After waiting about 5 months for a receipt alone from August to December, I can't believe this just happened... I've been APPROVED!!! Being bored and frustrated, I decided to try entering my receipt number into the USCIS website and not only did it work this time, but I just found out that they approved us on February 8th. I can't believe this and I'm in serious shock right. After these people told me it could take 9-10 months because of the delay, I've been approved. Now its time to move on to the next step, which I'm sure I'll have questions on. For everybody still waiting, just hang tough. God works in mysterious ways. He gave us something so wonderful without even expecting it on this Valentine's Day.

Sad stuff hun, bin his ####### do it yourself and then send your remarks to the American Bar Assocation in which he has xxxx amount of days to respond back to the ABA- this course of action does not result in monetary fulfillment, but at least if he acted in bad faith and without compliance, he can get slapped around a bit.

I seen mine online and the next update was an approval. That said I got an RFE for my daughter, I sent in the birth certificate (the one that isn't required), it's been touched 11 out of the last 14 days. My wife's package has already been sent to the VISA Center for processing but the USCIS case was touched the 24th as well as my daughters. Still no approval for her. I also was told the computer glitch story....BS. Once it is online it is workng fine. I don't think they are putting them online until almost completed or they have to issue and RFE. Who knows with them anymore - we sent everything and now poooffffff - RFE both applications luv it, wonder what little item they want .......already gave them first born child....must be looking for something else. j/k ...but interesting that not online until recently and then wham bam touch every day and then WOOOFFFF - you got mail...oh yes, RFE time....soddy gits the lot of them.

We are all crazy at this point but your martial status is determined as of December 31, 2007 for the year ending filing of 2007. You can file single but you must do the amended return - otherwise showing single is not correct (without the amended return).

Check with a CPA or tax accountant if you can - but I was told - you can file married sep and just put NRA where it ask for your SO's Social Security - if u decide to go the married filing jointly, then you must get the ITIN number.

There is also a foreign tax credit (exemption)if you do put them on there, but not sure what that amount is somewhere between 50k and ???? USD, but not really sure of the exact amount as that chapter is like seventeen million pages - and as this point sod it, I am just going for the married filing sep -

If there is something else that has come up, then I guess it will be my first RFE. Now there is a unique concept, but again just depends on what gives you the best breaks - but to explain - if you file MARRIED JOINTLY yes on the ITIN number and then it has to have passport certified copy attached to the W7 and then sent to Texas addy.

Sadly, this does makes sense. lol

The W-7 instruction on page 4, under "Spouse of USC...", mentioned filing jointly AND non-resident being claimed as an excemption. No mention at all about couples filing separately.

So I would "guess" writing "NRA" would be ok. It makes sense to me. Your tax person SHOULD definitely know. I hope you get through and not have to wait six months for an answer. lol

There are so many different threads on this issue, but this seems to be the consensus - I really dont want an RFE - oppsie too much USCIS reading, but do not want it being kicked back becasue of this error.

Have not been around to catch up on the gossip lately, but if anyone has been approved anywhere in the system - congrats!!!

Sorta a quirky question for some members that have gone through this process-

What has been the average time waiting to receive the "MYSTERIOUS ENVELOPE" from USCIS with regards to an RFE - I mean one week, one month, one year??? I dont want to seem impatient after the fiasco for waiting for an NOA1 - but was wondering.

Told my lawyer in between my work and sleeping that if not received by Monday October 10th, to call them cause I am not buzzing that number anymore, and with an RFE on both applications, something is missing -

Sorta strange but again look at this yes, I am here in Florida, file to TSC ok fine, then it goes to CSC - noooooooo~~~~ Chicago and then it gets sent off to Vermont ~~~~ so thats a heads or tails issue - we were suppose to be in California but for some reason (again not moaning by any means) we ended up in Vermont.

Go figure.................no wait dont do that.........there is no rhyme nor reason to their processing anymore

Big thanks to all...something interesting tho and any thoughts on this...

Spoke with lawyer, and she stated that the I129f should be approved within the next two weeks, and if so, she would like to move forward on that application instead of the I130.

I know there is alot of talk about the I129f being binned out of VSC, but she said NOOOOOO! She has been really good about everything and pretty spot on the averages of approvals so far.

Her words to me were, about six months after NOA2 for I130 to finsih - but only 2-3 months to finish for I129F. Told her not crazy about the I129F steps, and that is if it even gets off the ground at USCIS (of course it gets touched next day lol) but she said the I129f's fly thru NVC.

hmmm........


Glad to be out of there tho and I only wish God Speed to the rest of you on this journey and my many heartfelt thanks to VJ for such a great site. I would have been lost without you. And to all the people that I have met - we have and are sharing a common goal, and we are committed to finish it - but such an experience I would never wish on anyone! EVER!!!!! ALL OF YOU ROCK !!!
