We are in a confused situation about my Dubai Police Clearance. We search everywhere to get a concrete answer to our confusion and found nothing.

I possess an expired Dubai Police Clearance (since it is only valid for 3 months) and exerted all out efforts to get a valid one by completing and gathering requirements, sending them email and calling the Police Offices so many times but bring us to nowhere. No reply, no clear answer.

FYI - Dubai Police Clearance is dated March 2009, I never went back to Dubai since I left for good last April 2009 which I believe there is no reason for me to get another one since I never went back since I left last April. I left cleared with the clearance.

We are planning to call USEM to ask them (if possible) of what we are going to do about the clearance. Is it possible to get in touch with them regarding this matter?

We are waiting for the Packet 3 to come and we are quite running out of time.

If we need to get another one, I will be forced to fly back to Dubai which is quite expensive and difficult.

Is anyone out there has the same situation? Please help.

the NOA2 is the petition approval notice ... only approved petitions are forwarded to consulates... so by the shear fact that the petition is on station indicates to the CO that the petition has been approved... not sure what additional evidence the NOA2 will provide and why it is even considered a "rule of thumb". Just me opinion.

The child must be a permanent resident of the US to get a green card. This means he uses your address and does not leave the USA for more than one year (continuously) without an AP or Greencard or a re-entry permit will be needed. He CAn go to school out of the country but should plan on returning every summer (at least) to maintain his residency. He also needs to be listed on your tax reurn as a dependent OR file his own income tax return. He should obtain sme form of US ID showing his permanent residence in addition to the green card (not required but it helps)

He qualifies to apply for a green card as the minor child of his K-1 mother. He must maintain his green card on his own after it is issued and meet all qualifications as any other green card holder.

Our oldest son is a student in Moscow also and returns each summer, he can work here during the summer if he chooses and has a Vermont drivers license. we have the same plan. Once he finishes his education, he can decide where he wishes to live and where he wishes to be a citizen for that matter.

My fiance has her interview in February in Moscow. We are including her son to follow within 1 year on a K-2, as we think the option of living in the USA could be valuable to him in the future given the poor Ukrainian economy as well as allowing him to visit us whenever he wants if he should decide to stay in Russia or Ukraine after his 4 years at the University in Russia. Her son is not sure he wants to get a U.S. green card (AOS) as he and my fiancee believe that it will require him to make a certain number of visits to the US each year and spend a certain amount of time each year in the USA. Can anyone tell me what are the residency requirements for a child coming on a K-2 to maintain his conditional green card. I didn't realize there were any residency requirements, but I thought his green card (AOS) was simply a function of his mother getting a K-1 followed by a green card.


residency requirements are the same for ALL permanent residents... and is no different for a 2 yr card or a 10 yr card. The "conditions" attached to the 2 yr card is all about a "bonafide" marriage relationship. However, you can have a bonafide relationship and still lose your residency...

entry with intent to marry in the USA is not visa fraud.... it needs to be a non-immigrant entry with the intent to circumvent US immigration law

Hi, I'm new here...

My boyfriend and I want to get married this year, *hopefully* - he is from Portugal, and I live in California. Our situation is pretty typical - met at a restaurant while I was on vacation in Portugal and have seen each other 3 occasions since then, both in the states and in Portugal; we have each met each others' families.

So, after researching, I decided that K-1 visa is probably the "safest" route (as opposed to getting married on a B2 visa or getting married in Portugal and trying to bring him back). I want to make sure to do everything the right way so that we don't risk having to be apart any longer!

I have been pouring through your forums and really love the information that is provided here! I now know that I will NOT need an attorney, which was a big question as well.

Anyways, I have a few specific questions:

1) He will be here in March on a regular tourist visit for 3 months - if we start the paperwork while he's in the U.S., will that cause a problem since he entered on a tourist visa?

2) After we get married in the U.S., we want to go to Portugal to have another ceremony / reception - is there a restriction on travel outside of the U.S. after marriage? If so, how long?

3) I am 7 years older than him - that's not a big enough of an age difference to cause a problem, is it??? (I'm 32, he's 25)

We've just started the K1 process, we are about to start filling out forms. This is my first post I've got a question (many more to come!). My fiance is British, I'm American, and we live in Tokyo so I do not have a job in the US now. We'll both be actively pursuing jobs as the time comes closer to our departure from Japan. We will have saved up around 15k so even though we'll probably be unemployed should my dad cosponsor him? I don't want the K1 to be rejected on the grounds of unemployement in the US. When using assets, you need a ratio of at least 3:1 (assets:income). If 125% of the poverty level income for a family of 2 is $20K, then you need $60K. Look up the poverty level guidlelines (I-864-P) and do the math. I will tell you $15K is well short of the need.

Ok, so my American friend here in Japan proposed to his Japanese girlfriend and reckons it's easier and faster to get married (at the ward office, no fuss) here and go through the K3 process so that's what they're gonna do. My fiance (a Brit) and I were gonna do the K1 process. We've read up on both and they both sound long and complicated. What I'm wondering is:

-Is one cheaper than the other?
-Would we be more likely to be approved going through the K1 process?

Although I guess no one would have experience going through both, has anyone heard about the differences between the K1 and the K3?


If your American friend has currently been residing in Japan for more than 6 mos., then a marriage and a consulate filed I-130 (ultimately gaining a CR1 visa) might be the quickest.

My Chinese fiance speaks some English and can easily memorize answers to likely questions, but I feel may have trouble understanding other questions. Best chance of success is an interview in the language where your SO will understand the questions with 100% certainty, and will be able to articulate a clear and accurate response. It is a decision where you will leave nothing to chance, or possibly leave something to chance because of limited vocabulary or misunderstanding of a language that they are not proficient in.

It would have been fortunate in that they could now take the CR1/2 route instead of K1/2 but you are exactly correct. The marriage itself would have changed nothing with regard to her ability to return to the USA. Marriage, followed by filing AOS and obtaining AP is what it would have taken to be "golden".

Not sure why the discussion about hopes in retrospect, as they have nothing to do with the realities here.


CR1/2 is still possible but the OP will be needing to pre-plan by gathering some needed documents from the US first and then invest about 3 weeks or so in Ukraine to get all the paperwork approvals needed there before a marriage at a ZAGS office can occur....

I suppose they mean that a marriage would have met the terms of the K-visa and then they could have adjusted status and applied for AP outside the country which would have a greater probability of success.


AP needs be approved BEFORE departure... so that would not be a solution here either....

The moment she left without AP or status adjustment she relinquished her K-1 status... therefore, no ability to fix this as there is/was no longer any status to adjust from since it was gone the moment she stepped out of the country

I was hoping that this would have been the outcome as well. Take 2 hrs out of the day and get hitched at the courthouse.

Consulate/USCIS is heartless when it comes to "tough luck" stories.

You can K1 again, 'cause IMBRA really isn't a problem for 2nd try, so ignore if someone said it is.

It's up to you if getting married overseas is an issue for you or not.

You could get a lawyer to plead to the Consulate your request for extended K1, but it would be a futile battle I am certain.

You will have to refile for a new visa, bottom line. Small error, yet major mistake by letting K1 90 days slip by you.

Getting "hitched" and her leaving still would not improve the OP's situation as he would still be facing a new petition/visa... The solution was for the OP's fiancee to have stayed (regardless of marriage or not) as her status could be "repaired" from inside the USA if they married outside the 90 days.

The truth is... When life throws you one of these curve balls... it is very difficult to be under pressure to make additional life commitments under a timeline... hindsight is always 20/20. We did have every intent to marry in Vegas during the dates her daughter was in the hospital... I'm not perfect... I freaked a little... damn me for that?... should I have done things differently? Hell yes...

I guess... I think the best thing to do ... is send my letter now... if it gets shot down... at least I can include that the next time we go through this Visa hell again...
If by some act of human nature versus the black and white of cold government rule... she does get a new visa, we can immediately wed and thank the Lord for watching over us.

As to the relationship bona fides.... we had been together 4 times for over 1 week each time before filling, and once more while it was being acted on.


hope for the best, but expect the worst... since you are well past the 90 days of the original I-94, the consulate's hands are tied.

As for "bucharest may not care, kiev doesn't" - I thought you have to have at least the first vaccinations at the medical exam in bucharest (I mean at least to have started) and you are expected to follow-up in the US...??? I read this on other forums, now I'm confused... :blink:


A K-1 does NOT have any vaccination requirements... the requirements are for the greencard. You may choose and are encouraged to get the greencard vaccinations done/updated before arriving in the USA (mainly because of cost), but the K-1 does not require this. Some consulates (such as Canada & UK) do require updated vaccinations before they will issue the K-1 visa. This is the consulates requirement and not the actual requirement of the visa. Kiev does NOT require vaccinations be complete for a K-1 like London does, Bucharest may be the same....

K-1 has no vaccination requirement.... The vaccination requirement is for immigrant visas or greencards. Bucharest may not even care about vaccinations.. Kiev doesn't...

Your A number is like your SSN, its yours for life so fill it in in the form.

Make sure you keep your EAD card because when you apply for AOS you can reapply for a replacement EAD and they will ask for that number I believe.


No, it will not be a renewal EAD (because the original eligibility is not longer valid) but a new authorization based on a new eligibility category

I'm a little confuse about when to send the I-134 form. In the K1 Visa Checklist it says that it is to be mailed to my fiance and not with the I-129F package. Some other people I know said "it is part of the I-129F package". So I'm a bit confused.
