My Fiancées medical and interview are now completed. Can she visit the panel physician facility in Shanghai to get her vaccinations done before she comes to the US? Will this be accepted by USCIS for AOS? I've read the guides and FAQ's but I'm still not entirely clear.

vaccinations can be done by any clinic in the world, as long as you have records and they are appropriately reported/recorded on the proper form for aos

depends on your consulate... some want to see all applicants while others use 14 yrs as the benchmark. You need to provide the consulate name so people familiar with it can tell you what they require

I'm starting to gather information for the I-129F, and I've read that it's possible to shave some time off by filing this abroad rather than from the US. I'm currently living in Thailand, and I've been living here on and aff for 5-6 years.

Does anyone know the requirements to file the I-129F from the USCIS office in Bangkok?

No but he will be her her husband. His income will need to pay child support, her income will need to make up the shortfall that paying child support causes. My ex casually told me about 2 years into our relationship that his $250K loan from his parents for schooling (international student) would be paid back once he gets a job. He never told me it was a "loan" and that it would need to be paid back. Nothing like being informed that the next tens of years of my life will be assisting to pay HIS debt... which is something I felt I should have been made aware of when we started dating.

she needs to be aware that she will be assisting with child support by way of making up the difference in income. That her family may need to make sacrifices for a child she's never met, for a woman she's never met. Just as I would have had to help pay his debt with changes to my life and why when Tony and I started dating I made sure he was fully aware I had a credit card debt I was paying off, and made sure he was okay with helping out with it if I didn't get a job before my savings to pay it while unemployed were depleted.

It seems even if you're petitioner is a sex offender, you're still able to come over to the US on a K-1 Visa. A coworker of my cousin came over from The Philippines 4-5 years ago on a K-1 Visa. Her fiancee a few years prior to filing the K-1 visa was arrested and found guilty of possessing child pornography. He was prior military and was discharged (USAF Article 134) after the conviction. He then met her online, went to Philippines to meet her and filed a K-1 Visa afterwards. She was approved. Now she's filing to be a US citizen soon.

I don't know all the details to their case, but just referencing what my cousin conveyed to me and by looking at his sex offender profile on the state database.

Back in 1982, I was charged with a felony of fraud, no jail time, 3 years probation and restitution. For almost 5 months I was holding my breath worried about the consequences this would have on my approval, but thanks to God, I was approved on August 29th. I think it really depends what the arrests were for, the outcome and how long ago they were and your history since those arrests. Also, if you were a minor or not.

With regard to being interviewed, I have seen a very small percentage being interviewed but usually after the approval of the I129F.

Hi everyone! I would appreciate if anybody could shed some light on what is best to do in our situation. My US citizen fiance is putting together the paperwork to get me a Fiancee visa, we have already a baby that was registered in Mexico as mine only, for reasons long to explain here he was not able to travel to the border to get the baby registered as his, so she has only a Mexican birth certificate. He wouldn t have the chance to go now to the border and have her recognized and the two years since we last met are approaching, he was with me in Mexico when she was born and stayed with us for 4 months so the proof of us together would actually be baby pictures. Do you know of any problem that could arise because she is showing on paper (birth certificate) as my daughter only? Would she become (if I get to marry him) his stepdaughter?


stepdaughter means daughter via marriage and not blood... if he is the biological father then she will always be his "daughter"

Thats exactly what I did. You will still have to apply for SSN, I don't know why they ask that question.


Many embassies require Part I

It is because the DS-230 is an IMMIGRANT visa application (just look at the title of the form). K-1 is a NON IMMIGRANT visa. That is why the form is NOT for a K-1 (though some embassies may use parts of it)

I've read many things here and on other sites. I have lots of evidence of our ongoing relationship such as itineraries, receipts, email threads, photos, etc. My question is, how much really should I mail with the petition? At the very least I will mail my itinerary, hotel bill, and photos of my proposal and engagement ring receipt. I know most evidence will be needed for the interview. Any advice?

Evidence of meeting face to face is needed for the I-129F. The USCIS does not need evidence of relationship. At the very least you need to submit your passport stamps showing entry into the country. This is further supported by other evidence such as itinerary, boarding passes, receipts and photos.

Phone records, emails, etc.. are needed for the interview.

no, never said the child needs an i-129f petition... I said the visa application forms to the CONSULATE!.. The petition is NOT a k-1 visa application so do not confuse the two they are quite different

the child just needs be listed on the alien fiance(e) petition. When time comes for visa application at the consulate, the K-1 & K-2 fill out essentially the same forms.

You use the same forms for a child of any age, which is pretty much the same forms the mother fills out for the K-1 that is submitted to the consulate.

each consulate is different but it is essentially the application materials and the list of required documents (birth certificate, police certificate, medical report, etc..) for that consulate

I have a question concerning living situation. I currently live with my parents due to their financial situation and I pay rent to my parents on monthly basis. My parents are willing to write a letter and have it notarized that I do live with them, but I am paying them rent every month. I want to include this in the affidavit of support documentation I will be sending to my fiancé. Will the fact that I do not have an apartment hurt us in anyway.
 
My parents, along with my fiancé and I have looked at various scenarios for this, that include us building out my parents basement and living their in our own apartment, but have decided that it is best that we live in our own apartment once we are married. My parents are aware that we have decided to find our own apartment and are adjusting their budget for when I move out next year. I currently make more than double the 125% above what is required to sponsor my fiancé, so I don't need a cosponsor. I do have some savings in the bank and I am capable of supporting my finance when he comes here and we get married.


Your current living arrangements have no bearing on the visa.

One living arrangement that might have a bearing is if one was still living with ones ex-spouse.

Note it says that the application has been forwarded to the listed consulate (in the application I listed mine as London, UK). On the back print it states somewhere that 'IF it's stated that the application is being forwarded to the National Visa Processing center, blah blah blah.........' - I thought an approved application was always forwarded to the NVC. Why does mine not?

Has anyone seen this before?
Any help greatly appreciated!

All children (under 21 years old and unmarried) of an alien classified K1 should be listed on I-129F Petition for Alien Fiance(e). Children also must be present at the interview. The child of a K1 principal alien may acquire K2 status even after the principal alien has married American Citizen Petitioner and acquired lawful permanent resident status in U. S. A marriage certificate of the principal alien along with the rest of the required documentation must be provided for the child's visa interview in this case. The cut-off date for issuance of a K2 visa is 1 year from the date of the K1 visa issuance to the principal alien.

My wife is in the USA and her daughter is in Russia. The P-3 is foreign nationals to enter into the U.S. to perform, teach or coach as artists or entertainers. Why would she use a P-3 for a following-to-join?


No, P-3 meaning Packet 3, which is the set of application forms your then fiancee received from Moscow to apply for the K-1. It is the same forms you use to apply for the child's K-2.

The USCIS nor NVC is involved if you are exercising the follow-to-join benefit within the one year after the K-1. You need to get going and do it fast as the FTJ expires one year after the K-1 was issued and that means the K-2 MUST be issued by that date, not just applied for. Get it in applied for in Moscow ASAP

My wife has her green card. We are filing in an I824 to bring her daughter here. On part 3 it asks for "information about the original petition or application." Are they meaning the I-485 Adjustment or the I-129f? We are not sure which they want.


I-824 is not the right form. You need to go directly to the consulate with the same forms (DS) as P-3 for your now wife.

I'm just curious...what are the questions they normally ask for kids ? I'm quite worried, hopefully my kids can answer the consul confidently. Any inputs ? Thank you all in advance. K-2 is automatic once the K-1 is approved, any questions asked are not important to the issuance of the visas and will simply be age appropriate to satisfy the CO's curiosity but nothing else.

I am new here please this my case hope i will get help for my brother.My brother wanted to visit her finance in the usa who is a us citizen, He applied for B2-visitor visa a year ago but was denied base on not having enough ties to his country. now they want to apply for K1 visa but they are thinking about this issue. it was actually her finacee's mother who was inviting him to visit but on the ds156 he actually stated he was his auntie. her fiance wants to file K1 for him now would that be a problem? If you are denied a visiting visa base on not having enough ties to your country will the embassy still keep your ds156 information on their system? If it would be a problem what can we do to solve it.
