I think he is waiting for our K3 to be approved, which is why he is delaying the afidavit of suport form. whistling.gif i should never make assumptions, but i want my case in my hands. Hecan go on his merry way. My brother in-law does not know if that is a good idea.

Congradulations on your NOA1!! I am in September, because that is my reciept date for my NOA1. It ususaly only take a week for the NOA1 number to be issued I thought. I noticed that you all were having difficult with something being wrong with the process? Does the late reciept date holdup your petition that much longer? Or was it just the issuing of the number that was held up?

Missy lol, hope your still laughing a bit about email....

The I-130's were put on the backburner for quite awhile so they sorta bunched them up and sent them to Chicago for processing. There is the contractor who is now speeding up the NOA1's and yes the timelines have been so outta whack compared to the I-129F's and other forms.

There are alot of I-130's from late July and forward,......and forward.....and forward that have not received their reciept numbers because of this backlog. Hopefully the rest get caught up soon, Gone with the wind on those days of getting a NOA1 in 10 to 30 days.

Will it affect holdup for petition for being processed longer , uncertainity there, and not even going to guess, but will look at the positive side and think maybe just a little.

Cheers

Shoot sorry mates but dumb question of the day here and I know I know I was going to be good...

On our I-797C Notice of Action which by the way is in a frame above my work desk lol, it says something that I said hmmm........but think I know what it means but want someone to confirm.

on the fourth paragraph down it states the following....

If this case is an I-130 Petition - Filing and approval of a Form I-130 for Alien Relative (sigh hubbie is now an alien lol) is only the first step in helping a relative immigrate to the US. The beneficiaries of a petiion must wait until a visa number is available..blah blah blah blah...

Ok so I know that this is a standard form for different family members, but sorta misleading to someone not familair with the immigration laws of a spouse of a USC - there is not Visa number to wait for.....or did they change this in the last few weeks. Sorry sick humor.......

Was just thinking that it is so misinformative to say that instead of what is really going on. Dunna know any comments from the peeps that have that great wealth of wisdom here?

and hopefully USCIS updates soon so we can start tracking our progress but thats another story another month.

Thanks all, I am not dense, just thought it made no sense at all. But then again, what part of USCIS does- devil.gif

For family based petitions, there is no waiting for a number for a spouse. Once you get approved by USCIS your petition will on the way to NVC.

Aye what i thought but just dont know with USCIS anymore - Happy New Year to you and yours

Nebraska quit processing I-130 applications in March, so they would have sent it to CSC, then they probably sent it Chicago since it was after 8-30. The USCIS site shows apps up to 8-20 processed ( the are scanning them with high speed scanners and sending them back to CSC and VSC electronically). It sounds like yours will be received sometime in the next week to 10 days.

I just received NOA1 kicking.gif kicking.gif kicking.gif

Details are as follows:

9/8/07: Mailed to TSC.
9/11/07: Received at TSC
12/22/07: Notice issued from VSC
12/26/07: Received notice in mail.

I was surprised to see the notice coming from VSC. When I looked at the envelope, I noticed it said 'mailed from ZIP code 60605' which was odd because it didn't look like a east coast ZIP code. I googled the ZIP code and guess what, it led me to Chicago! I guess USCIS website was correct, when they stated that all I-130 from CSC have been forwarded to Chicago lock box.

I am very happy and I wish everyone an expedited NOA1 and NOA2's. Happy New Year!

WEEEEEEEEEEEEEEEEEEEEEEEEEEEEE-

Yes got mine as I was going to work, and thought omg Im in trouble why is this coming to me since I have a lawyer, but yep NOA1 time and guess what, from Vermont also with Chicago lockbox addy for stamp...... Hello All!

I'm an October filer but I follow your thread, cause when there's movement for you, there's hope for me. It looks like USCIS is cranking out NOA2s for July filers right now. I know that August is still waiting for NOA1, but at least Chicago Lockbox is updating. I suspect that you August filers will be receiving your NOA1's in the mail starting next week. What I have also realized is that USCIS says that they have updated files up to a certain date but they still don't send out an NOA1. Seems like lots of folks were getting an NOA2 without ever receiving any NOA1 in the mail. So I guess when you start seeing checks cashed you know your files are in action.

I think August will start seeing NOA2's by Feb. So thats not too bad. Keep your heads high all....the beginning of the end is near for you all yet! good.gif

Hope you are right Marlita, Keeping fingers crossed, its about time!

The latest receipt update notice states that I-130s at the Chicago Lockbox were caught up throug 8/20/2007. Okay, now here is my question: Where is my receipt notice -- they received it on August 14. ?????????????????????????????????????????????? Maybe this week or next week or week after that? Or maybe sometime in February.

Hate to be sarcastic but enough is enough. This has been over 4 months now waiting for NOA1.

Sigh Dodson, sigh sigh sigh we are with you hun nothing here either.

Eli - I dont think you were being rude at all, just that I was sorta confused myself, if USCIS received in late August, that would tell me an August filing unless sent from the North Pole (sorry cheeky there) so I thought maybe there was some light at the end of the tunnel also - and if it was a July filer, then yes off to that category.

Cheers to all, we just want to see some movement somewhere and yes that news surprised me. Better yet, check out USCIS - whats with the LA LOCKBOX??? That one caught me off guard but maybe just maybe???

Yeah yesterday not good as far as mental up, but kept busy and just said ok lets try for another week and maybe something will come in the mail before New Years Eve.

Hugs hun and hang in there for right now, this site and people we have met gives up some hope and also a place to vent our disappointments and to exchange information. Not a bad xmas present while we are waiting!! good.gif

And we didn't have any delivery confirmations from the post office. So when we had a receipt from USCIS where they said they had received our I 130 only 24.08, I was rather surprised because I was shure it didn't take long (more than 3 weeks, hah?). So I just thought it was mailed in August.

Q : Is USCIS prioritizing certain application(s) during the receipting process?

Yes. The Application to Adjust Status (I-485) will have first priority because USCIS needs to ensure that these applications are receipted in a timeframe that would allow processing of an application for an Employment Authorization Document (EAD) within 90 days of filing as mandated by law [8 CFR 247a.13(d)]. Our second priority will be to receipt the Application for Naturalization (N-400) so that we can minimize any delays in obtaining citizenship.

Another question to ask ourselves is this:

If they are not sending our I-130's to the Chicago lockbox for data entry and they are holding these petitions are California and Vermont to processing just a receipt notice, how long will it take them to catch up?

If Chicago is going to start processing receipt notices for applications received after December 3rd, why should these guys get their applications in the system before us? That is certainly not fair and I will really be pissed and mad at this.

I have been waited since August 14 and if the Chicago Lockbox is going to be faster, then so be it. But I do not think it is wise nor fair to have applications just mailed in December put ahead of our receipt notices.

I totally agree and would comment but the marshmellows one still has me chuckling here at 5:55am in the morning, omg too funny.....at least we can find a moment of sanity or humor in this gigantic mess. What I dont understand and maybe someone can answer for me since I do not see any law ( whatever they are now with USCIS) that states that getting your fiance here for a wedding late next year is more important to process than getting your spouse here. Dont take this wrong, but all we are LOOKING FOR IS A RECEIPT!!!!!!!!!!! mad.gif

My complaint today is going to be a follow up letter to my Congressman, and since I do not have a receipt number, I am just pointing out to him these issues, its like getting married to someone from afar is a huge slap in the face. Someone said to me recently, USA is anti immigration right now, except if its illegal. Somewhere in that sentence an oxymoron has been created but it goes along with Jumbo Shrimp, IT DOES EXIST.

Again, use whatever resources you have to deal with this issue, if you are comfortable in waiting it out for a few more weeks, and try to enjoy the holidays without your mate, then do so. If you are so confused as most of us, then research or if you are super pissed off like a few of us, then do take matters into your own hands and fire off a letter to Senator, Congress person or even your local deli. I will tell you this........you do get alot of frustration out of the system by doing it.

Again, none of us are of the same make up, and for that we are so unique......I will applaud each members action here as long as it helps them through this first god awful step.

Cheers all and post later after coffee-

I am an American citizen currently married to a Canadian citizen. I am in the process of sponsoring my husband of 2 years into the U.S. with an IR-1 visa. We have been waiting over 2 months just for the initial notification from U.S. Citizenship & Immigration Services that they have received our application for an IR-1 visa. This process normally takes just a few days. I cannot fathom how long the remaining process will take. I have been monitoring immigration forums and find many, many, others who share my position. While my husband I wait through this process, we must live apart. While I can visit him in Canada, he is not allowed entry into the U.S. because the U.S. generally doesn't allow individuals currently in process for an immigration visa to visit for any length of time because of the threat that they may stay in the country illegally to wait out the process.

While I appreciate the problems the country faces with illegal immigration, I feel, as an American citizen trying to sponsor a spouse from a low risk, low visa fraud nation, that waiting a few years for the U.S. Government to complete the process, is completely inefficient and unnecessary and some focus and resources used to combat illegal immigration should be turned towards the individuals that are trying to follow the rules and immigrate legally.

Please do not ignore the problems and frustrations of 'legal' immigrants.

Regards,

me
Phoenix, AZ

It's far from perfect, but it gets my thoughts across...

CSC received my I-130 on 8/14/07, and I got NOA1 on 10/2/07.

I was worry for my receipt notice during that time too and I called USCIS to learn that they had a massive increase in applications. Now, I can't wait for my NOA2 to come, hopefully, in Feb provided there's no RFE.

For us August filers, our three years of tax transcripts needed later on will be 2007-5 or 2006-4?

GL everyone!

Congrats on that issue, guess they dont process applications in the order they are received. Good to know they are at 100% of bs in their website news. Nothing against you and actually glad to see this since it means someone worked one day at CSC,.

Best of luck on journey

Cheers

We are probably on the lowest priority for these guys anymore. Of course it will take 60 days to sort out things because 30 days out of it will go partying and celebrating New Year and Christmas for them. Who cares if our loved ones suffer right?

Ok stepkids heres the deal,

The applications are not being forwarded to Chicago in our timeframe that I know for sure, well at least my lawyer states that and he had better know since he has strong ties to HS issues.

Second yes there is this backlog, but the 18 month thing hopefully will not happen to us. Lawyer says maybe two to three months behind but if that is a crock then I am off to Washington DC with this #######. I should have just done the fiance Visa thing and not gotten married......he would have been here by now or at least ready to pack a bag.

Why are we on the backburner......oh sod it, no one knows, and for sure of one thing, USCIS does not care. BUT I DO and this item is going to my congressman as it defeats what USCIS preaches to us all, we shall process in order received. Bull ####### might as well take the website down and revamp it with some poker tables since we dont have our mates here, at least we can call their bluff there.

Cheers and gl xxx

Well if anyone wants to act and get into the group hug thing, and take advantage of the political scene heres the latest ...........

If immigration whether it be illegal or the "LEGAL WAY" is on the front burner, I would think that more politicans would get onto this bandwagon after the holidays of course.

Sigh..........

I can't believe it I finally got an answer from USCIS, the reason my I-130 is not approved yet is because they are doing a Background check within USCIS, not FBI per Becky - LOL But she was actually very nice... She did tell me it can take anywhere from 30 days to 6 months crying.gif crying.gif to finish this process.... I don't.......I am writing a letter to the Associate Director for that department next!!!!!!

Nita helpsmilie.gif

Nita,

It does do that and the process continues to try and tighten that red tape each day - you have got to be kept busy, I dont care what it is - but a famous saying that always comes to mind....."Idle Mind...Idle Thoughts" -

There are days when I am busy with work that I do not even look here (oh surprise) or USCIS website for update to case, and then there are those dark days when I just sit and wonder what the heck is happening....... and then anger, frustration, and all those other great negatives play upon the mind.

The best you can do is to keep in mind that soon, one day, this part of the journey will be over and then a lesson will be written into your book of life, a chapter to be closed or if someone needs a hand, you can pass that part of the book over to them so that they will know ~ it too shall pass.

Hi all,

I'm new to this CR1 forum although I've been around on the K-3 forum for a while. We just found out that along with many others, our K-3 petition is being canceled and we are being forced to go with a CR-1. I am not too happy about this, but their seems to be no option. I've heard all the arguments about why the CR1 is a better visa, but none really matter to me. My wife will not be working when she gets here and the additional cost and hassle of AOS is immaterial if I could get her here just one month earlier.

In any case, I have read the CR-1 guide and need to know where I can get the latest versions of the OF-169, OF-230 and I-864 forms in PDF. If possible, I would like to have these ready once our case goes to NVC.

Thanks for any information,
CG

Cheers CG-

How did you find out that your K3 was being canceled - I know that ours was touched yesterday also and yes the I130 has been there for awhile but not in system, so I thought maybe they were just checking to see if there was an I130 pending and maybe going to bin the I129f.

When I spoke to Omsbdmn rep last week, she did say to me, even though its not written in stone, that they are trying to sort this issue out, but again - who knows what when where etc.

Curious tho about the cancel of the I129f - I would personally prefer to go the I130 route - but that is my personal preference and since the timelines are not that much off, not a big deal - but will take what is given of course.

IR-1 / CR-1 Spouse Visa Process & ProceduresChanged Receipt Numbers??
NoelandTin-

Yes - but normally processing for applications will have a WAC OR EAC number unless your at NVC and then its the embassy code - not sure about AOS - havent even dreamed about that little goodie.

Thanks tho - but for a I-130 it should reflect WAC or EAC yes? Well unless they are changing midstream again blink.gif

Hi you xxxxx

Just got access to case online this afternoon so try again - havent seen mate since June ekkkkk - but hopefully things are moving a little bit more for us now = our I129f showed up before the I130 online but after all this waiting, i think i will take anything that USCIS throws at us (well of course an RFE would not be in that toss) but sorta hoping for the I130 as they are about neck and neck in timelines right now. Also USCIS has been into the habit lately of cancelling the I129F if the I130 goes through first - ???

Let me know how it is going thru pm and will respond but at least we are into this journey with some good help here.

Cheers luv

Prior to July it use to take 2-3 weeks. I filled mine on September 14th 2007, and USCIS received it on the 17, but I haven't received the Notice of Action (NOA1) from the USCIS. There are people who filled in August and still haven't received the NOA 1. Now, it could take upto 90 days to get NOA 1. Yes, the I-129F (K3) visa works faster than the I-130, but you would have to do a lot of paper work when you arrive in the USA. I hope it helps, keep us posted on you status.

Hun,

Same here husband from Uk we married in Florida and he went back so lawyer filed all paperwork, I129 I130 and K3 on August 28, 2007 - now we just wait, yes it was received but USCIS says wait till end of November for reciept basically.......so long........so far away...........let me know how it goes and best to you both
