Are you married or not? I guess you are not since you filed for a K-1. You son is not proof of itself that you two physically met within the last two years before you filed the petition (you could have had the child via sperm donation and never physically met.....yes I know a stretch but in the dog show breeding arena, we do this all the time). You need documentation that you two met in person somewhere within the last two years. Like passport stamps,, receipts, photos, etc.

His overstay will require some sort of waiver and that may be the biggest issue.



His two year overstay will have incurred him an automatic 3 or 10 year ban. You may have to wait until that is up, or appeal, until he can come to the States. Got to play by all the rules, which you understand I am sure.

The case file to some consulates can take two weeks, the case file to Guangzhou can be 2-3 months... you will likely be somewhere in between

Have you read your US embassy/consulate website to see if they have info on the consulate process? appointment process, medicals process, etc..?

the letter will have the assigned consulate case #

most consulates will not schedule an interview without the case file

you cannot apply for a greencard and then marry because you have to basis of eligibility for the greencard... the marriage must come first and then apply for an immigrant visa (which results in a greencard after US entry).

The I-129F has instructions... let them be your guide.... that is where you start.... you need to go through the instructions and simply compile all the required evidence that it says is required. It also tells you how much is the fee... who to make the fee payable to and where you send it

As for the near 21 yr old daughter is concerned, a quick marriage to her mother does not solve your problem... this is because in order for you to petition for her as your stepchild, the step parent / step child relationship needed to have been created BEFORE the child's 18th birthday.

Ok, so the father is issued a K1 visa. Just inside the 12 month window of opportunity, a K2 is issued for the child. 6 months later, the K2 expires. 6 months beyond that, the mother agrees to let the child immigrate. Is that the timeline we're assuming?

The consulate has the discretion to re-validate an expired visa. I don't know the likelihood is of them doing so if the visa expired 6 months ago. Not very good, I would think. It also wouldn't be possible to apply for a new K2 because the child would no longer be eligible as a derivative of the K1.

Anyway, they'll never get to the point of having the K2 visa issued if the mother doesn't consent to the child immigrating. If she isn't going to give her consent for 2 years, then the child will never receive a K2.

An alternative approach would be for the father to apply for an F2A visa for the child as soon as he becomes an LPR. With the current priority dates, this will take about 4 years. If the father becomes a US citizen after 3 years, the petition can be upgraded to an IR, and the child would be eligible immediately.


or the USC spouse submits an I-130 petition for the child when they are ready... since the step parent/ step child relationship occured before the child's 18th birthday then no need to wait for the LPR to become a citizen...

To the OP.. if it is done on the basis of an I-130 petition it would be an IR visa NOT a K-4

unless of course they were not registered themselves... but you might be right.

In MN at least just because you are "ordained" does not automatically mean you are able to perform a marriage... the "ordained" person must register with the county government (and pay a fee) in order to be a registered officiant. Without this they are not able to legally perform a marriage.

Thank you for responding! This is the first step I-129F application to USCIS. Of course I am going to send pictures to prove our face to face meeting. I also wanted to send the letters as proof of relationship but we have hundreds of pages and all of them in Russian. Do you think I shouldn’t send them at all, or send originals to show that we communicate or send originals and translated copies? Thanks!


You certainly are not "harmed" but I will tell you that I did not "front load" my I-129F with any letters. Front loading can be a good thing for high risk, high fraud consulates. You will need to decide if Moscow is one or not.

If you are married and have resided outside the USA for 6 mos. or more then you may be eligible to file for a spousal visa directly with the consulate (this is called DCF or Direct Consulate Filed). The biggest delay in the visa process is the USCIS servicve centers... a consulate filed I-130 for a spouse avoids the stateside USCIS process thus making the DCF proces the quickest by up to several months.

Why are you submitting cell phone bills?


That's exactly what I was thinking - if the information is clear and concise, then hopefully the adjudicator will spend less time on my packet.

I'm submitting cell phone bills to prove that we have been in contact and had an ongoing relationship. My bills list all the calls and texts I've made to my fiance.


For USCIS purposes, cell phone bills do not prove a "face to face" meeting which is what they are concerned about at the petition stage. Ongoing relationship evidence is primarily the concern of the consulate at the interview stage.

for the I-129F it is proof of "face-to-face" meeting... phone calls, e-mails, etc... do not do this
