Yes. You need to either provide a tax return or a reason you did not file one. You will also need to do this for the AOS. I would submit the explanation plus the previous years return (2007) plus your docuentation of current employment and income.



The reason I will provide for not working is that I took a sabbatical plus went to the Philippines 3 times. Which is why I did not work. Do you think this is an adequate reason? I hope, because it is the truth

If you are filing the I-129F a BC for the USC is NOT required and can use the US Passport instead in order to prove citizenship.

The USC's citizenship can be evidenced by a BC or his passport... If that is what you are trying to do, then you don't have a problem

I thought that maybe we could make the resquest to Saint Louis, and if it's not there I guess they check Saint Louis City but well...
Or would it be written St. Louis City on his passport if that's were he was born?

If the child will follow less than 6 mos. after the K-1 then the child could get the K-2 issued at the same time as the visa is valid for 6 mos. after issuance. When you fiancee goes to CDJ for her interview, put the consulate on notice regarding "follow-to-join". Have them explain exactly how they do it. That will be the best source of information

dpends on which POE and how busy it is at the time you are there... JFK can get very busy in the middle to late afternoon and take up to 2-3 hrs....

I thought you could only apply for one kind of visa at a time? Wouldn't a B-1 application and a K-1 conflict?
Australia is a NVWP country, it's how she visited last time we met - THAT time we had a lot of trouble, border
agent must have asked us if we were getting married about 1,000 times. We'd been talking for maybe 6 months
online but we had actually only just met each other in real life, kind of put us on the spot, he finally took pity on
us though and issued her an I-94 (which we forgot about a month later when I drove her to the Vancouver
airport -- we had to mail that back in a hurry).


Let's get some facts straight

1) Nobody has applied for a visa yet... You have petitioned the USCIS to determine eligibility of your fiancee to apply for a visa at a future date. The USCIS does NOT issue visas... that is left to the consulates

2) Australia is a VWP (visa waiver program country) not a Non visa waiver program (which would actually mean that a visa is needed)

I plan on submitting a letter from my employer stating my position, status, income, various benefits offered (medical, dental, etc) and date of starting (May 2009), along with numerous paystubs up and to the time of the interview, which I assume will be at least 6 months from todays' date (I haven't sent anything in yet - me and my fiancee both thought we should graduate first this past semester and have me find a good full-time job first). I would also submit evidence that I was in school (like a copy of my diploma, transcripts, letter from professor) which is why I do not have tax returns and only recently attained my first full-time position making sufficient income just last month. Would the fact that I only recently started my new career position hamper my chances of the visa being approved, or am I safe with that amount of evidence? Any advice?

Page 8, 9, 10 and 13 are "fluff" and do not prove a face to face meeting. Itineraries are easily "forged", Ring receipt means you bot a ring but nothing else as well as a note between each other does not mean you were face to face. You are not harmed by including but is more "relationship" type evidence and is not a requirement for the I-129f but comes more into play at the consulate interview. E-mails would be similiar relationship type stuff

I-129 is a petition for a non-immigrant worker and an I-130 is a petition for an immediate relative... currently your bf is neither

Standard "boilerplate" letter does not know if your country has more than one consulate that performs the "K" visas. For example, in Canada it could be Vancouver or Montreal (but not Toronto, Calgary, etc..)... In Mexico it is Juarez or Juarez.

I did contact my congressman and told him I was concerned about all the violence in Juarez and was there any way to let her do the interview at her consulate in Guadalajara. (This was before I knew ALL interviews must go through Juarez) It seems as if Vermont sent the approved application to Juarez and skipped sending it to National Visa center. That's Odd... isn't it !

I am in Guadalajara this week for Holy week and can not read the contents of the letter for myself. I had someone open the letter and then email me the contents. I do know the letter was from Vermont and NOT the NVC. So it seems as if they went directly to Juarez with the approval. When I get back to the states I will contact the consulate.

I'm scratching my head here and hoping this doesn't add more time to the whole process. Does anyone have any ideas here? helpsmilie.gif

It is the standard letter, it still goes to NVC so they can send it to the consulate.... NVC is the gateway... the petition cannot get into the consulate system without passing through the gateway
