... the petition cannot get into the consulate system without passing through the gateway

I wish to marry my fiancee from Ukraine. I am a U.S. citizen living in Europe and can not return to Ukraine for 6 months. She is a widow with a young son, owns her own flat and a business (on paper). Ukraine does not let single woman leave easily. These are my possible options: Marry her in Ukraine by proxy (not present) and then get her a visa to USA (not likely). Get her a visa to go to her brother in Spain and marry her there. This seems to be the best option, but how do I get her to USA afterward? Does getting married first make it easier to get into the USA? What would be necessary to accomplish this? She is not in a safe situation in Ukraine and needs to get out. Please help.

no, the sponsored immigrant simply getting a job is not one of the criteria that cancels an I-864. The equivalent of 10 years of working however does.

K-1 Fiance(e) Visa Process & ProceduresHelp! Need advice
QUOTE (philandhannah @ Jun 23 2009, 11:58 AM) <{POST_SNAPBACK}>
Hey, I just want to hear some feedback and advice about a thought we have in regards to the K-1 fiance visa.

I'm Irish and my fiance is a US citizen. We are planning to get married in Ireland and then live in the US. From my research this is what I've come up with in terms of a possible legal route we can take:

We would apply for the K-1 fiance visa and I at the same time would apply for the Form I-131 allowing me to travel on the visa.

I would, next spring, go to America and we would marry at a court house getting the marriage license etc making us legally married. I would then return to Ireland and we would be married at a ceremony a month later with our friends and family present.

We would then both return to the US to live and I would apply for permanent residence.

I'm just wondering through your experience would this route be legal and an upfront way of doing things?

I also have some quick questions too. How long does a person have before they must apply for permanent residence while on a K-1 fiance visa?
And also while on a K-1 with the I-131, can one leave and return multiple times or is it a one time thing?

Also, if anyone has a better route we could take given our wishes and circumstances, please feel free to share. Any help and advice would be much appreciated. Thanks so much!

You cannot apply for a K-1 and I-131 at the same time. Advance Parole is to protect your entry status while your status is being adjusted to that of permanent resident. If you are not in the USA, you have no status to protect.

Hey I was applying for a K1 visa for my fiance in Germany, I turned everything in and they had sent it all back to me because they did not recieve my check that I forgot to put in there. And this was in March 5 2009. Can I still send all my papers in with the money or is it too late? Should I just start a new packet and send them all of that, I think it might be better since i have more pictures and proof since she came and visited me a couple weeks ago.

Need to know what you guys think/know before I send it in. Thanks.

K-1 Fiance(e) Visa Process & Proceduresoriginal signatures on forms?
there was a USCIS memo to the Adjudicastor's Field Manual (AFM) where the original signatures was not a reason for petition denial as the consulate could "capture" the required signatures at time of interview. Unfortunately, I am unable to locate this memo.

FWIW, the public version of the AFM is available online for all to review.

K-1 Fiance(e) Visa Process & ProceduresTwo I-129F packets sent
QUOTE (SCFsnoopy @ Jun 24 2009, 01:43 AM) <{POST_SNAPBACK}>
Was on the phone with my fiancé today – I was asking him to post a copy of our I-129F and NOA1 so that I can have them with me for POE when I go over in August. Long story short, I found out that when he sent out petition off, he forgot to put the photos in the packet, so he sent a second envelope about two days later with a photocopy of the original I-129F and slipped the photos into that packet.

I know photos aren’t the be-all and end-all of proof of meeting (there were also photocopies of boarding passes, my J-1 visa, entry stamps, etc) but it still helps. Do you think USCIS would have realised, when they got the second envelope, that those photos were meant to go with the original petition? As far as I know they didn’t send the second packet back so I can only assume they figured it out, since obviously the second packet had no check in it which would make them immediately return it if they thought it was a new petition.

I suppose the worse case scenario will be an RFE, so I’ll ask him to get more photos printed just in case… just wanted to see what you guys think about it.

I am in the very beginning stage in this process, mailing out the first package. I just want to make sure the only thing I have to do right now is to add him to the list of her childrenn on the I-129F?

There is no box on the I-129F or extra form I have to add in addition where I check for obtaining a K2 visa for him right now? I believe I read somewhere how this will be something to deal with later in the process, when she is going to her interview with the embassy in her country?

Thanks.

No box to check for obtaining a K=2 visa because all you are doing now is submitting a petition to determine eligibility to apply... No visa application yet.. that comes later...
