Removing Conditions on Residency General DiscussionFiling For Removal Of Conditions After Spouse's Death
As some of you are aware, my wife (the USC) passed away a couple of weeks ago. Obviously, I have been extremely busy trying to sort out the ungodly mess a bereavment leaves, and of course, the added issue of the whole ROC thing.

Now my understanding is this: I wait until 3 months before the 2nd wedding anniversary, just as I would have done had my wife lived, file the same I-751 form, but indicate on said form that she is in fact deceased.

Is that correct?

To the OP: sometimes a second biometrics appointment isn't necessary at all - I didn't have one. In fact, after mailing my I-751 only a month ago, I received a letter from the good folks at USCIS telling me that my application had been successful, and that I was now an unconditional permanent resident. No RFE, no biometrics, no interview, no nothing - except super fast track approval.

I can only conclude that in my particular case, approval was granted so swiftly due to my unfortunate circumstances (my wife passed away shortly before Christmas) and the USCIS showed their humanist face, for which I am grateful. Anyhow, the point is that a second biometrics isn't always necessary.

Well, peeps that filed at Vermont around that time were getting approved in 2-3 months, so there's clearly something amiss. Obviously the first thing you need to do is get on the horn to USCIS and at least ask the question. Also, there's a poster on here that goes by the name estadia that's in exactly the same boat as you (fiance from India, only been waiting longer) who I'm sure would be only too happy to offer you advice and support.

well I had my embassy interview on 1st Oct and failed to get the visa! all was going well until we got to the I134 question 11 where we ticked the box to say that Karen would not be supporting me (there is no need, I have plenty of money) and that, apparently, is a big mistake. Estadia, this is bullshit. Total ###### bullshit. But, trying to find a positive here, could the fact that they've put a definitive date (25th August) on the latest "stage" of this debacle mean that they've rectified the the error they've obviously made, and are finally making progress? You know what I'd do? I'd give it until the end of the year (maximum) and then cancel the damn thing. All you have to do is send USCIS a letter to that effect, and hey presto, action cancelled (and I ###### guarantee they'd receive that letter!)

Then start again, only this time, fly over to India, marry your guy, and file for the K3/CR1 thing - surely they can't #### it up twice!!?? I know that initially may sound difficult to swallow (starting again after so much time and money being spent thus far) but I really think it's something you might wanna consider.

As you may have gathered, I'm not a religious man, and as such, don't believe in prayer. However, I do believe in karma -what goes around comes around- and you'll get your reward sooner or later. Oh, and the USCIS retard that ###### up your case will get kicked in the nuts by a hairy arsed biker or something.

Hello again, all my friends! I write this note from Miami Beach, Florida, and today is our wedding day!! We will leave this hotel in about 2 1/2 hours and drive to Key West (almost 4 hours), and the weather appears to be cooperating today for our 5:15pm ceremony on the beach! I do not want to think about the AOS until I get back and make it through this next weekend---my large-family-delayed-Thanksgiving Day celebration. The medical stuff will be interesting for us since the K-1 visa did not require any documentation for immunizations. we have a list of the ones previously received by each, and that was all the instructions indicated were necessary. Of course, they had their physicals and Xrays, but no official forms for the immunizations. innocent.gif

THANKS! the weather was PERFECT! very little wind, 74F (23C for you foreigners! tongue.gif goofy.gif ), and a fabulous sunset! And, of course, my bride was gorgeous! I hope to be able to provide a wedding pic or two sometime next week, once the photographer can get them to me.

now for the tricky stuff....they said they would be mailing our marriage license to us in 3 or 4 weeks. (maybe sooner) That makes it very difficult to obtain SSN cards and get the AOS stuff in the mail before our January 12th deadline. We will get the paperwork ready, but I am wondering if we should proceed with obtaining the SSN cards now in her maiden name, and then get the corrected cards later. I hate duplicating efforts, but we may not have time, otherwise. opinions, please? (about our situation!) star_smile.gif ClockWatch2.gif

sigh...we leave the warm weather of Miami Beach in 2 hours to start the long drive back home, where it is not quite so warm. It is time for us to experience what many others have had the last week or two---reality! rofl.gif hugs to all!

It's very confusing because the requirements's just changed in July. It didn't used to be required, but now it is. Sveta should have received a DS-3025 for her and her daughter, that is the vaccination record. You have to get a civil surgeon to transcribe the vaccination record on the I-693. A lot of local ones won't do it, but there is a Dr. Arnold who will do it long distance for $20 each. The other VERY confusing thing is that they've just added the TB skin test to the requirements, but the civil surgeons are all saying that it isn't a requirement...so no one really knows for sure. We got it done (at our general physician, covered by insurance) and will just send in a copy of the results along with our petition.

Aravis, with regard to this damned TST test, I've decided to be pro-active here. I have written to Dr Arnold, and here is what's in the letter:


"Dear Dr Arnold

I am writing to you to request information/clarification on the process of vaccination transcription, a service which I believe you offer to new immigrants wanting to adjust status.

Whilst the process would seem to be fairly straightforward, there seems to be some confusion regarding the transcription of the Tuberculosis Skin Test (TST) onto the I-693 form. As I’m sure you must be aware, all K1 visa medicals conducted after June 1st, 2008, require that a TST be carried out, irrespective of the fact that a chest x-ray (which one would assume is far more conclusive with regard to determining the presence of TB) is mandatory at the medical.

There are a lot of people from the online immigration community in which I participate, visajourney.com, that have spoken of being in touch with your office with regard to the TST issue, only to be met with rather ambiguous/confusing responses. Here is an excerpt from such a post:

“We spoke with Dr. Arnold's office who told us that they do not transcribe the TB skin test and she made it sound like it was not required if you had the X-rays.”

As such, I have enclosed a copy of the latest I-693 form (downloaded from the USCIS website) and highlighted the relevant section (section 2 A) which clearly states that the civil surgeon must fill it in, along with the other parts of the vaccination/medical areas.

I have enclosed a pre-paid envelope to facilitate your reply, (you may keep the form!!) and I look forward to hearing from you soon.
