K-1 Fiance(e) Visa Process & ProceduresK-1 application fee - Helsinki

Hi, I just have to ask because I don't understand at all and I'll soon start crying

I have all the documents ready for the interview and I want to send my checklist to the Embassy, in Helsinki, Finland. Only one question remains. They say on the checklist:
"VISA APPLICATION FEE: Application fee of USD___ or Euros___ can be paid to our xxx account, please bring the receipt to the interview."

WHAT is the ammount they want? I've found mixed information:

On the US Helsinki Embassy site, they say:
"K category immigrant visa $240 - €192.00 "
http://finland.usembassy.gov/fees.html

But on http://travel.state....types_1263.html they say:
"K – Fiance(e) or Spouse of U.S. citizen category visa: $350.00".

So which one is it? I really don't want to make anymore mistakes so please help me!

k-1 fee is changing to $240.. Helsinki info is more up to date

Im not really good at answering things like this but ill try. From what i read in other posts the fees have changed. Im not sure if the fees have changed for everywhere or just for certain countries. Try calling the consulate where you need to send your documents they should be able to tell you the exact amount.

visa fees are the same worldwide

K-1 Fiance(e) Visa Process & ProceduresQuestion about spelling her name on K1 papers

Thanks for all the advice, still not 100% sure which way to go.

And the only reason I mention the Transnistria issue is because most of my family and friends had no idea what it was about before I meet her. They ask what it's like to date a Moldovan girl, and I always have to say she is Russian! You better not call her Moldovan or you'll be in big trouble!

much ado about nothing... this is not a big issue and you are making it something it is not

K-1 Fiance(e) Visa Process & ProceduresQuestion about spelling her name on K1 papers

Not to mention that you are supposed to include the copy of her passport page along with your petition so why confuse them by spelling her name in different ways.

Are you sure about this?

K-1 Fiance(e) Visa Process & ProceduresQuestion about spelling her name on K1 papers

I guess we'll go with the name that's on her passport, but I might make a few calls and see if I can find out any additional information. What makes it all the more complicated is that she is from the Transnistria region in Moldova, so every and all of her documents is in Cyrillic, the one and only "Moldovan" document she has is her passport, which she just got this week. I know this can be a little confusing if you are not familar with the region and its conflicts over the last 20 years.

I filed the petition in the "normal" transliteration of my wife & son's name (Svetlana & Vladimir). When it came time for the visa application I saw the Ukrainian transliteration of the names (Svitlana & Volodymyr). The visas were issued in the name in the passport. I had no issues with the Consulate or the USCIS on the name spelling differences.

All dealings with the USCIS after arrival will in the passport transliteration until or if you change it.

FWIW, I have no idea why you feel that the autonomous region of Pridnistrovia is a complicating factor as it is not. My wife was married and my son was born in Tiraspol. We had a mixture of Moldovan, Pridnistrovian, Russian and Ukrainian documents.

K-1 Fiance(e) Visa Process & ProceduresI made an I-129F misake! What do I do?

Hi,

I just received my NOA1 text message notification last week (my fiance lives in Russia) and on the 1-129F I put that she would have her interview in St. Petersburg. But when reading through the embassy/consul ratings I learned that only the Moscow Embassy handles immigration in Russia. So I need to change my 1-129F to state that she will have the interview in Moscow. How can I do this? What do you think will happen?

Thanks for any advice you can give

you could have put buenos aires and they would change it to moscow

Thanks for that so it is best to have the marrage within the 1st 2mths of the 3 month period so teh forms can be sent in and have a month to process

it takes a lot longer that 1 mos for the forms to process. greencard process can be up to 5+ mos.

K-1 Fiance(e) Visa Process & Proceduresk1 visa translations

Perhaps I have more experience with the actions of Consular officers. They often tend to re-adjudicate issues USCIS has already decided upon.

Really though, this is a recommendation. Unless you are recommending against it for some reason, why not just let it be?

They "often tend to re-adjudicate issues USCIS has already decided upon"? Please... cite some specific examples where translation has been re-adjudicated.

Really though... you of all people have made a VJ living chastising people who recommend doing something unnecessary because they foolishly believe that it somehow makes the case more approvable or even more importantly, for having an opinion different from your own...

There aren't. We simply disagree on whether it has any potential to help the case. As you know well, there's more to the "case" than the USCIS approval of the petition. Sometimes I recommend a belt and suspenders approach and sometimes I don't. Emphasis on "recommendation". Opinions obviously vary. You're welcome to yours as are the readers. Goes both ways.

and what does "more to the "case" than the USCIS approval of the petition" mean in relationship to document translations... absolutely nothing

Since they don't know the friend from Adam, they won't have any reason to think the friend has any potential conflict of interest. That's where I see the improvement and why I make the recommendation. Clearly, the petitioner doing it themselves is acceptable.

If it was an improvement and somehow make a case more magically acceptable/approvable to the USCIS they would indicate so.... Since it does not help the case in any form, it is totally unnecessary.... The translation is either acceptable or not... by your own words, a translation done by the petitioner is acceptable if they are qualified to sign the "statement"... did not know there were different levels of acceptability...

Yes, use the certifying statements you've seen as long as they match the USCIS instructions for the I-129F. My suggestion in your circumstance is to do the work of translating yourself and then have a similarly qualified friend certify your work. You can do it yourself but I think my suggestion is an improvement.

Except the USCIS won't know the friend from Adam, so I don't really know how it is an improvement... competent in both languages with a certification as such is all the USCIS requires....

better to have any translated documents notarized so you will not get an RFE

This is misinformation... translated documents DO NOT need to be notarized.... translated documents need to include a "certifying statement" from the translator that he or she is competent in both languages.... if that is you, then you can do it yourself

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance from Japan
Let me call attention to your first question in your post.

We are waiting on the approval of our NOA2 at this moment.. What is the average wait for a police clearance after request at Japan Embassy?

And I answer:

Applicants Outside of Japan: Former legal residents, former illegal aliens, and Japanese citizens, should apply at the nearest Japanese Consulate. Processing time: Two to three months.

Now you tell me thanks but no thanks?

Read:

As anything in the internet, before you proceed, I'd check this with an immigration attorney (preferably one that is knowledgeable on LGBT issues). I have read other articles where it would appear that USCIS is holding on in deportation cases related to same sex marriages/unions

Good luck

K-1 Fiance(e) Visa Process & ProceduresBC birth certificate for interview

Hi everyone, I just recently ordered a new birth certificate for myself in long-form for my interview and I was born in Nova Scotia.
My issue is that I have a 3 year old daughter born in British Columbia and when I went to try and get a long-form birth certificate for her, there is no such thing.

The options I am given are as follows :

Birth Certificate with Parental Information ($27 each)
Birth Certificate with Individual Information Only ($27 each)
Certified Photocopy of a Birth Registration ($50 each)

I have already ordered and have in hand, the birth certificate with Parental Information, which Packet 3 clearly states that there needs to be parental information on the birth certificate. I read an interview experience from someone and they needed a long-form of their birth certificate, not wallet sized ones.. So I'm panicking a bit.
The birth registration is really only a copy of the form I filled out with just registering my daughter's birth, it's not official and it won't bear a seal once it's printed and sent off to me, what should I do?

Long Form = BC WITH parental information

You cant file for the fiancee visa. The petitioner must be the US citizen or Green Card holder. Your fiance can file for you.

K-1 Fiance(e) Visa Process & ProceduresK-2 Follow To Join

Okay, I have been researching and researching, reading and re-reading and re-re-reading. Phew! My brain feels like it's going to explode :bonk:

Would I be correct in assuming that once the consulate receives the notice of Fiance Visa Petition from the NVC they will send instructions for packet 3? Okay, now this is where I am not so sure? At the time we filed for the I-129F we only entered my 16 year old son as my dependent, we did not apply for him to emigrate at that point. So, when I receive packet 3 would I be able to apply/add my son for the K2 visa? Or,because we did not initially put him down as emigrating will we have to wait until my K1 visa is issued before I can apply for his K2? I am trying to work out the time-line.

We had some issues initially with whether my son was going to emigrate at the same time as me, or follow due to his education, but we have all decided since that point that he will emigrate as soon as. Obviously, because we all ready started the process it has complicated things, which has complicated my understanding of the process too.

Thanks.

as long as he was listed on the petition, their is no issue with him making application now or up to one year later.

applications are submitted concurrently with or after yours

I will continue to read the information in more depth.......what I have read says that we can apply for the K4 only once the I-130 has process has begun, and the K4 enables my son to be with us while the I-130 is pending.

The K-4 is a derivative visa for children of beneficiaries of K-3's. Why are you not looking to the K-2?

I read that the child can all ready be in the country (USA) while you apply for them this way? The child HAS to be in the USA for you to apply for AOS

Will my child need examination in his home country (U.K) etc and will I need to return home to be with him for this? Examination is required by the doctor/clinic authorized by the consulate that will issue the visa

Do you know how long it may take to apply for kids separately? Typically not very long but depends on the consulate

Is applying for kids separately a similar process to K-1? Medicals, police report etc etc. Same visa application, fees and medical are required

Okay, I have been doing some research and so far I have found out that we would file the I-130 -- Petition for Alien Relative, and my son could join us out in America under the K4 visa while the I-130 is pending. My son is 16, so he is classed as a dependent.

still need to do more research... your child would NOT be able to follow on a K-4, unless you arrived on a K-3 (same as a K-2 needs the parent to be on a K-1).

So what do you suggest? Does the aspect ratio even show up on a picture that small?

On the I-129F instruction sheet it doesn't mention dimensions?

So should I cut the original by .75 inches? Just send it normally? Or send in the original as well as one that is scanned and printed to 2 inches by 2 inches?

Whether you can trim or re-crop the photo will depend on how it has been centered and how much white space is available. If you need to trim the picture so much that it cuts off the top of the head or gets above the shoulders it may be more issue than what you have now. You can try shrinking it and see how it turns out.

You can be the only one who can judge that because you have the photo in front of you.

I mean 5 cm by 7 cm converted to our metrics is 2 inches by 2.75 inches, so its off by .75 of a inch. So I don't think aspect ratio will be a problem due to the fact I am making the picture SMALLER and not bigger.

in order to maintain the aspect ratio the photo will be shrunk to approx. 1.50 x 2.0. One way you are .75 large, other way you are .50 small

Hi,

My fiance (who lives in Iran) just sent all her required documentation that I needed from her (2 signed G-325A and 2 letters of intent and passport photo).

The problem is I just learned that the size of the photo is 5 cm by 7 cm or 7 cm by 5 cm, I don't know. The US immigration site clearly says 5 cm by 5 cm and I told her that as well.

I was wondering if I can take her passport photo to a Walgreens or CVS and have them scan the image into the computer and develop that picture in 5 cm by 5 cm passport photo.

Will that work?

You can but it might be hard to maintain an aspect ratio... IMO, I do not think this mis-sized photo will be a problem

K-1 Fiance(e) Visa Process & ProceduresI-1864 for K-1?

Hello people!!

Any of you were asked by USEM for the I-864F? It was my understanding that this form is for AOS.

I read in the NVC site, that I-864 is only for immigrants visa and AOS once married, NOT for K-1 interview. Idk, but I reply to USEM the exact paragraph I read. Here--> During the visa interview, applicants will be required to present evidence to the Consular Officer that they will not become a public charge in the U.S. You may present evidence that you are able to financially support yourself or that your U.S. citizen fiancé(e) is able to provide support. The Consular Officer may request that a Form I-134, Affidavit of Support be submitted by the U.S. citizen fiancé(e). The U.S. citizen fiancé(e) will need to submit Form I-864 to USCIS with the application for adjustment of status to that of legal permanent resident following the marriage. <----

Highlighted above occurs after entry & marriage and not at the consulate
