this is wrong... Not all countries have available police records and they still issue immigrant visas. If you are unable to get a PC because the issuing authorities refuse to provide the the consulate will "waive" this requirement. Bring documentation that the UK authorities will NOT issue it because of circumstance.

However, in reading the info from ACPO there does not appear to be a restriction to an illegal resident not getting a PC

legally recognized marriages in one country are typically recognized by most every country, exceptions always apply but I doubt it applies to Ireland. Some countrues have a process to record a foreign marriage via there respective consulate in the US... you can check the Irish consulate website to see if there is such a practice

She applied for a visa (via DS-156). Her visa application was denied. No underlying petition is required for a tourist visa application so that fact is moot.

My divorce decree did not have a "raised" seal on it... however it did have "official" looking court "stamps" on it. Since a regular photocopy of the decree is all that is required, even if the decree has the "raised" stamp it would no longer be "raised" on the photocopycopy that is submitted to the USCIS.

I-129F is a petition... K-1 is a visa...

You list all the children on the I-129F petition... They will apply separately for visas later at the consulate after the petition has been approved

Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

The initial I-129f petition can only be submitted stateside to a USC service center... the consulate interview can only happen after the petition has been approved... so whether it is UAE or PI really does not matter much but is more an issue of logistics and convienience

Hi all,

I have a question about the K1 and H1B/L1B visas.
Me (beneficiary) and my fiancée are currently, as can be seen on our timeline, in the process of acquiring a K1 visa.

Prior to submitting the I129F I tried to transfer via my company (a huge american IT company). It was very slow and I didn't have much luck due to various reasons. Now however, two months after filing the I129F things seem brighter on the transfer front and I was wondering how to go about this if I was to be transferred and thus receiving a L1B (maybe H1B).

H1B/L1B is not an immigration visa, K1 is... will that cause me problems?
If I get transferred, should we cancel our K1 application?

Basically, will it somehow turn around and cause me grief in the future?

Any insight or comments are appreciated.

You do not have a pending K-1 visa application... you have a pending I-129F petition to determine eligibility to apply for a K-1 visa at a later date.

An H1B & L-1 are both non-immigrant visas (as is a K-1 believe it or not). An H-1B and possibly the L-1 are also considered "dual" intent visas so the intended visa applicant CAN have immigrant intent... So I see no real issues with a pending I-129F interfering with a H1B/L1 application. If it occurs, then withdraw the I-129f if that is what you choose

not true... but a successful I-140 is very difficult.... It is for extraordinary scholar or researcher, athlete, a worker who has worked for a company for three years abroad, or a skilled worker that is not available in the USA. Nursing was at a shortage in the past and the US imported many foreign trained nurses. I do not know if that situation still exists today

I celebrated my engagement with my fiancee and her family during the Xmas holiday but before I left to see her a started to gather my papers and notorize certain documents so that when I return we can file in February. But she has to go away to her province of birth to get certain documents example: BAPTISMAL RECORDS etc. Getting some of these papers will take some time. My question is, will the embassy accept my notorized papers and hers even if she has hers prepared and notorized many months after mine in our petition packet. Or do they want everything with current notary dates. All from 2010 not some from 2009 and others from 2010. :help:


re-check the I-129F evidence requirements... what you listed above (BAPTISMAL RECORDS) is not needed for the petition filing. What other evidence is she gathering?

The USC is the petitioner... The USC submits the petition... Once the petition is approved and the case file is physically on station at the embassy, then the alien fiance(e) (benneficiary to the petition and future visa applicant) is able to then and only then apply for a K-1 visa.

if no I-129f is in process then you are a long way away (many months) from the medical.....

Who is the USC here? If it is you, then YOU submit the I-129F to the USCIS. You cannot do anything with the embassy/consulate until the I-129F has been approved

Our case is already at the embassy here in Nigeria and my interview is on the 30th of March...

I have already started my medicals and the names are in the correct order here (medical document) as in my passport.

I'm a little confused about this whole process but this website has been VERY helpful. So thanks to everyone that has helped me so far!!
I just found out that I would have to go to Montreal for my CR1 interview.

Now if I apply for the K1 visa, once I get my K1 interview and get my visa...and after we get married. We send the forms etc within the ninety days..... do I go back to Canada and wait for AOS or can I stay in the US and wait for the rest of the process to go through? and is the K3 visa the same process???

I was reading forums about the Montreal wait times for processing for CR1 visa and its close to 6months.

theoretically, you need one visa to immigrate to the USA.... as a CR-1 you enter as a resident, for a K-1 or K-3 you enter as a non-immigrant but can change your status to resident from inside the USA

US visas govern entry into the USA. Period. Has nothing to do with visiting other countries or traveling to the USA on a direct route.
