Thank you all for your support it helped me not to lose faith.
Communication is the key, but sometimes the pain blinds us too much.
We have known each other for 5 years prior to marriage and have been married and apart for 11 months... I don't think wait was the problem, it was more the stress and pressure USCIS added on our relationship and the fact that no matter which door my husband would push, the only answer he would get was " be patient". It made him feel useless in the long run. Like all of us here, that is what USCIS does to us and our genuine marriages.
Only time will tell.

Christine -

Got your pm - xxxxxxx - USCIS tests us in so many ways - and MSZ- pffttttttt

Christine,

I am still here hun just when you come online lets chat please - do me one favor tho read this its from JEN's post and its her signature....

A great marriage is not when the "perfect couple" comes together.
It is when an imperfect couple learns to enjoy their differences.

DO not let USCIS and the powers to be do this to you.

Just wanted to say stay strong mate, your fight has been filled with strife but yet you have not let go...

Please post and let us know how the interview goes, but never ever let them determine if your marriage is real or not, for that little item belongs with you your spouse and GOD - If our government feels so dedicated in enlisting the services of a fortune teller to determine if its real, well from our talks and your posts, you have shown true commitment in trying to sort out the red tape and have taken every step and beyond to make a stand and to smash their crystal ball to shreds.

I for one send you tons of prayers tonight ...to my beloved GOGO......

They send you notices and other stuff when they are ready to do so, not when you expect them to do.
Due to the backlog you should learn to be patient.

You Have a Smart Mouth. That needs to be checked. What do you work for them people?? If they do there job people would have to wait so long!!! mad.gif They got my money!! I ready for my husband!! Smarty mad.gif Check ya self!!

USCIC works at their own pace not ours....wish it was different but we are at the mercy right now of their workload which is beyond backlogged. If you read other threads or even care to , there are people from late July forward that do not even have a NOA1 for their I-130. Yes they are pro active in sending out complaints to Congress peeps, Senators, White House etc, whatever works for them to try and get some attention (I also did the same thing and will continue). But Stinger is right, there is no smart mouth on his comment, he is just stating the obvious.

Good Luck to you on your journey and I do believe we all paid for our other half to be here within a reasonable amount of time, will it happen in that certain timeframe that we want , of course not, but they will get here eventually.

Cheers

wacko.gif First of all I have read my Threads and do care to do so. If you have read my threads you would have known I'm part of the group that have not recieve a NOA1.

Stinger is right in his or her own smart mouth way but Stinger brought it wrong!

All Service Centers are over loaded and some are doing better then most getting the job done. I know CAl. is not showing me that California Love I done Heard about!!

Good Luck to you with Texas Center. My topic was about California Not Texas!!

Good Day

Thanks ok I am no longer at Texas FYI - now Vermont- but wish you the best in your journey

Cheers and sorry must have not seen your timeline correctly as I thought it said you had received your NOA1-

Remember this man has the future in his hands. I would not make any threats or through out any harsh words until the case is put back in your hands. You would have to write a letter, maybe certified/notarized that he no long represents you. I am at the NVC process. We had already filled appointment. To change it I would have to resubmit.

My lawyer used to have time frames on his website. He has since taken them down. Smart man.

Good morning Sunshine Susie! What does the "K" stand for?

I have had many problems with my lawyer, but he has admitted to his faults. He had an incompetent assistant that he did not follow up on. I do not want to beat a dead horse, because it is counter productive. I found VJ.com when I was trying to figure out what he was doing wrong with our case. I now know the whole process better then him and his new assistant.

He offered to refund a small amount of money back. I told him it was a slap in the face and demanded more. I am sure he is waiting to see if our K3 is going through before we come to an agreement.

I will be patient. I hope you have copies of all your documents you submitted to him. I have every communication I have had with the lawyer via email. You can do this process on your own. As you can see the lawyer cannot get anything done any faster then someone who does it one there own. Matter affect it takes the lawyer longer because he is working on several cases. They can make mistake just as we might if we did it on our own.

Sorry to hear this but it is typical for lawyers to promise the world and deliver you just a small piece of a city. Did he or she actually put down in the contract the 8 month timeframe? That would be the key. Otherwise, most say that timeframe but as well know from this great site, and being pro active that it is not.

Its your call, but what I have done and ours is good to a point, I let them make sure all doc's were in order, and then I was the one that made each call and researched what was going on. I was prepared to do this anyways, because it is my style.

Finding a new lawyer if you need one that is, will be another chip out of your pocketbook, but that is entirely up to you. If he is that rude, suggest to him that if things are out of order with the paperwork or written promises, you can file a complaint with the bar, they dont take litely to that suggestion, but no money is compensated for this, just a smack on the face or if he has other complaints, sometimes they can suspend him. You can check his track record through numerous ways, one being going to www.crimetime.com and clicking on your state and checking status of lawyers/attorneys. Most will link you to Martindell for reference tho, but its early in the am for me.

Best of luck to you on your journey and Happy New Years!!

Susie

p.sThere are a few things on the agrement that have not been respected like him saying the process will take 8 months at the maximum but that he sill do his best to make it shorter etc...

This is actually in the contract?? Hmmmm.............Find your local Bar Association and file a formal complaint, but not before you let him or her know exactly what you plan on doing.........and your file is yours to have so they can not keep it from you at any time.

Good Morning my dear friend......Hope all is well with you and so glad to have you here in our thread, and the K is for hubbies last name....... although somedays i think he says for "KICK #######"

Yes on the threats will get you no where but you can check out his track record and if this is a common practice, hmmm......would not want others to experience this type of misrepresentation - but again, having dealt with lawyers/attorneys for so long now, they do not like to see those letters come in from the Bar Association. But you must have strong proof of his negilence and if his words were estimated timeframe, then thats all it was. Estimated. For an attorney to guarnatee you a certain amount of time for this process?????? wow, crystal ball with that one.

Cheers

It will be on the back of the check or you can wait for your NOA1- but now there is a small little hiccup.....when you try to enter your case online, you will get an error, dont flip, they are now backlogged in entering this information and they bulletin from USCIS states it could take up to three weeks..........or ???????

Check cashed good sign, so hang on but I think we will experience alot of these hiccups down the road. It will start with a number like EAC ( mine did and I ended up in Vermont) or WAC -

Niceman,

They told me the same thing the day i called and guess what, went to mailbox and there it was - pfftt USCIS - anyways just hang on your almost there - and you can call everyday if you wish but they are so backlogged wont make a big difference, check the status of your check and money order first.

No hun dont do anything, mine is from August and my lawyer says wait until mid January I just find it interesting that I-129f are being processed like turkeys for xmas on the other thread but when they are tied to an I-130 hmm...anyways, please dont worry and dont do anything...you will be ok. I just spoke with extremely polite USCIS immigration officer and for the first time since I submitted my applications, I have somebody actually deal with me and the case, and not just brush me off.
She kept asking me about my husband's country of birth, date of birth, when did I send the I130, was it in the morning or the afternoon that USCIS received it, . who signed it, if i had a copy of fedex, conformation. Since my I-129 F is already in the system, she typed all that information in the system. Than she asked to give her few moments to send the inquire to the Vermont Service Center. She sent it and she gave me a reference number that starts with ETC0….. something.
Anyhow, she said the inquire did not go trough, but she'll send it again and asked me to write down the reference number and give them 45 days to respond.
This is FIRST time that I get somebody more involved with my case, and to actually get something different than "wait 2-3 more weeks, " response.
Has anybody had any experience of this kind, reference number, inquiry, etc...? Does this mean anything at all?

Wow, interesting...I have had just the normal tracer put on the application but because of no receipt on either application they sent back email saying........Can you please supply us your receipt number .....dear oh dear that was the whole inquiry issue ...lol...but hey i tried and they did respond quickly and yes they said at that time could be up to 30 days for a response although I got it in about one week.

Normally I get some pretty good peeps, just doing their job, only thing is that the information changes from person to person so again, I only hold truth when it is in front of me.

Hope this is good news for ya hun.

!
: Just got off the phone with Immigration Officer Cunning
: She said they should be scanned in anytime within the next week

: She said they are sending the overload to the NBC
: they have nothing but contractors there that have scanning machines that are fast and efficient

They are scanning them in, then sending them back to the Service center

Then they cash the checks

But she said that they are working all this weekend
the contractors

: and monday
: only contractors

She said to call back wed
was she polite

: yes she was very polite

She wished him Merry Xmas fyi-

I believe this link is for naturalized citizens to tell about their journey to the States and their life in America, and why they chose to become a citizen.

Take a look at the November 07 USCIS newsletter for the type of story they are looking for.

I'd say any 'story' you type in here that reflects negatively on the service will just end up in somebody's waste bin.

I applaud you all for trying to get your voices heard. You'll be more effective if you choose the correct avenues.

Not really. It says your "IMMIGRATION" story, not your naturalized citizenship story. Thats why its the uscIs

Anish,

Just for a laugh before the holidays eh? Read the newsletter and chuckled to myself....

"In fact, today one would be hard pressed to find a facet of immigration services where progress has not been made over the past fiscal year. From unveiling a new 100-question Naturalization Test, to developing E-Verify, the nation’s first electronic employment eligibility system, there have been significant improvements to both our products and the quality of services we provide"

RJP, where did u learn that Chicago is using scanners to electronically scan our petitions. I've seen you make this statement in another thread and was curious then as now...How did you learn this? USCIS website indicates they are sending previous and new petitions to Chicago Lockbox for data entry but how did you uncover the method or means of such data entry. Thanks!

I forget just what thread it was, but picked up info from someone who had spoken to a USCIS rep.

Yes is also somewhere in a blog out there, and told by USCIS IO, but again dont trust them too much, but the blog was pretty spot on and was true.

IR-1 / CR-1 Spouse Visa Process & ProceduresMy Consulate Review
QUOTE (Dylan @ Jan 5 2008, 01:45 PM) <{POST_SNAPBACK}>
Sorry if it's long folks but here it is anyway.

I flew into Montreal on Thursday afternoon and checked into the Hyatt Regency Hotel which is right around the corner from the Consulate. The hotel was nice and comfortable and well worth the extra few dollars I spent. After reading about the hotel fire started by drunken University kids at a cheaper Hotel, I wasn't about to take a chance in dealing with a similar situation.

I work up at 6:20am on Friday and got ready to my interview. I was out the door by 7:00am to make my way to the Consulate. Thank god, it was a much warmer day (-9) than the day before (-25) so I was comfortable waiting outside. I was the first in line and about 5 minutes later, I was joined by a family of four who where immigrating to the US.
I guess they did not read the instruction package since they had big bags and cell phones with them, so one of them had to leave to take everything back to the hotel but he made it back in time.

At 7:30, the doors opened up and I was given the letter A- Window 9 card. Yippy!
I took off my jacket and handed over all my documents and went through the electronic sensor, then I was hand wanded. For whatever reason, there was a small beep on my right side so I was manually patted down. The male officer called over the 'Hockey Player' looking woman who was watching the monitors. I got the feeling she is the senior officer there and the officer I was dealing with is intimidated by her. She seemed annoyed at him for calling her over as she patted my thigh. 'She's FINE. There is nothing there!'.

Then, when my papers went through the scanner. She had him take everything apart because she could see a big metal object in them. My mind was racing, trying to figure out what is could be. "Is it the paper clips?" I asked. "No, it's bigger".
Finally- when the male officer was pulling apart all my stuff, I saw that in my 'proof of a relationship' pile I had a greeting card that had a magnet attached to it. I apologized profusely and they were great about it.

After that, the mail officer took me downstairs where I waited for about 15 minutes. He then came and got me and the family that was behind me in line and brought us upstairs. He told me to go to window 9.

There was a blond hair woman there, who greeted me kindly. She asked for my appointment letter and the letter A card and said she would call me back in a bit. After a few moments, she called me again and asked for my medical report minus the X-ray. She then gave me a slip of paper and told me to go to the cashier.

I didn't know why I was going to the cashier as my husband paid the fee's through the NVC but I just figured it must be routine, until I was asked for $400.00. I almost died. I asked if they took credit cards and she said it wasn't working and I needed $400.00 US cash or $420.00 cnd.

I then said that I was sure my husband paid them already and she asked me if I had a receipt. I looked through my paper work and found a letter that said they received the fee for the affidavit of support- and she said that is a different fee. Then I gave her a letter saying that they received all the fee's related to the case but she said that is probably for the application. I really thought the walls were crashing in around me. I told her again, I was sure my husband paid the $380.00, so she suggest I go back to window #9 and ask them to check my file again.

I went back and explained the situation. When she looked again, she saw a blue piece of paper attached to my file that said PAID. She apologized and explained that normally, when you pay at the NVC, they insert a pink page and that because my case was expiated that generally the fee's get paid at the consulate since it keeps it from being held up at the NVC level. I was just so relieved, I laughed and smiled.

A short time later, she called me back to the window and took my prints. It took a few attempts to get acceptable quality ones but we got it done quickly. She then told me to take a seat and the consular would call me.

At about 9:15, I was called to room 9.
I entered and saw a middle aged man in suit who told me I could hang my coat up.
Strangely enough, looked and sounded very much like the Consular who had been helping us in Toronto. I swore me in then said he needed to scan my middle finger for verification.
Instinctively, I placed my index finger on the scanner. 'No, your middle finger' he told me (nicely). I got a flustered and confused and asked "Do you mean my F- You finger?'. He started to laugh and said that usually it's just the kids that call it that- but yes that finger.

Then asked me some standard questions such as how I meet my husband. When I told him I meet him on myspace, he laughed and said that's a common answer and that he never hears "We met in a bar anymore'. He asked what was the date we met online and in person.

He then asked if my husband was here, and I explained that he was in California with our daughter. He then said, that sometimes they ask for proof of a bonifide relationship and that since we had a a child together we satisfied that.
He then asked what my husband did for a living and I explained it to him. He wanted to know if I intended to be a stay at home mom and I told him yes and that my husband didn't want me to work until we were finished having kids and they were school age. He smiled and kind of laughed. I got the impression, he was traditional like my husband.

He asked what I planned to do for work when the time was right and I explained that my friend had promised me a job working for the Benefits Administration/ Insurance call center she runs.

He asked if I ever had been arrested- No.
If I had any trouble entering the US. I told him I was never refused visiting my husband but I was bounced about 9 years ago at at POE because I didn't have any ID with me that proved Citizenship. He seemed understand and he quickly moved on.

He then asked how old I was when I came to Canada and what family members came with me. Also if I had any family in the US.

He then said he was going to grant my visa

He asked if there was anything else in relation to my case that I thought he should know. I told him no, but then asked if he was aware that this was an expiated case because of a medical situation with our daughter.
He said that he wasn't aware of that and was glad I mentioned it- so that he could give my file a priority date for issuing the visa inside my passport. He said it would be done that day or no later than Monday and it would be mailed out in Mondays mail bag.

He then said, he tells people to wait about two weeks to make their travel plans so they can be sure they will have their passports back by then and that if it comes sooner- they can have a happy surprise.

In closing, everyone I dealt with was VERY friendly and professional.

It's a shame that they are understaffed since that is the reason for the long delays in waiting for an appointment.

Hi Jigi,
I'm sorry to hear about this snafu, and I hope that you and your wife will be able to quickly produce all of the materials requested by the embassy. Yes it will take time, and it'll be good to have everything all cleared up. As for telling your parents and relatives that you are married: you must do this!
I agree with the others: since your wife does not know where her ex is, but he is wanted on charges of not paying child support, then it would be good to produce court documentation of this fact. I don't think that "we don't know where he is" will be good enough.
Good luck, we're thinking of you, and please keep us posted.

Jigi,

I sent you an email but just to sum up that situation on the ex husband and whereabouts unknown.

Your wife can obtain from Child Support Division in her state that exact statement, they are a governmental agency and that should suffice. Most Support Agencies basically wait for a tax return to be filed or Drivers License renewed to locate people that are in the arrears for support. There are others way to track down people but again, that is in my email to you and if you wish to go that route, let me know.

Again, a statement from Child Support which would have a local office in her county should be more then enough ammo for this situation. Also, court documents are updated as to each year on cases that have not yielded results from default payments, meaning each year it is posted on the court case that she has with the divorce decree with children (Family Court) the attempts for Income Tax attachment through the court order.

Good Luck but think this should help in that area

Yes, they might contact your relatives. Perhaps, it is the time to tell your relatives that you've got married.

Yep time to let them know may help you in the long run.

hi,

What shall i write in the Notary.... I have made a few points describing out chat room meeting... how we fel in love.. our voice chat .. webcam chats.. how i helped her in getting a job and why did she married me and liked me...

Please Help me

Jigi

For what they are asking ........is this because of the age difference between the two of you? You say it is .....this case of marriage is very very unusual for my country..... I am not familiar with your culture (so sorry) but when you say unusual do you mean that older women do not marry younger men per se?

Notarized statements for how you met ??? Wow, senior members should be able to answer this one, with online chat rooms and dating nowadays, it is pretty common for things to happen in the way they do. I am by no means an expert here, but seems strange on that issue. But I would give them all the information they request at this point and yes notarized (??why?? hmmm ) and pray for the best.

If they want you to write how you met, what went on etc etc. then do so, and attach some emails, correspondences and letter or cards. This is what our lawyer told us awhile back in case the question did come up, but we could fill up a car with that stuff. She also said that as long as my previous divorce was final, then that was not an issue with the embassy. They can ask, but can not deny as it is a legal marriage now and was a legal divorce prior to marriage. Stumped on this one. wacko.gif

I wish you the best in this journey but only thing I can see from your post is what you said in the beginning about older women marrying younger men and here in the states that is no biggie, or even in the UK. But would that be any different than a man who is older marrying a younger woman, happens everyday and every minute.

What do they mean by her first marriage and when and why her marriage ended? What do they mean by when? Do they not have the divorce decree? Why? That would show on the divorce decree as something to the effect of irrecon difference etc. Do they want details of exactly why? But back to the WHEN PART?

IR-1 / CR-1 Spouse Visa Process & ProceduresVisa Granted!
QUOTE (severinep @ Jan 4 2008, 08:57 AM) <{POST_SNAPBACK}>
Voilà, our journey is over. My IR-1 visa (immigrant visa) was granted yesterday.

My appointment was at 1pm at the US embassy in Paris. We showed up at 12:15 pm and they didn't want to let us in so we came back at 1pm, time of the appointment.
After 10 mins, I had to give my letter of appointment to someone. I was called again and this time, she shecked my documents and asked for my medical. Asked a few questions like "When are you coming to the USA?". I answered I didn't know exactly. I was caught off guard as I can't go to the US if I don't have the visa. She told me I had 6 month to enter the US and to go sit down, the officer would call me for my interview.

By the time I was called, it was 4pm already and she just asked where I was going to live in the US (whate State) and where was my husband and that was it, she said congratulations, you'll get your visa in 7 days, don't open the sealed enveloppe we will give you bla bla bla bla...

It took less than 20 mins for everything. The wait lasted for 3 hours though.

Some tips: it wasn't mentioned anywhere that I had to bring en enveloppe (Fedex, DHL...) so I had to go to the post office and send it to the US embassy.
My husband had to scan the appointment letter he received or I was unable to do my medical on time. I received my appointment letter 1 week exactly before the interview and during that week, you had Christmas day and New Year's day. With doctors on vacation, I would have never had the time to do all this on time.

Good luck to everyone! It was way easier than I thought!
