yes Sky, who knows and we have learned a really valuable lesson here about USCIS - they call the shots for NOW until the next session of USCIS goes haywire, but maybe it will calm down. If its seven so be, at least we made the system.

Should be interesting to monitor tho as to the approval process for NOA2's - wishing everyone good luck on your next step into the wild blue yonder.

I'm sure that's exactly what's happening. The supervisors are saying 'hey don't bother answering the phone calls, enjoy your coffee'. Let's just execute everyone. My tone is sarcastic, BTW. Everyone bitches about the time it's taken, myself included, but no one seems to remember that they received a YEAR'S worth of applications in 6 weeks. What are we expecting? The public servants to work 24/7? It's ridiculous.

I know everyone is frustrated. Believe me, I am too.

The US is not an oppressive regime. I just watched a bunch of illegal immigrants protest for their right to get a driver's license. If this was an oopressive regime they would be on a bus back to their home country or dead. Oppressive Regime's usually dont' let people protest for right's they don't have. I'm not saying the US is perfect but it's far from oppressive.

I hear you but you know my issues, if its going to take two years then tell us, but dont post erroneous ####### on the website and let people be mislead.

I just feel for peeps that are still waiting, you waited, I waited, and all I can think of is this....you plan increase in fee, you plan for an influx of applications yes, they were not prepared to handle the amount that came in, ok fine, but at least do not tell us on the phone the excuses they come up with. To me that is mismangement at its very upmost finest.

This issue is not just with us, but all different areas of the visa journey so at least they are on track with their screw ups. One guy actually got a green card with a woman on it, go figure. I think he still has it strapped to his belly.

i have the same situation.. go to the passport agency close to you in india with your marriage certificate and birth certificate and they will change the name for you, tell them you want to apply for a new one ... now it only take less that a week to get a new passport in india.

in my case i used my wifes maiden name and she just had to endorse that i am her husband in the passport with is a seal and my name and 1st magistrates signature

Ok heres a question and I dont really want to start another thread as this seems to be my home base.

So for those of us fortunate to have received a NOA1 and whether it be from CSC or VSC (yes we know postemarked Chicago) but heres the question - Looking at USCIS timeframe, and yes bumps head against wall, promised not to do that anymore, but CSC and VSC still show diddly squat for I-130 applications being moved forward - i.e,, sitting on July 2007 for VSC and August 2007 for CSC - this has not changed for months fyi......

So now that we have a NOA1 - what timeline are we looking at- in other words if applications are being scanned, what is actually going on in Vermont and California that there has been no movement whatsoever -

Challenge anyone ???? I promised myself darn I would not even consider their website anymore, but went in to look up NOA1 number and I know its not in system yet till end of month at least, but glanced at CSC and VSC and was just thinking........what are they doing??? mad.gif mad.gif

HOHO, yes i believe this to an extent, have had long conversations with certain members here that are so further down the road then us, well then again who isnt at this point, but I just dont know what to say to you and Alto.d, its a criminal act of mental hardship what they put people through, even tho we pay a fee for a service and expect that service to be performed in a timely manner, yes we were aware of the backlog quickly, but to keep people on hold for their lives that have filed in July and August, and then you see others from october starting to get their NOA1's i dunna know (heck even for that matter I filed after you and Alto)....just seems wrong, and this is not bashing anyone that has gotten their NOA1 - that I say with sincere Congratulations, but for the life of me, I cant figure out what you need to do.

Not that is making a big dent in my insane mind right now, but gotta laugh, 3-4 weeks ummmm sure ok, let me check in another month, that should be about time they get around to it. But have heard that peopel just get their NOA2 without even getting their information into the system, so I guess at this point, or really, at any point, just take what they say with a grain of pepper and see. What else can ya do besides our normal ranting and raving and sending letters off.

I really think it will be more important when the NOA2 process comes up for any RFE's etec., but hey, who knows with this Motley Crew anymore what they are truly doing......they are swamped, they admit it, and until the backlog gets cleared up, I think we will have to adjust to their misinformation and try to use VJ as a more reliable source, OH WAIT, I already do that devil.gif

No, that's not right. My husband visited me several times during the process (both when we filed for a K-1, before he was my husband, and during our cr-1 process more recently).

Your spouse should not be *resident* in the US when the i-130 is filed, but there's no reason he can't be in the country when you do - he just has to be in his home country for the medical exam and interview. There is also no reason that he cannot visit you. If he is not from a visa waiver country or already in possession of a tourist visa it can be difficult to obtain one while a spousal visa is in process, but even this is not impossible.

Visiting during the process is like visiting at any other time - you can be denied entry. In our experience, most of the time we were not even questioned at the POE beyond what the length and purpose of the stay was. The one time there was more than this asked, we had on hand plenty of ties to the UK - a tenancy agreement, job contract, the NOA 1 and 2 and bank statements - which gave credence to Russ's claim that this was, indeed, just a visit and he would be returning home at the end of it!

so yes, it is both permissible and possible for your spouse to visit during the process!



There is no law against it, its all up to the POE customs agent - just depends - good luck to you.

No truth, it is a building basically where the contractors have their high speed scanners - tis all - i actually believe it was at one time a bank like HSBC or along those lines,something like that, so right now it is just a mail stop for sorting the applications and scanning them.

After that they are sending them to whatever service center can handle the load. Do not think that your file will end up where your location should be though, it can happen, but do not count on this if you plan on filing your I-129f if applicable until you get the NOA1 indicating exactly which center you will be processed at.

nvc should take 3 - 6 months depending on how fast and organized you are.
then schedule interview and get visa varies with country, but I think uk is faster than most, so maybe 3 months more.

so 10 - 13 months total if you have no rfe, and send everything in without delays.
thats my guess.

So if I look at an 1-130 standalone, IRI-CRI, it shows average processing time now from NOA1 to NOA2 about 123 days. Ok. Then if I go to our region which would be UK, it shows from approval of I-130 to interview about 264 days.... Had a great idea today ok........so if I get some flack from USCIS I am going to take their RFE and go down to the Grand Caymans for a vacation for a few days - there is this town there, where they raise sea turtles and release them after they mature or heal, and the town is called "HELL" - alot of people just go there to mail something to show they have been to "HELL" - ok well USCIS will love that goodie. kicking.gif

Its a start helpsmilie.gif and at least they are taking some kind of interest in what is going on, i mean how long can we be on the back burner before the pot gets too hot? Hopefully things will settle down soon, or at least follow some normal timeframe, but again that remains to be seen, just gotta be patient, and the only word in that statement that bothers me is this>

That word may lol, but at least we are being noticed. I just got my letter from Omsdmn today and I am sure it was pure form format, but at least I got that, cause it means they are somewhat interested altho it was geared toward the I-130 process and delays. Not going to second guess here, but glad to see some action happening for all of us, wherever we may be down the line.

It would be guessing on October petitions being caught up in February but I am sure a fair amount will be in with following months floating in like the tide. Can't forget our mates that are still in the earlier months prior to October sweating this thing out with no word.......

Hi Susie - are there loads of people from August without a NOA1? I thought quite a few of those had rolled in now. Also although USCIS says they are working on Oct - noone on here yet has claimed to have an NOA1 yet.

Dont know about the word loads, but yes there are quite a few and even some from the first of week of August, September not looking good either, they seem to dribble in like a faucet, a few for the first week in September and the latest I have seen is one or two from around the 15th or so of September.

I do not want to bring you down here, just wanted to let all know that even tho Chicago says October - ok but to get that elusive NOA1 is somewhat of a sticky situation right now, tis a hit and miss situation as far as we see, so who knows what they are really doing.

We have also had particularly awful experiences calling USCIS sad.gif (BTW I was never rude or aggressive either)...and in the end I was also hung up on (it was a man that I spoke with). I called USCIS right back and luckily I did get someone that tried to help me. Prior to that we called USCIS and changed our address and 6 weeks later found out it was never processed by the operator. They really know how to pick the winners! good.gif
Luckily things got sorted out for us but we were looking at serious set backs (both time and money) because of their incompetience.
Now I keep much better logs of all calls that I make regarding our petition, and they do rattle off their "employee number" and name when they finally pick up the phone...but they rattle it off so fast there is no way that most people could write it down if they did indeed understand what was just said. unsure.gif Being that we still have AOS to get thru we will no doubt be calling USCIS again in the future and I am dreading that ClockWatch2.gif but I fully intend to get the operators name and number before proceeding with my enquiry because obviously after you've had a problem it is too late.

...and of course I recommend anyone else calling USCIS do the same!

Also...get a reference number (transaction number?) if they have done ANYTHING (esp. address change) for you over the phone!

I would think that there six months is way past due as they do not have an NOA1 yet from filing in July 2007 -or maybe the timeline has not been updated not sure - but correct me again if I am reading this incorrectly as I always welcome our small debates.... Cheers

After going to get the mail today, I discovered my timing was good. No not the NOA#2. Privacy forms from my congressman. I do not know if its going to help or not. If at all possible either fax now or hand deliver them and ask who your case worker will be - remember they are not good at picking up their voice mail, but once you get a case worker they can do wonders - get to know them, they will become your best friend.

Hello All!

I've been noticing lots of I-130 filers have not updated their timelines with the correct service center they are being processed through. Currently the ONLY service centers processing I-130 immigrant petitions are California(CSC) of Vermont (VSC). If you are not listing either one of these service centers in your official timeline (not your signature timeline), then your timeline is incorrect.

I understand that many of you originally sent your files to Nebraska or Texas, but be aware that those service centers are NOT processing your petition. Only CSC or VSC. Many of the newer filers have sent their petition directly to Chicago Lockbox so we are slowly not having this confusion of incorrect timelines.

However, there are still a lot of you out there with incorrect info in your timeline. The timelines are very important becasue they allow Visa Journey to calculate estimations on an adjucation date. It also helps the immigration timelines. It helps those of us who use the timelines for our own personal tracking and timelines give an overall averaging history, which can be ver helpful and beneficial.

It is fine to keep your signature timeline stating that you originally filed at Chicago, Nebraska, or Texas, but please update your official VJ timeline to help keeps things a little more accurate.

To all who can view their case status online, who are affected by the delay. I filed Sept 20 and got NOA1 January 3. Whenever i check my status online it says that They received my petition January 3rd but my actual hard copy says received date Sept 20 and notice date Jan. 3. I was just wondering if this is normal as far as the received date when you check it online<????


Mine says that too. I believe its normal. I think the online "received" date is the date that your service center received petition from Chicago Lockbox. My NOA1 hardcopy lists my October date as the received date. Does your NOA1 hardcopy list your priority date? Mine doesnt.

I could be a bit wrong here but I dont think there is a Priority Date for the I-797C on any of them, and my received date shows August 2007 - but as far as access, yes tis a whatever, lets just get surprises in the mail at this point lol...technical difficulties my #######....

You can try however my husband did this also at the embassy in London and our I-130 was not even filed yet, he was quickly denied within five minutes, even tho he showed proof of work, home, etc, they just plain flat out said "strong ties to the USA" and denied.

You may be better off going for the VWP but again this will also carry the possibility of being denied at POE.

If you are denied the B2 remember something, if you do try to just come over on the VWP, you will have to mark the sheet for entry that you have had a Visa denied and more than likely will be denied entry to the USA and turned around to go home.

A good friend who is head of customs at JFK said to us, dont even try it, your setting yourself up for disappointment.....95% are turned around.

Good Luck as I have seen some stories here where people are able to visit on the VWP as long as they have enough documentation on them such as an ongoing job, copies of your immigration paperwork and also it just really depends on the Customs Agent at POE~~~~~

Do you mean to say that your case has been in security checks at the USCIS level??? That your papers have not even moved to the National Visa Center?

I would contact the USCIS Ombudsman and file a complaint.
Contact your Senators and complain to make inquiries on your behalf
and finally prepare to get an immigration lawyer to file a Writ of Mandamus.


Contact Senator or Congress person immediately and get case worker - this is nutz
