I am presently in PI meeting my fiancee and her family. This our first encounter together and I am delighted with her and she is also with me. I understand that when I return to the states I am the one who has to submit a petition on her behalf to the USCIS. I just wanted to know if she could complete her part of the process in HK since
she works there and it would be easier for her complete the application there. She lives in a small province in the PI and traveling to Manila everytime she has to go to the US Embassy can be a tremendous hardship for her. She know her way quite well in HK and she can go to the PI Consulate there as well as the US Embassy.

My GF is a Phillipino native working in Hong Kong and was told at the Hong Kong US embassy that she could file her documents in Hong Kong thru the USA embassy and Phillipine Consulate. I have always understood that she has to be in the Phillipines when filing her application. I am a USA citizen residing in Miami, Florida and I will be filing a K-1 visa so we can get married and I can bring her to the USA. All visas are filed for at a US Consulate abroad. However, she is not yet eligible until you submit a petition on her behalf to the USCIS and it has been approved.

Hi! I'm a K1 visa holder.Me and my fiance got married last May 1. And we are already applying for my change of status. My question is, I have a 3 year old son included on the petition and he was left in the Philippines. We can't get him yet then because we decided it would be better for me to get adjusted here before my son comes. We planned on getting him by December though, because my visa was approved last February and we were told that it is better to get him within one year from the approval date of my visa. What should we do now? Do we need to file the I-130 or is he still covered by the K2 status? Please help I need to see my baby asap :(


Follow to join is valid for up to one year from the date the K-1 was issued.... If beyond the one year then and only then is an I-130 is needed...

If you want to exercise the follow-to-join then contact the USEM to start the K-2 issuance process

But the I-129F is reviewed by the USCIS not HCMC.... If you want HCMC to review them then submit them to them at the time of the interview.

It is not the church that makes it legal. What makes it legal is if 1) the ceremony is performed by a registered officiant and 2) the couple have a marriage license that gets properly signed and recorded.

I'm still relatively new to this site but it's already been an amazing help to my boyfriend and I when we first started to look at how we could be together in the U.S and since then it's been really helpful to us in deciding which visa we should apply for. We're looking at applying for the K-1 visa and most likely sending our packet out in the next few weeks. As we are starting to get everything together, we ran into a question that I haven't been able to find an answer to online yet so I'm hoping someone will be able to help us decide what to do.

Our question is about his passport. His passport has the stamps that we were going to use as proof that we've been together in the past two years but this passport expires in six months. I know that before the visa can be approved, he'll have to have a passport that's valid for at least six months after his entry date (at least, I believe that's what it is) but I wasn't sure if this was an issue that would matter until he gets an interview or if it will affect the petition that I submit as well as well. I'm afraid that even though everything else is order we might get either denied or a RFE that will set us back several weeks because even though the passport shows the stamps, it will also show the date that it runs out. I wasn't sure if this mattered this early in the process so long as he gets it renewed before he goes to the interview.

Naturally, we both want this process to go as smoothly as possible so we were wondering if he should go ahead and get his passport renewed before I submit our petition (and send a copy of both the old and new one with it) or if the expiration on his passport won't matter until he goes for his interview so we can wait to get this done. We'd rather wait a few days on the passport than risk having to go back and forth with the service center over something we could take care of now. But any advice you guys could offer would be wonderful. Thanks in advance for the help!


USCIS does not care that the expire date is close in or beyond as long as it demonstrates the information that is required

I want to start off by saying that I know a person may apply for a B2 visitor's visa while waiting to get a K1 visa. I've seen that posted several places throughout the forums. But my question is will it HURT the K1 visa process by applying for a B2 visa simultaneously? Will the consulate interviewer or any other party view this negatively? Or is the application of a simultaneous B2 visa not a factor in the K1 process?

Only certain classes of J-1's are subject to 2 yr HRR. You need to determine if hers is/was (she should have some paperwork on it or it is indicated on the J-1 itself). If it is then it is possible to get a waiver otherwise you are good to go

Recently just became a USA citizen, Now i want to bring my fiancee from Laos to the USA. Who I have flown to meet twice last year. I have begun getting paperwork together for K-1 visa. If anyone can help, or have any advice please feel free to comment. Any advice would greatly be apreciated. I have read all the k1-visa guide and anything i can find on the internet on a k1-visa process. But i feel like i'm ok to procede with this process by myself without a lawyer. But i would hate to run into a snag on the way thou. I do have a some question thou,

1.) I was told you need to have 4 sign copy of G-325a, Do you sent all four copy with your I-129f?

2.) Do I have to get all of my finacee paper work translated (divorce decreed, birth cert. ect..) before sending them in with the I-129F application?


1) G-325a used to be a 4 part form... it is no longer

2) Any evidence submitted to the USCIS that is NOT in English requires an accompanying English translation

A careful read of the instructions will indicate the proof of citizenship can either be accomplished by a copy of your birth certificate or a copy of your US passport (all pages).... Read the instructions carefully, they are your friend

Yes eventually, but not now. For a K-1, the I-864 is submitted after marriage when the new alien spouse applies for a greencard via Form I-485....

Does this mean I will have to file a Form I-824 just to get them to forward the case to NVC? That is one of the options on form I-824....This circumstance really sucks!

My Fiancée received her Packet 3 late April and we sent back DS-230 & OF-169 May 14th still waiting for interview date. In Packet 3 are instruction to pay a visa fee of $131.00 USA. Based on these instructions will we need to pay the difference of the fee we already paid given our petition was filed before June 4, 2010?

Not based on the petition date but based on the visa application date.... visa application is when the DS-156, et al.. are submitted to the consulate... Typically the visa application date and the interview date are one and the same

Option 1 theoretically can be started immediately upon the fiance(e) getting citizenship (assuming all the required evidence is gathered)

Option 2 cannot be started until after a marriage event so a natural built in delay (also requires an I-129F)

Option 3 same as Option 2 but only the I-130

Option 4 requires the USC to be legally resident in the foreign country for a minimum of 6 mos, so there is a natual delay there before even considering the logistics of doing it

Open discussion on Option 5 is against the TOS of VJ

B: Changes all the time... VJ has timelines that adjust based on current data

C: You do NOT get a K-1 visa FOR your fiancee. You petition for determination of her eligibility to apply... Once approved SHE applies and gets approved for the visa

D: Tourist visa is faster... but it is not to be used for immigration to the USA
