I think the point of the OP is that the I-130s have been put on a shelf to process all the other applications. That is what is, and remains, unfair. K-1's are being processed... K-3 seems to be ahead... N-400s are up to date, it seems to be only the I-130s that haven't been processed at all, in over 6 weeks. I take my data from the weekly USCIS processing delay updates. I have a link to the list of the forms being processed in my blog (see link in signature).


Not really interested nor could care less about this or that, case is this: Process as received PERIOD. That is not happening and that is point being made.

K1, N400 ASO whatever, but again, their website states Process in order of receiving and as you or anyone can see, that IS NOT THE CASE - hence the problem of tyring to decipher what is going on. Or at least for me.

I will continue to do what I must to have MY HUSBAND here and if it means meeting my senator, my congress person, so be it. If it takes away from an Immigation Adj, then thats the luck of the draw but I do not think thats the road I am going for. I am just fighting to have the system somewhat balanced out and getting a fkn NOA! receipt. The rest I am willing to wait for as their guidelines post, but waiting this long as others are and not knowing what the heck or where the heck things are....different story with differnt action.

unless your congressperson is specifically involved in one of the immigration related committees, I'd suggest contacting one of your senators. Senators tend to have much larger staffs. also contact their office in your home state rather than the DC office. I took both routes there and sent emails off to a few....best reply was from my congressman since my senator is busy and just added me to his newsletter///god please hit spam and go on with other emails.......

The trace on name is done at the USCIS (at this point) and as of last week we were not in there, we did not need any help in doing this, you just have to have that 90 day issue to go forth to an Immigration Officer and they can check to see. Maybe you can bs a little about the dates, try it, nothing to lose. Its just seems that these I-130's are packed away somewhere and for a senator or congress person to initiate progress, the question does remain....WHERE THE HECK DO THEY START???

I just want them aware of the problem and maybe someone can shake something up somewhere and why and I am serious about this issue and sent email to my lawyer today asking this.......WHEN DID THE I`-130 become a step child? I know there are some debates on this issue, but if you research many threads through here, it it plain to see that other app's are being at least entered into system but these. I dont know. Really I could be out of it by now, but analzying it, its pretty darn clear. I do not see on USCIS website (and no it holds no water to me anymore) of them saying///"OH yeah and if you filed an I-130 just sorta kick back and wait it out mates". But I see other applications being processed under the other thread time line journals so just cant really figure it out.

Do not hold anything against other filers of different types of issues, its just that I thought that a backlog is a backlog, but I did not realize that they could categorize and shuffle us out of the conveyor belt. The time to categoize spell binds me in fact.

Sigh but patient for now nothing else we can do except what has been spoken about before.

There are quite a few of us who have enlisted the help of our congress peeps and senators, whether they can help or not remains to be seen with this certain issue since we all do not have receipts nada nothing. Most of us are from the start of August, i.e, German and forward - you are November???

We had to wait the 90 days in terms of actually putting a trace on the file, but again that was just an exercise in futility as I got a response quite quickly......dear mrs so and so....we need your receipt number to locate your file......doh...that is why I ordered the inquiry and trace. Had to laugh, and then take more meds (j/k here) but can give you the sense of what is going on. Just a side note, but I am not sure here as its a grey area, but sometimes your representative will want to know your number in order to see what is going, SOMETIMES - all I am trying to do is make it common to my government here in Central Florida that something needs to be done with this issue - I am sure they are aware, but I want to be really sure. Oh well sighs

Maybe with Chicago opening up, it will help, dont know yet, remains to be seen, think postive but do what you have to -

If he is living in that area and registers to vote, or even if he has not done so, that is not the excuse they would want to give. Yes understand on Alaska saying please contact your local rep congress person, but that answer from New Mexico would not fly with me. Up to him to pursue with another government entity - my congressman who is of opposite party, is helping me out. So best of luck to you.

Cheers and hang in there - my senator only sent me his newsletter which is now considered spam junk mail, my congressman answered immediately and has assigned someone to check on what is going on.

How sad!!! This is exactly what I suspected they would do when they announced the new instructions for sending I-130s to Chicago Lockbox after Dec. 3 2007. Because in the instructions it says "While the changes are effective December 3, any form I-130 filed with the Service Center will not be rejected; it will be forwarded to the designated Chicago Lockbox". However, I hope like most people here that the new instruction only refer to the I-130s after 12/3/07!!! Never imagine they will really do this---shiping all those I-130s which have been sitting in their mailroom for over 3 or 4 months already to Chicago Lockbox, instead of taking care of them at VSC or CSC. It doesn't make any sense at all. Well, let's be positive for now, let's hope this is good thing. Let's hope our petitions will not be lost in this process. Imagine shipping from VSC to Chicago and back to VSC!!!

Hi Susie, you are right, we really need each other's support during this difficult time. However, I just don't see any light or hope. Nobody knows how long our I-130s will stay at Chicago Lockbox before being touched and when they will be shippied back to VSC or CSC? Really crying.gif


I know hun, it was sorta rough today telling my husband ummm babes....I really dont know what is going on and even tho its my job to be informative, and I am learning about immigration 101 everyday from this great site and super people and some tears for peeps and laughs from others.........its just really unimaginative to say I DONT KNOW HUN.....I think that is what hurts me the most. Have a great SO is special, being away from them very hard and having to wait is ok we can make certain plans, but with this limbo line, we cant even make plans so ahhhh....shrink said come back in three days to discuss issues with USCIS lol..... ya know I am kidding but have to make someone laugh here. Its sad, its confusing and I dont know positive or negative, but will go on with work and life and keep him close to my heart as always.

Why would they return my I-130 packet? I can see them returning just he I-129F packet, but why would you not just forward my I-130 to Chicago facility?

I think, now I would have to send my I-130 packet to the Chicago facility and then once I receive my NOA1 then I'll send the I-129F to the CSC or do you guys think that I can still mail both packets together as before to the Chicago Lockbox facility?

This is a very useful tool, regardless of which Service Center, Consulate or home country you belong to. Take a moment today and help out your fellow VJers and enter your time line or ensure it is updated.

At the top of the page, go to: My Assistant, from the pop up menu, select Edit / Add My Time Line and follow directions from there.

Working on that release Anish its one of my options but juggling it between work and hubbie overseas time. If this situation exist after the first I dont know either, lets see wow almost four months here and nothing.

Is there a light at the end of the tunnel, yes, but we may need to send them extra batteries to recharge it, it will happen, but with the holidays and the backlog and the non responsive answers or misinformation from both website and USCIS personnel I just think we are pretty down and desperate right now,

I know I will continue on with many different roads, of course with me, they will all say Under Construction instead of Highway or Freeway, but thats me, willing to take the chance of something happening.

One thing I can see though, what happens if things are still stagnant in January for I-130's....hmmmmmmm from August on..... me thinks alot more people will get active. Just a thought could be wrong, but dont think so,

I wish you a Happy Holiday under the circumstances for I can understand, I will not have my husband with me and he is MY ONLY FAMILY, so guess it looks like will just plan to have next year bigger and better. All I can do for both of us.

Agree hun, totally...maybe with President Bush giving them an extra holiday their moral will be lifted. To be really honest with you, I dont blame them at all. They are doing what they can with the tools given to them, as far as I have experienced, tis the government that I find fault with in this whole charade.

Six months on December 25th will be last time i saw hubbie, such a great guy lets me rant and rave and yet is so balanced. I wake up every morning alive and healthy just lonley for him, so I guess no wait I know I am blessed for that major factor in life/ I will continue to hold on because he is so worth it as and to find a gem, sometimes you just have to keep digging and digging but sooner or later ya find them - priceless -

Hey Susie I noticed that you sent your I-129F the same day as I130. Have you not gotten an NOA1 on the I129F also? Thats odd if so, cause I see that other people who did this got an NOA1 quick on the 129 even thought the 130 never got anything for months.


Your right hun, there are a few of us that did this, and nothing on either. Spoke with lawyer today, thank god she answers in a heartbeat, got her trained now, but no nothing, not in system called USCIS as of 3pm my time so maybe next year early......growling

I managed to get FedEx to send the 2nd package back to me (and they gave me my money back, no questions so I will def use Fedex again).

If you sent a check for payment I would double check to see if it has been cashed yet. I would advise not to believe what the USPS tracking website says.

Hopefully your package also was delivered to USCIS even though USPS says it is coming back.

Perhaps this is what happened to us? Paul has been calling the Western Union number daily to find out whether or not our money-order has been claimed, which it hasn't, and from what I understand, the first thing USCIS does when they get your package is tear it open like a kid at Christmas and run to cash the check inside. Now, do you figure that's all changed since "initial data entry" is being done in Chicago now before they send it along to Nebraska or Vermont or whathaveyou? My first question to you is: Can we expect to have our check-cashing done later since there's another initial step being added? Will Chicago cash it, or do they just enter it, and then send to the service centre and have them cash it? Can I rely on this this method of finding out whether or not the post office buggered up, and USCIS actually did recieve my package?

Another thing I was wondering is, if we never ever recieve our first package back and we do go ahead and cancle our first money-order and resubmit a whole new package, given the slight possibility that the post office messed up and in fact did deliver my package properly, what will USCIS do with two of the same applications? The first one will no longer have a valid money order. Will they throw it out? Process it and ask for payment later? Return it to us with a nasty note? Would having two applications from the same people screw up any initial data entry and foul things up for me?

Now that's what I call service!

What does USPS say on their thread about your tracking number? If it shows undeliverable then I would think its coming back at some time in the far future...maybe a good question for a senior member here, or even some quick free legal advice but I think some of the senior peeps here are much more informed than any lawyer I ever spoke to,.

This sucks........but maybe go to Post office and really see what the deal is yes? I tend to deal with alot of Postal and Fed Ex shipments and their tracking systems are pretty good, but if it keeps saying out for delivery that means, well its technically lost in Fed Ex terms. But call them and get the real story first.

Good Luck but definate no on the check or money order cashing first - mine still does not show and got NOA1 today but postdated on the 21st of this month. Go figure, hmmm.......

When you're on the USPS website and you're looking up zipcode information for the Chicago Lockboxes 804625 and 804616, when you put the whole address through the website spits back:

P.O. BOX 804625
CHICAGO, IL 60680-4107

YEP, that's right. A COMPLETELY DIFFERENT zip+4 code than the 60680-1029 that the USCIS website lists. The zip+4 of 4107 is given by the USPS zip code finder for BOTH lockbox numbers regardless of whether or not you include in the 1029 zip+4 code in your zip code inquiry.

THAT'S F***IN' NUTS!!!

So...does that mean that USCIS has both I-130 Chicago lockboxes addresses COMPLETELY wrong on it's website or that the USPS (both their website as well as their actual operation) has NO idea that USCIS has two working lockboxes in the 60680-1029 zip code?

I don't know which of those options is more palatable or more outrageous. And then, who do we even take this complaint up with? Won't they both just steer us to the other massive bureauocracy that ISN'T them?

USCIC works at their own pace not ours....wish it was different but we are at the mercy right now of their workload which is beyond backlogged. If you read other threads or even care to , there are people from late July forward that do not even have a NOA1 for their I-130. Yes they are pro active in sending out complaints to Congress peeps, Senators, White House etc, whatever works for them to try and get some attention (I also did the same thing and will continue). But Stinger is right, there is no smart mouth on his comment, he is just stating the obvious.

Good Luck to you on your journey and I do believe we all paid for our other half to be here within a reasonable amount of time, will it happen in that certain timeframe that we want , of course not, but they will get here eventually.

Updated the list. Hopefully there will be more approvals coming this month (including mine!). I get disheartened sometimes when I see that most of the people in my time frame has already gotten their approvals and I haven't yet. This waiting game sure is a killer - not only have you got to wait, you also have to suffer "peer-pressure" if you can call it that - but it's all good! smile.gif Have to think positive all the time, this has nowhere to go but to a NOA2, right?

The only thing that I see that stands out to what you say is the higher risk fraud countries- but again we are in this thing now for over a year and just now having an interview - UK -

No rhyme no reason sometimes for what they do - gave up long time ago trying to figure out FIFO!
