When you say "a couple years", exactly how long ago? If you've had a K1 visa petition approved in the last two years then you'll need to request a waiver for the IMBRA filing limitations at the time you submit your I-129F petition. The request must be a signed and dated letter, and you need to include evidence to support your request, basically explaining why you're submitting another K1 petition so soon after having a previous petition approved. The fact that you're petitioning for the same beneficiary should be adequate for getting the waiver.

Ok. The important dates are the date your previous petition was approved (the NOA2 date), and the date you submit your second petition (the NOA1 date). If less than two years between these two dates, you need to apply for the waiver. If it's close, just wait until it's been more than two years. good.gif

Note that if you don't need the waiver, then this will be your last "freebie" without having to apply for a waiver. The second filing limitation under IMBRA is if you've filed two or more petitions at anytime in the past, regardless of whether the petitions were approved or the visas granted.

Your only dealing with Venezuela will be for her to get a police certificate showing no criminal record. You are prtitioning the US government, Venezuela has nothing to do with it.

Your fiancee will have an interview when she applies for the visa, several months after you file the petition. You can attend but it is not necessary, I strongly suggest it. You MUST ("carved in stone" type MUST) have met in person before filing a K-1 petition and show evidence of that with the filing.
The interview takes place at the US consulate, it is the US government that interviews her


So she will need a police report saying that she has no criminal record for the interview process at the US Consulate in Venezuela?

Also, in your experience, what are the chances of the Visa being approved after you have filed the petition and finished the interview? I know it's a case-by-case basis, however, I'm just wondering what I can expect to be presented with and to occur.


she can have a record but it cannot include any disqualifying events...

If VJ is any representative example, my guess here is that 95% of K-1's are ultimately issued...

no, the interview is at the US consulate for the fiance(e)... when able, the USC can accompany/join/be in the neighborhood for the fiance(e)'s interview

Thanks for the quick reply, only problem is getting time off work for more visits. I already had a hard enough time to get August off because of my work. I'm a Network administrator and my partner was laid off some time ago giving me very limited space for any long term vacation for more visits. I-129F (not to be confused with the I-129) takes about 3-5 mos. to process dependent on service center. Then NVC and London processing takes over and it could be another two months.

The I-601 is filed at the consulate after the visa is initially refused. Waiver process timing can be a long time.

For the K-1 petition/application process. An I-134 (not I-134a), is typically submitted to the consulate at interview time. USCIS will NOT be asking for this in the petition stage of the process.

Your petition has not moved because... it has not moved and is waiting in the queue. It can wait in the queue for many months

As more I explored here, I noticed every one get their NOA1 in less than 10 days.

I don't know why only ours, sent petition on 6 April, get phone call three days later say we need submit another form. Mailed to them again on around 22 April, however, we get NOA2 on 6 June which said our petition was received on 24 May.

I don't know where our petition was during 22 Apirl to 24 May. As we definitely mailed it by Fedex...

It appears you received "exceptional" service... most people would not have received a phone call and simply would have had the package returned 30 -60 days later....

Apparently it depends on the adjudicator... It has been said that some adjudicators will work on RFE's right away (get the case load off there desk), while others will work these cases once weekly or on some other type of schedule. Also, being "prime" vacation time, you are at the mercy of the original adjudicators summer work schedule, as the same adjudicator that issued the RFE will be the one to "clear" the case.

You must be able to demosntrate to the satisfaction of the border officer that you will leave.... Tieing up loose ends and ending your "life' in your home country naturally makes the ability to prove that you will indeed leave a bit more difficult.

Just to clarify... the "proper" visa is needed to have her STAY after marriage... A person can get married on any visa (tourist, etc..) but it is the desire to STAY after the marriage event that causes the complications.

Yes I did an 1-130 i imagine because she did get a green card.

Hi i was hoping someone could help me with a question i have. I am going to be divorced soon not sure exactly when we have been seperated long time. Does the divorce have to be final before i meet the girl in the philippines since at the interview in manila they will see when we met with passport and proof of relationship. Also when i get the final divorce papers is there any special documents i need to show the consular at the time of her interview.
