USCIS expects 4 pages signed per person for the G-325A! AND they also expect you to submit documents or pictures to prove you have had a relationship for past. They are not fooling around. Photocopy might be ok if the other signatures are in black also on other two pages, depends on how close the case worker is paying attention that day when it comes across his or her desk.

Try calling to check case status and get to speak to a person, they usually ask for Case Number, Name and Address.
If the info matches, they might have made a mistake entering info into the computer.


YES sadly but truthfully it is quite possible considering all the extra paperwork USCIS has had in past 3 months with so many people filing in late July trying to beat the new fee increase rush. Things have been messed up and delayed now for 3 months. YOU need to call that 800 customer service number now and talk to a person and let them know what has happened so it can be checked on and fixed asap. AND make sure you write down the person name, ID# and date and time you call them.

YES, based on the timeline you mention. If you just filed for K1, it will be at least 3 - 6 months from filing date before you will be approved for interview, then time before interview for K1, then time before she comes to USA from her home country to get married. I am assuming you mean you are US citizen, living in USA, and working in another country and that your company in that country has offered your finance a job, so can she be free to travel during this process and yes she will be as long as she has visa of other kind to travel on. BUT remember that once she interviews for K1 and receives it the USA embassy will take away any other current visa she may have in her passport and cancel it, and then place K1 in place. Then the clock is ticking you have 90 days to get her to USA and get married before it expires and once she comes to USA on the K1 she is there to stay until you marry and then file AOS/AP/EAD forms, which then it is about a 45-60 day wait on the AP if going fast on processing, once she has AP she can travel in and out of USA no problems.

What they mainly look for at this stage is proof of current income, example is copies of W2 earnings statement from employer for most current year, or past 6 to 12 months paystubs from work, 3 years of most current tax return(1040) to prove stable level of above poverty guidelines. Letter of reference from employer, bank statements for past 6 to 12 months, letter of reference from bank. I know all this for I able to ask a USA embassy worker for 8 hours on a flight back from my fiance's country during holidays two years ago, I was lucky I mean how many times do you get to have personal one on one access to someone that has knowledge about things I am about to have to deal with, but we were seated next to each other and got to talking and he happened to be only person on flight speaking English also, anyway I picked his brain and asked him everything I could to make most of the time and he told me a lot of great tips and information which I used when I applied for K1 and AOS. IT worked well.

The one filled out by her parents notarized will be great, BUT she will have to fill out one also since she is the petitioner/K1 filer even if she will not have income to support you above poverty guidelines. THUS one from your finance and one from your in laws to be. I know it is not logical or seems like extra form for nothing but that is how it works in USA federal government, if their checklist says they have to have one of those whether it is immaterial or not they will expect it or require it.

YES, because

A) your finance is one the main sponsor(petitioner) even if they do not have income or assets you will still be expected to file one and they will expect one from you also at USCIS or embassy
cool.gif then the cosponsor does their part or I-134.
C) I would also include a cover letter explaining what you did and why on top of I-134fs, for they do read that and it helps them process more quickly and accurately.
D) looks good on the notarized financial proof and I-134 form
E) in dealing with USCIS (American government in general) it is better to have more documents and proof than not enough, for example it is tricky on the questions of their forms they ask or say it is optional or you can do this or that, but speaking from experience, just send in everything they ask for even if it is optional. It will save you a RFE or them denying it and asking for more information thus delaying process. I just wish they would say clearly in black and white to direct everyone we have to have this and this and no exceptions for they confuse people with saying you can do this or that or this or that is optional to supply us with proof and which case they expect it anyway, so why not just say it up front. You need to do what you said, get married ASAP(recommend within two weeks) once she arrives, then apply for AOS/EAD/AP within a day or two or as soon as you get the marriage license copy to mail in with AOS/EAD/AP application. Also you better start reviewing the checklist of items you will need for applying for the AOS and get on it at least 3 months in advance to start gathering up that documents you need to submit as proof, because it is tedious and a lot of work and not something you can do in one day.

Something else you need to remember that K1 90 day work permit approval you receive once you arrive in USA is only good for 90 days or until you get married, so once you marry it is of no use to her anymore and cannot be used.

Also another thing you need to do is make sure she gets a copy of that DS(something or other) form from her USA approved Medical Exam Dr in her native country which is the one she will need to have to submit to a USA CIVIL SURGEON DR in order for that CIVIL SURGEON to complete a I-693A vaccinations form which you will have to have when you apply for AOS, or you will get a RFE for not having it, they have screwed down on this lately, used to you could slide by with just mailing in the copy of the DS form from her Medical Exam in her home country, not much so anymore. AND wait until you start trying to get a CIVIL SURGEON to fill one out for you! AHHA they will try to rip you good, for just completing paperwork and their signature, let me know if you need address of CIVIL SURGEON that will do this by mail for $10 fee within week or two. This is a major racket and you will see once you start checking into this. Basically USCIS has said so what if you get a official medical exam overseas by our approved DR we send you to and they fill out that DS vaccination form, guess what you get when your arrive in USA, more bureaucracy new K1 couple, now you get to go search out a CIVIL SURGEON to fill out this piece of paper called a I693A which basically is same thing as the DS vaccination form. I truly think the DR lobbyist must have been involved in this piece of legislation or policy for it granted them a license to steal easy money and prey on K1 immigrants.

Thus I would say to be realistic that when your finance arrives in late May you will have to allow at least 2 weeks to mail off your CIVIL SURGEON request DS vaccination form to be completed/transferred on a new I-693A form to be mailed in and this is if you have everything else together thus within few weeks of her arrival you should be able to apply for AOS, which then could take 3 months or less if all goes well at USCIS or as long as 6 to 12 months depending on the USCIS case worker, but at least it looks like now you will get that EAD and AP card within 1.5 to 2 months while you wait on AOS green card.

Also if you go apply for a social security card, allow about 10 - 20 days to do so, problem is not social security office but Dept of Homeland Security USCIS and POE when they take your finance brown sealed packet, there is a serious lag time on this so even if you go apply at SS office immediately, to them it will be like she does not exist and her data from brown sealed envelope will not have been data entered into SAV system that Social Security Administration checks before granting SS Card #, I mean you can apply but then you will just have to wait and then make sure you call back to the person at the social security office you applied with about once a week and check on status of it. Reason I mention all this, if you decide to change your spouse maiden name on social security card after you marry, you have like 15 days before 90 day K1 expires to do this otherwise SS office will not allow it and make you wait on Green Card AOS then come back and to do name change. Or what I wish we had done is this, I suppose you could marry immediately within few weeks, go apply in her new married name but take copy of marriage certificate with you and just apply for social security card in her new married name and not worry about having to change name later on social security card since it is already in married name.

And get ready big boy you are in for a wild ride and some waiting, best thing going for you is that you filed through Vermont Service Center on K1 and they seem to be very organized and speedy there, but as far as getting AOS, that is a ####### shoot, anything can happen in that process and you can wait awhile on that Green CArd, there are people on here that I have seen waiting for 2 plus years for AOS, it is insane what USCIS and Dept of Homeland SEcurity have done to this legal immigration system, and all in the name of FBI name checking for these delays, which to me I ponder well why did you not do this FBI name checking during K1 process for visa was granted for if they truly are a terrorist or criminal in USA illegally it is a little late now to be checking on them after they arrive in the USA, and I wonder what they are doing for two years or so while FBI is checking their names out! HAHA it is a joke.

1) Doublecheck I think you need two of those passport style photos to send in if memory serves me correctly. Also write her name on back of those photos as K1 beneficiary and your name as K1 petitioner, USCIS case workers handle a lot of stuff so it is easy for things to get misplaced out of files sometimes.

2) YES send in those previous marriage certificates and copies that are notarized. The reason I say this is I know a guy that married a Ukraine woman that had similar situation as you and he got a RFE and it was for not sending in her previous marriage certificate, so if you do this you are taking a chance even if other posters on here tell you not to worry about it. I would send it.

3) YES divorce decree notarized and send copy of it with English translation that is notarized and make copy of that to send in.

4) G-325A, do not leave lines or question blank, go over and make sure you answer them. Also you may want to type out a letter with brief statement that details how you meet and the times and dates and places with either the I129f or G325a cannot remember but it helps, for they expect it at USCIS even if they do not say it. And sign all 4 pages of G325a form for each person to mail in. 8 total. 4 for you and 4 for her.

5) YES letter from her on her intent and you need one for your own intent also.

6)No I have been told that she does not have to send in documents or translations of her name changing, just the first marriage certificate(with English Translation), and then the divorce decree(with English translation) and it is ok to make copies of those originals and submit with forms of I129F and G325A.

I know legally UK and Canadians can visit easily for long periods of time legally, but how are people doing it time and money wise? Maybe this is too private of a subject but I'm wondering if people who can do the very long stays do not need to work (i.e. wealthy), are students between semesters, unemployed, working legally in the others country, student in the others country, etc.? We have been wracking our brains to be able to spend more time together (we currently see each other once per month for a long weekend alternating locations) and it's just so short. Not to mention we don't *really* know what it would be like to live together. But in order for him to come here he'd have to quit his job and sell his home to have funds to live here since he could not legally work here yet, but as we know he needs that tie of home and job to show he has ties back home. And I cannot quit my job here to go there for a long period of time.

Anyway, these are just some thoughts we've had and don't know how others manage such long visits. Oooooh, dreaming of the day we can spend more than 3 or 4 nights together....

There are more people like you than you imagine. Those others you wonder about well... possibilities are
A) retired or semi-retired

C) younger people aka students in college
D) have profession that allows them to have schedule or time off to travel like that
E) Self Employed
F) on job already in that country

So do not let it get you down, at least your finance is in a country that is close and you can travel back and forth to without a visa requirement yourself to see him freely or within several hours or less as opposed to going half way around the world. Hang in there, it will be stressful and depressing for awhile but finally works out.

You never know, depends on the case worker looking at your K1 app and then on the interview the questions they ask of your finance. Are you sure this guy really wants to get married yet? Be careful. Because once you start this process it is lengthy and time consuming along with fact that once he arrives in USA he has 90 days or less to make up his mind to propose and you get married. Just sounds odd he would not propose to get married to you first then file K1, hope it all works out somehow for you, good luck.

Submissions really dropped off after July, as you can see. Interesting to me, that there were still a lot of submission all the way from Jan through July. Right now, the service centers seem to be slugging through mostly june applications, with about half of them done so far. Once they are through July applications, things should really start moving biggrin.gif. All of Aug thru October COMBINED is less than what was submitted in July. biggrin.gif



Hey that is a very good observation you made. I agree with you. See there is a trend or pattern here after all! oops I will get moderated for that. After looking at your list it is obvious that
A) many applied in June and especially July to beat the new fee increase
cool.gif starting from August on there is a 250% decline in AOS sent
C) the new fees are having their intended affect - slow down the number of applications for understaffed and overworked USCIS case workers
D) like you said if you filed after July 30 within 6 months and onward it looks like you will be getting much better processing times and service, how could you not when the workload drops by 2.5 to 3 times less.

If you are that much age difference, think about it, you know there will be extra scrutiny, expect it. Just make sure you dot all your i's and cross all your t's and document that relationship or prove it is legit.

NO Only after the k1 visa is granted and interview, you are on the clock for next 6 months to get to the USA, then you have 3 months to marry in and not travel and leave USA.

Thanks to the discussions here, I've got my G325A all filled out.

I use a Mac and used Adobe Acrobat Reader V.8 to fill out the form.
The problem is there are several lines where the information I've input (addresses are long in China!) does not completely fit in the space provided. I can keep typing, and if I look the information is there. But, once I move to another field, the information is trucated, but there is a little black box with a white plus mark in it.

I thought that perhaps when I printed the form, it would do something like make the field bigger, or print smaller so it would all show, but it does not.

Is there something I need to do get all the information to print, or do I need to go back and edit the document and use abbreviations so that everything fills in the space provided.

We had same problem you are having, fitting in all the typed answers in the boxes, so we just typed in what would fit in other boxes, then printed the form out, then wrote in the boxes with hand print to fit the box, it went through fine and no problems. No sure what else you can do to make it work, good luck.

NO it is not enough and you better get a co sponsor that has W2 income statement to submit copy of for proof, otherwise you will get rejected, they look at this very closely. And they will look to make sure you meet those poverty guidelines whether you have assets or not, they are more interested in cash flow or proof of monthly wages or yearly wages that are most recent within the month of applying or year.

Curious, I thought you had to be a US citizen to file for a visa of spouse? Also I thought an LPR could only file for a visa for a non immigrant spouse if it was done on or before December 31, 2000. Correct me if I am wrong. Just observation.

You can take it now, because you will not be using 2007 fed tax returns until after 4/15/07 for financial proof. Only the 2006, 2005 and 2004. I would recommend taking all of it now, if your interview date gets delayed until after 4/15/08 you can always mail more current up to date info then, that is great you are so organized and ahead on all of it.

Good luck then, if you want speed then the route I suggested at county courthouse or the 30 mintue deal in Virginia is it, especially if you want speed so you can apply for AOS before you leave on honeymoon or when you get back. Otherwise you start adding new parts to the equation like other states and then waiting on them to process your marriage license and well you are going to wait more than likely, only way to get the speed you want is to do it yourself and get married in that 30 minute deal in Virginia, otherwise it is going to be or could be several days waiting for that license or weeks, because each state is different and each county recorders office works at different pace, just telling you what I learned firsthand.

No problem. I remember digging around on this website and other visa websites and emailing other members and reading posts from way back and any other thing I would find on internet, so I feel for you. I would do the courthouse 30 minute deal you got in Virginia, then you can apply for AOS that day or as soon as you get all the documents to support the AOS I-485 app and I-864 app you have to send in together, we allowed ourselves about 2-3 days to work on putting the whole thing together then mailing off on a friday before the new fee deadline and that was not planed it just worked out that way and fell that way due to our wedding and on the calendar after getting back from honeymoon. You might explain to your finance what is going on, that it is the way the system is set up so she understands and does not think you are trying to pull some unromantic thing, I know I had to explain all this process to my wife/finance to get her to calm down and understand it all, it is very frustrating and hard on a couple in love, and believe me the USCIS does not care. You also need to start to get all the forms filled out and signed before applying, cause it is a lot of work or prep time getting all the documents to support your claims or answers on the I-864 and I-485, I would start working on it about 2 - 3 months ahead of time collecting everything, there is a checklist on this website under AOS that is pretty straightfoward and helpful to look at.

If you apply for AOS on the day of courthouse marriage or day after, then you will also be forced to pay for and apply for EAD, and AP(Advanced Parole which means the temporary travel document your finance/wife will need to go in and out of USA while waiting for her AOS green card. Here is what these abbreviations mean, took me awhile to figure out what the world these people were talking about, since everyone is into abbreviating everything. AOS = Adjustment of Status EAD= Employment Authorization Document PR = Permenant Resident

See under previous system before July 30 of 2007 you had choice to pick what you wanted to apply for, 1)AOS or 2)AOS and EAD or 3)AOS or AP 4) AOS and AP and EAD, and this was very good and the way it still should be. BUT our fine president signed off on these new fees and procedures for K1 visas back in early spring this year and well here you are, you are stuck you have no choice, you will shell out about $1200 or so when you apply for your AOS and EAD and AP now under current system. We were lucky we only filed for the AOS(I-485 app and I-864 app and supporting documents)which cost us $395. WE DID NOT BOTHER with the EAD or the AP and here is why, it is a waste of time and money. Look at how many filers of AOS that also applied for EAD and AP get their AOS green card within about month of those two other documents, QUITE A FEW! I would say about 80 - 90% from what I have read, researched and monitored and seen now for over a year. THUS why apply when in a month you get Green Card and do not need the other EAD or AP and can do whatever you want anyway for next 2 years. AND what is one month vs another $500-$700 for EAD and AP, not much gained we thought, money better spent on other things.

BUT under this new system you will have no choice but to file for all three documents, you get the new $1100-$1200 fee and you will have to apply for AP(to travel), EAD(to work), and AOS(green card) all at same time. AND that also means more forms to fill out and documents to send in. MORE WORK, leave it up to the US federal government to think of this when they claim to want to streamline or help legal immigrants. Dream on.

AND I would say that within 30-60 days of applying for or mailing off all this after the marriage at courthouse you will get your AP document for your wife to be able to travel outside of USA to anywhere in Carib, like St. Marteens and come back with no problems. AND not to scare you but this is not exact science, sometimes it takes longer, I would say due to the workload they receive for caseworkers that week or month, priority of what they are told to process within USCIS, etc, many things. But I would say from what I have seen that within 30 - 60 days she will be able to travel and that is about 80-90% of the AOS filers for AP and EAD I observed.

ARE Sure you can't just go to the US Virgin Islands or Puerto Rico since they are in the USA borders and in the CARIB and it would make your life simpler and give you the speed you desire to travel to an exotic pretty romantic island! no0pb.gif

THIS happened to us and I would say it will affect you also since your soon to be wife is from ole Mother Russia Soviet. Just thought of another pitfall/expense you will have if you decide to take your new wife/finance to another country that is not within the USA jurisidiction, applying for a visa to travel to that country. We found that it was a problem, because USA citizens like you and I have no problem to travel in and out of any place in Carribbean without having a visa(all we needed was passport or formerly a driver license, birth certificate, SS card, etc) your wife/finance will since she is from Eastern European country, so basically any place you decide to go to in Carribbean for example you will have to check out their visa requirements for Russians and how much paperwork and fees it will be and how much time to file for it. Sorry forgot all about this. That is why I made our short list Hawaii, Puerto Rico, US Virgin Islands and passed on Guam. I knew that it was like driving in car across state line into another state and no passport check so no big deal, thus we stayed within and flew to Maui for 2 weeks. And after having been to Saint Marteens already, I can tell you go to Hawaiin islands, she will love it even more so and it is not a third world country island, it is the USA and excellent, that is if you are in doubt or afraid of going to US Virgin Islands or Puerto Rico like we were.

And, they are not US born in this case. She said permanent resident. Thus, she would need her passport and her green card.

Removing Conditions on Residency General DiscussionRenewing Driver License Before 2 yr Green Card Expires in Missouri
UPDATE - For anyone ever renewing a driver license in Missouri FYI!

1) Unlike other USA states, Missouri will not renew your driver license past your GC expiration date, so unlike other states of other posters mentioned here getting 5 or 6 year driver license renewed out past the GC expiration date, does not happen in Missouri. Will only renew your driver license up to the date of GC expiration. crying.gif

2) Was informed that even if you apply for renewal of your Missouri drivers license while waiting for your new 10 year GC to be approved or for interview or to come in mail the only way the drivers license in Missouri would be renewed would be if a permanent resident received a letter from USCIS showing or expressing your 10 year GC approval. Also mentioned something about some sort of email internet system now from USCIS but was not exactly clear with that.

Curious anyone here with experience in this have to use this magical letter from USCIS they would have received while waiting for their 10 year GC to be processed so they could show this letter to driver license office to renew their driver license while waiting on the 10 year GC to come in the mail or for their interview?

Rhode Island, do renew DL with or without the UCIS issues. I just got mine in July and they gave me a 5 year DL. I guess it depends on the state that you are in. Just go to the DMV and ask what do they need for your DL renewal. Goodluck! smile.gif
